Article 1

- Issued together with the Decision on the Regulation on the preparation, examination, and approval of construction project designs to implement Articles 25 and 26 of the Regulations on investment and construction management.

Article 2

- This Regulation shall take effect nationwide from the date of issuance, all previous regulations on the preparation, review, and approval of design plans that conflict with this Regulation are hereby abolished.

Article 3

- Ministries, ministerial-level agencies, government-affiliated agencies, provincial people's committees under the central government are responsible for implementing this decision.

REGULATIONS

Preparation, examination, and approval of construction project designs
(Issued together with Decision No. 536/BXD-GD dated December 14, 1994 of the Minister of Construction)

PART I

GENERAL PROVISIONS

Article 1

This Regulation specifies the contents of the design stages, procedures, responsibilities, and authorities of the investors, construction consulting organizations, and other related organizations in the work of preparing, examining, and approving construction project designs belonging to all economic sectors, aiming to unify the management of design work throughout the country. All construction projects must be organized for preparation, examination, and approval according to the provisions of this Regulation.

The content of the preparation, examination, and approval of design plans for construction projects funded by foreign capital in Vietnam is specified in a separate document.

Article 2

Design procedure: Depending on the scale and technical complexity of the project, a one-step or two-step design process will be carried out according to the approved investment project document.

Projects with simple technology or existing standard designs will undergo a one-step design: construction technical design.

Article 3

Basis for designing projects:

- Approved investment project;

- Technical survey documents, basic investigation materials, socio-economic investigations for specialized organizations with legal personality to establish;

- Construction standards, technical standards, simplified cost norms, standard designs issued by the state.

In cases where foreign construction standards and technical standards are applied, they must be approved by the Ministry of Construction.

Article 4

Construction project designs must be prepared by organizations with legal personality and a license for construction consulting design. Design examination must be conducted by specialized organizations with legal personality for construction consulting that did not participate in the preparation of the design documents.

Article 5

Organizations preparing designs and organizations providing consulting services for design examination must bear responsibility for the quality of the design and the results of the examination before the law for their respective tasks. The head of the authority with the power to approve the design may only approve it after it has been examined and bears responsibility for his decision.

Article 6

For specialized construction projects such as transportation, water conservancy, mines, power transmission lines and substations, oil and gas, postal services, agriculture, forestry, and fisheries, relevant ministries managing specialized construction shall issue specific guidelines on the content of design preparation for projects within their sectors based on these circulars and the Regulations on investment and construction management, in accordance with specialized construction technical standards, and in coordination with the Ministry of Construction before issuing them.

PART II

PREPARATION OF DESIGN DOCUMENTS FOR CONSTRUCTION PROJECTS

Content of technical design.

1. Explanatory section:

1.1 General description.

- Basis and grounds for technical design;

- Basic content of the approved investment project;

- List of construction standards, technical standards, and standard designs used;

- Summary of the selected design project and comparative design options.

- Required parameters and performance indicators of the project according to the selected option.

1.2 Natural conditions, environmental impacts, and technical conditions influencing the design.

- Topographic, geological, hydrogeological, hydrological, meteorological, and seismic data in the construction area;

Environmental impact investigation;

Technical conditions governing design.

1.3 Economic-technical section:

- Capacity, designed power, and parameters of the project;

- Scheme, product list, product quality, product consumption;

- Economic-technical indicators and investment effectiveness of the scheme.

1.4 Technology section:

- Production methods and layout of production technology chains;

- Calculation and selection of equipment (type, brand, technical characteristics);

- Calculation and selection of equipment (type, brand, technical characteristics, country and year of manufacture...);

1.5 Construction section:

- Overall site layout, land area occupied, construction area of the project (including construction support facilities);

- Overall layout, land occupation area, construction area of the project;

- Construction technical solutions: main load-bearing structures, basic foundation calculations accompanied by detailed calculation methods and structures;

- Equipment installation and interior decoration;

- Infrastructure systems: electricity supply, heat supply, steam supply, oil supply, water supply, drainage, ventilation, signaling, fire alarm and extinguishing, automatic control with attached detailed calculation methods and results;

- Engineering systems: electricity supply, heat supply, steam supply, oil supply, water supply, drainage, ventilation, lighting, sound, signaling, fire alarm and extinguishing, automatic control, with calculation details clearly stated;

- External decoration (planting greenery, gardens...);

- Summary of construction volume, major materials, and technological equipment for each project component and the entire project, comparing economic-technical indicators of design schemes;

1.6 Construction organization design section:

Main guidance on construction methods and safety during the construction process.

