Regarding the establishment of the management board for the Dung Quat industrial zone

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

To implement Decision No. 207/TTg dated April 11, 1996 of the Prime Minister on approving the general planning of the Dung Quat Industrial Zone;

At the proposal of the Minister, Head of the Government Organization-Civil Service Department,

DECISION:

Article 1. Establish the Management Board for the Dung Quat Industrial Zone to assist the Prime Minister in directing the implementation of construction and development of the Dung Quat Industrial Zone according to the approved planning, plans, and schedules.

Article 2. The Management Board for the Dung Quat Industrial Zone (hereinafter referred to as the Management Board) shall have the main tasks and authorities as follows:

1. Assist the Prime Minister in urging the preparation of detailed planning for functional areas (including infrastructure outside the industrial zone serving the operation of the industrial zone) and investment projects within the industrial zone for the Prime Minister's consideration, decision-making, and assignment to relevant agencies for implementation; Urge and inspect the implementation of planning and plans already approved by the Prime Minister.

2. Take the lead and coordinate with ministries, ministerial-level agencies, government agencies, provincial People's Committees related to help the Prime Minister resolve or, upon delegation from the Prime Minister, promptly address new issues arising, inter-sectoral, and inter-provincial issues during the planning, construction, and development of the industrial zone.

3. Promote investment in the industrial zone.

4. Guide and accept investment application files for the Dung Quat Industrial Zone and work with competent authorities to decide on the issuance of investment permits.

5. Issue construction permits based on design documents that have been approved by competent authorities.

6. Urge, inspect, and coordinate with relevant agencies to assist investors in implementing approved investment projects.

7. Take the lead and coordinate with relevant agencies to organize and manage services serving the operation of the industrial zone in accordance with the provisions of the law.

8. Organize coordination with local authorities and relevant agencies to ensure security, safety, and public order in the industrial area.

9. Propose to the Prime Minister necessary policies, measures to ensure the construction and development of the industrial zone. 10. Submit to the Prime Minister for promulgation the regulations governing the management of the Dung Quat Industrial Zone and disseminate, guide, and inspect the implementation of these regulations.

Article 3. The working relationship between the Management Board and ministries, ministerial-level agencies, government agencies (referred to as ministries), and the People's Committee of Quang Ngai Province, the People's Committee of Quang Nam - Da Nang Province (referred to as the People's Committee of the locality), and enterprises operating in the industrial zone or related to the Dung Quat Industrial Zone.

1. With respect to ministries:

a. Coordinate with ministries, ministerial-level agencies, government agencies related in the construction and implementation of planning, plans for the construction and development of the Dung Quat Industrial Zone.

b. Be authorized by ministries to perform certain state management tasks within the industrial zone.

c. The Management Board may be invited to attend meetings of the Government, ministries, and the People's Committee of the locality when discussing issues related to the construction and development of the Dung Quat Industrial Zone and provided with necessary documents and information for monitoring and directing the construction of the industrial zone.

d. The Office of the Government assists the Prime Minister in monitoring the implementation of planning, construction, and development plans for the Dung Quat Industrial Zone and promptly addressing the Management Board's recommendations.

2. With respect to the People's Committee of the locality: The People's Committee of the locality has the following responsibilities:

a. Perform administrative state management functions over the Dung Quat Industrial Zone within its territorial jurisdiction.

b. Implement the construction and development of the Dung Quat Industrial Zone according to assigned tasks.

c. Supervise and inspect compliance with regulations on labor safety, environmental protection, fire prevention, and security maintenance in the industrial zone.

d. Coordinate and create conditions for the Management Board to fully carry out the tasks stipulated in Article 2 of this Decision.

The People's Committees of Quang Ngai and Quang Nam - Da Nang Provinces, based on actual conditions, after reaching agreement with the Government Organization-Civil Service Department and the Chairman of the Management Board for the Dung Quat Industrial Zone, shall establish appropriate organizations to assist the People's Committee of the province in performing the above tasks and other tasks related to the Dung Quat Industrial Zone within their jurisdiction and coordinate with the Management Board to implement the planning and schedule for the construction and development of the Dung Quat Industrial Zone.

3. With respect to enterprises of all economic sectors operating in the Dung Quat Industrial Zone.

Industrial enterprises, export processing enterprises (if any), infrastructure development companies operate under the regulations of the industrial zone issued together with Decree No. 192/CP dated December 28, 1994 and the Export Processing Zone Regulations issued together with Decree No. 322/HĐBT dated October 18, 1991 of the Government and are subject to supervision and inspection by the Management Board regarding the implementation of planning, construction, and management regulations of the industrial zone.

Article 4. The Management Board for the Dung Quat Industrial Zone has legal personality, has its own account, seal, dedicated staff, and operational funds provided by the state budget; the headquarters of the Management Board is located in Quang Ngai Province.

The Management Board has a Chairman, several Deputy Chairmen, and a supporting staff. Among the Deputy Chairmen, there is one Deputy Chairman representing the People's Committee of Quang Ngai Province, one Deputy Chairman representing the People's Committee of Quang Nam - Da Nang Province, and one representative from the Ministry of National Defense, these representatives work concurrently.

The Minister, Head of the Government Organization-Civil Service Department, submits to the Prime Minister for appointment of the Chairman and Deputy Chairmen.

The supporting staff of the Management Board is decided by the Chairman after obtaining approval from the Government Organization-Civil Service Department.

Article 5. This Decision shall take effect from the date of issuance. During its implementation, if deemed necessary, the Director of the Dung Quất Industrial Zone Management Board shall submit to the Prime Minister for a decision to adjust and supplement the contents of this Decision to be in line with the development requirements of the Dung Quất Industrial Zone.

Article 6. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Quang Ngai Province, the Chairman of the People's Committee of Quang Nam - Da Nang Province, and the Director of the Dung Quat Industrial Zone Management Board are responsible for implementing this Decision.
