Establishing the Management Board for Industrial Zones of Bac Kan Province

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Considering the proposal of the People's Committee of Bac Kan Province at Document No. 07/TTr-UBND dated March 29, 2007, and that of the Minister of Home Affairs at Document No. 1114/TTr-BNV dated April 23, 2007.

DECISION:

Article 1. Establishing the Management Board for Industrial Zones of Bac Kan Province

1. The Management Board for Industrial Zones of Bac Kan Province (hereinafter referred to as the Management Board) shall be under the Bac Kan Provincial People's Committee to manage industrial zones within the province.

2. The Management Board shall have legal personality, bank accounts, office premises, and a seal with the National Emblem; it shall be the focal point for the budget plan of the Bac Kan Provincial People's Committee, and shall be allocated separate development investment capital from the central budget (as stipulated in Decision No. 183/2004/QĐ-TTg dated October 19, 2004 of the Prime Minister on the mechanism for supporting central budget capital for the construction of technical infrastructure in industrial zones in economically disadvantaged areas and other relevant legal documents); it shall be subject to management by the Bac Kan Provincial People's Committee regarding organization, staffing, programs, work plans, and operational funding.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. The Management Board shall have the tasks and powers to manage investment in industrial zones within the province according to Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law, and shall perform other related tasks and powers concerning the management and development of industrial zones according to the delegation of authority by law.

2. The Bac Kan Provincial People's Committee shall specify the functions, tasks, powers, and organizational structure of the Management Board in accordance with the law.

đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;

1. Organizational Structure:

a) The Management Board shall have a Director and two Deputy Directors appointed and relieved of their positions by the Chairman of the Bac Kan Provincial People's Committee in accordance with Decision No. 45/2007/QĐ-TTg dated April 3, 2007 of the Prime Minister on the authority to manage cadres in industrial zone management boards, export processing zone management boards, high-tech park management boards, economic zone management boards, and other management boards under the Ministry and provincial and municipal people's committees directly under the Central Government;

b) The Management Board shall have an administrative support staff including an office and specialized departments;

c) Affiliated units.

Depending on the requirements for managing and developing industrial zones in each stage, the Director of the Management Board shall submit to the Chairman of the Bac Kan Provincial People's Committee for decision on the organizational structure of the Management Board.

2. The staffing of the Management Board shall be decided by the Chairman of the Bac Kan Provincial People's Committee in accordance with the law on the decentralization of administrative and public service staffing management and the staffing management mechanism for state-owned public service units.

Article 4. Effective date

This Decision takes effect from the date of issuance.

Article 5. Responsibilities for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the Bac Kan Provincial People's Committee, and the Director of the Bac Kan Provincial Industrial Zone Management Board are responsible for implementing this Decision./.
