  • The head of the agency or organization directly managing the facility shall base the decision on the nature and characteristics of the operation, production, and business activities to determine the quantity of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces.
  • Training includes leaders of departments, team commanders, and staff performing fire prevention and firefighting design review and acceptance work; leaders of departments, team commanders, and staff who are expected to be assigned to perform fire prevention and firefighting design review and acceptance work.
  • Initial inspections shall be conducted for team commanders and staff meeting the standards stipulated in Clause 3 of Circular No. 82/2021/TT-BCA and having received training as stipulated in Clause 6 of this Circular.
  • Procedures for performing fire prevention, firefighting, and rescue tasks by police officers and non-commissioned officers in the People's Public Security forces include design review, inspection of fire prevention and firefighting acceptance results; issuance of certificates for fire prevention and firefighting equipment inspection; issuance and reissuance of certificates for fire prevention and firefighting training; issuance, exchange, and reissuance of consulting certificates for fire prevention and firefighting; issuance of certificates confirming eligibility to operate fire prevention and firefighting services; approval of fire extinguishing plans at facilities; administrative penalties in the field of fire prevention, firefighting, and rescue.
  • The file and acceptance, processing of applications for issuance and reissuance of fire prevention and firefighting training certificates are carried out according to the provisions of Clauses 5, 7, 8, 9, and Clause 10 of Article 33 of Decree No. 136/2020/NĐ-CP.

Article 1. Amend and supplement certain articles of Circular No. 141/2020/TT-BCA dated December 23, 2020 issued by the Minister of Public Security on fire prevention, firefighting, and rescue work of the People's Police force (hereinafter referred to as Circular No. 141/2020/TT-BCA).;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the proposal of the Director of the Fire Prevention, Firefighting, and Rescue Police Department;

The Minister of Public Security issues this Circular amending and supplementing certain Articles of1. Amend and supplement Point b Clause 1 Article 6 as follows:

“b) Inspect the responsibility for fire prevention and firefighting of heads of agencies, organizations, and facilities; inspect safety in fire prevention and firefighting of facilities, residential areas, households, and households combined with production and business activities according to the contents prescribed in Articles 5, 6, and 7 of Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and implementing measures of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting (hereinafter referred to as Decree No. 136/2020/NĐ-CP), amended and supplemented according to the provisions of Decree No. 50/2024/NĐ-CP dated May 10, 2024 of the Government amending and supplementing certain articles of Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and implementing measures of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting and Decree No. 83/2017/NĐ-CP dated July 18, 2017 of the Government on rescue operations of fire prevention and firefighting forces (hereinafter referred to as Decree No. 50/2024/NĐ-CP).”

2. Provincial Public Security Fire Prevention, Firefighting, and Rescue Police Departments and County-level Public Security Fire Prevention, Firefighting, and Rescue Police Departments shall decide on the allocation of staff based on staffing and operational requirements to ensure compliance with the standards prescribed in Clause 2 and Clause 3 Article 4 of Circular No. 141/2020/TT-BCA to carry out fire prevention, firefighting, and rescue work, manage areas, and facilities.

The allocation of inspection staff must ensure full management of the assigned areas and facilities and comply with the regulations stipulated in Article 16 of Decree No. 136/2020/NĐ-CP, Article 12 of Decree No. 83/2017/NĐ-CP, amended and supplemented at Clause 8 Article 1 and Clause 3 Article 2 of Decree No. 50/2024/NĐ-CP.”

2. Amending and supplementing Clause 2 Article 8 as follows:

3. Amend and supplement Points b and c Clause 2 Article 10 as follows:

“b) Inspect according to the contents prescribed in Clause 2 Article 16 of Decree No. 136/2020/NĐ-CP, amended and supplemented at Point a Clause 8 Article 1 and Clause 3 Article 2 of Decree No. 50/2024/NĐ-CP;

c) Prepare inspection records according to Model PC10 prescribed in Appendix IX attached to Decree No. 50/2024/NĐ-CP. Inspection records must be prepared in at least two copies, one copy handed over to the inspected entity, one copy kept in the file, and one copy handed over to related units (if applicable);”

4. Amend and supplement Points a, b, and d Clause 1 Article 11 as follows:

“a) Cases as prescribed in Clause 1 Article 17 of Decree No. 136/2020/NĐ-CP, amended and supplemented at Point a Clause 9 Article 1 of Decree No. 50/2024/NĐ-CP;

b) Violations of fire safety regulations that pose a risk of fire or explosion as prescribed in Point đ Clause 3 Article 16 of Decree No. 136/2020/NĐ-CP, amended and supplemented at Point b Clause 8 Article 1 of Decree No. 50/2024/NĐ-CP;”

a) Amend and supplement point a and point b, Clause 1 as follows:

"b) Leaders of departments, commanders of teams, and officers who are expected to be assigned to perform design review and acceptance work related to fire prevention and firefighting."

