Pursuant to the Law on Inland Waterway Transport dated June 15, 2004 and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport dated June 17, 2014;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Vietnam Inland Waterway Administration, hereby promulgates this Circular stipulating examination, inspection, issuance, reissuance, and conversion

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

(hereinafter referred to as GCNKNCM, CCCM) for seafarers, operators of inland waterway vessels, and assuming the position of seafarer on inland waterway vessels.professional certificate 1. This Circular applies to agencies, organizations, and individuals related to the examination, inspection, issuance, reissuance, and conversion of GCNKNCM, CCCM for seafarers, operators of inland waterway vessels, and assuming the position of seafarer on inland waterway vessels.

Article 2. Applicability

2. This Circular does not apply to agencies, organizations, and individuals related to the examination, inspection, issuance, reissuance, and conversion of GCNKNCM, CCCM for seafarers, operators of inland waterway vessels performing security and defense duties.

Professional time

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. is the working time according to the position on inland waterway vessels. is the training time on inland waterway vessels according to the trained position under the guidance of a person with appropriate technical expertise.

6. is the certificate proving the capability to work safely on coastal vessels, vessels carrying petroleum products, chemical vessels, or liquefied gas carriers; capable of controlling vessels type I high-speed, type II high-speed, or coastal vessels. Type I high-speed vessel

7. is the vessel defined in Clause 1, Article 24 of the Law on Inland Waterway Transport 2004 amended and supplemented in Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport 2014 and having a design speed of 30 km/h or more. 8. is the vessel defined in Clauses 2 and 3, Article 24 of the Law on Inland Waterway Transport 2004 amended and supplemented in Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport 2014 and having a design speed of 30 km/h or more. Chapter II

TO TAKE THE EXAMINATION FOR

 PROFESSIONAL CERTIFICATE

PROFESSIONAL CAPABILITY, CONDUCTING QUALIFICATION TESTS FOR

 SPECIALTY CERTIFICATEN |||

Article 4. Professional Competence Certificate, Specialized Certificate

1. The Professional Competence Certificate for Master is divided into four levels: Level One (T1), Level Two (T2), Level Three (T3), Level Four (T4).

2. The Professional Competence Certificate for Chief Engineer is divided into three levels: Level One (M1), Level Two (M2), Level Three (M3).

3. Basic Safety Training Certificate (BSTC).

4. Service Certificates:

a) First Class Able Seaman Certificate (AS1), Second Class Able Seaman Certificate (AS2);

b) First Class Motorman Certificate (MM1), Second Class Motorman Certificate (MM2);

c) First Class Pilot Certificate (PC1), Second Class Pilot Certificate (PC2).

5. Specialized Certificates:

a) High Speed Craft Master Certificate Type I (HSCMC I);

b) High Speed Craft Master Certificate Type II (HSCMC II);

c) Coastal Navigation Vessel Master Certificate (CNVM);

d) Coastal Navigation Vessel Safety Work Certificate (CNSWC);

đ) Petroleum Carrier Safety Work Certificate (PCS);

e) Chemical Carrier Safety Work Certificate (CCS);

g) Liquefied Gas Carrier Safety Work Certificate (LGCS).

6The Professional Competence Certificate and Specialized Certificate issued to seafarers and inland waterway vessel operators shall be in accordance with the model set out in Appendix I of this Circular. stipulating at Appendix I of this Circular.

Article 5. General Conditions for Taking Examinations and Tests to Obtain the Professional Competence Certificate and Specialized Certificate

1. Being a Vietnamese citizen or a foreigner permitted to reside or work legally in Vietnam.

2. Completing the corresponding vocational training, supplementary, and upgrading programs for each type and level of Professional Competence Certificate and Specialized Certificate (except for specific cases stipulated in Clauses 9, 11, and 13 of Article 6 of this Circular).

3. Meeting the age requirement and having sufficient service time and apprenticeship period up to the date of the examination and test board decision as specified in Article 6 of this Circular.

4. Having a health certificate issued bya competent medical facility authorized healthcare facility |||.

Article 6. Specific Conditions for Taking Examinations and Tests to Obtain the Professional Competence Certificate and Specialized Certificate

In addition to the general conditions prescribed in Article 5 of this Circular, candidates for examinations and tests to obtain the Professional Competence Certificate and Specialized Certificate must also meet the following specific conditions:

1. Condition for taking the test to obtain the First Class and Second Class Able Seaman Certificate, First Class and Second Class Motorman Certificate: at least 16 years old.

2. Condition for taking the test to obtain the First Class and Second Class Pilot Certificate: at least 18 years old.

3. Condition for taking the test to obtain the Safety Work Certificate on Coastal Navigation Vessels, Petroleum Carriers, Chemical Carriers, and Liquefied Gas Carriers:

4. For investment projects specified in Clause 5, Article 38 of this Decree:a) At least 18 years old;

b) Hold a First Class Able Seaman Certificate, First Class Motorman Certificate, or First Class Pilot Certificate.

4. Condition for taking the test to obtain the High Speed Craft Master Certificate Type I, Coastal Navigation Vessel Master Certificate:

: Total cost of electricity purchase for the year (VND) from direct and indirect power plants participating in the electricity market, as specified in Clause 2 of this Article;a) Hold a Professional Competence Certificate for Master from Level Three upwards;

b) Have at least 18 months of service time as a Level Three Master.

5. Condition for taking the test to obtain the High Speed Craft Master Certificate Type II: hold a First Class Able Seaman Certificate, First Class Pilot Certificate.

6. Condition for taking the examination to obtain the Professional Competence Certificate for Master Level Four:

a) Hold a First Class Able Seaman Certificate, First Class Pilot Certificate, or Second Class Pilot Certificate;

b) Have at least 18 months of service time. For those who have at least 30 months of actual work experience as a First Class Able Seaman, First Class Pilot, or Second Class Pilot, such experience can be converted equivalently to the required service time to take the examination for the Professional Competence Certificate for Master Level Four.

7. Condition for taking the examination to obtain the Professional Competence Certificate for Master Level Three:

a) Hold a First Class Able Seaman Certificate, First Class Pilot Certificate, or Professional Competence Certificate for Master Level Four;

b) Have at least 18 months of service time. For those who have at least 30 months of actual work experience as a First Class Able Seaman, such experience can be converted equivalently to the required service time to take the examination for the Professional Competence Certificate for Master Level Three.

8. Condition for taking the examination to obtain the Professional Competence Certificate for Chief Engineer Level Three:

a) Hold a First Class Motorman Certificate or Second Class Motorman Certificate;

b) Have at least 18 months of service time. For those who have at least 30 months of actual work experience as a First Class Motorman or Second Class Motorman, such experience can be converted equivalently to the required service time to take the examination for the Professional Competence Certificate for Chief Engineer Level Three.

9. Condition for taking the examination to obtain the Professional Competence Certificate for Master Level Three or Chief Engineer Level Three without attending the corresponding program:

a) Hold a初级职业技能证书,按照船舶驾驶员、水手或轮机员、机工职业进行培训;

c) 作为船长二级或轮机长二级职务,至少有30个月的服务时间。

13. 条件参加船长一级或轮机长一级的专业能力证书考试,无需参加相应课程学习:

a) 持有船舶驾驶员或轮机员高等职业教育毕业证书或以上学历;

b) 完成船长二级或轮机长二级职务至少18个月的见习期。

Chapter III

组织专业能力证书考试及颁发专业证书的检查

 

Article 7. Competence to organize examinations, inspections, issue, reissue, and convert certificates of professional competence, specialized certificates.issue, reissue, convert Director of the Vietnam Inland Waterway Administration:

1. a) Organize examinations, decide on the recognition of examination results, issue, reissue, and convert Certificates of Professional Competence (CPC) for captains and engineers of the first and second classes throughout the country, and CPC for captains from the fourth class upwards and engineers from the third class upwards for vocational training institutions under the Administration.

When reissuing or converting CPCs and SCs, the competent authority must invalidate the original captain's or engineer's license, CPC, or SC by cutting a corner. from third class or higher Article 8. Application forms and procedures for examinations and inspections to obtain certificates of professional competence and specialized certificates.;

1. Individuals who wish to participate in training and examinations to obtain CPCs or inspections to obtain SCs shall submit one set of application forms directly or through postal services or other appropriate means to vocational training institutions or the Department of Transport (for localities without vocational training institutions). The application form includes:b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). a) A request form as stipulated in Appendix III of this Circular;brigadeb) Two (2) color photographs measuring 2x3 cm, taken within six (6) months; c) A health certificate issued by a qualified healthcare facility;

d) A copy with the original for comparison (in case of direct submission) or a certified copy of relevant licenses, CPCs, or SCs, or a notarized translation into Vietnamese (for captain's or engineer's licenses, SCs, or CPCs issued by foreign competent authorities) to prove eligibility for the corresponding type of CPC or SC as prescribed in Articles 5 and 6 of this Circular.

a) Iconduct examinations, issue BB 1.6b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). examination results, |||2. Director of the Department of Transport: Vocational training institutions or the Department of Transport shall accept, review, and process the applications as follows: a) For direct submissions, if the application is complete, they will issue a notice for the procedure to participate in training, examinations, and inspections to obtain CPCs or SCs; if the application is incomplete, they will return it immediately and guide the individual to complete the application; National and GCNKNCM b) For applications received through postal services or other appropriate means, if the application is incomplete, within two (2) working days from the date of receipt, the vocational training institution or the Department of Transport must send a letter requesting the individual to supplement and complete the application;;

c) Within three (3) working days from the date of receiving a complete application, the vocational training institution or the Department of Transport will issue a notice for the procedure to participate in training, examinations, and inspections to obtain CPCs or SCs; d) The competent authority as stipulated in Article 7 of this Circular will organize examinations and inspections and issue CPCs and SCs to candidates who meet the requirements of the examination and inspection period. BB 1.6b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). e) Individuals participating in examinations, inspections, or those authorized to receive CPCs or SCs must present their identity card or passport. issue, reissue vocational certificates (for localities without vocational training facilities) and basic safety training certificate.

3. Head of vocational training facility meeting the required conditions:

a) Iconduct inspections, issue BB 1.6b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). inspection results, issue, reissue, convert vocational certificates and basic safety training certificates.

