CIRCULAR

Regarding amendments and supplements to certain points of Circular No. 47/2001/BNN-CS dated April 19, 2001 of the Ministry of Agriculture and Rural Development

Pursuant to Decision No. 141/2000/QĐ-TTg dated December 11, 2000 of the Prime Minister on investment policies and benefits for households, individuals, and communes participating in forestry projects and management of upstream protective forests in Thanh Hoa, Quang Tri, Phu Yen, and Gia Lai provinces under Loan Agreement No. 1515-VIE (SF);

Pursuant to Decision No. 28/2001/QĐ-TTg dated March 9, 2001 of the Prime Minister amending and supplementing Decision No. 141/2000/QĐ-TTg dated December 11, 2000 on investment policies and benefits for households, individuals, and communes participating in forestry projects and management of upstream protective forests in Thanh Hoa, Quang Tri, Phu Yen, and Gia Lai provinces under Loan Agreement No. 1515-VIE (SF);

Pursuant to Circular No. 47/2001/TT-BNN-CS dated April 19, 2001 of the Ministry of Agriculture and Rural Development guiding the implementation of Decision No. 28/2001/QĐ-TTg dated March 9, 2001 of the Prime Minister on investment policies and benefits for households, individuals, and communes participating in forestry projects and management of upstream protective forests in Thanh Hoa, Quang Tri, Phu Yen, and Gia Lai provinces under Loan Agreement No. 1515-VIE (SF);

Pursuant to the recommendations of the Asian Development Bank (ADB) recorded in the Memorandum of Understanding dated February 4, 2005 and the letter dated May 30, 2005 from the Director of the Agriculture, Environment and Natural Resources Department, Mekong Subregion Office, Asian Development Bank;

The Ministry of Agriculture and Rural Development amends and supplements certain points of Circular No. 47/2001/TT-BNN-CS dated April 19, 2001 of the Ministry of Agriculture and Rural Development as follows:

1. Point 1.2 Clause 1 Section II (New planting and regeneration with supplementary planting of forest trees) is amended and supplemented as follows:

"The investment cost for protective forest planting, regeneration with supplementary planting shall be applied according to Document No. 3859/BNN-PTLN dated September 25, 2002 of the Ministry of Agriculture and Rural Development adjusting the investment cost and adding design costs for the ADB project."

2. Point 2.2.2 Clause 2 Section II (Combined agriculture and forestry planting: Planting of forestry trees, green hedges, soil improvement trees within cultivation areas following combined agriculture and forestry methods) is amended and supplemented as follows: "Support not exceeding 1.8 million VND/ha (increased by 0.3 million VND/ha) and this level shall apply to the area planted in 2005 and the area already planted in previous years still requiring care in 2005."

3. Clause 4 Section II (Improvement and construction of infrastructure facilities) is supplemented as follows: "Increase the proportion of investment capital for infrastructure up to 50% of the total project investment capital of the province in communes where the project is implemented within the framework of approved commune development plans."

4. Section III (Regarding the mechanism for managing investment capital) is amended as follows: "The mechanism for managing investment capital and support shall be implemented according to Circular No. 78/2001/TT-BTC dated September 28, 2001 and Circular No. 103/2002/TT-BTC dated November 13, 2002 of the Ministry of Finance guiding financial mechanisms for forestry projects and upstream protective forest management funded by ADB."

This Circular takes effect fifteen days after its publication in the Official Gazette of the Government.

Provisions in Circular No. 47/2001/TT-BNN-CS dated April 19, 2001 of the Ministry of Agriculture and Rural Development guiding the implementation of Decision No. 141/2000/QĐ-TTg dated December 11, 2000 and Decision No. 28/2001/QĐ-TTg dated March 9, 2001 of the Prime Minister that are not contrary to the provisions of this Circular remain in force. In the course of implementation, if there are difficulties, relevant units must promptly report to the Ministry of Agriculture and Rural Development to continue to supplement and perfect this Circular./.
