REGARDING THE DESIGN REVIEW FEE FOR CONSTRUCTION PROJECTS
FOR BUILDING CONSTRUCTIONS

The Ministry of Finance has received Document No. 597/BXD-KTTC dated April 7, 2006 from the Ministry of Construction requesting permission for ministries, sectors, and localities to temporarily collect the "design review fee for construction projects" at the level specified in Circular No. 109/2000/TT-BTC dated November 13, 2000 guiding the collection, payment, management, and use of the design review fee. Regarding this matter, the Ministry of Finance provides the following opinion:
- Based on the Construction Law and Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government detailing the implementation of the Construction Law;
- Based on Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges; and Decree No. 24/2006/NĐ-CP dated March 6, 2006 amending and supplementing Decree No. 57/2002/NĐ-CP dated June 3, 2002 detailing the implementation of the Ordinance on Fees and Charges;
While awaiting amendments and supplements to Circular No. 109/2000/TT-BTC dated November 13, 2000 of the Ministry of Finance guiding the collection, payment, management, and use of the investment project design review fee, the Ministry of Finance agrees that ministries, sectors, and localities may collect the "design review fee for construction projects" at the level specified in Circular No. 109/2000/TT-BTC; units collecting fees shall be responsible for managing and using the "design review fee for construction projects" in accordance with the provisions of the aforementioned Circular No. 109/2000/TT-BTC.
The Ministry of Finance replies for the Ministry of Construction to be informed and to guide relevant units to implement accordingly.