2. Section drawings:

2.1 Current plans of the ground surface (line) and location on the map of the designed project.

2.2 Detailed layout plans of project components;

2.3 Technical preparation plans for construction sites (land leveling, stormwater drainage) and external infrastructure projects: roads, electricity supply, water supply, wastewater discharge, wastewater treatment, environmental protection;

2.4 Layout diagrams of production technology chains and positions of major equipment;

2.5 Architectural floor plans, cross-sections, and longitudinal sections of project components, and elevations;

2.6 Arrangement of equipment and necessary auxiliary components;

2.7 Detailed drawings of complex parts;

2.8 Floor plans showing layout options and dimensions of main load-bearing structures: foundations, columns, beams, floors, roofs...

2.9 Interior decoration;

2.10 Overall perspective views of the project;

2.11 Internal infrastructure systems: electricity supply, water supply, drainage, ventilation, air conditioning, communication, fire alarm and immediate extinguishing;

2.12 Escape routes and fire and explosion prevention measures;

2.13 External construction completion: fences, greenery, gardens;

2.14 Construction organization plans and construction plans for special components;

2.15 Models of the entire project or individual components (as per separate contracts with the investor);

3. Comprehensive budget estimate:

The comprehensive budget estimate is prepared according to the guidelines for pricing and construction cost management issued by the Ministry of Construction for projects under investment programs.

Article 8

Content of construction drawing design:

1. Construction drawings:

- Detailed floor plans and cross-sections of project components, fully displaying the position and size of structural details and technological equipment, including a list of construction volumes and equipment quantities, quality standards of typical processed materials, and instructions on construction sequence and labor safety requirements during construction.

- Detailed information for project components, fully displaying the position, size, specifications, and quantity of each type of material and component, with necessary notes for construction personnel.

- Detailed information on the installation of technological equipment at the manufacturing plant, fully displaying the position, size, specifications, and quantity of each type of equipment, components, spare parts, and materials, with necessary notes for construction personnel.

- Installation locations and detailed drawings of technical and technological systems;

- Detailed interior and exterior decoration.

- A summary table of construction volumes, equipment, and materials for each project component and the entire project, fully displaying the specifications and quantities of each type of material, component, and equipment.

2. Construction drawing cost estimate:

2.1 Basis and grounds for preparing the budget estimate, explaining quantities and necessary appendices.

2.2 Preliminary estimates and budget estimates for each project component and a consolidated budget estimate for all construction drawings or components of each phase.

3. In case of one-step design: The construction technical design includes construction drawings and explanatory sections as well as the comprehensive budget estimate.

Article 9

Design documentation; The form of explanation, scale of drawings, and detailed representation of each type of drawing must comply with standards for preparing design drawing documentation.

1. Technical design documents include:

- Explanatory volume (according to Article 7)

- Drawing volume (according to Article 7)

- Budget estimate volume (according to Article 7)

- Model (if necessary)

2. Construction drawing design documents for each project component include:

- Drawing volume (according to Article 8)

- Estimate-preliminary budget volume (according to Article 8)

3. Construction technical design documents include:

- Construction drawing volume (according to Article 8)

- Estimate-preliminary budget volume (according to Article 8)

- Technical design explanatory volume accompanying the comprehensive budget estimate (according to Article 7)

4. Quantity of design documentation and receiving agencies are stipulated as follows:

4.1 For technical design: The design organization must prepare and deliver seven sets to the investor for submission to:

- Approval authority;

- Investor (two sets)

- Permitting authority;

- Construction contractor (two sets)

4.2 For construction drawings: The design organization must prepare and deliver five sets to the investor for submission to:

- Investor (two sets)

- Construction contractor (three sets)

The number of files mentioned above is mandatory and has been included in the design cost. If additional copies are required, the project owner may contract for them outside the design cost.

Article 10

Construction survey work: The content and volume of construction surveys must be consistent with the design stages and characteristics of the project. The design organization is responsible for specifying survey requirements. The survey organization is responsible for the quality of survey materials produced.

Article 11

The design organization is responsible for:

1. Signing a contract to undertake design work with the investor and appointing a project leader to be fully responsible for the design of the project. If subcontracting specialized design work to other organizations, those specialized design organizations must have legal status and be accountable to the project leader and the law regarding their design work.

2. Raise requirements, recheck results, and accept survey materials that meet design requirements.

3. Be responsible for the quality, content, and volume of all design documents (including the use of supporting documents for design and sample designs).

4. Ensure the design schedule according to the contract, provide design documents on time, and be responsible for supplementing, correcting, or redoing when the design has not been approved.

