Regulations on functions, tasks, powersand organizational structure of the Vietnam Institute of Water Resources Science

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 83/2006/NĐ-CP dated August 17, 2006 of the Government on procedures and formalities for establishing, restructuring, and dissolving administrative organizations and state-run public service organizations;

Pursuant to Decision No. 594/QĐ-TTg dated May 10, 2007 of the Prime Minister on the establishment of the Vietnam Institute of Water Resources Science under the Ministry of Agriculture and Rural Development based on the reorganization and restructuring of the Vietnam Institute of Water Resources Science and the Southern Institute of Water Resources Science;

At the proposal of the Director of the Cadre and Civil Servant Department,

DECISION:

Article 1. Position and Functions

1. The Vietnam Institute of Water Resources Science under the Ministry of Agriculture and Rural Development is a public scientific organization with legal personality, its own seal, and bank accounts at the Treasury and State Bank to operate in accordance with the law; its main office is located in Hanoi City.

2. The Vietnam Institute of Water Resources Science is classified as a special category according to Article 10 of Decision No. 181/2005/QĐ-TTg dated July 19, 2005 of the Prime Minister on the classification and ranking of public service organizations and public services.

3. The Vietnam Institute of Water Resources Science has the function of conducting scientific research, providing scientific services for public welfare, transferring technology, postgraduate training, international cooperation, participating in investment and construction consulting for water resources, hydropower, and environmental projects to meet national management requirements, agricultural development, and rural development.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Develop and submit to the Ministry strategic plans, programs, long-term, five-year, and annual plans regarding science and technology, and development projects related to water resources, hydropower, and the environment to meet planning, exploitation, development, and comprehensive water resource management needs; implement these strategies, programs, plans, and projects after they have been approved by competent authorities.

2. Conduct comprehensive studies on water resources, natural conditions, and the environment to provide scientific bases for national and regional socio-economic development planning. Specific areas of scientific research include:

2.1) Water resources strategy for regions, provinces, and the country;

2.2) Planning for sustainable development and management of land and water resources in river basins and sub-basins nationwide;

2.3) Water resources and environmental protection;

2.4) River regulation, coastal protection, flood prevention, and disaster mitigation;

2.5) Impact of climate change on water resources, planning, construction, operation of water resources systems, dikes, fisheries, agriculture, and rural areas;

2.6) Irrigation and drainage technology for land improvement and water supply; management and protection of water resources and hydropower facilities;

2.7) Construction and maintenance technology for water resources and hydropower facilities;

2.8) Building materials;

2.9) Specialized electromechanical equipment for water resources;

2.10) Clean water and rural sanitation;

2.11) Water resources economy;

2.12) Information technology and automation;

2.13) Termite control research.

3. Review or participate in reviewing major state and local projects concerning technology, economics, and engineering according to the law.

4. Appraise and approve research project outlines, budgets, and final results of scientific research, technological development, and production trial projects of units under the Institute according to state regulations and the Ministry of Agriculture and Rural Development's delegation.

5. Transfer scientific research and technological results to production according to the law.

6. Provide consulting services for construction, review, and appraisal of water resources, hydropower, fisheries, and environmental protection projects consistent with the Institute's specialized fields; invest and construct infrastructure projects according to the law.

7. Train high-level scientific and technological personnel; organize postgraduate training and joint undergraduate training in water resources, hydropower, and environmental sciences according to the law.

8. Engage in international cooperation in scientific research, technology transfer, joint ventures, technology development partnerships, new technology trials, and human resource training in assigned fields with domestic and foreign organizations and individuals according to the law.

9. Lead the compilation of technical procedures, standards, economic and technical norms, and submit them to competent authorities for issuance according to the law.

10. Organize production, business operations, and import-export activities according to the law.

11. Provide scientific and technological information, publish journals, and electronic information portals according to specialized fields.

12. Manage and implement investment construction projects of the Institute according to the Construction Law, Bidding Law, and relevant laws.

13. Manage and implement human resources, funds, assets, and other resources allocated according to the law.

14. Decide on inviting foreign experts and scientists to Vietnam and dispatching staff abroad for work according to current laws and the Ministry of Agriculture and Rural Development's cadre management delegation.

15. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. The leadership of the Vietnam Institute of Water Resources Science consists of the Director and Deputy Directors of the Institute;

1.1) The Director of the Institute is appointed and relieved of duty by the Minister of Agriculture and Rural Development, and is responsible before the Minister and the law for all activities of the Institute;

1.2) Deputy Directors of the Institute are appointed and relieved of duty by the Minister of Agriculture and Rural Development upon the recommendation of the Director, and are responsible before the Director and the law for the areas of work they are assigned or delegated.

