DECREE

Guidelines on soliciting voter opinions regarding the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries.

The Government issues this Decree to guide the solicitation of voter opinions on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries.

Pursuant to the Law on Government Organization dated June 19, 2015;

On the basis of the Ordinance on Implementation of Democracy in Communes, Wards, and Towns dated April 20, 2007;

||| Based on the proposal of the Minister of Home Affairs;

Article 1. Scope of regulation: This Decree guides the solicitation of voter opinions on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries as stipulated in Clause 2, Article 131 of the Law on the Organization of Local Administration.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 2. Applicability: Organizations and individuals directly related to the solicitation of voter opinions on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries.

In this Decree, voters are understood as citizens of the Socialist Republic of Vietnam who have registered their permanent residence at the commune-level administrative units directly affected by the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries, are eighteen years old or older, and possess full civil capacity as of the date when the competent authority decides to organize the solicitation of voter opinions.

Article 2. Interpretation of Terms

1. Propagating false information about the content and significance of soliciting voter opinions.

Article 3. Prohibited Acts

2. Using deceitful means, bribery, coercion, or obstruction to prevent voters from exercising their right to express opinions or to make them express opinions contrary to their wishes.

3. Forging documents, cheating, or using other deceptive methods to alter the results of soliciting voter opinions.

4. Exploiting the solicitation of voter opinions to incite disturbances, disrupt public order, infringe upon national security, social order and safety, or the interests of the State, legitimate rights and interests of state agencies, organizations, and individuals.

VOTER LIST FOR OPINION POLLING

Chapter II

Article 4. Principles for compiling the voter list for opinion polling

1. All voters residing in the commune-level administrative units directly affected by the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries shall be included in the voter list and issued opinion polling ballots.

2. Each voter may only be listed once on the voter list at the place where they have registered their permanent residence.

3. If a voter is currently under temporary detention, arrest, or serving a compulsory educational measure or compulsory drug rehabilitation measure, the People's Committee of the commune where the voter has registered their permanent residence shall include the voter's name on the list for opinion polling at the location where the voter is temporarily detained, arrested, or undergoing compulsory educational or drug rehabilitation measures.

4. A voter returning to Vietnam from abroad during the period from after the voter list is compiled by the People's Committee of the commune to 24 hours before the competent authority decides to organize the opinion polling shall present their passport indicating Vietnamese citizenship to the People's Committee of the commune where they have registered their permanent residence to be included in the voter list and issued an opinion polling ballot.

5. If a voter changes their place of residence to another administrative unit after the voter list has been posted and the voter is already listed but loses civil capacity or is sentenced to imprisonment or deprived of civic rights prior to or at the start of voting, the voter's name shall be removed from the voter list.

6. The voter list shall be posted for a period of thirty days from the start of posting until the organization of the distribution of opinion polling ballots.

6. The list of voters shall be posted for a period of thirty days from the date of posting the list until the day of distributing ballots to solicit voter opinions.

Article 5. Competence to establish and post the list for distributing ballots to collect voter opinions; complaints and resolution of complaints regarding the voter list

1. The People's Committee at the commune level shall be responsible for establishing and posting the voter list to distribute ballots to collect voter opinions within its administrative area at the time of organizing the opinion collection.

2. When checking the voter list, if any errors are found, citizens have the right to lodge complaints with the People's Committee at the commune level where the voter list was established within ten days from the date the People's Committee at the commune level organized the distribution of ballots to collect voter opinions. The People's Committee at the commune level where the voter list was established must record those complaints. Within three working days from the date of receiving the complaint, the People's Committee at the commune level must resolve it and notify the complainant of the resolution result.

3. In cases where the complainant disagrees with the resolution of the complaint or the complaint remains unresolved beyond the resolution period, they have the right to initiate litigation before the Administrative Court in accordance with the provisions of the law on administrative procedure.

4. For administrative units at the district level that do not organize administrative units at the commune level, the People's Committee at the district level shall be responsible for establishing, posting the voter list, and performing other tasks and authorities of the People's Committee at the commune level as stipulated in Article 131 of the Law on the Organization of Local Administration and this Decree.

