CIRCULAR

MINISTRY OF FINANCE DECREE NO. 54 TC/TCCB OF JULY 14, 1995 GUIDING THE CONTENTS OF THE WORK OF STATE MANAGEMENT OF PUBLIC ASSETS OF PROVINCES' DEPARTMENTS OF FINANCE AND PRICES UNDER THE CENTRAL GOVERNMENT'S DIRECT CONTROL

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies; and Decree No. 178/CP dated October 28, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 347 TC/QD/TCCB dated April 26, 1995 of the Minister of Finance promulgating the Charter on organization and operation of the State Asset Management Department under the Ministry; and Circular No. 03 - TC/TT/TCCB dated January 4, 1995 of the Ministry of Finance guiding the functions, tasks, and organizational structure of the Departments of Finance and Prices.
In order for the Departments of Finance and Prices of provinces under the central government's direct control (hereinafter referred to as "province") to have a basis for defining their functions and tasks of the Public Asset Management Division, the Ministry of Finance provides specific guidance on some contents of public asset management work as follows:

I - GENERAL TASKS IN PUBLIC ASSET MANAGEMENT:

1/ Studying and proposing measures and financial regulations aimed at managing and using public assets within the local jurisdiction effectively according to the state regime, policies, standards, and quotas prescribed by the state;

2/ Guiding administrative and service organizations under the province to implement property management regimes for state-owned assets and financial management regimes for national resources including those that have been surveyed but not yet put into exploitation;

3/ Guiding and organizing the implementation of statistical, comprehensive, and analytical work on the situation of state asset management and national resource management under provincial jurisdiction or delegated management; implementing regular and irregular reporting systems as required by the Chairman of the Provincial People's Committee and the Minister of Finance;

4/ Organizing inspections of the management, use, and exploitation of public assets and resources by administrative and service organizations (ASO) and economic organizations, recommending to competent authorities measures to ensure compliance with state regulations;

5/ Participating with relevant functional sectors of the locality in recovering state-owned assets and resources in ASOs and economic organizations, implementing asset and resource transfers according to decisions of the Chairman of the Provincial People's Committee or the Minister of Finance;

6/ Managing and archiving files, documents, and data related to public asset management and financial management of national resources.

II - SPECIFIC TASKS IN PUBLIC ASSET MANAGEMENT:

1/ For public assets in local ASOs funded by the state budget or with a state budget origin, the Department of Finance and Prices has the following tasks:

a - Maintaining records to manage all assets of local ASOs and other ASOs managed by the central government according to the list prescribed by the Ministry of Finance;

b - Reviewing annual plans for purchasing and repairing assets for local ASOs to submit to the People's Council and People's Committee for approval in accordance with state standards, quotas, regimes, and policies;

c - Participating in tender or auction committees for asset purchases and liquidation committees for local ASOs;

d - Managing and implementing asset transfers from surplus to shortage areas, organizing auctions for damaged or unused assets in local ASOs according to decisions of the provincial People's Committee.

2/ For infrastructure assets, including roads, bridges, ports, dykes, cultural and educational facilities... under provincial management, the Department of Finance and Prices has the following tasks:

a - Statistically compiling infrastructure assets of the locality according to the Ministry of Finance's regulations;

b - Participating with relevant sectors in planning and investment plans for the construction of local infrastructure systems;

c - Reviewing and participating in opinions on annual plans for construction, maintenance, repair, and renovation of infrastructure assets to submit to the People's Council and People's Committee for approval and participating in the acceptance of completed projects under local management.

3/ For confiscated, seized, ownerless assets, and temporarily seized assets, the Department of Finance and Prices has the following tasks:

a - Organizing the receipt and management of confiscated, seized, ownerless, and temporarily seized assets according to decisions of the provincial People's Committee or competent authorities;

b - Preparing files recording and tracking these assets along with documents reflecting their value and condition;

c - Studying and proposing measures for handling; implementing the return, sale, or lease of confiscated, seized, ownerless, and temporarily seized assets according to decisions of the provincial People's Committee or competent authorities.

4/ In the field of financial management of national resources, the Department of Finance and Prices has the following tasks:

a - Cooperating with state management agencies of national resources, preparing files to manage and track quantities, reserves...of resources assigned by the state for local management and use;

b - Reviewing and participating in opinions on annual plans for surveying, searching, exploring, and protecting resources assigned by the state for local management to submit to the People's Council and People's Committee for approval;

c - Participating with relevant agencies in organizing auctions of locally managed resources for organizations and individuals to exploit and recover when the lease period expires, or according to decisions of the provincial People's Committee or competent authorities.

5/ In the field of land management, the Department of Finance and Prices has the following tasks:

a - Cooperating with the Land Administration Department and related sectors to compile land funds, types of land, land use, land allocation, leasing situations, and valuation of various types of land assigned by the state for local management;

b - Reviewing and participating in opinions on annual plans for land measurement, zoning, and management to submit to the People's Committee and People's Council for approval.

6. In lĩnh vực quản lý tài sản viện trợ, Sở Tài chính - Vật giá có nhiệm vụ:

a - Mở sổ sách theo dõi những tài sản viện trợ (cả hiện vật và giá trị) của địa phương theo thông báo của Nhà nước; và viện trợ của các tổ chức phi Chính phủ, cá nhân trong và ngoài nước trực tiếp trao cho địa phương;

b - Cùng với các ngành, cơ quan có liên quan xác định số lượng và giá trị các tài sản viện trợ, ghi tăng tài sản cho các đơn vị được hưởng và phối hợp thực hiện việc ghi thu, ghi chi cho tổ chức đơn vị được nhận tài sản viện trợ, định kỳ đối chiếu với cơ quan quản lý viện trợ của Bộ Tài chính về số tài sản viện trợ của địa phương.

7. Trong khi thực hiện nhiệm vụ về quản lý công sản, Giám đốc Sở Tài chính - Vật giá được quyền:

a - Yêu cầu các cơ quan hành chính sự nghiệp trên địa bàn tỉnh được giao sử dụng, khai thác tài sản, tài nguyên thuộc sở hữu Nhà nước báo cáo, cung cấp đầy đủ thông tin, tài liệu cần thiết về tài sản, tài nguyên;

b - Yêu cầu các tổ chức trực thuộc Bộ Tài chính đóng trên địa bàn tỉnh cung cấp các tài liệu quản lý Tài chính có liên quan đến tài sản và tài nguyên thuộc sở hữu Nhà nước, phục vụ cho nhiệm vụ quản lý được giao;

c - Dự toán kinh phí triển khai các nhiệm vụ quản lý công sản được giao ngoài định mức chi hành chính sự nghiệp trình UBND tỉnh duyệt.

III - TỔ CHỨC QUẢN LÝ CÔNG SẢN TẠI SỞ TÀI CHÍNH:

Theo hướng dẫn tại Thông tư 03 - TC/TT/TCCB ngày 4/1/1995 của Bộ Tài chính, Sở Tài chính có Phòng Quản lý công sản để giúp Giám đốc Sở thực hiện các nhiệm vụ về quản lý công sản tại địa phương.

Sở Tài chính - Vật giá căn cứ đặc điểm tình hình, nhiệm vụ cụ thể về quản lý tài nguyên - công sản tại địa phương để xác định biên chế quản lý công sản, đề nghị UBND tỉnh bổ sung biên chế cho Sở để lập Phòng quản lý công sản, đủ khả năng thực hiện nhiệm vụ được giao.
