DECISION

Regarding the issuance of the list of occupations and jobs entitled to receive physical benefits for workers operating under hazardous and toxic conditions in the Agriculture and Rural Development sector dangerous, toxic substances of the Ministry of Agriculture and Rural Development

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, powers, and responsibilities of State management by Ministries and ministerial-level agencies;

Pursuant to Decree No. 96/CP dated December 7, 1993 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to Article 104 of the Labor Code dated June 23, 1994; Article 8 of Decree No. 06/CP dated January 20, 1995 ofthe Government and Circular Joint No. 10/1999/TTLT-BLĐTBXH-BYT dated March 17, 1999 of the Joint Circular of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health guiding the implementation of physical benefit regimes for workers operating under hazardous and toxic conditions;

Pursuant to Circular No. 1669/BNN-CS dated June 8, 2001 of the Ministry of Agriculture and Rural Development regarding the request for agreement on the list of occupations entitled to physical benefits;

After receiving the agreement from the Ministry of Health at Circular No. 2042/YT-DP dated March 19, 2002,

DECISION:

Article 1. Issuing 177 lists of occupations and jobs entitled to receive physical benefits within the Agriculture and Rural Development sector.

Where:

The number of occupations and jobs entitled to level IV benefits: 2

The number of occupations and jobs entitled to level III benefits: 7

The number of occupations and jobs entitled to level II benefits: 83

The number of occupations and jobs entitled to level I benefits: 85

Article 2. Based on this Decision, the Ministry of Agriculture and Rural Development shall guide the implementation of the physical benefit regime for individuals engaged in the occupations and jobs specified in Article 1 in accordance with the provisions of Circular Joint No. 10/1999/TTLT-BLĐTBXH-BYT dated March 17, 1999 of the Joint Circular of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health guiding the implementation of physical benefits for workers operating under hazardous and toxic conditions; and send it to the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health for monitoring.

Article 3. This Decision replaces all previous agreements on physical benefit regimes for hazardous and toxic occupations within the Agriculture and Rural Development sector.

Article 4. This Decision takes effect fifteen days from the date of issuance./.
