Pursuant to the Law on Election of National Assembly Deputies 2001 (amended and supplemented in 2003);

Pursuant to the Law on Elections of Members of People's Councils 2003;

Pursuant to the Law on Prevention and Combating Corruption 2005;

Pursuant to Government Decree No. 37/2007/NĐ-CP dated March 9, 2007 on Asset Disclosure and Income Reporting;

Pursuant to Government Decree No. 37/2007/NĐ-CP dated March 9, 2007 on Transparency of Assets and Income;

The Government Inspectorate issues guidelines for declaration, verification, and public announcement of verification conclusions on assets and income for elections of National Assembly deputies, People's Council representatives, and election and approval of positions at the National Assembly and People's Councils as follows:

PART A. DECLARATION, VERIFICATION, AND PUBLIC ANNOUNCEMENT OF VERIFICATION CONCLUSIONS ON ASSETS AND INCOME FOR ELECTIONS OF NATIONAL ASSEMBLY DEPUTIES AND ELECTION AND APPROVAL OF POSITIONS AT THE NATIONAL ASSEMBLY

I. DECLARATION OF ASSETS AND INCOME

1. Candidates for National Assembly deputies and those expected to be elected or approved at the National Assembly must declare their assets and income according to the simplified declaration form for assets and income issued together with this Circular. (The declaration form for assets and income issued together with Government Decree No. 37/2007/NĐ-CP shall be used for annual declarations).

2. The declaration of assets and income shall be submitted to the Election Council (at the central level) or the Election Committee (at the local level).

3. Those who have already declared and submitted the declaration of assets and income according to the declaration form for assets and income issued together with Government Decree No. 37/2007/NĐ-CP before this Circular takes effect shall not need to re-declare.

II. REQUIREMENTS AND DECISIONS TO VERIFY ASSETS AND INCOME

1. The Election Council, the Standing Committee of the Central Vietnam Fatherland Front Committee, the Election Committee, the Standing Committee of the Provincial Vietnam Fatherland Front Committee, and the National Assembly Standing Committee shall issue documents requesting verification of assets and income of candidates for National Assembly deputies and candidates for positions to be elected or approved by the National Assembly when there is one of the following grounds:

1.1. When there is a conclusion from the Party Inspection Agency, State Audit Agency, or Investigative Agency regarding the responsibility of the candidate or the person expected to be elected or approved, which is related to acts of corruption, and such conclusion includes a recommendation for verification of assets and income of the candidate or the person expected to be elected or approved.

1.2. When there is a complaint or reflection about the assets and income of the candidate or the person expected to be elected or approved, and such complaint or reflection has clear content and sufficient basis for verifying the lack of honesty in declaring assets and income, and the complainant or reflector clearly states their name, address, and commitment to cooperate and provide materials they possess to the competent authority.

Complaints and reflections about the assets and income of candidates or persons expected to be elected or approved must be promptly considered and resolved in accordance with the provisions of the law.

2. After studying and considering the grounds stipulated in Article 16 of Government Decree No. 37/2007/NĐ-CP and this Circular, the Standing Committee of the Central Vietnam Fatherland Front Committee, the Election Committee, the Standing Committee of the Provincial Vietnam Fatherland Front Committee, and the National Assembly Standing Committee shall issue documents requesting verification so that the competent authority can issue a decision to verify assets and income.

The issuance of documents requesting verification shall be completed no later than 30 days before the final round of consultations to establish the list of candidates, 30 days before the election day for the election of National Assembly deputies, and 30 days before the opening of the National Assembly session for the election and approval at the National Assembly.

In cases where it is truly necessary, the issuance of documents requesting verification may be carried out after the aforementioned deadlines, but must be suspended 10 days before the election or approval date.

Cases where grounds for verification arise after the aforementioned 10-day period will continue to be examined and resolved in accordance with the provisions of the law.