Article 8. Documents and procedures for taking qualification tests for professional capability certificates and specialty certificates

1. Individuals who wish to enroll in courses, take exams for GCNKNCM, or undergo inspections for CCCM shall submit one set of documents directly or through postal services or other appropriate means to vocational training facilities or Departments of Transport (for localities without vocational training facilities). The documents include:

a) Application form as prescribed in Appendix III of this Circular;

b) Two (2) color photographs measuring 2x3 cm, taken within six (6) months;

c) Health certificate issued by an authorized healthcare facility;

d) Photocopies with originals for verification (in case of direct submission) or certified photocopies of relevant certificates, GCNKNCM, CCCM, or notarized translations into Vietnamese (for master's, engineer's certificates, or specialty certificates, master's or engineer's professional capability certificates issued by foreign authorities) to prove eligibility for the corresponding GCNKNCM, CCCM as stipulated in Articles 5 and 6 of this Circular.

"2. Implementation procedures:"

Vocational training facilities or Departments of Transport shall accept, review, and process the documents as follows:

a) In cases where documents are submitted directly, if the documents are complete, they will be given a receipt for enrollment, examination, and inspection for GCNKNCM, CCCM; if the documents are incomplete according to regulations, they will be returned immediately and individuals will be instructed to complete the documents;

b) In cases where documents are received through postal services or other appropriate means, if the documents are incomplete according to regulations, within two (2) working days from the date of receiving the documents, vocational training facilities or Departments of Transport must send a letter requesting the individual to supplement and complete the documents;

c) Within three (3) working days from the date of receiving complete documents according to regulations, vocational training facilities or Departments of Transport will send a receipt for enrollment, examination, and inspection for GCNKNCM, CCCM;

d) Authorities with competence as stipulated in Article 7 of this Circular shall organize examinations, inspections, and issue GCNKNCM, CCCM to candidates who meet the requirements of the examination and inspection periods;

e) Individuals participating in examinations, inspections, or those with authorization letters to receive GCNKNCM, CCCM must present their identification card or passport;

Article 9. Provisions on organizing classes

Vocational training institution or Department of Transport (for localities without vocational training institutions):

1. Accept applications, examine, and review conditions for enrollment, examination, and assessment as prescribed.

2. Open classes, organize teaching, examination, and evaluate students' learning outcomes according to the prescribed curriculum.

3. Within seven days from the date of commencement, report to the competent authority specified in Article 7 of this Circular:

a) List of eligible students (Report No. 1) reviewed by the head of the vocational training institution in accordance with Appendix IV of this Circular;

b) Training plan for the entire course as prescribed in Appendix V of this Circular.

4. After completing the course, report to the competent authority specified in Article 7 of this Circular:

a) Students' learning outcomes (Report No. 2) reviewed by the head of the vocational training institution in accordance with Appendix VI of this Circular;

b) Plan for organizing examinations and assessments.

5. For CCCM, within ten days before organizing the examination for CCCM issuance, the vocational training institution must submit a written report to the Vietnam Inland Waterway Administration for supervision of the examination sessions; for special CCCM as specified in point b, Clause 3, Article 7 of this Circular, after obtaining the examination results of the students, the vocational training institution sends the examination results to the Vietnam Inland Waterway Administration for the Administration to issue a Decision recognizing the examination results and issuing special CCCM.

Article 10. Organization of Examination for Issuance of Professional Competence Certificate, and Assessment for Issuance of Professional Certificate

1. Upon receiving the examination and assessment plan and students' learning outcomes (Report No. 2), the competent authority specified in Article 7 of this Circular issues a decision to establish the Examination Board and Assessment Board in accordance with Appendix VII of this Circular and directs the implementation of the examination and assessment sessions in accordance with current regulations. The Chairman of the Examination Board and Assessment Board or his authorized representative, and the Secretary of the Examination Board and Assessment Board must be present throughout the organization of the examination and assessment sessions to direct and resolve matters; they may participate in the examination and assessment but shall not grade.

2. The Secretary of the Examination Board and Assessment Board reviews the application files for examination and assessment of candidates; posts the list of eligible candidates for examination and assessment in the examination and assessment rooms; candidates must have sufficient points in all subjects meeting the requirements, having at least 80% of the prescribed theoretical and practical study time, and possessing all valid documents as required in their application files for examination and assessment.

3. The Examination Board and Assessment Board convenes meetings:

a) First session: develop the examination and assessment schedule as prescribed in Appendix IX of this Circular; select examination and assessment questions from the question bank issued by the Vietnam Inland Waterway Administration; assign tasks and propose measures to organize the examination and assessment sessions;

b) Second session: review examination and assessment results as prescribed in Appendix X of this Circular; consider proposals and recommendations and resolve other related issues. Additionally, the Chairman of the Examination Board and Assessment Board may convene extraordinary meetings to address any unusual issues arising during the examination and assessment sessions.

4. At the end of the examination and assessment sessions, the Examination Board and Assessment Board report to the competent authority specified in Article 7 of this Circular:

a) List of examination and assessment results (Report No. 3) as prescribed in Appendix XI of this Circular;

b) Minutes of the first and second Examination Board and Assessment Board meetings as prescribed in Appendices XII and XIII of this Circular;

c) Other documents related to the examination and assessment sessions.

5. Upon receiving the reports from the Examination Board and Assessment Board, the competent authority issues a decision recognizing the examination and assessment results and issuing the Professional Competence Certificate and CCCM (with attached issuance lists) for candidates who meet the examination and assessment requirements as prescribed in Appendix XIV of this Circular. When issuing a higher-grade Professional Competence Certificate, the lower-grade Professional Competence Certificate and CCCM will be invalidated by corner cutting and returned to the individual for personal storage along with the admission file.

6. When issuing the Professional Competence Certificate and CCCM, the competent authority records it in the issuance book for the Professional Competence Certificate and CCCM. The issuance book is bound for each course or multiple courses. Issuance, replacement, reissuance, and conversion of the Professional Competence Certificate and CCCM are regulated in Appendix XV of this Circular.

Article 11. Examination and Inspection Board

1. The Examination and Inspection Board consists of five or seven members.

2. Composition of the Examination Board:

a) The Chairman of the Board is the leader of the competent authority as prescribed in Article 7 of this Circular or a person authorized to act on their behalf;

b) The Vice-Chairman of the Board is the leader of the competent authority or the leader of vocational training institutions;

c) The Secretary Member is a specialist overseeing vocational training work at the competent authority;

d) The remaining Members are specialists from the competent authority or leaders of departments, faculties, and specialized subject groups of vocational training institutions.

3. Composition of the Inspection Board:

a) The Chairman of the Board is the leader of the vocational training institution or the leader of the Department of Transport (for localities without vocational training institutions);

b) The Vice-Chairman of the Board is the leader or head of a department of the vocational training institution or the leader of a specialized department under the Department of Transport (for localities without vocational training institutions);

c) The Secretary Member is the leader of the training department of the vocational training institution or a specialist overseeing vocational training work at the Department of Transport (for localities without vocational training institutions);

d) The remaining Members are leaders of departments, faculties, and specialized subject groups of the vocational training institution or specialists from the Department of Transport (for localities without vocational training institutions).

Article 12. Duties and Authorities of the Examination and Inspection Board

1. Directing and directly organizing examinations and inspections.

2. Deciding to establish the Examination and Inspection Committee in accordance with Appendix VIII of this Circular.

3. Approving candidates who meet the conditions for examination and inspection.

4. Organizing meetings of the Board twice or more as necessary, and only convening when the Chairman or the Vice-Chairman authorized to act on behalf of the Chairman is present, along with at least two-thirds of the Board members. During Board meetings, if there are differing opinions, the majority will prevail; in case of equal opposing views, the Chairman of the Board shall decide.

5. Selecting examination and inspection questions to ensure confidentiality and suitability for each category of GCNKNCM, CCCM.

6. Compiling examination and inspection results and reporting to the competent authority:

a) List of examination and inspection results of candidates;

b) List of successful candidates;

c) Minutes of Board meetings;

d) Other related documents.

Article 13. Examination and Inspection Committee

1. Depending on the number of candidates participating in the examination and inspection, a joint Examination and Inspection Committee may be established or separate committees may be formed, but there must be a minimum of three members. The Head of the Examination and Inspection Committee is a member of the Examination and Inspection Board. Members of the Examination and Inspection Committee are selected from various agencies, units, vocational training institutions, or experienced experts.

2. Duties of the Examination and Inspection Committee:

a) Conducting examinations and inspections in accordance with regulations;

b) Proposing adjustments to the Examination and Inspection Board if errors are found in the examination and inspection questions;

c) Organizing and arranging members of the Examination and Inspection Committee to ensure that each subject has a minimum of two members;

d) Collecting examination and inspection results and handing them over to the Secretary of the Examination and Inspection Board.

3. Qualifications for members of the Examination Committee:

a) Good moral character;

b) Members of the theoretical examination committee must have a professional intermediate degree or higher vocational college degree in the same field of expertise, and have been involved in teaching or working in inland waterway transport for at least twelve months;

c) Members of the practical examination committee for captains and chief engineers must hold a higher GCNKNCM than the GCNKNCM being examined; in the case of examining first-class captains and chief engineers, the members of the examination committee must hold a first-class GCNKNCM for captains and chief engineers and have at least thirty-six months of service experience;

d) Must be trained in examination supervision and marking procedures and be issued an examination supervision and marking card by the Director of the Vietnam Inland Waterways Administration.

4. Qualifications for members of the Inspection Committee are determined by the head of the vocational training institution or the Department of Transport (for localities without vocational training institutions).

Article 14. Subjects of examination, examination format, examination time, inspection

1. The examination board bases on the question bank issued by the Vietnam Inland Waterways Administration to select examination and inspection papers including theoretical and practical subjects.

2. For combined theoretical subjects:

a) Examination format: multiple choice;

b) Examination time: maximum 01 minute/question;

c) Grading: pass or fail;

For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;) Master Mariner Director, Chief Engineer Officer Class I: each paper contains 25 questions, answering correctly 21 out of 25 questions is required to pass;;

d) Master Mariner, Chief Engineer Officer Class II: each paper contains 20 questions, answering correctly 16 out of 20 questions is required to pass;

e) Master Mariner, Chief Engineer Officer Class III: each paper contains 15 questions, answering correctly 11 out of 15 questions is required to pass;

g) Master Mariner Class IV, Vocational Competence Certificate, Specialized Competence Certificate: each paper contains 10 questions, answering correctly 7 out of 10 questions is required to pass.

3. For specialized theoretical subjects:

a) Examination format: oral questioning;

b) Examination time: maximum not exceeding 45 minutes, preparation time for candidates not exceeding 30 minutes, questioning and answering time not exceeding 15 minutes.

