PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;

Pursuant to the Civil Servant Ordinance dated February 26, 1998 and the Ordinance Amending and Supplementing Certain Articles of the Civil Servant Ordinance dated April 29, 2003;

Pursuant to the Action Program of the Government implementing the Resolution of the Seventh Plenary Session of the Ninth Central Committee of the Communist Party of Vietnam on ethnic affairs as stipulated in Decision No. 122/2003/QĐ-TTg dated June 12, 2003 of the Prime Minister;

At the proposal of the Minister of Home Affairs and the Minister, Chairman of the National Ethnic Minorities Committee,

DECISION: 

Article 1. Objectives, Duration, and Source of Cadres and Civil Servants to be Strengthened

1. Implement the temporary strengthening (for a period of 3 to 5 years) of cadres and civil servants from provincial and district-level agencies (excluding the provinces in the Central Highlands which have separate decisions) to key communes and towns in ethnic minority areas to assist localities in better performing their tasks of economic, cultural, and social development, ensuring security and defense in the locality.

2. The cadres and civil servants specified in Clause 1 of this Article shall be concentrated in key districts and communes with large populations of ethnic minorities and significant shortcomings.

Article 2. Standards for Cadres and Civil Servants to be Strengthened

1. Proficient in the Party's policies and State laws on ethnic affairs and religion; understanding the political system at the commune level with its specific characteristics in ethnic minority areas.

2. Possessing professional qualifications and experience; able to speak and understand the language of the ethnic group and their customs and traditions in the locality; capable of propaganda and mobilization work.

3. Having good moral character, a sense of responsibility, and enthusiasm for work.

4. Maximum age not exceeding 45; in good health to perform assigned tasks.

Article 3. Tasks of Cadres and Civil Servants to be Strengthened

Advising People's Committees of key communes and districts to effectively implement the Party's policies and State laws, and the resolutions of the People's Councils at the same level in the following specific fields:

1. Organizing the effective implementation of administrative reform at the local level and the performance of public duties by commune-level cadres and civil servants to ensure professionalism;

2. Organizing the development of production, poverty reduction, and improvement of living standards for ethnic minority groups, promoting positive changes in the local economy and society;

3. Effectively organizing the development of culture, preserving and promoting traditional cultural values of ethnic minorities, and protecting natural resources and the environment;

4. Consolidating and improving the quality of the political system, implementing democratic regulations at the grassroots level suitable to the customs and culture of each ethnic region;

5. Organizing the implementation of tasks related to security and defense, political stability, social order and safety, ethnic and religious policies;

6. Mobilizing and propagandizing the masses to fulfill the political tasks of the Party, state agencies, and mass organizations;

7. Summarizing and concluding successful mechanisms and models to expand them widely.

Article 4. Benefits for Cadres and Civil Servants to be Strengthened

1. Maintaining their original salary, position-related allowances, other benefits (if any), and positions in the sending agency or unit. If the working area has higher regional allowances, they will receive these; upon completion of the strengthening period, within three months, the original unit is responsible for arranging appropriate work.

2. During the strengthening period, if they excel in their tasks, they will be prioritized for early consideration for promotion to a higher rank, earlier pay grade increase (up to twelve months ahead of schedule), and appointment to suitable positions.

Article 5. Support and Subsidy Policies for Strengthened Civil Servants and Officials

1. In addition to the benefits stipulated in Article 4, strengthened civil servants and officials shall also be entitled to:

a) A minimum initial support of one million VND per person;

b) An additional monthly subsidy equal to 50% of their current salary and allowances (if applicable), which shall be received concurrently with their monthly salary and shall not be deducted for social insurance and health insurance contributions;

c) Depending on specific conditions in key communes and villages and the financial capacity of the locality, the People's Committee of the province shall submit to the Provincial People's Council to specify the additional monthly subsidy for strengthened civil servants and officials, which may exceed the levels specified in points a and b of Clause 1 of this Article.

2. The welfare benefits of strengthened civil servants and officials in key communes and villages of ethnic minority areas shall be guaranteed by the local budget and paid by the agency or unit managing the civil servants and officials before they are strengthened.

Article 6. Responsibilities of the Provincial and District People's Committees

1. The Chairman of the Provincial People's Committee shall consider and decide on the key communes and villages of the locality after receiving the review opinion of the Committee for Ethnic Minorities Affairs.

2. The Chairman of the Provincial People's Committee shall consider and decide on the fields requiring strengthened civil servants and officials (including key positions), the number of civil servants and officials to be strengthened, and the specific strengthening period for each key commune and village; direct the Department of Home Affairs to develop plans for strengthening, work regulations for strengthened civil servants and officials in key communes and villages; clearly define tasks, responsibilities, authorities, working relationships with grassroots organizations, and annually provide detailed evaluations of strengthened civil servants and officials, and report to the dispatching agencies on the situation of dispatched civil servants and officials.

3. The District People's Committee shall implement the strengthening of civil servants and officials according to the plan of the Provincial People's Committee; the number of strengthened civil servants and officials shall be within the assigned establishment of the agency or unit.

4. Strengthened civil servants and officials must be trained in necessary knowledge about working methods, propaganda methods, and mobilizing the masses, and must be trained in the language of the ethnic minority area where they will be strengthened. The subjects, contents, training programs, teaching materials for ethnic minority languages, training duration, training institutions shall be decided by the Provincial People's Committee.

Article 7. Responsibilities of the Commune People's Committees

The Commune People's Committee shall be responsible for managing and creating favorable conditions for strengthened civil servants and officials to perform tasks as prescribed in Article 3 of this Decision; arrange accommodation and workplaces to enable strengthened civil servants and officials to fulfill their tasks effectively and strictly adhere to the regulations of the Provincial People's Committee regarding strengthened civil servants and officials.

Article 8. Responsibilities of Central Ministries and Agencies

1. The Committee for Ethnic Minorities Affairs shall lead and coordinate with the Ministry of Home Affairs to monitor and compile the implementation of this Decision in localities and report periodically to the Prime Minister.

2. Other ministries and agencies shall cooperate with localities based on their functions and responsibilities to guide the implementation of strengthening civil servants and officials in key areas and support training and upgrading knowledge for civil servants and officials who need to be strengthened to assist grassroots organizations in addressing relevant requirements and tasks.

Article 9. Effective Date

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, and Chairmen of Provincial and Central City People's Committees are responsible for implementing this Decision./.