5. Implement product quality inspection systems and internal acceptance of documents and data during the design process before handing over the design to the project owner.

6. Present and defend the design during the review and approval process.

7. Hold the copyright of the design project (except for sample designs issued by the state), store and manage original documents.

Article 12

The Project Investor has the responsibility:

1. Sign contracts with construction consulting organizations with legal status in their respective fields based on issued licenses, monitor and urge the implementation of the contract and timely payment of design costs as stipulated.

2. Provide necessary documents, data, and legal texts for the design organization to base their work on for designing the project.

3. Prepare a request for review and submit it for approval of the design.

4. Require the design agency to resolve issues arising from changes in the design during the construction process.

Article 13

The design price is established according to specific guidance documents.

Payment of design costs must be based on the economic contract between the project owner and the design organization.

CHAPTER III

TECHNICAL DESIGN REVIEW

Article 14

The design review organization for state investment projects in Group A.

1. The Minister in charge of the industry, prior to approving the technical design of Group A projects, must select consulting organizations or establish a Design Review Board with sufficient expertise to comprehensively review the design and total budget estimate.

The Minister of Construction shall lead the review of the total budget estimate and submit it to the Prime Minister for consideration to authorize the Minister in charge of the industry to approve.

2. Consulting organizations selected for the design review tender must have legal status: they must have a license to practice construction consulting; their capacity must be determined in the license and be appropriate to the type, scale, and level of the project they undertake to review according to state regulations.

3. If a Design Review Board is established, the Minister in charge of the industry must select experts with appropriate qualifications to review each aspect and the entire design and total budget estimate. Each member of the Board must bear professional responsibility for the area they review. The Chairman of the Board must compile and bear overall responsibility for the review results - total budget estimate. The cost for the Board's operation is regulated by the state and paid once to the Board.

4. In cases where the project has complex technology and domestic consulting organizations lack the ability to review, the Minister in charge of the industry must report to the government to obtain permission to select foreign consulting organizations to review the design.

Foreign consulting organizations undertaking design review tenders must be granted a construction consulting tender license by the Ministry of Construction as per current regulations.

The consulting tender price for design review is decided by the Minister in charge of the industry to sign a contract after obtaining approval from the Prime Minister.

Article 15

- Design review organizations for state investment projects in Groups B and C.

1. Heads of ministries and local authorities with the authority to approve designs must use specialized agencies or select construction consulting organizations with sufficient capacity and valid consulting licenses to review designs. The design review organization must not be involved in the design of the project.

2. The Ministry of Construction is responsible for selecting specialized agencies or selecting construction consulting organizations to review the technical design of Group B projects of government agencies and central-level organizations.

Article 16

Design review organizations for non-state-owned economic sectors.

1. Project owners are responsible for contracting with construction consulting organizations with legal status, sufficient professional capacity, and valid consulting licenses issued by the Ministry of Construction to review the design of projects they invest in.

For complex projects, it may be contracted to hire foreign consulting organizations to review, but this must be approved by the Ministry of Construction and granted a construction consulting tender license.

2. No design review is required for residential buildings under three stories (one ground floor and two upper floors), with an investment capital under 500 million VND or a floor area under 200 square meters, built in areas with approved detailed planning, not located in city centers, not adjacent to main roads of levels 1 and 2 in cities, not within natural conservation areas, and not near cultural and historical sites recognized as valuable where the designer must be responsible for the safety and durability of the building.

3. Provincial People's Committees directly under the central government guide and permit the establishment of construction consulting organizations with sufficient capacity to review designs according to the Construction Consulting Practice Regulation No. 158 - BXD/QLXD dated June 22, 1993, issued by the Ministry of Construction.

Article 17

The content of design review is specified as follows:

1. For state-owned construction investment projects:

1.1 Compliance with national standards, construction norms, unit prices, and current policies related to construction.

1.2 Appropriateness and accuracy of the design project compared to the approved investment project. Main aspects to consider include:

- Compatibility between production lines or usage requirements and the overall site plan and architectural space.

- Stability and durability of the structure: foundation, main load-bearing structures.

- Safety of infrastructure systems: heating, steam, oil pipelines, water supply, drainage, ventilation, communication signals, fire alarm and extinguishing, safety in explosions.

- Technical and economic indicators compared to the approved project;

1.3 Appropriateness of the design budget estimate compared to the approved total investment amount in the investment project.

1.4 Conditions and technical solutions ensuring stability for adjacent works, protecting the environment, and ensuring safety during construction.