4. For practical subjects: the content of the examination includes basic skills in specialized fields, vocational work, and handling common situations in practice. The examination time and method are decided by the examination board.

5. Vietnamese language shall be used throughout the learning, examination, and inspection process.

6. Examination and inspection regulations according to the Law on Vocational Training.

Article 15. Recognition of examination and inspection results

1. The competent authority as prescribed in Article 7 of this Circular:

a) Decides to recognize the examination and inspection results for candidates who have met the requirements for combined theoretical subjects and scored at least 5 points (out of 10) in specialized theoretical subjects and practical examinations;

b) Issues the Vocational Competence Certificate, Specialized Competence Certificate to candidates who meet the examination and inspection requirements within 10 working days from the date of the Decision recognizing the examination and inspection results;

c) Directly or through delegation, the vocational training institution where the candidate registered for study and examination shall issue the Vocational Competence Certificate, Specialized Competence Certificate to candidates who meet the requirements.

2. Candidates who do not meet the requirements may retain their examination and inspection results for combined theoretical subjects and scores of at least 5 points (out of 10) in specialized theoretical subjects and practical examinations for a period of 12 months and may participate in any examination organized by that authority.

Article 16. Archiving of application files for study, examination, inspection, issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates

1. The competent authority as prescribed in Article 7 of this Circular must archive the following documents:

a) List of eligible students (Report No. 1); student academic performance (Report No. 2); list of examination and inspection results (Report No. 3);

b) Decision to establish the Examination Board; Decision to establish the Invigilation and Marking Committee and related documents of the Examination Board; Decision to recognize examination and inspection results and issuance of Vocational Competence Certificates, Specialized Competence Certificates along with the list of certificates issued;

c) Minutes of Examination Board meetings;

d) Record of issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates.

2. For vocational training institutions, in addition to the documents specified in Clause 1 of this Article, they must also archive the following documents:

a) Results of subject inspections;

b) Examination and inspection results of candidates;

c) Related teaching and learning materials and records.

3. For candidates participating in examinations and inspections, they must archive the following documents:

a) Personal application file for study, examination, and inspection;

b) Old versions of Master Mariner, Chief Engineer Officer certificates, Vocational Competence Certificates, Specialized Competence Certificates with corners cut off (if applicable).

4. Archiving of issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates:

a) Competent authorities issuing, reissuing, and converting Vocational Competence Certificates, Specialized Competence Certificates must archive the record of issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates;

b) Individuals must self-archive the issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates.

5. The archiving period for application files for study, examination, inspection, issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates shall comply with current regulations.

Chapter IV

ISSUANCE, REISSUANCE, AND CONVERSION OF VOCATIONAL COMPETENCE CERTIFICATES, SPECIALIZED COMPETENCE CERTIFICATES

VOCATIONAL COMPETENCE CERTIFICATES, SPECIALIZED COMPETENCE CERTIFICATES

Article 17. Issuance of Professional Competence Certificates and Specialized Certificates

1. Issuance of Basic Safety Training Certificate:

a) Completing one of the training programs, supplementary training, or vocational improvement programs as stipulated in this Circular.

b) Individuals holding vocational certificates issued before January 1, 2015, listed in the certificate issuance record book of the issuing authority, shall be issued a basic safety training certificate at vocational training institutions.

2. Issuance of Professional Competence Certificate for Third-Class Master Mariners and Third-Class Chief Engineers:

a) Possessing a third-class master mariner or third-class chief engineer vocational certificate or having graduated from a vocational secondary school or specialized secondary school trained in ship navigation or marine engineering occupations;

b) Completing the probationary period according to the position of third-class master mariner or third-class chief engineer for at least six months.

3. Issuance of Professional Competence Certificate for Second-Class Master Mariners and Second-Class Chief Engineers:

a) Holding a diploma from a vocational college or higher education institution trained in ship navigation or marine engineering occupations;

b) Completing the probationary period according to the position of second-class master mariner or second-class chief engineer for at least six months.

Article 18. Reissuance of Professional Competence Certificates and Specialized Certificates

1. Individuals whose Professional Competence Certificates or Specialized Certificates are damaged and listed in the certificate issuance record book of the issuing authority shall be reissued such certificates.

2. Master Mariner and Chief Engineer Licenses:

a) Individuals holding master mariner or chief engineer licenses that have exceeded their validity period by twelve months since December 31, 2019, and listed in the license issuance record book of the issuing authority, may retake the theoretical examination to obtain a reissued Professional Competence Certificate;

b) Individuals holding master mariner or chief engineer licenses that have exceeded their validity period by more than twelve but less than twenty-four months since December 31, 2019, and listed in the license issuance record book of the issuing authority, must retake both theoretical and practical examinations to obtain a reissued Professional Competence Certificate;

c) Individuals holding master mariner or chief engineer licenses that have exceeded their validity period by twenty-four months or more since December 31, 2019, and listed in the license issuance record book of the issuing authority, must undergo training and take the examination to obtain a corresponding Professional Competence Certificate based on the type and level of the previously issued license.

3. Professional Competence Certificate:

a) Individuals holding a Professional Competence Certificate within three months prior to its expiration date or exceeding its validity period by three months, and listed in the certificate issuance record book of the issuing authority, may be reissued a Professional Competence Certificate;

b) Individuals holding a Professional Competence Certificate that has exceeded its validity period by three to six months, and listed in the certificate issuance record book of the issuing authority, must retake the theoretical examination to obtain a reissued Professional Competence Certificate;

c) Individuals holding a Professional Competence Certificate that has exceeded its validity period by six to twelve months, and listed in the certificate issuance record book of the issuing authority, must retake both theoretical and practical examinations to obtain a reissued Professional Competence Certificate;

d) Individuals holding a Professional Competence Certificate that has exceeded its validity period by twelve months or more, and listed in the certificate issuance record book of the issuing authority, must undergo training and take the examination to obtain a corresponding Professional Competence Certificate based on the type and level of the previously issued certificate.

4. Individuals whose Professional Competence Certificates are still valid but lost, and listed in the certificate issuance record book of the issuing authority, and not confiscated or processed by competent authorities, shall be reissued a Professional Competence Certificate within thirty working days from the date of receiving complete application files as prescribed.

5. Individuals whose Professional Competence Certificates have exceeded their validity period and are lost, and listed in the certificate issuance record book of the issuing authority, and not confiscated or processed by competent authorities, must undergo training and take the examination to obtain a corresponding Professional Competence Certificate based on the type and level of the previously issued certificate.

6. When reissuing a Professional Competence Certificate or Specialized Certificate, the original number remains unchanged, while the issuing authority must notify relevant agencies to cancel the old Professional Competence Certificate or Specialized Certificate.

7Individuals holding a Professional Competence Certificate for Master Mariners from Class Four upwards who wish toobtain ||| a First-Class Seafarer License.

Article 19. Master Mariner Licenses, Chief Engineer Licenses, and Specialized Certificates already issued

1. Individuals holding a Master Mariner License or Chief Engineer License issued before January 1, 2015, continue to be valid until December 31, 2019, and listed in the license issuance record book of the issuing authority shall be reissued Professional Competence Certificates or Specialized Certificates, 2. Master Mariner Licenses, Chief Engineer Licenses, and Specialized Certificates already issued shall be reissued as follows:.

a) Individuals holding a First-Class Master Mariner or First-Class Chief Engineer License shall be reissued a First-Class Master Mariner or First-Class Chief Engineer Professional Competence Certificate;

b) Individuals holding a Second-Class Master Mariner or Second-Class Chief Engineer License shall be reissued a Second-Class Master Mariner or Second-Class Chief Engineer Professional Competence Certificate; c) Individuals holding a Third-Class Master Mariner or Third-Class Chief Engineer License shall be reissued a Third-Class Master Mariner or Third-Class Chief Engineer Professional Competence Certificate; d) Individuals holding a Limited Third-Class Master Mariner License shall be reissued a Fourth-Class Master Mariner Professional Competence Certificate;

đ) Individuals holding a Seafarer Certificate shall be reissued a First-Class Seafarer Certificate;

e) Individuals holding a Limited Seafarer Program Certificate shall be reissued a Second-Class Seafarer Certificate;

g) Individuals holding a Marine Engineer Certificate shall be reissued a First-Class Marine Engineer Certificate;

h) Individuals holding a Limited Marine Engineer Program Certificate shall be reissued a Second-Class Marine Engineer Certificate;

i) Individuals holding a Vessel Operator Certificate shall be reissued a First-Class Vessel Operator Certificate;

k) Individuals holding a Limited Vessel Operator Program Certificate shall be reissued a Second-Class Vessel Operator Certificate.

h) Individuals holding limited program engine operator certificates may have their second-class engine operator certificates reissued;

i) Individuals holding vehicle driver certificates may have their first-class vehicle driver certificates reissued;

k) Individuals holding limited program vehicle driver certificates may have their second-class vehicle driver certificates reissued.

Article 20. Conversion of certificates of professional competence, professional certificates

1. Persons holding a captain's degree, chief engineer's degree, or certificate for captain or chief engineer issued by competent authorities of Vietnam; foreign persons or Vietnamese residing abroad holding a captain's degree, chief engineer's degree, or certificate for captain or chief engineer issued by competent authorities of foreign countries, if they wish to work on inland waterway vessels, must go through procedures to convert their certificates to certificates of professional competence for captains and chief engineers, and professional certificates for inland waterway vessels according to the provisions of this Circular.

2. For captain and chief engineer certificates, fishing vessel professional certificates:

a) Persons holding a fourth-class fishing vessel captain or chief engineer certificate with a power of 400 cv or more, who have served in the position of fourth-class fishing vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for second-class inland waterway vessel captains and chief engineers but must take corresponding examinations for second-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

b) Persons holding a fifth-class fishing vessel captain certificate with a power from 90 cv to less than 400 cv, who have served in the position of fifth-class fishing vessel captain for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel captains but must take corresponding examinations for third-class inland waterway vessel captains and meet the requirements set forth.

c) Persons holding a fifth-class fishing vessel chief engineer certificate with a power from 90 cv to less than 400 cv, who have served in the position of fifth-class fishing vessel chief engineer for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel chief engineers.

d) Persons holding a small fishing vessel captain certificate with a power from 20 cv to less than 90 cv, who have served in the position of small fishing vessel captain for at least six months, may convert their certificates to certificates of professional competence for fourth-class inland waterway vessel captains but must take corresponding examinations for fourth-class inland waterway vessel captains and meet the requirements set forth.