"1. Initial inspection for team commanders and officers meeting the criteria prescribed in Clause 1 and Clause 3, Article 3 of Circular No. 82/2021/TT-BCA and who have been trained as prescribed in Article 6 of Circular No. 82/2021/TT-BCA."

b) Amend and supplement Point d of Clause 1 as follows:

"d) When there are signs that business establishments engaged in production, assembly of fire prevention and firefighting equipment, business establishments providing consulting and technical inspection services for fire prevention and firefighting, or those exploiting fire prevention and firefighting activities to infringe upon security and public order, they shall be referred for handling by the competent authority."

Article 2. Amend and supplement Clauses 1, 3, and Clause 4 of Article 5 of Circular No. 150/2020/TT-BCA dated December 31, 2020, issued by the Minister of Public Security on equipping fire prevention, firefighting, and rescue equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces (hereinafter referred to as Circular No. 150/2020/TT-BCA).-"1. The list and quantity of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces are specified in Appendix II and Appendix III attached hereto."

2. Amending and supplementing Clause 5 as follows:

"3. The head of the agency or organization directly managing the establishment shall base their decision on the nature, characteristics of operations, production, and business activities at the establishment, as well as the requirements of fire prevention, firefighting, and rescue work, to determine the quantity of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces in accordance with the provisions of Appendix II and Appendix III attached hereto, and to decide on the specific types of fire prevention, firefighting, and rescue equipment to be equipped for each position within these forces when performing fire prevention, firefighting, and rescue tasks."

2. Amend and supplement Clause 3 as follows:

"4. In addition to the list of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces as specified in Appendix II and Appendix III attached hereto, the head of the agency or organization directly managing the establishment may, based on the nature and level of fire and explosion hazards at the establishment and the ability to ensure funding, decide to equip additional necessary fire prevention, firefighting, and rescue equipment for these forces within their management scope, as stipulated in Appendix VI attached to Decree No. 50/2024/NĐ-CP."

3. Amend and supplement clause 4 as follows:

Article 3. Amend and supplement some articles of Circular No. 82/2021/TT-BCA dated August 6, 2021, issued by the Minister of Public Security on standards, tasks, training, and inspection of professional duties for design review and acceptance of fire prevention and firefighting of the Fire Prevention, Firefighting, and Rescue Police Force (hereinafter referred to as Circular No. 82/2021/TT-BCA).

"1. Training participants:"-"b) Leaders of departments, commanders of teams, and cadres who are expected to be assigned to perform design review and acceptance work for fire prevention and firefighting."

1. Amending and supplementing Clause 1 of Article 6 as follows:

"1. Initial inspection for team commanders and cadres meeting the criteria set forth in Clauses 1 and 3 of Article 3 of Circular No. 82/2021/TT-BCA and who have been trained in accordance with Article 6 of Circular No. 82/2021/TT-BCA."

a) Leaders of departments, commanders of teams, and staff performing design review and fire inspection tasks;

"4. Officers assigned to process files shall follow these steps:"

2. Amend and supplement Clause 1, Article 7 as follows:

"In case of proposal to refuse to process the file: Draft a reply document stating the reasons, report to the direct leadership and command for approval and signature by the directly responsible authority. The file components for submission for signature are specified in Points a, b, d, and đ of Item 8 of Appendix I issued together with this Circular;"

Article 4. Amend and supplement some provisions of Circular No. 06/2022/TT-BCA dated January 17, 2022, issued by the Minister of Public Security on the procedures for implementing fire prevention, firefighting, rescue, and disaster relief tasks in the People's Police (hereinafter referred to as Circular No. 06/2022/TT-BCA).-This Circular stipulates the procedures for implementing fire prevention, firefighting, rescue, and disaster relief tasks carried out by officers and non-commissioned officers of the Public Security (collectively referred to as cadres and soldiers) in the People's Police, including: reviewing design plans for fire prevention and firefighting; inspecting the results of fire prevention and firefighting acceptance; issuing certificates of fire prevention and firefighting equipment inspection; issuing, reissuing certificates of fire prevention and firefighting training; issuing, exchanging, and reissuing certificates of practice in fire prevention and firefighting consulting services; issuing certificates of qualification for fire prevention and firefighting service businesses; issuing permits for transporting hazardous goods related to fire and explosion by road transport vehicles, inland waterway vessels, and railways; approving fire extinguishing plans for facilities; restoring operations of facilities, motor vehicles, households, and individuals; administrative penalties in the field of fire prevention, firefighting, rescue, and disaster relief; enforcing administrative penalty decisions in the field of fire prevention, firefighting, rescue, and disaster relief.”

