CIRCULAR
Regulations on the program and content of technical safety training
for gas business activities
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 87/2018/NĐ-CP dated June 15, 2018 of the Government on gas business;
Pursuant to Decision No. 04/2015/QĐ-TTg dated January 20, 2015 of the Prime Minister stipulating management of safety in petroleum activities;
At the proposal of the Director of the Industrial Technical Safety and Environmental Protection Department,
The Minister of Industry and Trade issues this Circular to stipulate the program and content of technical safety training for gas business establishments as follows:
Article 1. Scope of Regulation
This Circular stipulates the program and content of technical safety training for gas business activities.
Article 2. Applicability
1. Gas business establishments;
2. Other organizations and individuals related thereto.
Article 3. Training Recipients
1. Group 1, including:
a) The head of a gas business establishment or an entity conducting gas business activities, responsible for managing the production and business operations of the establishment.
b) Heads of departments, branches, and equivalent units responsible for production, business, and technical affairs; workshop supervisors and equivalents.
c) Deputy heads of those specified in points a and b of Clause 1 of this Article who are assigned the responsibility to oversee safety at gas business establishments.
2. Group 2, including:
a) Full-time and part-time safety officers of the establishment;
b) Individuals directly supervising safety at workplaces.
3. Group 3, including workers directly involved in operation, maintenance, repair, storage, delivery, and transportation in the gas sector of the establishment.
4. In cases where workers fall under the category of technical safety training for transporting dangerous industrial goods, they shall be trained according to the provisions of the law on technical safety training for transporting dangerous industrial goods.
Article 4. Training Content
1. The content of technical safety training for gas business establishments (excluding retail liquefied petroleum gas stores (LPG stores)) and establishments producing and repairing LPG cylinders is set out in Appendix I.
2. The content of technical safety training for LPG stores is set out in Appendix II.
3. The content of technical safety training for establishments producing and repairing LPG cylinders is set out in Appendix III.
Article 5. Forms and Duration of Training
1. Forms of training:
a) Initial training.
b) Annual periodic training.
c) Refresher training: To be conducted when there is a change in job position, technology, or when an employee has been absent from work for six months or more, or upon failing a test.
2. Duration of initial training:
a) Group 1: At least 12 hours, including testing time.
b) Group 2: At least 16 hours, including testing time.
c) Group 3: At least 16 hours, including testing time.
3. Duration of periodic training: Half the duration of initial training.
4. Duration of refresher training: Equal to the duration of initial training.
5. Technical safety training for gas business activities may be organized separately or combined with other safety training activities prescribed by law.
Article 6. Evaluation of Training Results and Retention of Training Records
1. Gas business establishments or training organizations hired by such establishments are responsible for inspecting and evaluating the results of training.
2. Inspection regulations
a) The inspection content must correspond to the training content.
b) A passing grade requires an average score or higher.
3. Within fifteen working days from the end of training, gas business establishments or training organizations issue a decision recognizing the results of technical safety training in gas business activities.
4. Training records include:
a) Training materials;
b) A list of training recipients with their information and signatures confirming participation in training according to the model in Appendix IV.
c) Information about the trainer including: Name, date of birth, educational level, field of study, and work experience;
d) Content and results of technical safety training inspections;
đ) Decision recognizing the results of technical safety training inspections according to the model in Appendix V (in cases where the training organization is hired by the gas business establishment for training).
5. Gas business establishments are responsible for retaining all records specified in Clause 4 of this Article for three years and presenting them when requested by state management agencies.
Article 7. Responsibilities of Gas Business Enterprises
1. Organize training or hire organizations to conduct technical safety training for gas business activities of the enterprise in accordance with the regulations on training programs and contents stipulated in this Circular.
2. Ensure that trainers have a bachelor's degree or higher in a relevant field and at least five years of work experience in that field.
Article 8. Implementation clause
1. This Circular takes effect from February 18, 2019.
2. The Department of Technical Safety and Industrial Environment shall be responsible for organizing, directing, guiding, and inspecting the implementation of technical safety training activities in the gas business sector.
3. During the implementation, if any issues arise or difficulties occur, organizations and individuals shall report to the Ministry of Industry and Trade for timely consideration and resolution./.
