PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Thrift and Combating Wastefulness dated November 29, 2005;

Pursuant to Decree No. 14/1998/NĐ-CP dated March 6, 1998 of the Government on the management of state assets;

Pursuant to Decree No. 137/2006/NĐ-CP dated November 14, 2006 of the Government on the regulations regarding the decentralization of state management over state assets at administrative agencies and public service units, including those established with state ownership rights according to the law;

Considering the proposal of the Minister of Finance,

DECISION:

Article 1. General Provisions

1. This Decision stipulates the standards, quotas, and regulations on equipping, managing, and using cars for state reception under the Ministry of Foreign Affairs.

2. Cars for state reception are formed from state budget funds or have their origin from state budget funds (including aid and gifts from organizations and individuals both within and outside the country or established with state ownership rights according to the law).

3. The Ministry of Foreign Affairs shall implement the equipping, management, and allocation of use of cars in accordance with the purposes, economically and effectively, to meet the requirements of serving foreign affairs work of the Party and State based on the standards, quotas, and provisions of this Decision.

Article 2. Regulations on purchasing, using, and replacing cars for state reception

1. Purchasing and equipping cars for state reception shall be carried out through bidding in accordance with current regulations. In special cases where it is necessary to purchase through direct assignment, such assignments must be implemented in accordance with the legal provisions on bidding.

2. It is strictly prohibited to use cars for state reception for personal purposes; to give, lease, or lend them to any organization or individual. In cases of sale, exchange, or transfer, they must be carried out according to the decision of the Prime Minister.

3. Cars for state reception shall be replaced when they have been used for more than 120,000 kilometers.

4. Special cases allowing the replacement of cars for state reception before meeting the conditions specified in Clause 3 of this Article are as follows:

a) Due to the need to serve the foreign affairs work of the Party and State in new circumstances, requiring the replacement of cars ahead of schedule, the Ministry of Foreign Affairs shall take the lead, coordinate with the Ministry of Finance and relevant agencies to submit to the Prime Minister for consideration and decision;

b) If the car has technical defects that the manufacturer cannot repair, or if the car is involved in an accident with excessive repair costs, or if the car does not meet the safety quality conditions required for serving foreign affairs work, based on the inspection results of the competent state agency (Ministry of Transport, Ministry of Public Security, and related agencies), the Ministry of Foreign Affairs shall decide to replace the car after obtaining a written agreement from the Ministry of Finance.

5. The number of cars replaced in accordance with Clauses 3 and 4 of this Article shall be sold through public auction or transferred in accordance with the current regulations of the State. The proceeds from the sale of the cars, after deducting directly related expenses, must be remitted to the state budget in accordance with the law.

Article 3. Standards, quotas, and allocation for equipping and using cars for state reception

1. Group of cars serving the Head of State, Deputy Head of State, Chairman of the National Assembly, Prime Minister, Secretary-General of the United Nations, Foreign Ambassadors presenting Credentials (hereinafter referred to as Group 1); the number of cars equipped is: 04 vehicles.

2. Group of cars serving the Vice-Chairman of the National Assembly, Deputy Prime Minister, Minister of Foreign Affairs or equivalent, spouse or partner of the Head of State, Deputy Head of State, Chairman of the National Assembly, Prime Minister (hereinafter referred to as Group 2); the number of cars equipped is: 18 vehicles.

3. Group of cars serving other Ministers, members of high-level delegations, high-level delegations of Deputy Heads of State, members of the Royal Family (Prince, Princess, etc.), Chairman of the ruling party,... state guest delegations of ministries and sectors (hereinafter referred to as Group 3); the number of cars equipped is: 37 vehicles.

4. Type of specialized vehicle for carrying luggage for international delegations visiting our country and high-level delegations of our Party and State visiting other countries (hereinafter referred to as Group 4); the number of cars equipped is: 03 vehicles.