1. Amend and supplement Article 1 as follows:

Article 1. Scope of Regulation

2. Amend and supplement Clauses 1, 3, and Clause 4 of Article 5 as follows:

“1. Regarding the dossier and the acceptance and processing of dossiers for design review on fire prevention and firefighting shall be implemented according to the provisions of Clauses 4, 6, 7, and Clause 8 of Article 13 of Decree No. 136/2020/NĐ-CP, amended and supplemented at point c Clause 5 of Article 1, Clause 1, Clause 2, Clause 3, and Clause 5 of Article 4, point d Clause 1 of Article 5 of Decree No. 50/2024/NĐ-CP.

a) Amend and supplement Clause 1 as follows:

In cases where the dossier for requesting design review on fire prevention and firefighting does not fall within the jurisdiction to handle, the cadre or soldier receiving the dossier records information on the Refusal Notice Form for Handling Dossier according to Model No. 03 Appendix issued together with Circular No. 01/2018/TT-VPCP dated November 23, 2018, guiding the implementation of certain provisions of Decree No. 61/2018/NĐ-CP dated April 23, 2018, of the Government on the mechanism of a single window and a single window interconnection in handling administrative procedures (hereinafter referred to as Circular No. 01/2018/TT-VPCP) or notify via email or text message in cases of online submission and return the dossier to the agency, organization, or individual.”

“3. Leaders and commanders assigned to carry out design review work on fire prevention and firefighting assign cadres to perform by using the Process Control Sheet for Handling Dossier issued together with Circular No. 06/2022/TT-BCA or on the Ministry of Public Security’s Public Service Portal.”

b) Amend and supplement Clause 3 as follows:

“4. The cadre assigned to handle the dossier is responsible for studying and comparing the dossier received according to point c Clause 5 of Article 1 of Decree No. 50/2024/NĐ-CP with the relevant laws, standards, and technical regulations on fire prevention and firefighting, and implement the following steps:

c) Amend and supplement Clause 4 as follows:

a) Draft the Fire Prevention and Firefighting Design Review Certificate or the design review document on fire prevention and firefighting, and the notification document for payment of design approval fees (if applicable), report to the direct leader or commander for approval and signature if the dossier meets the requirements. The components of the dossier for signing are specified in points a, b, c, d, đ, and point g item 1 Appendix I issued together with this Circular; in cases of online submission, the components of the dossier for signing are specified in points b, c, d, đ item 1 Appendix I issued together with this Circular;

In cases where it is proposed to refuse to process the dossier: Draft the reply document, clearly stating the reasons, report to the direct leader or commander for approval and signature. The components of the dossier for signing are specified in points a, b, c, e, and point g item 1 Appendix I issued together with this Circular; in cases of online submission, the components of the dossier for signing are specified in points b, c, e item 1 Appendix I issued together with this Circular;

b) After the Fire Prevention and Firefighting Design Review Certificate or the design review document on fire prevention and firefighting has been approved and signed, proceed to number and stamp the document according to regulations, affix the stamp indicating that the design has been reviewed for fire prevention and firefighting according to Model No. PC08 specified in point đ Clause 5 of Article 1 of Decree No. 50/2024/NĐ-CP.

c) Hand over the Fire Prevention and Firefighting Design Review Certificate or the design review document on fire prevention and firefighting, along with the dossier stamped "Design reviewed for fire prevention and firefighting" and the notification document for payment of design approval fees (if applicable) or the reply document along with the previously submitted dossier to the result delivery department.”

3. Amend and supplement Clauses 1, 3, and Clause 4 of Article 6 as follows:

“1. Regarding the dossier and the acceptance and processing of dossiers for requesting inspection of the results of fire prevention and firefighting acceptance shall be implemented according to the provisions of Clauses 2, 4, 5, and Clause 6 of Article 15 of Decree No. 136/2020/NĐ-CP, amended and supplemented at Clause 7 of Article 1, Clause 1, and Clause 3 of Article 4 of Decree No. 50/2024/NĐ-CP.

a) Amend and supplement Clause 1 as follows:

In cases where the dossier for requesting inspection of the results of fire prevention and firefighting acceptance does not fall within the jurisdiction to handle, the cadre or soldier receiving the dossier records information on the Refusal Notice Form for Handling Dossier according to Model No. 03 Appendix issued together with Circular No. 01/2018/TT-VPCP or notify via email or text message in cases of online submission and return the dossier to the agency, organization, or individual.”

