DECREE

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Gender Equality Law dated November 29, 2006;

||| Based on the proposal of the Minister of Home Affairs;

The Government issues this Decree on the responsibilities of Ministries, ministerial-level agencies, and agencies under the Government (hereinafter referred to collectively as Ministries and sectors); provincial-level People's Committees, district-level People's Committees, urban district-level People's Committees, and provincial-level city People's Committees; commune-level People's Committees, ward-level People's Committees, and town-level People's Committees (hereinafter referred to collectively as People's Committees at all levels) in ensuring that the Vietnam Women's Union, provincial-level Women's Unions, municipal-level Women's Unions, district-level Women's Unions, urban district-level Women's Unions, provincial-level city Women's Unions, commune-level Women's Unions, ward-level Women's Unions, and town-level Women's Unions (hereinafter referred to collectively as all levels of the Women's Unions) participate in state administration in accordance with the law.

Article 1. Scope of Regulation and Applicability

Article 1. The working relationship between Ministries and sectors and the Vietnam Women's Union; People's Committees at all levels and Women's Unions at the same level is a cooperative relationship based on the principle of creating conditions for each agency to perform its functions, tasks, and powers well in accordance with the law.

Article 2. Principles of Coordination

Article 2. Ministries and sectors and People's Committees at all levels create favorable conditions regarding funding and means for Women's Unions at the same level to participate in state administration and organize related activities.

Article 3. Responsibilities of Ministries and sectors

1. Invite the Vietnam Women's Union to:

a) Participate in building mechanisms, policies, regulatory legal documents, programs, projects related to women's rights and interests, and economic, cultural, and social fields within the scope of state administrative management of Ministries and sectors as prescribed by law;

b) Participate in disseminating and educating about policies and laws;

c) Participate in inspecting and supervising the implementation of laws concerning women, children, domestic violence prevention, and gender equality in relevant fields.

2. Create conditions for the Vietnam Women's Union to carry out other tasks as prescribed by the Law on Gender Equality.

3. In addition to the provisions of Clause 1 and Clause 2 of this Article, the Ministry of Public Security and the Ministry of National Defense have support systems regarding funding, working conditions, and means of work, fundraising activities, and support for female officials, civil servants, and employees to address societal issues related to women's advancement and equality in accordance with national laws and policies.

Article 4. Responsibilities of People's Committees at all levels

1. Invite Women's Unions at the same level to:

a) Participate in building, revising, and supplementing mechanisms, policies, economic and social development programs, plans, and social order and safety related to women's rights and interests and gender equality as prescribed by law;

b) Coordinate with specialized agencies under People's Committees in disseminating and educating about policies and laws;

c) Be formal members of advisory organizations (Councils, Commissions, Steering Committees, etc.) related to women, children, and gender equality;

d) Participate in inspection and supervision teams regarding issues related to women's rights and interests, children's rights and interests, gender equality, domestic violence prevention, and other fields as prescribed by law.

2. Coordinate with Women's Unions at the same level to organize meetings to collect opinions on the implementation of policies, laws, and regulations; study, consider, and promptly handle violations of women's and children's legitimate rights and interests and other fields as prescribed by law.

3. Create favorable conditions for the activities of Women's Unions at the same level such as providing funding, working conditions, and means of work, fundraising activities, production and service organization, and support for women to address societal issues related to women's advancement and equality in accordance with national laws and policies.

Article 5. Responsibilities of the Ministry of Interior, the Vietnam Women's Union, and all levels of the Vietnam Women's Union

1. The Ministry of Home Affairs is responsible for:

a) Guide, monitor, and urge ministries, sectors, and People's Committees at all levels to fulfill their responsibilities as stipulated in Articles 3 and 4 of this Decree;

b) Take the lead and coordinate with the Vietnam Women's Union to inspect, audit, and supervise the implementation of this Decree.

2. The Vietnam Women's Union and all levels of the Vietnam Women's Union:

a) Nominate representatives to participate in state management activities;

b) Proactively study, propose, and recommend measures and policies related to the legitimate rights and interests of women, children, families, and gender equality; provide timely information related to women, children, and gender equality;

c) Closely cooperate with ministries, sectors, and People's Committees at all levels in fulfilling their responsibilities as prescribed by laws on gender equality;

d) Implement legal provisions regarding the rights and responsibilities of all levels of the Vietnam Women's Union;

đ) Guide and support all levels of the Vietnam Women's Union in implementing this Decree.

Article 6. Implementation Organization

1. Regular meetings:

a) Every six months, the People's Committee at the district and commune levels shall meet with the Vietnam Women's Union at the same level to review and assess the implementation of systems and policies and recommendations and proposals concerning the rights and interests of women, children, and other areas as prescribed by law;

b) Annually, the leadership of the provincial People's Committee shall meet with the Executive Board of the Vietnam Women's Union at the same level to review and assess the implementation of systems and policies and recommendations and proposals concerning the rights and interests of women, children, and other areas as prescribed by law;

c) Annually, the Ministry of Interior shall take the lead and coordinate with the Government Office to incorporate the assessment of the fulfillment of responsibilities by ministries, sectors, and People's Committees at all levels in ensuring the participation of all levels of the Vietnam Women's Union in state management into the regular work program of the Prime Minister with the Executive Board of the Vietnam Women's Union;

2. Organize mid-term and final reviews:

a) At the commune level: Once a year, the commune-level People's Committee shall organize a review of the implementation of this Decree, together with the commune-level Vietnam Women's Union, and submit a report to the district-level People's Committee for consolidation and submission to the provincial-level People's Committee;

b) At the ministry and provincial level: Conduct mid-term reviews every two years at ministries, sectors, and provincial People's Committees, and simultaneously submit mid-term reports to the Ministry of Interior;

c) Every five years, the Ministry of Interior shall organize a national conference to conclude the implementation of this Decree, in collaboration with the Vietnam Women's Union.

Article 7. Effective Date

1. This Decree takes effect from September 5, 2012.

2. This Decree replaces Decree No. 19/2003/NĐ-CP dated March 7, 2003 of the Government on the responsibilities of administrative agencies at all levels in ensuring the participation of all levels of the Vietnam Women's Union in state management.

Article 8. Responsibility for Implementation

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities, all levels of the Vietnam Women's Union, and relevant agencies are responsible for enforcing this Decree./.