đ) Persons holding a small fishing vessel chief engineer certificate with a power from 20 cv to less than 90 cv, who have served in the position of small fishing vessel chief engineer for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel chief engineers but must complete the supplementary chief engineer training program for third-class inland waterway vessel chief engineers and meet the requirements set forth.

e) Persons holding a fishing vessel seaman or engine room rating certificate may convert their certificates to first-class inland waterway vessel seaman or engine room rating certificates but must undergo corresponding examinations for first-class inland waterway vessel seaman or engine room rating certificates and meet the requirements set forth.

g) Persons holding a fishing vessel captain certificate from small class upwards and aged 55 years or older for women and 60 years or older for men, meeting the health requirements, may convert their certificates to first-class inland waterway vessel master certificates but must undergo corresponding examinations for first-class inland waterway vessel master certificates and meet the requirements set forth.

3. For captain and chief engineer certificates, marine vessel professional certificates:

a) Persons holding a college vocational degree or higher education degree trained in marine vessel operation or marine vessel machinery operation, possessing a marine vessel captain certificate with a gross tonnage of 500 GT or more or a marine vessel chief engineer certificate with a power of 750 kW or more, who have served in the position of marine vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for first-class inland waterway vessel captains and chief engineers but must take corresponding examinations for first-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

b) Persons holding a secondary vocational school degree or secondary education degree trained in marine vessel operation or marine vessel machinery operation, possessing a marine vessel captain certificate with a gross tonnage from 50 GT to less than 500 GT or a marine vessel chief engineer certificate with a power from 75 kW to less than 750 kW, who have served in the position of marine vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for second-class inland waterway vessel captains and chief engineers but must take corresponding examinations for second-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

c) Persons holding a marine vessel captain certificate with a gross tonnage under 50 GT or a marine vessel chief engineer certificate with a power under 75 kW, who have served in the position of marine vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel captains and chief engineers but must study to take corresponding examinations for third-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

d) Persons holding a marine vessel captain certificate with a gross tonnage under 50 GT, who have served in the position of marine vessel captain for at least six months, may convert their certificates to certificates of professional competence for fourth-class inland waterway vessel captains but must take corresponding examinations for fourth-class inland waterway vessel captains and meet the requirements set forth.

đ) Persons holding a marine vessel seaman or engine room rating certificate may convert their certificates to first-class inland waterway vessel seaman or engine room rating certificates but must undergo corresponding examinations for first-class inland waterway vessel seaman or engine room rating certificates and meet the requirements set forth.

e) Persons holding a marine vessel captain certificate with a gross tonnage of 50 GT or more and aged 55 years or older for women and 60 years or older for men, meeting the health requirements, may convert their certificates to first-class inland waterway vessel master certificates but must undergo corresponding examinations for first-class inland waterway vessel master certificates and meet the requirements set forth.

Article 21. Documents and Procedures for Issuing, Reissuing, and Converting Professional Competence Certificates and Specialized Certificates

1. Individuals who need to apply for issuance, reissuance, or conversion of Professional Competence Certificates (GCNKNCM) and Specialized Certificates (CCCM) shall submit one (1) set of documents directly or through the postal service or other appropriate means to the Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution as stipulated in Article 7 of this Circular. The documents include:

a) Application form according to the model prescribed in Appendix III of this Circular;

b) Two (2) color photographs measuring 2x3 cm, taken within six (6) months;

c) Health certificate issued by an authorized healthcare facility;

d) A copy with the original for verification (in case of direct submission) or a certified copy of relevant certificates, GCNKNCM, CCCM, or a notarized translation into Vietnamese (for captain, engineer certificates or specialized CCCM issued by competent authorities of foreign countries) to prove compliance with the conditions for issuance, reissuance, or conversion of the corresponding GCNKNCM and CCCM as prescribed in Articles 17, 18, 19, and 20 of this Circular.

"2. Implementation procedures:"

The Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution shall receive, examine, and process the documents as follows:

a) In cases where documents are submitted directly, if the documents are complete, they will issue a receipt for the result and proceed with the issuance, reissuance, or conversion; if the documents are incomplete, they will return them immediately and guide the individual to complete the documents;

b) In cases where documents are received through the postal service or other appropriate means, if the documents are incomplete, within two (2) working days from the date of receiving the documents, the Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution must send a letter requesting the individual to supplement and complete the documents;

c) Within five (5) working days from the date of receiving all required documents, the Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution shall issue, reissue, or convert the GCNKNCM and CCCM.

Chapter V

ASSUMPTION OF CAPTAIN AND ENGINEER TITLES

INLAND WATERWAY VESSELS

Article 22. Assumption of Captain and Engineer Titles

1. Seafarers holding a First-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) Passenger ships with a capacity exceeding 100 persons;

b) Ferries with a total deadweight of over 150 tons;

c) Cargo vessels with a total deadweight of over 500 tons;

d) Towboat fleets with a total deadweight of over 1000 tons;

đ) Vessels not specified in points a, b, c, and d of Clause 1 of this Article with a total engine power exceeding 400 horsepower.

2. Seafarers holding a Second-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) Passenger ships with a capacity from over 50 to 100 persons;

b) Ferries with a total deadweight from over 50 to 150 tons;

c) Cargo vessels with a total deadweight from over 150 to 500 tons;

d) Towboat fleets with a total deadweight from over 400 to 1000 tons;

đ) Vessels not specified in points a, b, c, and d of Clause 2 of this Article with a total engine power from over 150 to 400 horsepower.

3. Seafarers holding a Third-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) Passenger ships with a capacity from over 12 to 50 persons;

b) Ferries with a total deadweight up to 50 tons;

c) Cargo vessels with a total deadweight from over 15 to 150 tons;

d) Towboat fleets with a total deadweight up to 400 tons;

đ) Vessels not specified in points a, b, c, and d of Clause 3 of this Article with a total engine power from over 15 to 150 horsepower.

4. Seafarers holding a Fourth-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) River passenger vessels with a capacity up to 50 persons;

b) Cargo vessels with a total deadweight up to 50 tons;

c) Vessels with main engine power up to 50 horsepower.

5. Seafarers holding a Professional Competence Certificate (GCNKNCM) for a higher-class Captain may assume the title of Captain on vessels specified for a lower-class Captain.

6. Seafarers holding a Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Chief Officer on vessels specified for a higher-class Captain.

7. Seafarers holding a First-Class Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Engineer on vessels with a total engine power exceeding 400 horsepower.

8. Seafarers holding a Second-Class Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Engineer on vessels with a total engine power from over 150 to 400 horsepower.

9. Seafarers holding a Third-Class Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Engineer on vessels with a total engine power from over 15 to 150 horsepower.

10. Seafarers holding a Professional Competence Certificate (GCNKNCM) for a higher-class Engineer may assume the title of Engineer on vessels specified for a lower-class Engineer.

11. Seafarers holding a Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Assistant Engineer on vessels specified for a higher-class Engineer.

12. Vessels equipped with external engines with a total engine power up to 150 horsepower or internal engines with a total engine power up to 50 horsepower do not necessarily require the position of Engineer. If the Engineer position is not independently assigned, the Captain must hold a First-Class Engine Room Rating Certificate. For vessels equipped with external engines with a total engine power from over 150 to 400 horsepower, if the Engineer position is not independently assigned, the Captain must hold a Professional Competence Certificate (GCNKNCM) for Engineer suitable for the total engine power.

Article 23. Assumption of Other Seafarer Positions

1. A person holding a certain type of vocational certificate may only be permitted to assume the corresponding position as prescribed.

2. For operators of Class I and II high-speed vessels, coastal vessels, persons working on coastal vessels, vessels carrying petroleum products, chemicals, liquefied gases, in addition to the GCNKNCM and the vocational certificate specified for their position, must also possess a special CCCM corresponding to their role.

Article 24. Allocation of Seafarer Positions

1. The owner of the vessel is responsible for allocating sufficient positions and crew complements for work on inland waterway vessels and must establish a seafarer logbook in accordance with the regulations, complying with this Circular and relevant laws.

2. GCNKNCM and CCCM must be carried by the holder when practicing their profession.

Chapter VI

IMPLEMENTING PROVISIONS

Article 25. Reporting System

1. On the 20th day of each month, vocational training institutions shall report to the Department of Transport of provinces and centrally administered cities and the Vietnam Inland Waterways Administration on the results of seafarer training, vessel operators, and the issuance, reissuance, and conversion of vocational certificates as stipulated in Appendix XVI of this Circular.

2. On the 25th day of each month, the Department of Transport of provinces and centrally administered cities shall report to the Vietnam Inland Waterways Administration on the results of seafarer training, vessel operators, and the issuance, reissuance, and conversion of GCNKNCM and CCCM within their jurisdiction as stipulated in Appendix XVII of this Circular.

Article 26. Implementation

Pursuant to the Law on Inland Waterway Transport dated June 15, 2004 and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport dated June 17, 2014;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Vietnam Inland Waterway Administration, hereby promulgates this Circular stipulating examination, inspection, issuance, reissuance, and conversion

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

(hereinafter referred to as GCNKNCM, CCCM) for seafarers, operators of inland waterway vessels, and assuming the position of seafarer on inland waterway vessels.professional certificate 1. This Circular applies to agencies, organizations, and individuals related to the examination, inspection, issuance, reissuance, and conversion of GCNKNCM, CCCM for seafarers, operators of inland waterway vessels, and assuming the position of seafarer on inland waterway vessels.

Article 2. Applicability

2. This Circular does not apply to agencies, organizations, and individuals related to the examination, inspection, issuance, reissuance, and conversion of GCNKNCM, CCCM for seafarers, operators of inland waterway vessels performing security and defense duties.

Professional time

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. is the working time according to the position on inland waterway vessels. is the training time on inland waterway vessels according to the trained position under the guidance of a person with appropriate technical expertise.