Chapter III

INFORMATION AND PUBLICITY REGARDING THE COLLECTION OF VOTER OPINIONS

Article 6. Objectives and principles of information and publicity

1. Information and publicity about collecting voter opinions aim to provide full and accurate information to voters regarding the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries, so that voters understand the significance and content of the opinion collection; the rights, obligations, and responsibilities of voters; encourage and motivate voters to actively participate when competent authorities organize the collection of voter opinions.

2. Information and publicity about collecting voter opinions shall be conducted openly, democratically, in accordance with the law, and ensure public order and social safety in the locality.

Article 7. Content of information and publicity

1. The necessity of establishing, dissolving, merging, dividing, and adjusting administrative unit boundaries.

2. Plans for establishing, dissolving, merging, dividing, and adjusting administrative unit boundaries.

3. The target group and scope of impact of the opinion collection issue.

4. Time schedule for organizing the opinion collection.

5. Rights and obligations of voters in the opinion collection process.

Article 8. Forms of information and publicity

1. Organizing information and publicity about the opinion collection through mass media and local information systems in accordance with the provisions of the law.

2. Disseminating at meetings of voters organized by the People's Committee at the commune level and at village, hamlet, ward, group, community, cluster, section, block, neighborhood, street, quarter, group, ... (hereinafter referred to collectively as village or residential group) within the commune-level administrative area.

Article 9. Responsibilities of agencies and organizations in information and publicity regarding the collection of voter opinions

1. People's Committees at all levels shall be responsible for implementing information and publicity about collecting voter opinions concerning the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries in their localities.

2. Local press agencies shall be responsible for publicizing the collection of voter opinions, providing information on the organization of the collection of voter opinions in accordance with the law, government directives, and the instructions of People's Committees at all levels.

Chapter IV

PROCEDURES AND FORMALITIES FOR ORGANIZING THE COLLECTION OF VOTER OPINIONS

Article 10. Model ballot for collecting voter opinions

1. The ballot for collecting voter opinions on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries at all levels shall be uniformly used throughout the country.

2. The ballot for collecting voter opinions must be clear, easy to understand, meaningful, and ensure all contents as prescribed in the Model Ballot for Collecting Voter Opinions attached to this Decree.

Article 11. Timeframe for collecting opinions

1. For the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries at the provincial level

a) After drafting the proposal for the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries, the Ministry of Home Affairs shall issue a document along with the model ballot and opinion collection materials to the People's Committee of the province to organize the collection of voter opinions within the provincial area;

b) Within a maximum of five working days from the date of receipt of the document from the Ministry of Home Affairs, the People's Committee of the province shall issue a document along with the model ballot and opinion collection materials to the People's Committee of the district to direct and guide the People's Committee of the commune to organize the collection of voter opinions within the district area;

c) Within a maximum of five working days from the date of receipt of the document from the People's Committee of the province, the People's Committee of the district shall issue a document along with the model ballot and opinion collection materials to the People's Committee of the commune to direct and guide the People's Committee of the commune to organize the collection of voter opinions by each village and residential ward;

d) Within a maximum of sixty days from the date of receipt of the document from the People's Committee of the district, the People's Committee of the commune shall complete the collection of voter opinions according to the provisions of the Law on Organization of Local Administration and this Decree;

đ) Within a maximum of five working days from the date of completion of the collection of voter opinions, the People's Committee of the commune shall compile and prepare a report on the results of the collection of voter opinions within its area to send to the People's Council at the same level and the People's Committee of the district.

Within a maximum of five working days from the date of receipt of the report on the results of the collection of voter opinions from the lower-level People's Committee, the People's Committee of the province and district shall compile and prepare a report on the results of the collection of voter opinions within their areas to send to the competent authority according to the provisions of the Law on Organization of Local Administration and this Decree.

2. For the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries at the district and commune levels

a) After drafting the proposal for the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries, the People's Committee of the province shall issue a document along with the model ballot and opinion collection materials to the People's Committee of the district to direct and guide the People's Committee of the commune to organize the collection of voter opinions within the district area;

b) Within a maximum of five working days from the date of receipt of the document from the People's Committee of the province, the People's Committee of the district shall issue a document along with the model ballot and opinion collection materials to the People's Committee of the commune to direct and guide the People's Committee of the commune to organize the collection of voter opinions by each village and residential ward;

c) Within a maximum of sixty days from the date of receipt of the document from the People's Committee of the district, the People's Committee of the commune shall organize and complete the collection of voter opinions according to the provisions of the Law on Organization of Local Administration and this Decree;

d) Within a maximum of five working days from the date of completion of the collection of voter opinions, the People's Committee of the commune shall compile and prepare a report on the results of the collection of voter opinions within its area to send to the People's Council at the same level and the People's Committee of the district.