3. In cases where the subject of asset and income verification is a cadre under the management of a Party Central Committee or working in a Party agency, the request and decision to verify shall be made as follows:

3.1. If the subject of verification is a cadre under the management of the Central Committee (including those working in localities), the Election Council, the Standing Committee of the Central Vietnam Fatherland Front Committee, and the National Assembly Standing Committee shall issue a request and proposal for verification to be sent to the Central Inspection Committee for consolidation and submission to the competent authority managing cadres to issue a decision to verify.

3.2. If the subject of verification is a cadre under the management of the Standing Committee of a Party Committee directly under the Central Committee, the Election Council, the Standing Committee of the Central Vietnam Fatherland Front Committee, and the National Assembly Standing Committee shall issue a request and proposal for verification to be sent to the Inspection Committee of a Party Committee directly under the Central Committee for consolidation and submission to the Standing Committee of a Party Committee directly under the Central Committee to issue a decision to verify.

3.3. If the subject of verification is a cadre under the management of the Standing Committee of a Provincial Party Committee, Municipal Party Committee, County Party Committee, District Party Committee, Town Party Committee, or City Party Committee within a province, or a cadre working in a Party agency at the local level, the Election Council, the Standing Committee of the Central Vietnam Fatherland Front Committee, the Election Committee, the Standing Committee of the Provincial Vietnam Fatherland Front Committee, and the National Assembly Standing Committee shall issue a request and proposal for verification to be sent to the Provincial Inspection Committee or Municipal Inspection Committee directly under the Central Committee for consolidation and submission to the Standing Committee of a Provincial Party Committee or Municipal Party Committee directly under the Central Committee to issue a decision to verify.

4. In the case where the person whose assets and income are being verified is working at a state agency, political-social organization, people's armed unit, public institution, state-owned enterprise, or another entity using state budget or state property but not under the management of the Central Party Standing Committee or local Party Standing Committee, the request for and issuance of the verification decision shall be carried out as follows:

4.1. If the person being verified is an officer working at a central-level agency, organization, or unit, the Election Council, the Central Steering Committee of the Vietnam Fatherland Front, and the Standing Committee of the National Assembly shall issue a document requesting verification to be sent to the head of the agency, organization, or unit where the person being verified works, to issue the verification decision and assign the Inspectorate of the Ministry or, if there is no Ministry Inspectorate, assign the Department or Cadre Organization Division to conduct the verification;

4.2. If the person being verified is an officer working at a local-level agency, organization, or unit (provincial, district, commune level), the Election Council, the Provincial Steering Committee of the Vietnam Fatherland Front, the provincial-level city directly under the Central Government, or the Standing Committee of the National Assembly shall issue a document requesting or proposing verification to be sent to the Chairman of the People's Committee at the provincial level to issue the verification decision and assign the provincial Inspectorate to conduct the verification.

5. In the case where the person whose assets and income are being verified does not work at a state agency, political organization, political-social organization, people's armed unit, public institution, state-owned enterprise, or another entity using state budget or state property, the Central Steering Committee of the Vietnam Fatherland Front, the Election Council, the Provincial Steering Committee of the Vietnam Fatherland Front of the provincial-level city directly under the Central Government, or the Standing Committee of the National Assembly shall issue a document requesting verification to be sent to the Inspectorate at the province where the person being verified is a candidate for election, for the provincial Inspectorate to issue the verification decision and conduct the verification.

III. CONCLUSIONS AND PUBLIC DISCLOSURE OF THE TRANSPARENCY IN ASSET AND INCOME DECLARATION

1. The conclusion on transparency in asset and income declaration shall be implemented according to the model conclusion issued together with Decree No. 37/2007/NĐ-CP and must ensure the following requirements:

1.1. If the declared contents of assets and income are consistent with the verification results, the conclusion shall only record: "the declared contents are consistent with the verification results" (without recording information about the assets and income of the person being verified);

1.2. If the declared contents of assets and income are inconsistent with the verification results, the conclusion must clearly record which type of asset or income has discrepancies, the specific discrepancy between the declared asset and income statement and the verification results; for those assets and income that have been declared consistently with the verification results, they shall not be mentioned in the conclusion.