“3. Leaders and commanders assigned to carry out inspection work on the results of fire prevention and firefighting acceptance assign cadres and soldiers to perform the task by using the Process Control Sheet for Handling Dossier issued together with Circular No. 06/2022/TT-BCA or on the Ministry of Public Security’s Public Service Portal.”

b) Amend and supplement Clause 3 as follows:

“4. The cadre assigned to handle the dossier implements the following steps:

"During the implementation of this Circular, if there are difficulties or obstacles, relevant units, localities, organizations, and individuals should report to the Ministry of Public Security (through the Fire Prevention, Firefighting, Rescue, and Emergency Response Police Department) for timely guidance./."

a) Propose the content, time, composition of the inspection team, draft inspection plan for the acceptance results on fire prevention and fighting, draft notification document to be sent to the project investors, vehicle owners, and related units, report to leadership and directly submit to the competent authority for approval, signature, and notification to the project investors, vehicle owners of motor vehicles, and relevant agencies and units;

b) When conducting inspections on the acceptance results on fire prevention and fighting, officers and soldiers shall perform tasks including: Introducing the composition of the inspection team, announcing the content and plan of the inspection related to the acceptance work on fire prevention and fighting of construction projects and motor vehicles with special requirements for fire prevention and fighting; conducting inspections on the acceptance results on fire prevention and fighting according to the content stipulated in Clause 3, Article 15 of Decree No. 136/2020/NĐ-CP and through the inspection content according to Model No. PC10 Appendix IX issued together with Decree No. 50/2024/NĐ-CP;

c) Based on the inspection record of the acceptance results, draft approval document for the acceptance results on fire prevention and fighting, report to leadership and directly submit to the competent authority for approval and signature in case the requirements are met. The file components for submission for signature are specified at points a, b, c, d, and point e of Section 2 of Appendix I issued together with this Circular; in case of online submission, the file components for submission for signature are specified at points b, c, d of Section 2 of Appendix I issued together with this Circular;

In case the requirements are not met, draft a reply document specifying the reasons, report to leadership and directly submit to the competent authority for approval and signature. The file components for submission for signature are specified at points a, b, c, đ, and point e of Section 2 of Appendix I issued together with this Circular; in case of online submission, the file components for submission for signature are specified at points b, c, đ of Section 2 of Appendix I issued together with this Circular;

d) After the approval document for the acceptance results on fire prevention and fighting or the reply document has been approved and signed, proceed to number and stamp the document according to regulations;

đ) Hand over the approval document for the acceptance results on fire prevention and fighting or the reply document to the unit responsible for issuing the results.";

4. To amend and supplement Article 7 as follows:

Article 7. Issuance of Fire Prevention and Fighting Equipment Inspection Certificate

1. The dossier and the procedures for receiving and processing applications for issuance of Fire Prevention and Fighting Equipment Inspection Certificates shall be implemented in accordance with the provisions of Clauses 5, 6, 7, and Clause 8, Article 38 of Decree No. 136/2020/NĐ-CP, amended and supplemented at point b, Clause 13, Article 1, Clauses 1, 2, 3, and Clause 5, Article 4, and Clause 1, Article 5 of Decree No. 50/2024/NĐ-CP.

In cases where the application dossier for issuance of Fire Prevention and Fighting Equipment Inspection Certificates does not fall within the jurisdiction for resolution, officers and soldiers receiving the dossier shall record information into the Refusal to Accept and Process Dossier Form according to Model No. 03 Appendix issued together with Circular No. 01/2018/TT-VPCP or notify via email or SMS in case of online submission and return the dossier to the agency, organization, or individual.

2. After receiving the dossier in accordance with the regulations, officers and soldiers receiving the dossier shall establish and fully record information into the Process Control Record Form issued together with Circular No. 06/2022/TT-BCA, report to the competent authority for approval and signature, and hand over the dossier to the unit or department assigned to resolve it, except in cases of online submission as stipulated at point b, Clause 6, Article 38 of Decree No. 136/2020/NĐ-CP, amended and supplemented at Clause 3 and Clause 5, Article 4 of Decree No. 50/2024/NĐ-CP.

3. Leaders and commanders assigned to issue Fire Prevention and Fighting Equipment Inspection Certificates shall assign officers and soldiers to perform tasks using the Process Control Record Form issued together with Circular No. 06/2022/TT-BCA or on the Ministry of Public Security's Service Portal.

4. Officers and soldiers assigned to process the dossier shall perform the following steps:

a) Check the dossier components, legality, and compliance of the documents in the dossier according to point b, Clause 13, Article 1 of Decree No. 50/2024/NĐ-CP;

b) Inspect and compare the content of the fire prevention and fighting equipment inspection record, test results, and documents in the dossier with the technical standards, regulations, or safety requirements for fire prevention and fighting;

c) Based on the inspection results and dossier comparison, draft the Fire Prevention and Fighting Equipment Inspection Certificate according to Model No. PC29 Appendix IX issued together with Decree No. 50/2024/NĐ-CP, the notification document for printing fees for fire prevention and fighting equipment inspection labels, registration of inspection labels for fire prevention and fighting equipment, and fully record them in the Fire Prevention and Fighting Equipment Inspection Certificate, report to leadership and directly submit to the competent authority for approval and signature in case the dossier meets the requirements. The dossier components for submission for signature are specified at points a, b, c, đ, and point e of Section 3 of Appendix I issued together with this Circular;

