AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF THE DECREE NO. 75/2021/NĐ-CP DATED JULY 24, 2021 OF THE GOVERNMENT ON THE LEVELS OF BENEFITS, ALLOWANCES, AND PREFERENTIAL REGIMES FOR PERSONS WITH MERIT IN THE REVOLUTIONARY STRUGGLE

Article 1. Amending and supplementing certain articles of Decree No. 75/2021/NĐ-CP dated July 24, 2021 of the Government on the levels of benefits, allowances, and preferential regimes for persons with merit in the revolutionary struggle
1. Amend and supplement Article 1 as follows:
"Article 1. Scope of Regulation
This Decree stipulates the levels of benefits, allowances, and preferential regimes for persons with merit in the revolutionary struggle, relatives of persons with merit in the revolutionary struggle, and preferential regimes for persons with merit in the revolutionary struggle from the central budget allocated in the annual regular state budget estimate of the Ministry of Labor - Invalids and Social Affairs, the Ministry of National Defense, and the Ministry of Public Security."
2. Amending and supplementing Article 3 as follows:
"Article 3. Standard level of preferential benefits
1. The standard level of preferential benefits for persons with merit in the revolutionary struggle is 2,055,000 VND (hereinafter referred to as the standard level).
2. The standard level prescribed in Clause 1 of this Article serves as the basis for calculating the levels of benefits, allowances, and preferential regimes for persons with merit in the revolutionary struggle and their relatives. The levels specified according to the standard level in this Decree shall be adjusted when the standard level is adjusted and rounded to the nearest thousand VND".
3. Amend and supplement Article 4 as follows:
"Article 4. Levels of benefits, allowances, and preferential benefits
1. The monthly levels of benefits, allowances, and preferential benefits for persons with merit in the revolutionary struggle and their relatives are specified in Appendix I attached to this Decree.
2. The monthly levels of preferential benefits for war invalids and persons treated as war invalids are specified in Appendix II attached to this Decree.
3. The monthly levels of preferential benefits for war invalids category B are specified in Appendix III attached to this Decree.
4. The one-time levels of preferential benefits for persons with merit in the revolutionary struggle and their relatives are specified in Appendix IV attached to this Decree. In cases where the one-time benefit is calculated based on years of service, after rounding up the number of years of participation in the resistance war, any remaining months are rounded up according to the principle: from six months to less than twelve months is counted as one year, less than six months is counted as six months. In cases where the start date of the resistance war cannot be determined, it is counted from July 1 of that year".
4. Amending and supplementing certain points and clauses of Article 12 as follows:
a) Amending Point c Clause 1 of Article 12 as follows:
"c) Sampling烈士骸骨:每具墓的费用为50,000越南盾。"
b) Amending Clause 2 of Article 12 as follows:
"2. Sampling for DNA comparison with maternal lineage of martyrs (hereinafter collectively referred to as samples of relatives of martyrs): Organizations and units organizing the sampling of relatives of martyrs shall implement the contents of Clause 1, Point b of this Article; supporting individuals eligible for sampling of relatives of martyrs: a support amount of 500,000 VND per person".
c) Amending Clause 3 of Article 12 as follows:
"3. Storing samples of martyrs' remains and samples of relatives of martyrs lacking information in their raw form during the waiting period for DNA identification at DNA identification facilities: A cost of 500 VND per sample per day".
d) Amending and supplementing Clause 4 of Article 12 as follows:
"4. Identifying the identity of martyrs' remains lacking information through DNA identification methods:
a) DNA identification to determine the identity of martyrs' remains lacking information is a public service using state budget funds under the social welfare sector, implemented through procurement.
b) Samples for DNA identification to determine the identity of martyrs' remains lacking information include: samples of martyrs' remains and samples of relatives of martyrs.
c) Procurement conditions: Procuring DNA identification services to determine the identity of martyrs' remains lacking information from service providers meeting the following conditions simultaneously: Service providers must be public institutions under ministries, government agencies, state-owned enterprises, organizations, and units with legal personality, having the function of providing DNA identification services selected for procurement by the Ministry of Labor - Invalids and Social Affairs. The economic and technical quotas and unit prices of DNA identification services for martyrs' remains and biological samples of relatives of martyrs, and the public service prices issued by competent authorities serve as the basis for procurement.
d) Implementation method: procurement. The Minister of Labor - Invalids and Social Affairs decides to procure DNA identification services to determine the identity of martyrs' remains lacking information from service providers. Based on the approved procurement decision by the Minister of Labor - Invalids and Social Affairs, the Department of Persons with Merit (Ministry of Labor - Invalids and Social Affairs) signs a procurement contract for DNA identification services with service providers.
e) Procurement unit price: The Minister of Finance issues the maximum unit price for DNA identification services to determine the identity of martyrs' remains lacking information. The Minister of Labor - Invalids and Social Affairs issues economic and technical quotas, cost standards for implementing DNA identification services to determine the identity of martyrs' remains lacking information; decides on the procurement unit price ensuring it does not exceed the maximum price set by the Minister of Finance.
f) Procurement content: Number of samples for procurement of DNA identification; Quality of DNA identification services; Implementation and completion time; Procurement unit price; Contract value; Procurement funding source; Payment and settlement methods; Product acceptance and delivery methods; Rights and obligations of the service provider; Rights and obligations of the procuring entity; Other contents not contrary to the law."
