DECISION OF THE PRIME MINISTER
Regarding the approval of the List of export goods requiring business licenses for export-import activities

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Resolution No. 02/1998/NQ-CP of the Government dated January 26, 1998;

Considering the proposal of the Minister of Trade, 

DECISION:

Article 1. Approve the list of goods below that must be exported with a business license for export-import activities issued by the Ministry of Trade, appropriate to the relevant commodity sector:

1. Rice,

2. Explosives, flammable materials (except matches),

3. Books and newspapers,

4. Pearls, precious stones, precious metals (except fake jewelry),

5. Artworks, collectibles, antiques.

Article 2. For goods outside the List of prohibited export goods that have been published and outside the list of goods specified in Article 1 of this Decision, enterprises of various economic sectors are permitted to export (after completing customs procedures) according to the domestic business registration content when establishing the enterprise.

Article 3. The export activities of foreign-invested enterprises not subject to the provisions of this Decision.

Article 4. Authorize the Minister of Trade, based on the import-export commodity policy stipulated by the Government for each period, the List of Vietnamese import-export goods issued by the General Statistics Office, to detail the list of goods specified in Article 1 of this Decision; at the same time, coordinate with the Ministry of Justice and the General Customs Department to guide the implementation of this Decision.

Article 5. This Decision takes effect fifteen days from the date of issuance. Ministers, heads of ministerial-level agencies, heads of agencies under the central government, Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Decision.