2. Probationary period Certificate of professional capability for master, chief engineer

3. is the certificate proving the capability to assume the position of master, chief engineer on inland waterway vessels. Basic safety training certificate

4. is the certificate proving the capability to handle issues related to labor safety, vessel safety, fire prevention, first aid for injured persons, and environmental protection. Professional certificate

5. is the certificate proving the capability to assume the position of able seaman, engine room rating, or vessel operator. Special professional certificate

6. is the certificate proving the capability to work safely on coastal vessels, vessels carrying petroleum products, chemical vessels, or liquefied gas carriers; capable of controlling vessels type I high-speed, type II high-speed, or coastal vessels. Type I high-speed vessel

7. is the vessel defined in Clause 1, Article 24 of the Law on Inland Waterway Transport 2004 amended and supplemented in Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport 2014 and having a design speed of 30 km/h or more. Type II high-speed vessel

8. is the vessel defined in Clauses 2 and 3, Article 24 of the Law on Inland Waterway Transport 2004 amended and supplemented in Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport 2014 and having a design speed of 30 km/h or more. Coastal vessel

Chapter II

TO TAKE THE EXAMINATION FOR

 PROFESSIONAL CERTIFICATE

PROFESSIONAL CAPABILITY, CONDUCTING QUALIFICATION TESTS FOR

 SPECIALTY CERTIFICATEN |||

Article 4. Professional Competence Certificate, Specialized Certificate

1. The Professional Competence Certificate for Master is divided into four levels: Level One (T1), Level Two (T2), Level Three (T3), Level Four (T4).

2. The Professional Competence Certificate for Chief Engineer is divided into three levels: Level One (M1), Level Two (M2), Level Three (M3).

3. Basic Safety Training Certificate (BSTC).

4. Service Certificates:

a) First Class Able Seaman Certificate (AS1), Second Class Able Seaman Certificate (AS2);

b) First Class Motorman Certificate (MM1), Second Class Motorman Certificate (MM2);

c) First Class Pilot Certificate (PC1), Second Class Pilot Certificate (PC2).

5. Specialized Certificates:

a) High Speed Craft Master Certificate Type I (HSCMC I);

b) High Speed Craft Master Certificate Type II (HSCMC II);

c) Coastal Navigation Vessel Master Certificate (CNVM);

d) Coastal Navigation Vessel Safety Work Certificate (CNSWC);

đ) Petroleum Carrier Safety Work Certificate (PCS);

e) Chemical Carrier Safety Work Certificate (CCS);

g) Liquefied Gas Carrier Safety Work Certificate (LGCS).

6The Professional Competence Certificate and Specialized Certificate issued to seafarers and inland waterway vessel operators shall be in accordance with the model set out in Appendix I of this Circular. stipulating at Appendix I of this Circular.

Article 5. General Conditions for Taking Examinations and Tests to Obtain the Professional Competence Certificate and Specialized Certificate

1. Being a Vietnamese citizen or a foreigner permitted to reside or work legally in Vietnam.

2. Completing the corresponding vocational training, supplementary, and upgrading programs for each type and level of Professional Competence Certificate and Specialized Certificate (except for specific cases stipulated in Clauses 9, 11, and 13 of Article 6 of this Circular).

3. Meeting the age requirement and having sufficient service time and apprenticeship period up to the date of the examination and test board decision as specified in Article 6 of this Circular.

4. Having a health certificate issued bya competent medical facility authorized healthcare facility |||.

Article 6. Specific Conditions for Taking Examinations and Tests to Obtain the Professional Competence Certificate and Specialized Certificate

In addition to the general conditions prescribed in Article 5 of this Circular, candidates for examinations and tests to obtain the Professional Competence Certificate and Specialized Certificate must also meet the following specific conditions:

1. Condition for taking the test to obtain the First Class and Second Class Able Seaman Certificate, First Class and Second Class Motorman Certificate: at least 16 years old.

2. Condition for taking the test to obtain the First Class and Second Class Pilot Certificate: at least 18 years old.

3. Condition for taking the test to obtain the Safety Work Certificate on Coastal Navigation Vessels, Petroleum Carriers, Chemical Carriers, and Liquefied Gas Carriers:

4. For investment projects specified in Clause 5, Article 38 of this Decree:a) At least 18 years old;

b) Hold a First Class Able Seaman Certificate, First Class Motorman Certificate, or First Class Pilot Certificate.

4. Condition for taking the test to obtain the High Speed Craft Master Certificate Type I, Coastal Navigation Vessel Master Certificate:

: Total cost of electricity purchase for the year (VND) from direct and indirect power plants participating in the electricity market, as specified in Clause 2 of this Article;a) Hold a Professional Competence Certificate for Master from Level Three upwards;

b) Have at least 18 months of service time as a Level Three Master.

5. Condition for taking the test to obtain the High Speed Craft Master Certificate Type II: hold a First Class Able Seaman Certificate, First Class Pilot Certificate.

6. Condition for taking the examination to obtain the Professional Competence Certificate for Master Level Four:

a) Hold a First Class Able Seaman Certificate, First Class Pilot Certificate, or Second Class Pilot Certificate;

b) Have at least 18 months of service time. For those who have at least 30 months of actual work experience as a First Class Able Seaman, First Class Pilot, or Second Class Pilot, such experience can be converted equivalently to the required service time to take the examination for the Professional Competence Certificate for Master Level Four.

7. Condition for taking the examination to obtain the Professional Competence Certificate for Master Level Three:

a) Hold a First Class Able Seaman Certificate, First Class Pilot Certificate, or Professional Competence Certificate for Master Level Four;

b) Have at least 18 months of service time. For those who have at least 30 months of actual work experience as a First Class Able Seaman, such experience can be converted equivalently to the required service time to take the examination for the Professional Competence Certificate for Master Level Three.

8. Condition for taking the examination to obtain the Professional Competence Certificate for Chief Engineer Level Three:

a) Hold a First Class Motorman Certificate or Second Class Motorman Certificate;

b) Have at least 18 months of service time. For those who have at least 30 months of actual work experience as a First Class Motorman or Second Class Motorman, such experience can be converted equivalently to the required service time to take the examination for the Professional Competence Certificate for Chief Engineer Level Three.

9. Condition for taking the examination to obtain the Professional Competence Certificate for Master Level Three or Chief Engineer Level Three without attending the corresponding program:

a) Hold a初级职业技能证书,按照船舶驾驶员、水手或轮机员、机工职业进行培训;

b) 完成至少六个月的见习期。

10. 条件参加船长二级或轮机长二级的专业能力证书考试:持有船长三级或轮机长三级的专业能力证书,并且有至少18个月的服务时间,或者持有船长三级或轮机长三级的职业技能证书并且完成至少12个月的见习期。 third-class master or third-class engineer and having completed at least twelve months of apprenticeship.

12. 条件参加船长一级或轮机长一级的专业能力证书考试:

a) 持有高中毕业证书或同等学历;

b) 持有船长二级或轮机长二级的专业能力证书;

c) 作为船长二级或轮机长二级职务,至少有30个月的服务时间。

13. 条件参加船长一级或轮机长一级的专业能力证书考试,无需参加相应课程学习:

a) 持有船舶驾驶员或轮机员高等职业教育毕业证书或以上学历;

b) 完成船长二级或轮机长二级职务至少18个月的见习期。

Chapter III

组织专业能力证书考试及颁发专业证书的检查

 

Article 7. Competence to organize examinations, inspections, issue, reissue, and convert certificates of professional competence, specialized certificates.issue, reissue, convert Director of the Vietnam Inland Waterway Administration:

1. a) Organize examinations, decide on the recognition of examination results, issue, reissue, and convert Certificates of Professional Competence (CPC) for captains and engineers of the first and second classes throughout the country, and CPC for captains from the fourth class upwards and engineers from the third class upwards for vocational training institutions under the Administration.

When reissuing or converting CPCs and SCs, the competent authority must invalidate the original captain's or engineer's license, CPC, or SC by cutting a corner. from third class or higher Article 8. Application forms and procedures for examinations and inspections to obtain certificates of professional competence and specialized certificates.;

1. Individuals who wish to participate in training and examinations to obtain CPCs or inspections to obtain SCs shall submit one set of application forms directly or through postal services or other appropriate means to vocational training institutions or the Department of Transport (for localities without vocational training institutions). The application form includes:b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). a) A request form as stipulated in Appendix III of this Circular;brigadeb) Two (2) color photographs measuring 2x3 cm, taken within six (6) months; c) A health certificate issued by a qualified healthcare facility;

d) A copy with the original for comparison (in case of direct submission) or a certified copy of relevant licenses, CPCs, or SCs, or a notarized translation into Vietnamese (for captain's or engineer's licenses, SCs, or CPCs issued by foreign competent authorities) to prove eligibility for the corresponding type of CPC or SC as prescribed in Articles 5 and 6 of this Circular.

a) Iconduct examinations, issue BB 1.6b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). examination results, |||2. Director of the Department of Transport: Vocational training institutions or the Department of Transport shall accept, review, and process the applications as follows: a) For direct submissions, if the application is complete, they will issue a notice for the procedure to participate in training, examinations, and inspections to obtain CPCs or SCs; if the application is incomplete, they will return it immediately and guide the individual to complete the application; National and GCNKNCM b) For applications received through postal services or other appropriate means, if the application is incomplete, within two (2) working days from the date of receipt, the vocational training institution or the Department of Transport must send a letter requesting the individual to supplement and complete the application;;

c) Within three (3) working days from the date of receiving a complete application, the vocational training institution or the Department of Transport will issue a notice for the procedure to participate in training, examinations, and inspections to obtain CPCs or SCs; d) The competent authority as stipulated in Article 7 of this Circular will organize examinations and inspections and issue CPCs and SCs to candidates who meet the requirements of the examination and inspection period. BB 1.6b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). e) Individuals participating in examinations, inspections, or those authorized to receive CPCs or SCs must present their identity card or passport. issue, reissue vocational certificates (for localities without vocational training facilities) and basic safety training certificate.

3. Head of vocational training facility meeting the required conditions:

a) Iconduct inspections, issue BB 1.6b) Decide on inspection results, issue, reissue, and convert Specialized Certificates (SC). inspection results, issue, reissue, convert vocational certificates and basic safety training certificates.

b) Tconduct inspections c) A health certificate issued by a qualified healthcare facility;

4Which authority has the competence ||| GCNKNCM, CCCM then that authority shall implement reissuance, conversion GCNKNCM, CCCM. When reissuing, converting GCNKNCM, CCCM, the competent authority must invalidate the original master's, engineer's, GCNKNCM, CCCM certificates by cutting the corners.

