DECREE

AMENDMENTS AND SUPPLEMENTS TO THE DECREE NO. 58/2016/NĐ-CP OF JULY 1, 2016 ISSUED BY THE GOVERNMENT PROVIDING FOR DETAILS ON THE BUSINESS OF CIVIL CRYPTOGRAPHIC PRODUCTS AND SERVICES AND EXPORTS AND IMPORTS OF CIVIL CRYPTOGRAPHIC PRODUCTS

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Cybersecurity Law dated November 19, 2015;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree amending and supplementing Decree No. 58/2016/NĐ-CP dated July 1, 2016 of the Government providing for details on the business of civil cryptographic products and services and exports and imports of civil cryptographic products.

Article 1. Amending and supplementing Decree No. 58/2016/NĐ-CP dated July 1, 2016 of the Government providing for details on the business of civil cryptographic products and services and exports and imports of civil cryptographic products

Replacing Appendix II List of Civil Cryptographic Products for Export and Import under Permit of Decree No. 58/2016/NĐ-CP dated July 1, 2016 of the Government with Appendix II List of Civil Cryptographic Products for Export and Import under Permit attached hereto.

Article 2. Applying the List of Civil Cryptographic Products for Export and Import under Permit

1. The List of Civil Cryptographic Products for Export and Import under Permit shall only apply to civil cryptographic products whose HS code, name, and cryptographic function description match those of goods listed in the List.

2. In cases where there are discrepancies in determining the HS code of goods in the List issued together with this Decree and the List of Exported and Imported Goods of Vietnam, the Ministry of Finance (General Department of Customs) shall take the lead and coordinate with the Ministry of National Defense (Civil Cryptographic Administration Board) to decide on the HS code for exported and imported goods.

Article 3. Transitional Provisions

Export and import permits for civil cryptographic products already granted to enterprises shall continue to be valid according to the term stated on the permit for civil cryptographic products whose names are consistent with the List of Exported and Imported Goods of Vietnam. Customs authorities shall base their determination of HS code and processing of clearance procedures on the export and import permits already granted and the actual exported and imported goods.

Article 4. Effective date

This Decree takes effect from April 16, 2018.

Article 5. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and centrally-run city People's Committees, and related agencies are responsible for implementing this Decree./.