Within a maximum of five working days from the date of receipt of the report on the results of the collection of voter opinions from the lower-level People's Committee, the People's Committee of the province and district shall compile and prepare a report on the results of the collection of voter opinions within their areas to send to the competent authority according to the provisions of the Law on Organization of Local Administration and this Decree.

Article 12. Documents for soliciting opinions

1. Documents for soliciting opinions include:

a) The proposal for establishing, dissolving, merging, dividing, or adjusting administrative unit boundaries;

b) A summary of the proposal, including the plan for establishing, dissolving, merging, dividing, or adjusting administrative unit boundaries; a summary evaluation of the administrative unit's standards (if applicable) and conditions for establishment, dissolution, merger, division, or boundary adjustment; a list of guiding documents and policies of the Party and State.

2. Documents for soliciting opinions must be published on the provincial, district, and commune people's committee websites (if applicable); posted at the headquarters of the commune people's committee, community activity points, and publicized and disseminated through local mass media, village meetings, and neighborhood meetings during the period of soliciting voter opinions.

Article 13. Rights and Obligations of Voters

1. All voters have the right and obligation to participate when the competent authority organizes the solicitation of voter opinions.

2. Each voter has the right to express their agreement or disagreement on the Opinion Solicitation Form.

3. Voters must write and sign the Opinion Solicitation Form themselves, and may not have someone else write it for them, except in cases provided for in Clause 4 of this Article.

4. In cases where voters cannot read or write Vietnamese or are disabled and unable to mark and sign the Opinion Solicitation Form, they may have a family member or close relative write it for them.

Article 14. Publicizing the Results of Voter Opinions on the Government Portal

1. Within a maximum of five working days from the date of preparing the report on the results of soliciting voter opinions as stipulated in Point d Clause 1 and Point d Clause 2 of Article 11 of this Decree, the provincial people's committee shall send the Report on the Results of Soliciting Voter Opinions on the Proposal to the Government Portal for publication.

2. Within a maximum of five working days from the date of receiving the document from the provincial people's committee, the Government Portal is responsible for publishing the Report on the Results of Soliciting Voter Opinions.

Article 15. Handling Petitions Regarding the Results of Soliciting Voter Opinions

1. When discovering errors in the results of soliciting voter opinions, citizens and organizations have the right to lodge complaints with the people's committee that prepared the report on the results of soliciting voter opinions. Within five working days from the date of receipt of the complaint, the people's committee must resolve it and inform the complainant of the resolution result.

2. In cases where errors in the results of soliciting voter opinions arise from the process of compiling and preparing the report on the results of soliciting voter opinions, the people's committees at all levels must correct and complete the report on the results of soliciting voter opinions and submit it to the competent authorities in accordance with the Law on the Organization of Local Administration and this Decree.

3. In cases where errors in the results of soliciting voter opinions arise from the Government Portal's publication, the provincial people's committee shall issue a document requesting correction to the Government Portal. Within five working days from the date of receipt of the document from the provincial people's committee, the Government Portal is responsible for correcting the results of soliciting voter opinions.

4. In cases where the complainant disagrees with the resolution of the complaint or the complaint remains unresolved after the resolution period has expired, the complainant has the right to initiate litigation before the Administrative Court in accordance with the law on administrative procedure.

Article 16. Funding for Organizing Public Consultation

Chapter V

IMPLEMENTING PROVISIONS

Article 17. Effective Date

This Decree shall take effect from the date of issuance.

Article 18. Implementation Organization

1. The Ministry of Interior is responsible for assisting the Government in inspecting and guiding the People's Committees at all levels in soliciting voter opinions on proposals for establishing, dissolving, merging, dividing, and adjusting administrative boundaries in specific cases.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-run city People's Committees, and related organizations and individuals are responsible for implementing this Decree.
