Provisions on inspecting self-contained sanitation facilities on passenger train cars

Pursuant to the Railway Law dated June 14, 2005;
The Prime Minister issues this Decision amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport.
At the proposal of the Director of the Department of Environment and the Director of the Vietnam Vehicle Inspection Agency;
The Minister of Transport issues the Circular stipulating the inspection of self-contained sanitation facilities on passenger train cars.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular sets forth the provisions on inspecting self-contained sanitation facilities on passenger train cars operating on national railways.
2. This Circular applies to organizations and individuals installing and using self-contained sanitation facilities on passenger train cars, and relevant agencies, organizations, and individuals.
Article 2. Interpretation of Terms
1. Self-contained sanitation facility: is a sanitation device that retains and treats solid and liquid waste before discharging it into the environment (hereinafter referred to as the equipment).
2. Wastewater analysis laboratory: is a laboratory or center belonging to an organization with legal personality permitted to operate in the field of wastewater analysis.
3. Same model equipment: are equipment of the same brand, design, and technical specifications produced on the same production line.
4. Passenger car repair facility: are enterprises engaged in new construction, conversion, repair, and maintenance of passenger cars.
Chapter II
PROVISIONS ON INSPECTION
Article 3. Initial installation inspection of equipment on passenger train cars
1. Inspection dossier
a) Design dossier or modified design dossier for passenger train cars equipped with the equipment, which has been reviewed according to Article 5 of Circular No. 02/2009/TT-BGTVT dated April 3, 2009, issued by the Minister of Transport on inspecting the quality, technical safety, and environmental protection of railway transport vehicles (hereinafter referred to as Circular No. 02/2009/TT-BGTVT).
b) Quality certificate of the equipment from the manufacturer and the analytical results report of wastewater issued by the wastewater analysis laboratory for the same model equipment.
c) Inspection record of the equipment by the passenger car repair facility.
2. Content of inspection
a) Checking the completeness of the dossier as prescribed in Clause 1 of this Article.
b) Verifying the analytical results report of wastewater regarding pollution parameter values as prescribed by the Ministry of Transport.
c) Inspecting the type and installation of the equipment according to the reviewed design.
3. The procedure for inspecting and issuing certificates for passenger train cars equipped with the equipment shall be carried out in accordance with Circular No. 02/2009/TT-BGTVT and Circular No. 36/2011/TT-BGTVT dated May 6, 2011, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 02/2009/TT-BGTVT (hereinafter referred to as Circular No. 36/2011/TT-BGTVT).
Article 4. Periodic inspection of equipment
1. Inspection dossier
Inspection record of the equipment by the passenger car repair facility.
2. Content of inspection
a) Checking the completeness of the inspection dossier.
b) Inspecting the installation status and operation of the equipment.
3. The procedure for periodic inspection and issuance of certificates for passenger train cars shall be carried out in accordance with Circular No. 02/2009/TT-BGTVT and Circular No. 36/2011/TT-BGTVT. The periodic inspection of the equipment shall be conducted concurrently with the periodic inspection of passenger train cars as stipulated in Circular No. 02/2009/TT-BGTVT.
Article 5. Issuance of Certificate
Equipment inspection is part of the content of passenger train car inspection. The satisfactory inspection result serves as the basis for issuing the Technical Safety and Environmental Protection Certificate for the vehicle as prescribed in Circular No. 02/2009/TT-BGTVT and Circular No. 36/2011/TT-BGTVT.
Article 6. Responsibilities of the vehicle owner and the operator of the vehicle
Shall be responsible for repairing, maintaining, and keeping the technical condition of the equipment in good order and ensuring that the maximum values of pollution parameters of wastewater meet the regulations set by the Ministry of Transport during the operation and use.
Chapter III
IMPLEMENTATION
Article 7. Effective Date
This Circular takes effect from February 14, 2014.
Article 8. Responsibility for Implementation
The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of the Departments under the Ministry, the Director of the Vietnam Vehicle Inspection Agency, the Director of the Vietnam Railways Administration, the General Director of the Vietnam Railway Corporation, the Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation./.
