Circular No. 54/2006/TT-BTC guides the implementation of the Regulation on Publicizing Direct State Budget Support for Individuals and Residents

CIRCULAR

GUIDELINES FOR IMPLEMENTING THE REGULATION ON PUBLIC DISCLOSURE OF DIRECT SUPPORT FROM THE STATE BUDGET TO INDIVIDUALS AND COMMUNITIES

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 192/2004/QĐ-TTg dated November 16, 2004 of the Prime Minister on the issuance of the Regulation on Public Disclosure of Financial Information for all levels of state budget, budgetary units, organizations supported by the state budget, construction projects using state budget funds, state-owned enterprises, funds sourced from the state budget, and funds from people's contributions;

The Ministry of Finance provides guidelines for implementing public disclosure of direct support from the state budget to individuals and communities as follows:

1. Contents of disclosure:

1.1. Publicly disclose state policies and regulations on direct support to individuals and communities such as: subsidies for persons with meritorious service to the revolution; social assistance policies; support policies for the poor, elderly without dependents, homeless children, victims of Agent Orange,...

1.2. Publicly disclose state policies and regulations on extraordinary support to individuals and communities, such as: support for disaster recovery, epidemic control; famine relief;慰问和探望节日里的个人...

1.3. Publicly disclose procedures and review processes, payment procedures for beneficiaries under state support policies and regulations as prescribed.

1.4. Publicly disclose the results of reviews and payments for beneficiaries under state support policies and regulations as prescribed, such as: publicly disclose the number of beneficiaries, benefits received, and the level of support from the state budget (according to the attached form).

2. Forms of public disclosure:

2.1. Post at the headquarters of the People's Committee of communes, wards, towns

2.2. Notify in writing to the Party Committee, political and social organizations at the commune level, and village chiefs at the commune level.

2.3. Publicly disclose through mass media at the commune, ward, town level and villages, hamlets, villages, villages, villages, villages, villages, and neighborhood committees within the commune.

2.4. Publicly disclose at village meetings, hamlet meetings, village meetings, village meetings, village meetings, village meetings, and neighborhood committee meetings within the commune.

3. Time and duration of public disclosure:

- For contents 1.1 and 1.2: Publicly disclose immediately after the commune-level People's Committee receives the policy document, with a disclosure period of 30 days.

- For content 1.3: Publicly disclose immediately after the commune People's Committee begins to accept applications for review (for cases where the commune-level People's Committee is responsible for accepting applications and conducting reviews), with a disclosure period of 30 days.

- For content 1.4: Publicly disclose no later than 30 days after the review and payment results are officially issued by the agency responsible for reviewing and paying beneficiaries according to the prescribed regulations. The disclosure period must be at least 30 days.

For regular support (monthly support) from the state budget to individuals and communities, only one disclosure will be made after the official review results are issued by the competent authority.

4. Responsibilities for public disclosure:

4.1. The Chairman of the Commune People's Committee shall coordinate with agencies assigned the task of providing direct support to individuals and communities to implement the public disclosure of the contents specified in Point 1; at the same time, he/she shall be responsible for directing villages, hamlets, villages, villages, villages, villages, villages, and neighborhood committees and various departments, associations, and mass organizations at the commune level to carry out public disclosure as stipulated in Points 2.3 and 2.4 of this Circular.

4.2. Heads of agencies and units under the provincial and district People's Committees assigned the task of providing direct support to individuals and communities shall be responsible for promptly providing full information to the commune People's Committee to facilitate its implementation of public disclosure in accordance with the prescribed regulations.

4.3. The Chairman of the provincial and district People's Committees shall direct relevant agencies to provide necessary information and cooperate with the commune People's Committee to implement public disclosure of direct support from the state budget to individuals and communities.

5. Questioning and responding to questions:

The All-Vietnam Patriotic Front at the commune level, various organizations at the commune level, and the people shall supervise the implementation of public disclosure by the commune People's Committee in accordance with the provisions of this Circular. If there are any concerns, they have the right to question the Chairman of the commune People's Committee about the disclosed contents.

The Chairman of the commune People's Committee must respond to questions about the disclosed contents. Responses can be given directly or in writing. In cases where the questions involve agencies and units under the provincial and district People's Committees responsible for reviewing support for individuals and communities, the commune People's Committee has the right to request those agencies to respond in writing to the person asking the question instead of the commune People's Committee.

In cases where responses are given in writing, the response time shall not exceed 10 days from the date of receiving the questioning content. In cases where the questioning content is complex and requires more time to prepare the response, a specific response date must be provided in writing to the person asking the question, but it shall not exceed 45 days from the date of receipt of the questioning content.

6. Organization of implementation:

1. This Circular takes effect 15 days after its publication in the Official Gazette.

2. Ministries, ministerial-level agencies, government agencies, central-level agencies, and People's Committees at all levels shall be responsible for organizing its implementation; financial agencies at all levels shall assist the People's Committees at their respective levels in fully implementing the provisions on public disclosure of the state budget.