2. Advisory body to the Director of the Institute:

2.1) Organization and Administration Department;

2.2) Planning and Synthesis Department;

2.3) Finance and Accounting Department;

Each department has a Head and Deputy Heads. The Head is appointed and relieved of duty by the Minister of Agriculture and Rural Development upon the recommendation of the Director, and Deputy Heads are appointed and relieved of duty by the Director according to current state regulations and the Ministry of Agriculture and Rural Development's cadre management delegation.

3. Scientific and technological units under the Institute:

3.1) Southern Water Resources Science Institute;

3.2) Central and Western Highlands Water Resources Science Institute;

3.3) Water, Irrigation and Environment Institute;

3.4) Hydraulic Engineering Institute;

3.5) Pump and Hydraulic Equipment Institute;

3.6) Hydropower and Renewable Energy Institute;

3.7) Water Resources Management and Economics Institute;

3.8) Marine Technology Institute (to be established by the Ministry when conditions are met);

3.9) National Key Laboratory for River and Coastal Dynamics;

3.10) Training and International Cooperation Center;

3.11) Pest and Harmful Organism Control Center;

3.12) Hydroinformatics Software Center;

3.13) Participatory Agricultural Water Management Advisory Center;

4. Scientific and technological enterprises:

4.1) The company for construction and transfer of water resources technology operates according to the mechanism of scientific and technological enterprises as stipulated in Decree No. 80/2007/NĐ-CP dated May 19, 2007 of the Government on scientific and technological enterprises;

4.2) Other enterprises established and operating according to the Law on Science and Technology, the Enterprise Law, and Decree No. 80/2007/NĐ-CP dated May 19, 2007 of the Government;

The Institute has an Institute Director and Deputy Directors; Centers have Center Directors and Deputy Center Directors; Companies have Company Directors and Deputy Company Directors; The National Key Laboratory for River and Coastal Dynamics has a Director and Deputy Directors;

The Institute Directors, the Director of the National Key Laboratory for River and Coastal Dynamics, the Company Director, and the Center Directors under the Vietnam Water Resources Science Institute are appointed and relieved from their positions by the Minister of Agriculture and Rural Development in accordance with the provisions of the law;

Deputy Institute Directors, Deputy Directors of the National Key Laboratory for River and Coastal Dynamics, Deputy Company Directors, and Deputy Center Directors under the Vietnam Water Resources Science Institute are appointed and relieved from their positions by the Director of the Vietnam Water Resources Science Institute in accordance with the provisions of the law and the delegation of personnel management authority by the Ministry of Agriculture and Rural Development;

Based on needs, the Director of the Vietnam Water Resources Science Institute establishes scientific councils to advise the Director of the Institute on the strategy, direction, and plan for the development of science and technology of the Institute;

The establishment, reorganization, and dissolution of units under the Vietnam Water Resources Science Institute are decided by the Minister of Agriculture and Rural Development based on the proposal of the Director of the Vietnam Water Resources Science Institute and the Director of the Personnel Organization Department in accordance with the functions, tasks, and stages of development of the Institute and the provisions of the law;

Article 4. Effective date

This Decision takes effect 15 days after its publication in the Official Gazette and abolishes Decisions No. 24/1999/QĐ/BNN/TCCB dated February 1, 1999 of the Minister of Agriculture and Rural Development regarding the functions, tasks, and organizational structure of the Vietnam Water Resources Science Institute, No. 75/2002/QĐ/BNN-TCCB dated August 19, 2002 of the Minister of Agriculture and Rural Development regarding the functions, tasks, and organizational structure of the Southern Vietnam Water Resources Science Institute, and previous regulations of the Ministry that conflict with this Decision;

Article 5. Responsibilities for Implementation

1. The Director of the Vietnam Water Resources Science Institute and the Director of the Southern Vietnam Water Resources Science Institute shall be responsible for handing over the status quo to the Director of the Vietnam Water Resources Science Institute from the date this Decision takes effect;

2. The Director of the Vietnam Water Resources Science Institute shall be responsible for receiving the status quo of the Vietnam Water Resources Science Institute and the Southern Vietnam Water Resources Science Institute in accordance with the regulations, organizing the rearrangement of the Institute according to Decision No. 594/QĐ-TTg dated May 10, 2007 of the Prime Minister, drafting the operational rules of the Institute to submit for approval by the Minister, implementing them, and registering the activities of the Institute with competent state agencies in accordance with the law;

3. The Head of the Ministry's Office, the Director of the Personnel Organization Department, the Director of the Science, Technology, and Environment Department, the Heads of related agencies and units, the Directors of Provincial Departments of Agriculture and Rural Development, and the Director of the Vietnam Water Resources Science Institute are responsible for implementing this Decision./.