2. Public disclosure of the conclusion on transparency in asset and income declaration for candidates for National Assembly deputies shall be carried out as follows:

2.1. When the agency or organization that has issued a document requesting verification of assets and income also issues a document requesting public disclosure, the agency, organization, or individual with authority to issue the conclusion on transparency in asset and income declaration shall decide on the public disclosure of that conclusion.

The agency, organization, or individual deciding on public disclosure shall themselves disclose it or propose and entrust the Election Council, the Central Steering Committee of the Vietnam Fatherland Front, the Election Council, or the Provincial Steering Committee of the Vietnam Fatherland Front at the provincial level to organize the public disclosure of the conclusion on transparency in asset and income declaration.

The conclusion on transparency in asset and income declaration of candidates for National Assembly deputies shall be publicly disclosed at the meeting of voters where the person works or resides.

Other forms of public disclosure shall be examined and decided upon by the Election Council and the Central Steering Committee of the Vietnam Fatherland Front.

3. Public disclosure of the conclusion on transparency in asset and income declaration for individuals expected to be elected or approved at the National Assembly shall be carried out as follows:

3.1. When the Standing Committee of the National Assembly issues a document requesting public disclosure, the agency, organization, or individual with authority to issue the conclusion on transparency in asset and income declaration shall decide on the public disclosure of that conclusion.

3.2. The form of public disclosure and the location for public disclosure of the conclusion on transparency in asset and income declaration of individuals expected to be elected or approved at the National Assembly shall be examined and decided upon by the Standing Committee of the National Assembly.

PART B. MATTERS CONCERNING THE DECLARATION, VERIFICATION AND PUBLIC ANNOUNCEMENT OF THE VERIFICATION RESULTS ON ASSETS AND INCOME FOR ELECTIONS OF DELEGATES TO PEOPLE'S COUNCILS AT ALL LEVELS AND THE ELECTION AND APPROVAL OF POSITIONS AT PEOPLE'S COUNCILS AT ALL LEVELS

I. DECLARATION OF ASSETS AND INCOME

The declaration of assets and income for candidates for delegates to People's Councils and those expected to be elected or approved at People's Councils shall be carried out in accordance with the provisions for candidates for National Assembly delegates and those expected to be elected or approved at the National Assembly as stipulated in Part I, Section A of this Circular.

II. REQUIREMENTS, DECISIONS ON VERIFICATION, CONCLUSIONS AND PUBLIC ANNOUNCEMENT OF TRANSPARENCY IN THE DECLARATION OF ASSETS AND INCOME

The verification and public announcement of the conclusion on the verification of assets and income of candidates for delegates to People's Councils at all levels and candidates for positions to be elected or approved by People's Councils shall be implemented in accordance with the provisions of Decree No. 37/2007/ND-CP, Joint Circular No. 527/2007/TTLT/TTCP-BNV-UBKTTW, and Section A of this Circular. Authorities, organizations, and individuals with jurisdiction shall apply these documents according to the following principles:

1. For elections of delegates to provincial and district-level People's Councils, it shall be carried out as follows:

1.1. If the candidate is an officer under the management of the Standing Committee of the Party Committee or works at a Party agency, then:

a) The Election Council, the Standing Committee of the Provincial or District-level United Front Work Committee is the authority or organization with the power to issue a request for verification and a request for public announcement of the verification conclusion;

b) The Party Inspection Committee at the provincial or district level is the authority that receives requests, compiles them, and submits them to the Standing Committee of the Party Committee at the same level to make a decision on verification;

c) The Standing Committee of the Provincial Party Committee, the Standing Committee of the Central City Party Committee, the Standing Committee of the County Party Committee, the Standing Committee of the Town Party Committee, and the Standing Committee of the District Party Committee are the authorities with the power to make decisions on verification, issue verification conclusions, and decide on the public announcement of the verification conclusion;

d) The Party Inspection Committee at the provincial or district level is the authority conducting the verification.

