CIRCULAR

Regulations on the manner of implementation declaration, receipt

temporary residence information of foreigners in Vietnam

Pursuant to the Law on Entry into, Exit from, Transit through, and Temporary Stay of Foreigners in Vietnam dated June 26, 2014;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the General Department of Security;

The Minister of Public Security promulgates this Circular stipulating the manner of implementation declaration, receipt of temporary residence information of foreigners in Vietnam.

 PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the manner of implementation of declaration and receipt of temporary residence information of foreigners in Vietnam.

Article 2. Applicability

This Circular applies to foreigners residing in Vietnam, accommodation establishments with overnight stays by foreigners (hereinafter referred to as accommodation establishments); agencies responsible for managing the temporary stay of foreigners and other relevant agencies, organizations, and individuals.

Article 3. Principles of Implementation

1. Creating favorable conditions for foreigners, accommodation establishments, and relevant agencies, organizations, and individuals to implement declarations and receipt of temporary residence information of foreigners in Vietnam.

2. Temporary residence information of foreigners must be declared and received promptly, completely, and accurately. In cases where foreigners do not have passports or substitute documents, or if there are suspicions, the accommodation establishment must immediately report to the nearest public security agency for inspection.

3. Tourist accommodation establishments such as hotels shall declare temporary residence for foreigners through the electronic information website. Other accommodation establishments may choose one of two methods to declare temporary residence for foreigners through the electronic information website or using a Temporary Residence Declaration Form, encouraged to use the electronic information website.

Representatives of accommodation establishments or persons authorized, directly managing and operating accommodation establishments shall declare temporary residence for foreigners staying at the accommodation establishment. For accommodation establishments renting to foreigners for long-term stays where the owner does not reside there, or houses purchased by foreigners, the person named in the rental contract or house purchase contract shall be responsible for declaring temporary residence for foreigners staying at that accommodation establishment (hereinafter collectively referred to as the temporary residence declarant).

Chapter II

SPECIFIC PROVISIONS

Section 1

DECLARATION AND RECEIPT OF TEMPORARY RESIDENCE INFORMATION OF

FOREIGNERS THROUGH THE ELECTRONIC INFORMATION WEBSITE

Article 4. Accessing the Electronic Information Website to Receive a Declaration Account

1. The temporary residence declarant accesses the Electronic Information Website of the Provincial Police's Exit and Entry Management Department located in the province or centrally-administered city where the accommodation establishment is situated (hereinafter referred to as the Electronic Information Website), provides information about the name, type, address, phone number, and email of the accommodation establishment; their own full name, date of birth, phone number, identification card, citizen identity card, or passport number to receive a declaration account. When there are changes to the information related to the declaration account, it must be updated and supplemented immediately on the Electronic Information Website.

2. The temporary residence declarant is responsible for managing and securing the declaration account and all information generated by the declaration account. Upon discovering that the declaration account has been stolen, misused, or cannot be used, they must immediately notify the Provincial Police's Exit and Entry Management Department. The declaration account will automatically lose its validity if there is no new declaration information within 12 months or if false declarations or inaccurate information about foreigners or accommodation establishments are discovered.

Article 5. Declaration of Temporary Residence Information

1. The person declaring temporary residence shall access the electronic information website, log in to their declaration account to declare temporary residence information. The declaration of temporary residence for foreigners through the electronic information website must be carried out immediately upon arrival of the foreigner to register for temporary residence.

2. The temporary residence declaration information includes: Full name, gender, date of birth, nationality, passport number or other travel document equivalent to a passport, the expected duration of temporary residence of the foreigner. This information can be entered into individual fields or uploaded as a file following the template provided on the electronic information website.

3. The person declaring temporary residence shall check, modify, and supplement the information before confirming and saving it; they shall also check the management section of the temporary residence declaration information to confirm that the system has received the information, and if the system has not received it, they shall re-enter the information.

Article 6. Reception of Temporary Residence Information

The Exit and Entry Administration Department of the Public Security Province or Central City shall receive temporary residence information of foreigners declared through the electronic information website 24 hours a day, 7 days a week; they shall notify the border guard post at the place where the accommodation facility is located if the foreigner is residing at accommodation facilities in border areas.

Section 2

DECLARATION AND RECEIPT OF TEMPORARY RESIDENCE INFORMATION OF

FOREIGNERS BY TEMPORARY RESIDENCE DECLARATION FORM

Article 7. Declaration and Transfer of Temporary Residence Declaration Form

1. The person declaring temporary residence shall contact the police station of the commune, ward, town (hereinafter referred to as the commune-level police station) to obtain the model Temporary Residence Declaration Form NA17 issued together with Circular No. 04/2015/TT-BCA dated January 5, 2015 of the Ministry of Public Security.

2. The person declaring temporary residence shall fill in the Temporary Residence Declaration Form and directly transfer the Temporary Residence Declaration Form to the commune-level police station at the location of the accommodation facility within 12 hours from the time the foreigner arrives to register for temporary residence; for remote areas, this period is extended to 24 hours.

3. The Temporary Residence Declaration Form may be sent in advance via fax or the information may be notified by phone to the commune-level police station before transferring the Temporary Residence Declaration Form according to the deadline stipulated in Clause 2 of this Article.

Article 8. Reception of Temporary Residence Declaration Form

1. The commune-level police station shall receive temporary residence information of foreigners declared through the Temporary Residence Declaration Form 24 hours a day, 7 days a week.

2. The commune-level police station shall check the Temporary Residence Declaration Form; if it is not fully declared, they shall request immediate supplementation, implement confirmation, photocopy or record the received information in the duty book, and immediately return the Temporary Residence Declaration Form to the person declaring temporary residence; they shall also notify the border guard post at the location of the accommodation facility if the foreigner is residing at accommodation facilities in border areas.

Chapter III

IMPLEMENTATION

Article 9. Effective Date

This Circular takes effect from February 15, 2017.

Article 10. Responsibility for Implementation

2. Provincial and centrally-administered city public security organs shall be responsible for:

a) Publicizing the address of the electronic information website, telephone number, and fax number at their reception offices and through local mass media.

b) Assigning competent staff to receive information from temporary residence declarations of foreigners via the electronic information website or through Temporary Residence Declaration Forms in accordance with regulations.

c) Regularly inspect and provide technical support to accommodation establishments to ensure timely and smooth declaration of temporary residence for foreigners via the electronic information website.

d) Provide models of Temporary Residence Declaration Forms.

đ) Confirm that a temporary residence declaration has been made when requested by an organization, entity, or individual.

3. Heads of General Directorates, heads of units under the Ministry, Directors of Public Security, and Fire Prevention and Fighting Services of provinces and centrally-administered cities are responsible for implementing this Circular./.
