Repeals Circulars of the Ministry of Finance detailing the use of state capital for procurement to maintain the regular operations of state agencies, units under the people's armed forces, public service organizations, political organizations, socio-political organizations, socio-professional organizations, social organizations, and socio-professional organizations.

Pursuant to the Law on Legislative Regulatory Documents 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to the Bidding Law No. 22/2023/QH15 dated June 23, 2023;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents; and Decree No. 59/2024/NĐ-CP dated May 25, 2024 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents which have been amended and supplemented certain articles according to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government;

Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Administrative and Public Financial Affairs Department,

The Minister of Finance issues this Circular to repeal Circulars of the Ministry of Finance detailing the use of state capital for procurement to maintain the regular operations of state agencies, units under the people's armed forces, public service organizations, political organizations, socio-political organizations, socio-professional organizations, social organizations, and socio-professional organizations.

Article 1. Repeal all the circulars

Repeal all the following circulars:

1. Circular No. 58/2016/TT-BTC dated March 29, 2016 of the Ministry of Finance detailing the use of state capital for procurement to maintain the regular operations of state agencies, units under the people's armed forces, public service organizations, political organizations, socio-political organizations, socio-professional organizations, social organizations, and socio-professional organizations.

2. Circular No. 68/2022/TT-BTC dated November 11, 2022 of the Ministry of Finance amending and supplementing certain articles of Circular No. 58/2016/TT-BTC dated March 29, 2016 detailing the use of state capital for procurement to maintain the regular operations of state agencies, units under the people's armed forces, public service organizations, political organizations, socio-political organizations, socio-professional organizations, social organizations, and socio-professional organizations.

Article 2. Implementation clause

1. This Circular takes effect from September 9, 2024. From the date the Bidding Law No. 22/2023/QH15 takes effect until the date Decree No. 24/2024/NĐ-CP dated February 27, 2024 of the Government detailing certain provisions and implementing measures of the Bidding Law regarding the selection of contractors takes effect, the contents stipulated in Circular No. 58/2016/TT-BTC dated March 29, 2016 of the Ministry of Finance detailing the use of state capital for procurement to maintain the regular operations of state agencies, units under the people's armed forces, public service organizations, political organizations, socio-political organizations, socio-professional organizations, social organizations, and socio-professional organizations, and Circular No. 68/2022/TT-BTC dated November 11, 2022 of the Ministry of Finance amending and supplementing certain articles of Circular No. 58/2016/TT-BTC dated March 29, 2016 detailing the use of state capital for procurement to maintain the regular operations of state agencies, units under the people's armed forces, public service organizations, political organizations, socio-political organizations, socio-professional organizations, social organizations, and socio-professional organizations that are inconsistent with the Bidding Law No. 22/2023/QH15 shall not be applied. In case of difficulties, please report to the Ministry of Planning and Investment for guidance or submit to the competent authority for guidance in accordance with Clause 7, Article 133 of Decree No. 24/2024/NĐ-CP dated February 27, 2024 of the Government detailing certain provisions and implementing measures of the Bidding Law regarding the selection of contractors.

2. The Director of the Administrative and Public Financial Affairs Department, Heads of units under the Ministry of Finance, and related agencies, organizations, and individuals shall be responsible for implementing this Circular.