In case of proposing to refuse to process the dossier: Draft a reply document regarding the result of processing the application for issuance of the Fire Prevention and Fighting Equipment Inspection Certificate, report to leadership and directly submit to the competent authority for approval and signature. The dossier components for submission for signature are specified at points a, b, d, and point e of Section 3 of Appendix I issued together with this Circular;

d) After the Fire Prevention and Fighting Equipment Inspection Certificate or the reply document has been approved and signed, proceed to number and stamp the document according to regulations; draft a notification document for the agency or organization applying for the Fire Prevention and Fighting Equipment Inspection Certificate to coordinate with related units to affix the inspection label on the equipment according to the issued Fire Prevention and Fighting Equipment Inspection Certificate, report to leadership and directly submit to the competent authority for approval and signature;

d) Hand over the Fire Prevention and Fighting Equipment Inspection Certificate or the document responding to the result of the inspection certificate issuance application for fire prevention and fighting equipment to the unit responsible for delivering results;

e) Coordinate with the agency, organization applying for the Fire Prevention and Fighting Equipment Inspection Certificate and relevant functional units to organize the affixing of inspection seals on fire prevention and fighting equipment in accordance with regulations;

5. Establish and store the file for issuing the Fire Prevention and Fighting Equipment Inspection Certificate in accordance with the regulations on business files of the People's Public Security;

5. Amend and supplement Clause 1, Points d, đ, e, and Point g of Clause 4 and Clause 5 of Article 8 as follows:

a) Amend and supplement Clause 1 as follows:

“1. The file and the acceptance and processing of applications for issuing, reissuing Fire Prevention and Fighting Business Training Certificates shall be carried out in accordance with the provisions of Clauses 5, 7, 8, 9, and Clause 10 of Article 33 of Decree No. 136/2020/ND-CP, amended and supplemented at Point a of Clause 12 of Article 1, Point b of Clause 2 of Article 2, Clauses 1, 2, 3, and Clause 5 of Article 4, and Point d of Clause 1 of Article 5 of Decree No. 50/2024/ND-CP.

In cases where the application file for issuing, reissuing Fire Prevention and Fighting Business Training Certificates does not fall within the authority to handle, the officer receiving the file shall record information in the Refusal to Accept Application Form according to Model No. 03 attached as an appendix to Circular No. 01/2018/TT-VPCP or notify via email or text message in cases of online submission and return the file to the agency, organization, or individual;

b) Amend and supplement Point d, đ, e, and Point g of Clause 4 as follows:

“d) For reissuing Fire Prevention and Fighting Business Training Certificates: Compare the information of the person applying for reissue in the application document with the previously issued training certificate file;

đ) Base on the inspection results, evaluate the outcomes, compare the file and draft of the Fire Prevention and Fighting Business Training Certificate with the content requested according to Model No. PC35 Appendix IX issued along with Decree No. 50/2024/ND-CP for individuals, report to the direct leadership and command for approval and signature in case the file meets requirements. The components of the file for signing are stipulated in Points a, b, c, d, e, and g of Item 4 of Appendix I issued along with this Circular;

In cases where it is proposed to refuse to process the file: Draft the response document, clearly stating the reasons, report to the direct leadership and command for approval and signature. The components of the file for signing are stipulated in Points a, b, c, đ, e, and g of Item 4 of Appendix I issued along with this Circular;

e) After the Fire Prevention and Fighting Business Training Certificate or the response document has been approved and signed, proceed to number and stamp according to regulations;

g) Hand over the Fire Prevention and Fighting Business Training Certificate or the response document to the unit responsible for delivering results.”;

c) Amending and supplementing Clause 5 as follows:

“5. Establish and store the file for issuing and reissuing Fire Prevention and Fighting Business Training Certificates in accordance with the regulations on business files of the People's Public Security.”;

6. Amend and supplement Clause 1, Clause 4 of Article 9 as follows:

a) Amend and supplement Clause 1 as follows:

“1. The file and the acceptance and processing of applications for issuing, changing, and reissuing Fire Prevention and Fighting Consulting Practice Certificates shall be carried out in accordance with the provisions of Clauses 1, 2, 4, 5, 6, 7, and Clause 8 of Article 44 of Decree No. 136/2020/ND-CP, amended and supplemented at Points a and b of Clause 16 of Article 1, Points c and d of Clause 1 of Article 5 of Decree No. 50/2024/ND-CP.”;

b) Amend and supplement Clause 4 as follows:

“4. Officers assigned to handle the file are responsible for studying and comparing the received file with the content stipulated in Clause 3 of Article 43 of Decree No. 136/2020/ND-CP, amended and supplemented at Point a of Clause 15 of Article 1 of Decree No. 50/2024/ND-CP, and implementing the following steps:

a) Draft the Fire Prevention and Fighting Consulting Practice Certificate according to Model No. PC32 Appendix IX issued along with Decree No. 50/2024/ND-CP, report to the direct leadership and command for approval and signature in case the file meets requirements. The components of the file for signing are stipulated in Points a, b, c, d, and e of Item 5 of Appendix I issued along with this Circular;