5. The Ministry of Foreign Affairs shall take the lead, coordinate with the Ministry of Finance and relevant agencies to submit to the Prime Minister for specific decisions on the types of cars for each group when purchasing and equipping, ensuring suitability with the actual situation and conditions of the country and fully meeting the requirements for serving the foreign affairs work of the Party and State.

Article 4. Regulations on managing state reception vehicles

1. The Ministry of Foreign Affairs shall be responsible for managing and using the number of vehicles equipped according to their intended purpose, nature, and level as prescribed by state reception regulations and this Decision.

2. In cases where vehicle replacement is carried out as stipulated in Clause 3 and Clause 4, Article 2 of this Decision, the Ministry of Foreign Affairs shall develop plans for procurement and new equipment to ensure that they meet the requirements for serving foreign affairs work of the Party and State. On this basis, it shall coordinate with the Ministry of Finance and the Ministry of Planning and Investment to submit to the competent authority for consideration and decision on the allocation of funds in the annual budget of the Ministry of Foreign Affairs in accordance with the provisions of the State Budget Law.

3. The state budget shall ensure the operation of state reception vehicles through payment based on actual mileage used directly for foreign affairs work of the Party and State.

4. In special cases requiring additional vehicles (beyond the number currently provided for in Article 3 of this Decision) to meet the demand for transportation means serving state reception work, the Ministry of Foreign Affairs shall proactively lease additional vehicles within a price range consistent with the actual market price.

Article 5. Responsibilities of Ministries and Relevant Agencies

1. The Ministry of Foreign Affairs is responsible for:

a) Coordinate with the Ministry of Finance and relevant agencies to implement this Decision;

b) Uniformly coordinate with the Ministry of Finance to establish and promulgate regulations on the management and use of vehicles for state reception purposes, while ensuring safe, economical, and effective implementation in accordance with national asset management regulations;

c) Chair and coordinate with the Ministry of Finance to specify specific rates (per kilometer) based on the principle of covering all operational costs of the vehicles as prescribed (excluding basic depreciation and major overhauls);

d) Chair and coordinate with the Ministry of Planning and Investment and the Ministry of Finance to develop plans for procurement and equipping vehicles for state reception purposes in accordance with the standards and norms set forth in this Decision.

2. The Ministry of Planning and Investment shall have the responsibility:

a) Coordinate with the Ministry of Foreign Affairs and the Ministry of Finance to develop plans for equipping, purchasing state reception vehicles in accordance with the provisions of this Decision;

b) Chair and coordinate with the Ministry of Finance, the Ministry of Foreign Affairs, and relevant agencies to inspect compliance with investment plans for equipping and purchasing state reception vehicles in accordance with current regulations.

3. The Ministry of Finance shall be responsible:

a) Coordinate with the Ministry of Foreign Affairs and the Ministry of Planning and Investment to prepare the annual budget for submission to the competent authority for decision-making in accordance with the State Budget Law to ensure funding for the equipping, purchasing, and use of vehicles for state reception purposes to meet service needs;

b) Coordinate with the Ministry of Foreign Affairs to establish rates for groups of vehicles for state reception purposes as stipulated in Point c, Clause 1, Article 5 of this Decision;

c) Guide and coordinate inspections to urge the implementation of this Decision.

4. The Ministry of Public Security shall be responsible for:

a) Coordinate with the Ministry of Foreign Affairs to manage state vehicles for state reception purposes according to the purpose, nature, and level of state reception as prescribed;

b) Coordinate with the Ministry of Foreign Affairs and relevant agencies to ensure safety for state reception vehicles.

5. The Ministry of Transport shall be responsible for:

a) Coordinate with the Ministry of Public Security and the Ministry of Foreign Affairs to inspect the technical quality of state reception vehicles as a basis for considering decisions on vehicle replacement as stipulated in Point b, Clause 4, Article 2 of this Decision.

b) Carry out state management functions for state reception vehicles in accordance with the law.

Article 6. Implementation Provisions

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. Previous regulations contrary to this Decision are hereby abolished.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Heads of relevant agencies are responsible for implementing this Decision./.