d) Amend Clause 7 of Article 12 as follows:
"7. Transporting samples of remains of烈士的遗骸样本和缺少信息的烈士亲属对照样本的实际费用进行结算。"
5. Amend and supplement some points and clauses of Article 13 as follows:
a) Amend and supplement Point a of Clause 4 of Article 13 as follows:
"a) Support for medicine, treatment, and health recovery rehabilitation at care facilities, with a maximum amount of 8,500,000 VND/person/year. The form of support for health recovery rehabilitation shall be decided by the Director of each care facility in accordance with the health condition of the person who has rendered service to the country and the characteristics of the unit (including the cost of health recovery rehabilitation when the subject goes to a medical facility for treatment)."
b) Amend and supplement Clause 5 of Article 13 as follows:
"5. Support for serving the care of persons who have rendered service to the country at care facilities managed by the Department of Labor, Invalids and Social Affairs to ensure expenses for electricity, water for daily use, purchasing gasoline for generators, water filtration, environmental sanitation, electrical and water repairs, hiring labor, services, office supplies, communication, and other expenses. The maximum support for serving the care of persons who have rendered service to the country is 8,000,000 VND/person/year."
c) Amend and supplement Clause 6 of Article 13 as follows:
"6. Support for serving convalescence and reception work for persons who have rendered service to the country at convalescent facilities and reception centers managed by the Department of Labor, Invalids and Social Affairs to ensure expenses as stipulated in Clause 5 of this Article based on the actual number of persons receiving convalescence and reception services. The maximum support is 500,000 VND/person/convalescence or reception visit. In cases where localities do not have convalescent facilities, the competent authority may use these funds to rent accommodation facilities meeting standards (at least three-star hotels) to provide centralized convalescence services."
d) Amend and supplement Clause 7 of Article 13 as follows:
"7. Persons who have rendered service to the country residing in care facilities and returning home independently shall be supported up to one round trip per year (including travel and food expenses) for themselves and one accompanying family member (if any), from the care facility to their home or place of origin and vice versa: Expenses will be reimbursed according to invoices, including tickets for public transportation, legal receipts, or receipts in accordance with the law; ticket prices do not include additional service fees such as sightseeing tours or special requests; for air travel, reimbursement will be made up to the standard economy class fare and baggage handling fees (if not included in the ticket price) based on the weight of the luggage but not exceeding the standard allowance for regular tickets; food allowance is 100,000 VND/person/trip. In cases where support is provided through lump-sum payments, the support will be 3,000 VND/km/person based on the distance traveled but not exceeding 5,000,000 VND/person and accompanying family member/year."
d) Amend and supplement Point a of Clause 10 of Article 13 as follows:
"a) Support for the renovation, upgrading, repair, and maintenance of material infrastructure according to approved projects or technical-economic reports by authorized agencies. The maximum support does not exceed 15 billion VND/project, including a maximum of 100% of the project value for care facilities and convalescent centers managed by central and local authorities that have not achieved budget self-sufficiency, and a maximum of 70% of the total project value approved by authorized agencies for care facilities and convalescent centers managed by local authorities that have achieved budget self-sufficiency."
e) Amend Clause 11 of Article 13 as follows:
"11. Gift-giving regulations for care facilities for persons who have rendered service to the country, persons who have rendered service to the country, and families of persons who have rendered service to the country:
a) Gifts from Party and State leaders, National Assembly, Chairman of the Central Committee of the Vietnam Fatherland Front: For collectives, cash gifts are 5,000,000 VND/collective, and physical gifts are worth 500,000 VND/collective. For families or individuals, cash gifts are 1,000,000 VND/family or individual, and physical gifts are worth 250,000 VND/family or individual.
b) Gifts from leaders of ministries and central agencies: For collectives, cash gifts are 3,000,000 VND/collective, and physical gifts are worth 500,000 VND/collective. For families or individuals, cash gifts are 1,000,000 VND/family or individual, and physical gifts are worth 250,000 VND/family or individual."
6. Amend and supplement Clause 4 of Article 14 as follows:
"4. Allocate management costs equivalent to 1.7% of the total budget from the central government for implementing the Ordinance on Preferential Treatment for Persons Who Have Rendered Service to the Country in the annual budget estimates (excluding support for care facilities and convalescent centers and costs for martyrs' graves and memorials) of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Defense, and the Ministry of Public Security to organize implementation of the Ordinance, strengthen inspection and supervision, and ensure strict and transparent management of state budget implementation for preferential policies for persons who have rendered service to the country."
Article 2. Implementation clause
1. This Decree takes effect from September 5, 2023.
2. The level of preferential allowances and subsidies for persons who have rendered service to the country as prescribed in Appendix I, Appendix II, Appendix III, and Appendix IV attached to this Decree and the level of allowances prescribed in Article 8 of Appendix VI attached to Government Decree No. 75/2021/NĐ-CP dated July 24, 2021, shall be implemented according to the standards set forth in this Decree and shall take effect from July 1, 2023.
3. The level of expenses for convalescence benefits as prescribed in Article 6 of Government Decree No. 75/2021/NĐ-CP dated July 24, 2021, shall be implemented according to the standards set forth in this Decree and shall take effect from January 1, 2024.
4. The cases prescribed in Clause 5, Article 184 of Decree No. 131/2021/NĐ-CP dated December 30, 2021 of the Government regarding detailed regulations and implementation measures for the Ordinance on Preferential Treatment for Persons with Meritorious Service to the Revolution shall be supported with medicine, treatment, and health recovery rehabilitation; welfare facilities for persons with meritorious service managed by the Ministry of Labor - Invalids and Social Affairs shall be supported in serving the care of such cases. The content and level of support shall be implemented according to the provisions of Clauses 4 and 5 of Article 13 of this Decree.
Article 3. Responsibility for Implementation
The Minister of Labor - Invalids and Social Affairs, ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decree.
