CIRCULAR

1. Amend and supplement Point d of Clause 2 of Article 24 as follows: amending certain provisions of Circular No. 07/2019/TT-BCT
dated April 19, 2019 issued by the Minister of Industry and Trade on
export of textile and garment products to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership

Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14;

Pursuant to Resolution No. 72/2018/QH14 dated November 12, 2018 of the National Assembly approving the Comprehensive and Progressive Agreement for Trans-Pacific Partnership and related documents;

Pursuant to Decree No. 40/2025/NĐ-CP dated February 26, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;

Pursuant to Decree No. 31/2018/NĐ-CP dated March 8, 2018 of the Government detailing the Law on Foreign Trade Management regarding the origin of goods;

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade issues this Circular to amend and supplement amending certain provisions of Circular No. 07/2019/TT-BCT dated April 19, 2019 issued by the Minister of Industry and Trade on export of textile and garment products to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Clause 4 of Article 6Amending, supplementing, and replacing certain contents of Circular No. 07/2019/TT-BCT dated April 19, 2019 issued by the Minister of Industry and Trade on export of textile and garment products to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership

1. Amend and supplement Clause 3 of Article 3 as follows:

"The Ministry of Industry and Trade shall announce the annual tariff quota volumes based on the commitments set out in the Bilateral Letter dated March 8, 2018 from the Minister of Industry and Trade of Vietnam and the Minister of Economy of Mexico on trade between Mexico and Vietnam for certain textile and garment products with supply shortages and children's clothing."

2. Amend and supplement Clause 1 of Article 4 as follows:

"A Certificate of Origin form CPTPP (Certificate of Origin form CPTPP) issued by the competent authority according to the model prescribed in Appendix II accompanying Circular No. 06/2020/TT-BCT dated March 24, 2020 issued by the Minister of Industry and Trade amending and supplementing certain provisions of Circular No. 03/2019/TT-BCT dated January 22, 2019 issued by the Minister of Industry and Trade on rules of origin of goods under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership."

3. Amend and supplement Point b of Clause 3 of Article 4 as follows:

“Textile and garment products outside the tariff quota at item number 01, 02, 03 specified in Appendix I of this Circular which comply with the rules of origin of goods stipulated in the CPTPP Agreement and Circular No. 03/2019/TT-BCT dated January 22, 2019 issued by the Minister of Industry and Trade on Rules of Origin of Goods in the Comprehensive and Progressive Agreement Tfor Trans-Pacific Partnership (amended and supplemented by Circular No. 06/2020/TT-BCT dated March 24, 2020 issued by the Minister of Industry and Trade) shall be entitled to the preferential tariff rate of Mexico under the CPTPP.”

4. Amend and supplement Point c of Clause 3 of Article 4 as follows:

Textile and garment products within the tariff quota at item number 04 specified in Appendix I of this Circular which comply with the rules of origin of goods stipulated in the CPTPP Agreement and Circular No. 03/2019/TT-BCT dated January 22, 2019 issued by the Minister of Industry and Trade on Rules of Origin of Goods in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (amended and supplemented by Circular No. 06/2020/TT-BCT dated March 24, 2020 issued by the Minister of Industry and Trade) shall be entitled to the preferential tariff rate of Mexico under the CPTPP.

5. Amend and supplement Point d of Clause 3 of Article 4 as follows:

"Textile and garment products outside the tariff quota at item number 04 specified in Appendix I of this Circular which comply with the specific product rules of origin stipulated in Article 5 of this Circular shall be entitled to the preferential tariff rate of Mexico under the CPTPP. The declaration content on the Certificate of Origin form C/O (C/O) of Vietnam for textile and garment products as provided in this point shall be implemented according to the provisions in Appendix IV accompanying Circular No. 06/2020/TT-BCT dated March 24, 2020 issued by the Minister of Industry and Trade amending and supplementing certain provisions of Circular No. 03/2019/TT-BCT dated January 22, 2019 issued by the Minister of Industry and Trade on Rules of Origin of Goods in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership."

6. Replace Model No. 02 (Export Certificate), Model No. 03 (Supplementary Export Certificate), and Model No. 04 (Trader Information Registration) in Appendix III of Circular No. 07/2019/TT-BCT with Model No. 02, Model No. 03, and Model No. 04 in the Appendix accompanying this Circular.

Article 2. Implementation Provisions

This Circular takes effect from January 13, 2026./.