In cases where it is proposed to refuse to process the file: Draft the response document, clearly stating the reasons, report to the direct leadership and command for approval and signature. The components of the file for signing are stipulated in Points a, b, c, đ, and e of Item 5 of Appendix I issued along with this Circular;

b) After the Fire Prevention and Fighting Consulting Practice Certificate or the response document has been approved and signed, proceed to number and stamp according to regulations;

c) Hand over the Fire Prevention and Fighting Consulting Practice Certificate or the response document to the unit responsible for delivering results.”;

7. Amend and supplement Clause 1, Clause 4 of Article 10 as follows:

a) Amend and supplement Clause 1 as follows:

“1. The file and the acceptance and processing of applications for issuing, changing, and reissuing Fire Prevention and Fighting Business Operation Confirmation Certificates shall be carried out in accordance with the provisions of Clauses 1, 2, 3, 4, 5, 6, 7, 8, and Clause 9 of Article 45 of Decree No. 136/2020/ND-CP, amended and supplemented at Points a, b, c, d, and đ of Clause 17 of Article 1, Points c and d of Clause 1 of Article 5 of Decree No. 50/2024/ND-CP.”

b) Amend and supplement Clause 4 as follows:

“4. Officers assigned to handle the file are responsible for studying and comparing the received file with the content stipulated in Article 41 of Decree No. 136/2020/ND-CP, Clause 14 of Article 1 of Decree No. 50/2024/ND-CP, and implementing the following steps:

a) Draft the Fire Prevention and Fighting Business Operation Confirmation Certificate according to Model No. PC34 Appendix IX issued along with Decree No. 50/2024/ND-CP, report to the direct leadership and command for approval and signature in case the file meets requirements. The components of the file for signing are stipulated in Points a, b, c, d, and e of Item 6 of Appendix I issued along with this Circular;

In cases where it is proposed to refuse to process the file: Draft the response document, clearly stating the reasons, report to the direct leadership and command for approval and signature. The components of the file for signing are stipulated in Points a, b, c, đ, and e of Item 6 of Appendix I issued along with this Circular;

b) After the Business Confirmation Certificate for Fire Prevention and Control Services or the reply document has been approved and signed, proceed to number and stamp according to regulations;

c) Hand over the Business Confirmation Certificate for Fire Prevention and Control Services or the reply document to the department responsible for delivering results.”

8. Amend and supplement Clause 1, Point a and Point b of Clause 4 of Article 11 as follows:

a) Amend and supplement Clause 1 as follows:

“1. The application dossier and the procedures for receiving and processing the application for a Permit to Transport Hazardous Goods on Fire and Explosion shall be implemented in accordance with the provisions of Clauses 1, 2, 3, 4, and Clause 5 of Article 9 of Decree No. 136/2020/NĐ-CP, amended and supplemented by Article 4 of Decree No. 50/2024/NĐ-CP and Clause 2 of Article 18 of Decree No. 34/2024/NĐ-CP dated March 31, 2024 of the Government stipulating the list of hazardous goods and transportation of hazardous goods by road transport vehicles and inland waterway vessels (hereinafter referred to as Decree No. 34/2024/NĐ-CP). In cases where the application dossier for a Permit to Transport Hazardous Goods on Fire and Explosion by road transport vehicles, inland waterway vessels, or railway does not fall within the jurisdiction for resolution, the staff receiving the dossier shall record information in the Refusal Form for Receiving and Processing Dossier No. 03 attached to Circular No. 01/2018/TT-VPCP or notify via email or text message and return the dossier to the agency, organization, or individual submitting the dossier.

b) Amend and supplement Point a and Point b of Clause 4 as follows:

“a) Check the components of the dossier and the contents of the documents in the application dossier for a Permit to Transport Hazardous Goods on Fire and Explosion by road transport vehicles and inland waterway vessels in accordance with Clause 2 of Article 18 of Decree No. 34/2024/NĐ-CP, and the application dossier for a Permit to Transport Hazardous Goods on Fire and Explosion by railway in accordance with Clause 2 of Article 9 of Decree No. 136/2020/NĐ-CP, amended and supplemented by Point a of Clause 1 of Article 5 of Decree No. 50/2024/NĐ-CP;

Propose the content, time, composition of the inspection team (if any), draft inspection plan, notification of inspection, report to the leadership and direct command for approval and signature, and send it to the unit applying for the Permit to Transport Hazardous Goods on Fire and Explosion. In cases where the authority delegates subordinate public security agencies to conduct inspections on fire prevention and control safety conditions of the transport means, the draft inspection plan and notification of inspection must clearly specify this and inform the subordinate public security agencies to organize the implementation;

Implement the provisions of Clause 7 of Article 9 of Decree No. 136/2020/NĐ-CP to organize inspections on fire prevention and control safety conditions of the transport means in accordance with the content stipulated in Clause 3 of Article 8 of Decree No. 136/2020/NĐ-CP;