Article 8. Documents and procedures for taking qualification tests for professional capability certificates and specialty certificates

1. Individuals who wish to enroll in courses, take exams for GCNKNCM, or undergo inspections for CCCM shall submit one set of documents directly or through postal services or other appropriate means to vocational training facilities or Departments of Transport (for localities without vocational training facilities). The documents include:

a) Application form as prescribed in Appendix III of this Circular;

b) Two (2) color photographs measuring 2x3 cm, taken within six (6) months;

c) Health certificate issued by an authorized healthcare facility;

d) Photocopies with originals for verification (in case of direct submission) or certified photocopies of relevant certificates, GCNKNCM, CCCM, or notarized translations into Vietnamese (for master's, engineer's certificates, or specialty certificates, master's or engineer's professional capability certificates issued by foreign authorities) to prove eligibility for the corresponding GCNKNCM, CCCM as stipulated in Articles 5 and 6 of this Circular.

"2. Implementation procedures:"

Vocational training facilities or Departments of Transport shall accept, review, and process the documents as follows:

a) In cases where documents are submitted directly, if the documents are complete, they will be given a receipt for enrollment, examination, and inspection for GCNKNCM, CCCM; if the documents are incomplete according to regulations, they will be returned immediately and individuals will be instructed to complete the documents;

b) In cases where documents are received through postal services or other appropriate means, if the documents are incomplete according to regulations, within two (2) working days from the date of receiving the documents, vocational training facilities or Departments of Transport must send a letter requesting the individual to supplement and complete the documents;

c) Within three (3) working days from the date of receiving complete documents according to regulations, vocational training facilities or Departments of Transport will send a receipt for enrollment, examination, and inspection for GCNKNCM, CCCM;

d) Authorities with competence as stipulated in Article 7 of this Circular shall organize examinations, inspections, and issue GCNKNCM, CCCM to candidates who meet the requirements of the examination and inspection periods;

e) Individuals participating in examinations, inspections, or those with authorization letters to receive GCNKNCM, CCCM must present their identification card or passport;

Article 9. Provisions on organizing classes

Vocational training institution or Department of Transport (for localities without vocational training institutions):

1. Accept applications, examine, and review conditions for enrollment, examination, and assessment as prescribed.

2. Open classes, organize teaching, examination, and evaluate students' learning outcomes according to the prescribed curriculum.

3. Within seven days from the date of commencement, report to the competent authority specified in Article 7 of this Circular:

a) List of eligible students (Report No. 1) reviewed by the head of the vocational training institution in accordance with Appendix IV of this Circular;

b) Training plan for the entire course as prescribed in Appendix V of this Circular.

4. After completing the course, report to the competent authority specified in Article 7 of this Circular:

a) Students' learning outcomes (Report No. 2) reviewed by the head of the vocational training institution in accordance with Appendix VI of this Circular;

b) Plan for organizing examinations and assessments.

5. For CCCM, within ten days before organizing the examination for CCCM issuance, the vocational training institution must submit a written report to the Vietnam Inland Waterway Administration for supervision of the examination sessions; for special CCCM as specified in point b, Clause 3, Article 7 of this Circular, after obtaining the examination results of the students, the vocational training institution sends the examination results to the Vietnam Inland Waterway Administration for the Administration to issue a Decision recognizing the examination results and issuing special CCCM.

Article 10. Organization of Examination for Issuance of Professional Competence Certificate, and Assessment for Issuance of Professional Certificate

1. Upon receiving the examination and assessment plan and students' learning outcomes (Report No. 2), the competent authority specified in Article 7 of this Circular issues a decision to establish the Examination Board and Assessment Board in accordance with Appendix VII of this Circular and directs the implementation of the examination and assessment sessions in accordance with current regulations. The Chairman of the Examination Board and Assessment Board or his authorized representative, and the Secretary of the Examination Board and Assessment Board must be present throughout the organization of the examination and assessment sessions to direct and resolve matters; they may participate in the examination and assessment but shall not grade.

2. The Secretary of the Examination Board and Assessment Board reviews the application files for examination and assessment of candidates; posts the list of eligible candidates for examination and assessment in the examination and assessment rooms; candidates must have sufficient points in all subjects meeting the requirements, having at least 80% of the prescribed theoretical and practical study time, and possessing all valid documents as required in their application files for examination and assessment.

3. The Examination Board and Assessment Board convenes meetings:

a) First session: develop the examination and assessment schedule as prescribed in Appendix IX of this Circular; select examination and assessment questions from the question bank issued by the Vietnam Inland Waterway Administration; assign tasks and propose measures to organize the examination and assessment sessions;

b) Second session: review examination and assessment results as prescribed in Appendix X of this Circular; consider proposals and recommendations and resolve other related issues. Additionally, the Chairman of the Examination Board and Assessment Board may convene extraordinary meetings to address any unusual issues arising during the examination and assessment sessions.

4. At the end of the examination and assessment sessions, the Examination Board and Assessment Board report to the competent authority specified in Article 7 of this Circular:

a) List of examination and assessment results (Report No. 3) as prescribed in Appendix XI of this Circular;

b) Minutes of the first and second Examination Board and Assessment Board meetings as prescribed in Appendices XII and XIII of this Circular;

c) Other documents related to the examination and assessment sessions.

5. Upon receiving the reports from the Examination Board and Assessment Board, the competent authority issues a decision recognizing the examination and assessment results and issuing the Professional Competence Certificate and CCCM (with attached issuance lists) for candidates who meet the examination and assessment requirements as prescribed in Appendix XIV of this Circular. When issuing a higher-grade Professional Competence Certificate, the lower-grade Professional Competence Certificate and CCCM will be invalidated by corner cutting and returned to the individual for personal storage along with the admission file.

6. When issuing the Professional Competence Certificate and CCCM, the competent authority records it in the issuance book for the Professional Competence Certificate and CCCM. The issuance book is bound for each course or multiple courses. Issuance, replacement, reissuance, and conversion of the Professional Competence Certificate and CCCM are regulated in Appendix XV of this Circular.

Article 11. Examination and Inspection Board

1. The Examination and Inspection Board consists of five or seven members.

2. Composition of the Examination Board:

a) The Chairman of the Board is the leader of the competent authority as prescribed in Article 7 of this Circular or a person authorized to act on their behalf;

b) The Vice-Chairman of the Board is the leader of the competent authority or the leader of vocational training institutions;

c) The Secretary Member is a specialist overseeing vocational training work at the competent authority;

d) The remaining Members are specialists from the competent authority or leaders of departments, faculties, and specialized subject groups of vocational training institutions.

3. Composition of the Inspection Board:

a) The Chairman of the Board is the leader of the vocational training institution or the leader of the Department of Transport (for localities without vocational training institutions);

b) The Vice-Chairman of the Board is the leader or head of a department of the vocational training institution or the leader of a specialized department under the Department of Transport (for localities without vocational training institutions);

c) The Secretary Member is the leader of the training department of the vocational training institution or a specialist overseeing vocational training work at the Department of Transport (for localities without vocational training institutions);

d) The remaining Members are leaders of departments, faculties, and specialized subject groups of the vocational training institution or specialists from the Department of Transport (for localities without vocational training institutions).

Article 12. Duties and Authorities of the Examination and Inspection Board

1. Directing and directly organizing examinations and inspections.

2. Deciding to establish the Examination and Inspection Committee in accordance with Appendix VIII of this Circular.

3. Approving candidates who meet the conditions for examination and inspection.

4. Organizing meetings of the Board twice or more as necessary, and only convening when the Chairman or the Vice-Chairman authorized to act on behalf of the Chairman is present, along with at least two-thirds of the Board members. During Board meetings, if there are differing opinions, the majority will prevail; in case of equal opposing views, the Chairman of the Board shall decide.

5. Selecting examination and inspection questions to ensure confidentiality and suitability for each category of GCNKNCM, CCCM.

6. Compiling examination and inspection results and reporting to the competent authority:

a) List of examination and inspection results of candidates;

b) List of successful candidates;

c) Minutes of Board meetings;

d) Other related documents.

Article 13. Examination and Inspection Committee

1. Depending on the number of candidates participating in the examination and inspection, a joint Examination and Inspection Committee may be established or separate committees may be formed, but there must be a minimum of three members. The Head of the Examination and Inspection Committee is a member of the Examination and Inspection Board. Members of the Examination and Inspection Committee are selected from various agencies, units, vocational training institutions, or experienced experts.

2. Duties of the Examination and Inspection Committee:

a) Conducting examinations and inspections in accordance with regulations;

b) Proposing adjustments to the Examination and Inspection Board if errors are found in the examination and inspection questions;

c) Organizing and arranging members of the Examination and Inspection Committee to ensure that each subject has a minimum of two members;

d) Collecting examination and inspection results and handing them over to the Secretary of the Examination and Inspection Board.

3. Qualifications for members of the Examination Committee:

a) Good moral character;

b) Members of the theoretical examination committee must have a professional intermediate degree or higher vocational college degree in the same field of expertise, and have been involved in teaching or working in inland waterway transport for at least twelve months;

c) Members of the practical examination committee for captains and chief engineers must hold a higher GCNKNCM than the GCNKNCM being examined; in the case of examining first-class captains and chief engineers, the members of the examination committee must hold a first-class GCNKNCM for captains and chief engineers and have at least thirty-six months of service experience;

d) Must be trained in examination supervision and marking procedures and be issued an examination supervision and marking card by the Director of the Vietnam Inland Waterways Administration.

4. Qualifications for members of the Inspection Committee are determined by the head of the vocational training institution or the Department of Transport (for localities without vocational training institutions).

Article 14. Subjects of examination, examination format, examination time, inspection

1. The examination board bases on the question bank issued by the Vietnam Inland Waterways Administration to select examination and inspection papers including theoretical and practical subjects.

2. For combined theoretical subjects:

a) Examination format: multiple choice;

b) Examination time: maximum 01 minute/question;

c) Grading: pass or fail;

For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;) Master Mariner Director, Chief Engineer Officer Class I: each paper contains 25 questions, answering correctly 21 out of 25 questions is required to pass;;

d) Master Mariner, Chief Engineer Officer Class II: each paper contains 20 questions, answering correctly 16 out of 20 questions is required to pass;

e) Master Mariner, Chief Engineer Officer Class III: each paper contains 15 questions, answering correctly 11 out of 15 questions is required to pass;

g) Master Mariner Class IV, Vocational Competence Certificate, Specialized Competence Certificate: each paper contains 10 questions, answering correctly 7 out of 10 questions is required to pass.

3. For specialized theoretical subjects:

a) Examination format: oral questioning;

b) Examination time: maximum not exceeding 45 minutes, preparation time for candidates not exceeding 30 minutes, questioning and answering time not exceeding 15 minutes.