2. For investment projects belonging to other economic sectors:

2.1 The validity of the design dossier: the legal status of the design organization; the compliance of the design with the approved investment project concerning planning and architectural design of the work; adherence to technical design standards.

2.2 Design solutions ensuring structural safety of the work, environmental protection, fire prevention, and explosion protection during the construction period as well as when in use; ensuring stability for adjacent works.

3. Upon completion of the review, the reviewing agency must prepare a report detailing the errors in the design and conclusions regarding the use of the design, draft documents to be submitted for approval.

Article 18

Time limit for design review.

Depending on the scale and nature of the work, the investor shall enter into a contract with the design review organization to ensure quality and construction progress as approved in the investment project, but not exceeding the time limits prescribed as follows:

- For investment projects in Group A: Not more than 60 days;

- For investment projects in Groups B and C: Not more than 40 days.

Article 19

Design review costs.

Design review costs are included in the total budget estimate of the work, outside the design cost, according to the state-prescribed levels.

Article 20

Responsibilities of the design review organization.

Design review organizations are responsible under the law for the results of the design review. When signing a review contract, they must clearly specify the responsibilities for each type of review work in the contract with the investor. The design review contract must be approved by the head of the design approval authority before implementation.

PART IV

REVIEW OF THE DESIGN

Article 21

Approval of technical design or construction technical design must be based on the approved investment project and the results of the design review.

Article 22

Documents for submitting the design for review are submitted by the investor to the designated design review agency as follows:

1 - Application for approval of the design;

2 - Copy of the document approving the investment project;

3 - Design dossier at the design stage as stipulated in Articles 7 and 9 of this Regulation;

4 - Report on the results of the review.

Article 23

The competent authority managing construction design at the level with approval authority (Department with construction management functions, Design Review Office, Department of Construction, Specialized Construction Management Departments such as Transportation, Water Resources, Agriculture, Forestry, Fisheries) shall process the application for design approval as specified in Article 22, prepare the approval document for submission.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."

Approval of technical design and construction technical design is regulated as follows:

1. For investment construction projects owned by the State;

1.1 The Minister in charge of the sector approves the technical design of projects in Group A;

1.2 The head of the agency authorized to decide on investment approves the technical design of projects in Groups B and C.

1.3 The Minister of Construction approves the technical design of the work

1.4 Master plan or route of the work, land area occupied, construction area.

1.5 Main architecture and structure of the work

1.6 Construction and installation organization plan.

1.7 Technical design budget estimate of the work

1.8 Economic and technical indicators of the work.

1.9 Overall construction schedule of the work.

2. For investment projects belonging to other economic sectors:

2.1 Architectural form of the work consistent with detailed planning of the area or issued planning certificate.

2.2 Structural solutions ensuring stability and durability of the construction work and adjacent works.

2.3 Technical solutions for environmental protection, fire prevention, and ensuring construction safety of the work.

Article 26

The time limit for examination and approval of the design from the date of receipt of the dossier as stipulated in Article 22 is as follows:

- For projects in Groups A and B: Not more than 15 days

- For projects in Group C: Not more than 10 days

If the design is not approved within the above time limit, the examining agency must inform the investor in writing about the reasons and return the design dossier.

In case of necessary corrections, supplements, or resubmission of the dossier, the review and examination time limit will be calculated from the date of receipt of the adjusted and supplemented dossier.

Article 27

Documents approving technical design and construction technical design of construction works must be sent to the following agencies for supervision and management:

1. For works in Groups A and B invested by the State: Government Office, National Planning Commission, Ministry or agency authorized to decide on investment, Ministry of Construction, Ministry of Finance, construction permit issuing agency, and People's Committee of the province or city where the work is located.

2. For works in Group C invested by the State: agency authorized to decide on investment, planning and finance agencies, Department of Construction, and People's Committee of the province or city where the work is located.

3. For works belonging to other economic sectors: local construction permit issuing agency; People's Committee of the provincial city or district where the work is located.

Article 28

The validity period of approved technical design and overall budget estimates of the works is two years. After two years from the date of approval, if the work has not commenced construction, it must be reviewed again for approval.

Article 29

Approved design documents must be submitted for national, sectoral, or territorial (according to the hierarchy) archives and provided to relevant agencies as stipulated in Article 9 of this Regulation.

CHAPTER V

IMPLEMENTING PROVISIONS

Article 30.

This Regulation takes effect from the date of issuance. Other provisions contrary to this Regulation are abolished.

Article 31

Ministries, ministerial-level agencies, government-affiliated agencies, People's Committees of provinces and centrally-administered cities, construction management agencies, and investors are responsible for disseminating and implementing this Regulation.