The competent authority issuing the Permit to Transport Hazardous Goods on Fire and Explosion as stipulated in Clause 8 of Article 9 of Decree No. 136/2020/NĐ-CP may, based on practical circumstances, jurisdiction, work requirements, and guarantee conditions, delegate subordinate public security agencies to conduct inspections on fire prevention and control safety conditions of the transport means in accordance with the content stipulated in Clause 3 of Article 8 of Decree No. 136/2020/NĐ-CP and send the inspection results to the competent authority for review and issuance of the Permit to Transport Hazardous Goods on Fire and Explosion in accordance with regulations;

Based on the results of the dossier review, fire prevention and control safety condition inspection of the transport means carrying hazardous goods on fire and explosion, draft the Permit to Transport Hazardous Goods on Fire and Explosion according to Model No. PC05 and the Hazardous Goods Marking according to Model No. PC01 in Appendix IX issued together with Decree No. 50/2024/NĐ-CP, report to the leadership and direct command for approval and signature if the dossier meets the requirements. The components of the dossier for signing are stipulated at Points a, b, c, d, đ, e, and h of Item 7 of Appendix I issued together with this Circular;

In cases where it is proposed to refuse to process the dossier: Draft the reply document, clearly stating the reasons, report to the leadership and direct command for approval and signature. The components of the dossier for signing are stipulated at Points a, b, c, d, đ, g, and h of Item 7 of Appendix I issued together with this Circular;”

9. Amend and supplement Clause 1 and Clause 4 of Article 12 as follows:

“1. The application dossier and the procedures for receiving and processing the application for approval of fire fighting plans of facilities shall be implemented in accordance with the provisions of Clauses 4, 5, 6, 7, and Clause 8 of Article 19 of Decree No. 136/2020/NĐ-CP, amended and supplemented by Point b of Clause 11 of Article 1 of Decree No. 50/2024/NĐ-CP.

a) Amend and supplement Clause 1 as follows:

In cases where the fire fighting plan of the facility does not fall within the jurisdiction for approval, the staff receiving the dossier shall record information in the Refusal Form for Receiving and Processing Dossier No. 03 attached to Circular No. 01/2018/TT-VPCP or notify via email or text message in cases of online submission and return the dossier to the agency, organization, or individual.”

4. Staff assigned to handle the dossier shall implement the following steps:

b) Amend and supplement Clause 4 as follows:

a) Determine the suitability of the content of the fire fighting plan with the type of facility applying for approval and the content stipulated in Model No. PC17 in Appendix IX issued together with Decree No. 50/2024/NĐ-CP;

b) Prepare a comparison table to check and evaluate the contents of the fire fighting plan against the requirements and contents in the guidance on recording the fire fighting plan in Model No. PC17 in Appendix IX issued together with Decree No. 50/2024/NĐ-CP;

c) Based on the results of the dossier review and evaluation, report to the leadership and direct command for approval of the fire fighting plan in cases where the dossier meets the requirements. The components of the dossier for signing are stipulated at Points a, b, c, and đ of Item 8 of Appendix I issued together with this Circular;

In cases where it is proposed to refuse to process the dossier: Draft the reply document, clearly stating the reasons, report to the leadership and direct command for approval and signature. The components of the dossier for signing are stipulated at Points a, b, d, and đ of Item 8 of Appendix I issued together with this Circular;

In case of a proposal to refuse to process the file: The draft response document shall clearly state the reasons, report to the direct leadership/commander, and submit for approval and signature by the directly responsible authority. The components of the file to be submitted for signature are specified in points a, b, d, and đ of Section 8 of Appendix I issued together with this Circular.

d) After the fire extinguishing plan for the facility has been approved or the reply document has been reviewed and signed, proceed with numbering and stamping according to regulations;

đ) Hand over the approved fire extinguishing plan for the facility or the reply document to the unit responsible for issuing results.”

Article 5.Issued together herewith are the Appendices Circular 1. Appendix I: List of documents to be submitted for signature regarding fire prevention, firefighting, rescue, and emergency response in the People's Police Force.

2. Appendix II: List and quantity of fire prevention, firefighting, rescue, and emergency response equipment provided for one basic fire prevention and firefighting team.

3. Appendix III: List and quantity of fire prevention, firefighting, rescue, and emergency response equipment provided for one specialized fire prevention and firefighting team.

Article 6. Amend, supplement certain phrases and abolish Appendices, some points and clauses within Articles in this Circular

1. Abolish the phrase “safety” following the phrase “Implement inspection” at point đ clause 1 Article 5 of Circular No. 141/2020/TT-BCA.