4. For practical subjects: the content of the examination includes basic skills in specialized fields, vocational work, and handling common situations in practice. The examination time and method are decided by the examination board.

5. Vietnamese language shall be used throughout the learning, examination, and inspection process.

6. Examination and inspection regulations according to the Law on Vocational Training.

Article 15. Recognition of examination and inspection results

1. The competent authority as prescribed in Article 7 of this Circular:

a) Decides to recognize the examination and inspection results for candidates who have met the requirements for combined theoretical subjects and scored at least 5 points (out of 10) in specialized theoretical subjects and practical examinations;

b) Issues the Vocational Competence Certificate, Specialized Competence Certificate to candidates who meet the examination and inspection requirements within 10 working days from the date of the Decision recognizing the examination and inspection results;

c) Directly or through delegation, the vocational training institution where the candidate registered for study and examination shall issue the Vocational Competence Certificate, Specialized Competence Certificate to candidates who meet the requirements.

2. Candidates who do not meet the requirements may retain their examination and inspection results for combined theoretical subjects and scores of at least 5 points (out of 10) in specialized theoretical subjects and practical examinations for a period of 12 months and may participate in any examination organized by that authority.

Article 16. Archiving of application files for study, examination, inspection, issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates

1. The competent authority as prescribed in Article 7 of this Circular must archive the following documents:

a) List of eligible students (Report No. 1); student academic performance (Report No. 2); list of examination and inspection results (Report No. 3);

b) Decision to establish the Examination Board; Decision to establish the Invigilation and Marking Committee and related documents of the Examination Board; Decision to recognize examination and inspection results and issuance of Vocational Competence Certificates, Specialized Competence Certificates along with the list of certificates issued;

c) Minutes of Examination Board meetings;

d) Record of issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates.

2. For vocational training institutions, in addition to the documents specified in Clause 1 of this Article, they must also archive the following documents:

a) Results of subject inspections;

b) Examination and inspection results of candidates;

c) Related teaching and learning materials and records.

3. For candidates participating in examinations and inspections, they must archive the following documents:

a) Personal application file for study, examination, and inspection;

b) Old versions of Master Mariner, Chief Engineer Officer certificates, Vocational Competence Certificates, Specialized Competence Certificates with corners cut off (if applicable).

4. Archiving of issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates:

a) Competent authorities issuing, reissuing, and converting Vocational Competence Certificates, Specialized Competence Certificates must archive the record of issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates;

b) Individuals must self-archive the issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates.

5. The archiving period for application files for study, examination, inspection, issuance, reissuance, and conversion of Vocational Competence Certificates, Specialized Competence Certificates shall comply with current regulations.

Chapter IV

ISSUANCE, REISSUANCE, AND CONVERSION OF VOCATIONAL COMPETENCE CERTIFICATES, SPECIALIZED COMPETENCE CERTIFICATES

VOCATIONAL COMPETENCE CERTIFICATES, SPECIALIZED COMPETENCE CERTIFICATES

Article 17. Issuance of Professional Competence Certificates and Specialized Certificates

1. Issuance of Basic Safety Training Certificate:

a) Completing one of the training programs, supplementary training, or vocational improvement programs as stipulated in this Circular.

b) Individuals holding vocational certificates issued before January 1, 2015, listed in the certificate issuance record book of the issuing authority, shall be issued a basic safety training certificate at vocational training institutions.

2. Issuance of Professional Competence Certificate for Third-Class Master Mariners and Third-Class Chief Engineers:

a) Possessing a third-class master mariner or third-class chief engineer vocational certificate or having graduated from a vocational secondary school or specialized secondary school trained in ship navigation or marine engineering occupations;

b) Completing the probationary period according to the position of third-class master mariner or third-class chief engineer for at least six months.

3. Issuance of Professional Competence Certificate for Second-Class Master Mariners and Second-Class Chief Engineers:

a) Holding a diploma from a vocational college or higher education institution trained in ship navigation or marine engineering occupations;

b) Completing the probationary period according to the position of second-class master mariner or second-class chief engineer for at least six months.

Article 18. Reissuance of Professional Competence Certificates and Specialized Certificates

1. Individuals whose Professional Competence Certificates or Specialized Certificates are damaged and listed in the certificate issuance record book of the issuing authority shall be reissued such certificates.

2. Master Mariner and Chief Engineer Licenses:

a) Individuals holding master mariner or chief engineer licenses that have exceeded their validity period by twelve months since December 31, 2019, and listed in the license issuance record book of the issuing authority, may retake the theoretical examination to obtain a reissued Professional Competence Certificate;

b) Individuals holding master mariner or chief engineer licenses that have exceeded their validity period by more than twelve but less than twenty-four months since December 31, 2019, and listed in the license issuance record book of the issuing authority, must retake both theoretical and practical examinations to obtain a reissued Professional Competence Certificate;

c) Individuals holding master mariner or chief engineer licenses that have exceeded their validity period by twenty-four months or more since December 31, 2019, and listed in the license issuance record book of the issuing authority, must undergo training and take the examination to obtain a corresponding Professional Competence Certificate based on the type and level of the previously issued license.

3. Professional Competence Certificate:

a) Individuals holding a Professional Competence Certificate within three months prior to its expiration date or exceeding its validity period by three months, and listed in the certificate issuance record book of the issuing authority, may be reissued a Professional Competence Certificate;

b) Individuals holding a Professional Competence Certificate that has exceeded its validity period by three to six months, and listed in the certificate issuance record book of the issuing authority, must retake the theoretical examination to obtain a reissued Professional Competence Certificate;

c) Individuals holding a Professional Competence Certificate that has exceeded its validity period by six to twelve months, and listed in the certificate issuance record book of the issuing authority, must retake both theoretical and practical examinations to obtain a reissued Professional Competence Certificate;

d) Individuals holding a Professional Competence Certificate that has exceeded its validity period by twelve months or more, and listed in the certificate issuance record book of the issuing authority, must undergo training and take the examination to obtain a corresponding Professional Competence Certificate based on the type and level of the previously issued certificate.

4. Individuals whose Professional Competence Certificates are still valid but lost, and listed in the certificate issuance record book of the issuing authority, and not confiscated or processed by competent authorities, shall be reissued a Professional Competence Certificate within thirty working days from the date of receiving complete application files as prescribed.

5. Individuals whose Professional Competence Certificates have exceeded their validity period and are lost, and listed in the certificate issuance record book of the issuing authority, and not confiscated or processed by competent authorities, must undergo training and take the examination to obtain a corresponding Professional Competence Certificate based on the type and level of the previously issued certificate.

6. When reissuing a Professional Competence Certificate or Specialized Certificate, the original number remains unchanged, while the issuing authority must notify relevant agencies to cancel the old Professional Competence Certificate or Specialized Certificate.

7Individuals holding a Professional Competence Certificate for Master Mariners from Class Four upwards who wish toobtain ||| a First-Class Seafarer License.

Article 19. Master Mariner Licenses, Chief Engineer Licenses, and Specialized Certificates already issued

1. Individuals holding a Master Mariner License or Chief Engineer License issued before January 1, 2015, continue to be valid until December 31, 2019, and listed in the license issuance record book of the issuing authority shall be reissued Professional Competence Certificates or Specialized Certificates, 2. Master Mariner Licenses, Chief Engineer Licenses, and Specialized Certificates already issued shall be reissued as follows:.

a) Individuals holding a First-Class Master Mariner or First-Class Chief Engineer License shall be reissued a First-Class Master Mariner or First-Class Chief Engineer Professional Competence Certificate;

b) Individuals holding a Second-Class Master Mariner or Second-Class Chief Engineer License shall be reissued a Second-Class Master Mariner or Second-Class Chief Engineer Professional Competence Certificate; c) Individuals holding a Third-Class Master Mariner or Third-Class Chief Engineer License shall be reissued a Third-Class Master Mariner or Third-Class Chief Engineer Professional Competence Certificate; d) Individuals holding a Limited Third-Class Master Mariner License shall be reissued a Fourth-Class Master Mariner Professional Competence Certificate;

đ) Individuals holding a Seafarer Certificate shall be reissued a First-Class Seafarer Certificate;

e) Individuals holding a Limited Seafarer Program Certificate shall be reissued a Second-Class Seafarer Certificate;

g) Individuals holding a Marine Engineer Certificate shall be reissued a First-Class Marine Engineer Certificate;

h) Individuals holding a Limited Marine Engineer Program Certificate shall be reissued a Second-Class Marine Engineer Certificate;

i) Individuals holding a Vessel Operator Certificate shall be reissued a First-Class Vessel Operator Certificate;

k) Individuals holding a Limited Vessel Operator Program Certificate shall be reissued a Second-Class Vessel Operator Certificate.

h) Individuals holding limited program engine operator certificates may have their second-class engine operator certificates reissued;

i) Individuals holding vehicle driver certificates may have their first-class vehicle driver certificates reissued;

k) Individuals holding limited program vehicle driver certificates may have their second-class vehicle driver certificates reissued.

Article 20. Conversion of certificates of professional competence, professional certificates

1. Persons holding a captain's degree, chief engineer's degree, or certificate for captain or chief engineer issued by competent authorities of Vietnam; foreign persons or Vietnamese residing abroad holding a captain's degree, chief engineer's degree, or certificate for captain or chief engineer issued by competent authorities of foreign countries, if they wish to work on inland waterway vessels, must go through procedures to convert their certificates to certificates of professional competence for captains and chief engineers, and professional certificates for inland waterway vessels according to the provisions of this Circular.

2. For captain and chief engineer certificates, fishing vessel professional certificates:

a) Persons holding a fourth-class fishing vessel captain or chief engineer certificate with a power of 400 cv or more, who have served in the position of fourth-class fishing vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for second-class inland waterway vessel captains and chief engineers but must take corresponding examinations for second-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

b) Persons holding a fifth-class fishing vessel captain certificate with a power from 90 cv to less than 400 cv, who have served in the position of fifth-class fishing vessel captain for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel captains but must take corresponding examinations for third-class inland waterway vessel captains and meet the requirements set forth.

c) Persons holding a fifth-class fishing vessel chief engineer certificate with a power from 90 cv to less than 400 cv, who have served in the position of fifth-class fishing vessel chief engineer for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel chief engineers.

d) Persons holding a small fishing vessel captain certificate with a power from 20 cv to less than 90 cv, who have served in the position of small fishing vessel captain for at least six months, may convert their certificates to certificates of professional competence for fourth-class inland waterway vessel captains but must take corresponding examinations for fourth-class inland waterway vessel captains and meet the requirements set forth.