1.2. If the candidate does not fall within the scope specified in Point 1.1 of Section II of this Part, then:

a) The Election Council, the Standing Committee of the Provincial or District-level United Front Work Committee is the authority or organization with the power to issue a request for verification and a request for public announcement of the verification conclusion;

b) The Chairman of the Provincial or District-level People's Committee is the person with the power to make decisions on verification, issue verification conclusions, and decide on the public announcement of the verification conclusion;

c) The Inspectorate at the provincial or district level is the authority conducting the verification.

In cases where necessary, the Inspectorate at the provincial or district level will take the lead, coordinate, and summon officials from relevant agencies, organizations, and units (including village-level officials) to participate in the verification.

2. Specifically for the election of delegates to village-level People's Councils, it shall be carried out as follows:

2.1. If the candidate is an officer under the management of the Standing Committee of the County Party Committee, then:

a) The Election Council, the Standing Committee of the Village-level United Front Work Committee is the authority or organization with the power to issue a request for verification and a request for public announcement of the verification conclusion;

b) The Party Inspection Committee at the county level is the authority that receives requests, compiles them, and submits them to the Standing Committee of the Party Committee at the same level to make a decision on verification;

c) The Standing Committee of the County Party Committee is the authority with the power to make decisions on verification, issue verification conclusions, and decide on the public announcement of the verification conclusion;

d) The Party Inspection Committee at the county level is the authority conducting the verification.

In cases where necessary, the Party Inspection Committee at the county level will take the lead, coordinate, and summon officials from relevant agencies, organizations, and units (including village-level officials) to participate in the verification.

2.2. If the candidate is not under the management of the Standing Committee of the County Party Committee, then:

a) The Election Council, the Standing Committee of the Village-level United Front Work Committee is the authority or organization with the power to issue a request for verification and a request for public announcement of the verification conclusion;

b) The Chairman of the County-level People's Committee is the person with the power to make decisions on verification, issue verification conclusions, and decide on the public announcement of the verification conclusion;

c) The Inspectorate at the county level is the authority conducting the verification.

In cases where necessary, the Inspectorate at the county level will take the lead, coordinate, and summon officials from relevant agencies, organizations, and units (including village-level officials) to participate in the verification.

3. For the election and approval of positions at provincial and district-level People's Councils, it shall be carried out as follows:

a) The Standing Committee of the People's Council is the authority with the power to issue a request for verification and a request for public announcement of the verification conclusion;

b) The Standing Committee of the Party Committee is the authority with the power to make decisions on verification, issue verification conclusions, and decide on the public announcement of the verification conclusion;

c) The Party Inspection Committee at the same level is the authority conducting the verification.

4. For the election and approval of positions at village-level People's Councils, it shall be carried out as follows:

a) The Standing Committee of the Village-level People's Council is the authority with the power to issue a request for verification and a request for public announcement of the verification conclusion;

b) The Standing Committee of the County Party Committee is the authority with the power to make decisions on verification, issue verification conclusions, and decide on the public announcement of the verification conclusion;

c) The Party Inspection Committee at the county level is the authority conducting the verification.

In cases where necessary, the Party Inspection Committee at the county level will take the lead, coordinate, and summon officials from relevant agencies, organizations, and units (including village-level officials) to participate in the verification.

5. The public announcement of the verification conclusion for candidates for delegates to provincial, district, and village-level People's Councils shall be carried out in accordance with the provisions of Point 2.2 of Part III, Section A of this Circular.

6. The form and location of the public announcement of the verification conclusion for those expected to be elected or approved for positions at People's Councils shall be decided by the Standing Committee of the People's Council.

PART C. IMPLEMENTATION ORGANIZATION

1. This Circular takes effect from the date of signature.

2. During the implementation of this Circular, if there are any difficulties, they should be reported to the Government Inspectorate for coordination with relevant agencies and organizations to study and resolve them./.