2. Abolish Appendix II and Appendix III issued together with Circular No. 150/2020/TT-BCA.

3. Abolish point c clause 1 Article 6 of Circular No. 82/2021/TT-BCA.

4. Abolish clause 2 Article 13 and items 1, 2, 3, 4, 5, 6, 7, 8 of the Appendix listing the components of documents to be submitted for signature regarding fire prevention, firefighting, rescue, and emergency response in the People's Police Force issued together with Circular No. 06/2022/TT-BCA.

5. Supplement the phrase “or quarter or year” after the phrase “prepared monthly” at clause 2 Article 9 of Circular No. 141/2020/TT-BCA.

6. Replace the phrase “and hand over the documents to the unit or department assigned to handle them” with the phrase “and hand over the documents to the unit or department assigned to handle them, except in cases of online submission” at clause 2 of Articles 5, 6, 8, 9, 10, 11, and Article 12 of Circular No. 06/2022/TT-BCA.

7. Replace the phrase “fire extinguishing plan of the facility” with the phrase “fire extinguishing plan for the facility” at Article 12 of Circular No. 06/2022/TT-BCA.

8. Replace the phrase “Appendix VI promulgated together with Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting (hereinafter referred to as Decree No. 136/2020/NĐ-CP)” at clause 2 Article 4 of Circular No. 150/TT-BCA with the phrase “Appendix VI promulgated together with Decree No. 50/2020/NĐ-CP”.

This Circular takes effect from December 16, 2024.

Article 7. Effective Date

During the implementation of this Circular, if there are difficulties or obstacles, relevant units, localities, organizations, and individuals shall report to the Ministry of Public Security (through the Fire Prevention and Fighting, Rescue, and Emergency Response Police Department) for timely guidance./.

Article 8. Responsibility for Implementation

1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department shall be responsible for directing, inspecting, and urging the implementation of this Circular.

2. Heads of units under the Ministry, Directors of Provincial Public Security Departments, and organizations and individuals related thereto shall be responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, public security units at all levels, localities, organizations, and individuals concerned shall report to the Ministry of Public Security (through the Fire Prevention and Control Police Department) for timely guidance./.

Tiếng Việt Thông tư số 55/2024/TT-BCA Sửa đổi, bổ sung một số điều của Thông tư số 141/2020/TT-BCA ngày 23 tháng 12 năm 2020 của Bộ trưởng Bộ Công an quy định công tác kiểm tra về phòng cháy, chữa cháy và cứu nạn, cứu hộ của lực lượng Công an nhân dân; Thông tư số 150/2020/TT-BCA ngày 31 tháng 12 năm 2020 của Bộ trưởng Bộ Công an quy định về trang bị phương tiện phòng cháy, chữa cháy và cứu nạn, cứu hộ cho lực lượng dân phòng, lực lượng phòng cháy và chữa cháy cơ sở, lực lượng phòng cháy và chữa cháy chuyên ngành; Thông tư số 82/2021/TT-BCA ngày 06 tháng 8 năm 2021 của Bộ trưởng Bộ Công an quy định về tiêu chuẩn, nhiệm vụ, tập huấn, kiểm tra nghiệp vụ thẩm duyệt thiết kế, nghiệm thu về phòng cháy và chữa cháy của lực lượng Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ; Thông tư số 06/2022/TT-BCA ngày 17 tháng 01 năm 2022 của Bộ trưởng Bộ Công an quy định quy trình thực hiện nhiệm vụ công tác phòng cháy, chữa cháy, cứu nạn, cứu hộ trong Công an nhân dân 한국어 시행령 제 55/2024/TT-BCA는 공안부 장관이 2020년 12월 23일에 제정된 시행령 제 141/2020/TT-BCA의 일부 조항을 개정하고 보완하며, 공안부 장관이 2020년 12월 31일에 제정된 시행령 제 150/2020/TT-BCA의 일부 조항을 개정하고 보완하며, 공안부 장관이 2021년 8월 6일에 제정된 시행령 제 82/2021/TT-BCA의 일부 조항을 개정하고 보완하며, 공안부 장관이 2022년 1월 17일에 제정된 시행령 제 06/2022/TT-BCA의 일부 조항을 개정하고 보완하는 내용으로, 공안인민의 방화, 소방 및 구조구급 업무와 관련된 검사업무, 방화, 소방 및 구조구급 장비의 보급, 방화, 소방 및 구조구급 업무의 기준, 임무, 교육훈련, 업무검사 등에 관한 규정을 개정하고 보완함. 中文 通知第55/2024/TT-BCA号对公安部第141/2020/TT-BCA号(2020年12月23日)和第150/2020/TT-BCA号(2020年12月31日)通知以及第82/2021/TT-BCA号(2021年8月6日)和第6/2022/TT-BCA号(2022年1月17日)通知的部分条款进行修改和补充,涉及公安人员的消防、灭火和救援工作检查;民防力量、基层消防队伍和专业消防队伍的消防设备配备;消防设计审核和验收业务标准、任务、培训和检查等规定。该通知自2024年12月16日起生效。