đ) Persons holding a small fishing vessel chief engineer certificate with a power from 20 cv to less than 90 cv, who have served in the position of small fishing vessel chief engineer for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel chief engineers but must complete the supplementary chief engineer training program for third-class inland waterway vessel chief engineers and meet the requirements set forth.

e) Persons holding a fishing vessel seaman or engine room rating certificate may convert their certificates to first-class inland waterway vessel seaman or engine room rating certificates but must undergo corresponding examinations for first-class inland waterway vessel seaman or engine room rating certificates and meet the requirements set forth.

g) Persons holding a fishing vessel captain certificate from small class upwards and aged 55 years or older for women and 60 years or older for men, meeting the health requirements, may convert their certificates to first-class inland waterway vessel master certificates but must undergo corresponding examinations for first-class inland waterway vessel master certificates and meet the requirements set forth.

3. For captain and chief engineer certificates, marine vessel professional certificates:

a) Persons holding a college vocational degree or higher education degree trained in marine vessel operation or marine vessel machinery operation, possessing a marine vessel captain certificate with a gross tonnage of 500 GT or more or a marine vessel chief engineer certificate with a power of 750 kW or more, who have served in the position of marine vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for first-class inland waterway vessel captains and chief engineers but must take corresponding examinations for first-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

b) Persons holding a secondary vocational school degree or secondary education degree trained in marine vessel operation or marine vessel machinery operation, possessing a marine vessel captain certificate with a gross tonnage from 50 GT to less than 500 GT or a marine vessel chief engineer certificate with a power from 75 kW to less than 750 kW, who have served in the position of marine vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for second-class inland waterway vessel captains and chief engineers but must take corresponding examinations for second-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

c) Persons holding a marine vessel captain certificate with a gross tonnage under 50 GT or a marine vessel chief engineer certificate with a power under 75 kW, who have served in the position of marine vessel captain or chief engineer for at least six months, may convert their certificates to certificates of professional competence for third-class inland waterway vessel captains and chief engineers but must study to take corresponding examinations for third-class inland waterway vessel captains and chief engineers and meet the requirements set forth.

d) Persons holding a marine vessel captain certificate with a gross tonnage under 50 GT, who have served in the position of marine vessel captain for at least six months, may convert their certificates to certificates of professional competence for fourth-class inland waterway vessel captains but must take corresponding examinations for fourth-class inland waterway vessel captains and meet the requirements set forth.

đ) Persons holding a marine vessel seaman or engine room rating certificate may convert their certificates to first-class inland waterway vessel seaman or engine room rating certificates but must undergo corresponding examinations for first-class inland waterway vessel seaman or engine room rating certificates and meet the requirements set forth.

e) Persons holding a marine vessel captain certificate with a gross tonnage of 50 GT or more and aged 55 years or older for women and 60 years or older for men, meeting the health requirements, may convert their certificates to first-class inland waterway vessel master certificates but must undergo corresponding examinations for first-class inland waterway vessel master certificates and meet the requirements set forth.

Article 21. Documents and Procedures for Issuing, Reissuing, and Converting Professional Competence Certificates and Specialized Certificates

1. Individuals who need to apply for issuance, reissuance, or conversion of Professional Competence Certificates (GCNKNCM) and Specialized Certificates (CCCM) shall submit one (1) set of documents directly or through the postal service or other appropriate means to the Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution as stipulated in Article 7 of this Circular. The documents include:

a) Application form according to the model prescribed in Appendix III of this Circular;

b) Two (2) color photographs measuring 2x3 cm, taken within six (6) months;

c) Health certificate issued by an authorized healthcare facility;

d) A copy with the original for verification (in case of direct submission) or a certified copy of relevant certificates, GCNKNCM, CCCM, or a notarized translation into Vietnamese (for captain, engineer certificates or specialized CCCM issued by competent authorities of foreign countries) to prove compliance with the conditions for issuance, reissuance, or conversion of the corresponding GCNKNCM and CCCM as prescribed in Articles 17, 18, 19, and 20 of this Circular.

"2. Implementation procedures:"

The Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution shall receive, examine, and process the documents as follows:

a) In cases where documents are submitted directly, if the documents are complete, they will issue a receipt for the result and proceed with the issuance, reissuance, or conversion; if the documents are incomplete, they will return them immediately and guide the individual to complete the documents;

b) In cases where documents are received through the postal service or other appropriate means, if the documents are incomplete, within two (2) working days from the date of receiving the documents, the Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution must send a letter requesting the individual to supplement and complete the documents;

c) Within five (5) working days from the date of receiving all required documents, the Vietnam Inland Waterways Administration, Regional Inland Waterways Branch, Department of Transport, or vocational training institution shall issue, reissue, or convert the GCNKNCM and CCCM.

Chapter V

ASSUMPTION OF CAPTAIN AND ENGINEER TITLES

INLAND WATERWAY VESSELS

Article 22. Assumption of Captain and Engineer Titles

1. Seafarers holding a First-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) Passenger ships with a capacity exceeding 100 persons;

b) Ferries with a total deadweight of over 150 tons;

c) Cargo vessels with a total deadweight of over 500 tons;

d) Towboat fleets with a total deadweight of over 1000 tons;

đ) Vessels not specified in points a, b, c, and d of Clause 1 of this Article with a total engine power exceeding 400 horsepower.

2. Seafarers holding a Second-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) Passenger ships with a capacity from over 50 to 100 persons;

b) Ferries with a total deadweight from over 50 to 150 tons;

c) Cargo vessels with a total deadweight from over 150 to 500 tons;

d) Towboat fleets with a total deadweight from over 400 to 1000 tons;

đ) Vessels not specified in points a, b, c, and d of Clause 2 of this Article with a total engine power from over 150 to 400 horsepower.

3. Seafarers holding a Third-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) Passenger ships with a capacity from over 12 to 50 persons;

b) Ferries with a total deadweight up to 50 tons;

c) Cargo vessels with a total deadweight from over 15 to 150 tons;

d) Towboat fleets with a total deadweight up to 400 tons;

đ) Vessels not specified in points a, b, c, and d of Clause 3 of this Article with a total engine power from over 15 to 150 horsepower.

4. Seafarers holding a Fourth-Class Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Captain on vessels of the following types:

a) River passenger vessels with a capacity up to 50 persons;

b) Cargo vessels with a total deadweight up to 50 tons;

c) Vessels with main engine power up to 50 horsepower.

5. Seafarers holding a Professional Competence Certificate (GCNKNCM) for a higher-class Captain may assume the title of Captain on vessels specified for a lower-class Captain.

6. Seafarers holding a Professional Competence Certificate (GCNKNCM) for Captain may assume the title of Chief Officer on vessels specified for a higher-class Captain.

7. Seafarers holding a First-Class Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Engineer on vessels with a total engine power exceeding 400 horsepower.

8. Seafarers holding a Second-Class Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Engineer on vessels with a total engine power from over 150 to 400 horsepower.

9. Seafarers holding a Third-Class Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Engineer on vessels with a total engine power from over 15 to 150 horsepower.

10. Seafarers holding a Professional Competence Certificate (GCNKNCM) for a higher-class Engineer may assume the title of Engineer on vessels specified for a lower-class Engineer.

11. Seafarers holding a Professional Competence Certificate (GCNKNCM) for Engineer may assume the title of Assistant Engineer on vessels specified for a higher-class Engineer.

12. Vessels equipped with external engines with a total engine power up to 150 horsepower or internal engines with a total engine power up to 50 horsepower do not necessarily require the position of Engineer. If the Engineer position is not independently assigned, the Captain must hold a First-Class Engine Room Rating Certificate. For vessels equipped with external engines with a total engine power from over 150 to 400 horsepower, if the Engineer position is not independently assigned, the Captain must hold a Professional Competence Certificate (GCNKNCM) for Engineer suitable for the total engine power.

Article 23. Assumption of Other Seafarer Positions

1. A person holding a certain type of vocational certificate may only be permitted to assume the corresponding position as prescribed.

2. For operators of Class I and II high-speed vessels, coastal vessels, persons working on coastal vessels, vessels carrying petroleum products, chemicals, liquefied gases, in addition to the GCNKNCM and the vocational certificate specified for their position, must also possess a special CCCM corresponding to their role.

Article 24. Allocation of Seafarer Positions

1. The owner of the vessel is responsible for allocating sufficient positions and crew complements for work on inland waterway vessels and must establish a seafarer logbook in accordance with the regulations, complying with this Circular and relevant laws.

2. GCNKNCM and CCCM must be carried by the holder when practicing their profession.

Chapter VI

IMPLEMENTING PROVISIONS

Article 25. Reporting System

1. On the 20th day of each month, vocational training institutions shall report to the Department of Transport of provinces and centrally administered cities and the Vietnam Inland Waterways Administration on the results of seafarer training, vessel operators, and the issuance, reissuance, and conversion of vocational certificates as stipulated in Appendix XVI of this Circular.

2. On the 25th day of each month, the Department of Transport of provinces and centrally administered cities shall report to the Vietnam Inland Waterways Administration on the results of seafarer training, vessel operators, and the issuance, reissuance, and conversion of GCNKNCM and CCCM within their jurisdiction as stipulated in Appendix XVII of this Circular.

Article 26. Implementation

1. The Director of the Vietnam Inland Waterways Administration is responsible for:

a) Organize the implementation of this Circular;

b) Printing, issuing, and uniformly managing the use of GCNKNCM and CCCM blanks nationwide;

c) Organizing training for examination supervision, marking, and issuing examination supervision and marking cards.

2. The Director of the Department of Transport organizes the implementation of this Circular within their scope of responsibility; implements reporting systems and is subject to inspection, audit, and guidance on professional matters from the Ministry of Transport and the Vietnam Inland Waterways Administration.

3. The head of vocational training institutions is responsible for implementing this Circular; implementing reporting systems and being subject to inspection, audit,supervision

Article 27. Effective Date

, and professional guidance within the scope of responsibility of the competent state agency.

Article 28. Responsibility for Implementation

The Head of the Ministry's Office, the Head of the Ministry's Inspectorate, the Heads of Departments, the Director of the Vietnam Inland Waterways Administration, the Directors of the Departments of Transport of provinces and centrally administered cities, Heads of agencies, organizations, and individuals related to this Circular are responsible for its enforcement./.
