OF THE MINISTRY OF FINANCE NUMBER 55 TC/TCT ON JULY 15, 1995

REGARDING GUIDELINES FOR ADDITIONAL HANDLING OF TWO-WHEELED MOTORCYCLES WITH ILLEGAL IMPORTATION ORIGIN

THAT ARE CIRCULATING AMONG THE POPULATION

IN FORCE AMONG THE POPULACE

Implementing the Directive of Deputy Prime Minister Phan Van Khai on behalf of the Prime Minister in Circular No. 3381/KTTH dated June 22, 1995 from the Office of the Government regarding the handling of two-wheeled motorcycles with illegal importation origin that have been declared by the people;

After reaching a consensus with the Ministries of Interior and Commerce, and the General Customs Department; the Ministry of Finance provides additional guidelines for continuing to handle two-wheeled motorcycles with illegal importation origin that have been declared by the people as follows:

1) The subjects eligible for continued processing to register and circulate vehicles are those who declared within the deadline (by December 31, 1994) but had not completed registration procedures by February 15, 1995, according to Clause I of Circular No. 102 TC/TCT dated November 30, 1994 issued by the Ministry of Finance. The People's Committee of each province shall confirm a list of subjects who declared within the deadline until December 31, 1994 but had not completed registration procedures.

2) Regarding tax collection procedures, fees, fines for vehicle registration and circulation, etc., these shall be carried out according to Clause II of Circular No. 102 TC/TCT dated November 30, 1994, Document No. 329 TC/TCT dated February 18, 1995 issued by the Ministry of Finance, and Documents Nos. 1680 TCHQ/KTTT dated December 2, 1994 and No. 526 TCHQ/KTTT dated March 24, 1995 from the General Customs Department regarding the handling of two-wheeled motorcycles with illegal importation.

The implementation organization shall follow Clause I of Circular No. 102 TC/TCT issued by the Ministry of Finance. Specifically, the deadline for completing vehicle registration procedures must be no later than September 30, 1995. In October 1995, each province shall compile a report on handling two-wheeled motorcycles with illegal importation origin and submit it to the Ministry of Finance for compilation and reporting to the Prime Minister.

For cases where vehicles with illegal importation origin have not been declared or registered as required, if discovered, they must be confiscated and strictly handled according to the law.

This Circular takes effect from the date of issuance.
