JOINT CIRCULAR

Regulations on standards, conditions, contents, and forms of examinations for promotion to higher ranks of occupational titles in the health sector

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, use, and management of civil servants;

This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Health and the Minister of Home Affairs shall jointly issue a Circular stipulating the standards, conditions, contents, and forms of examinations for promotion to higher ranks of occupational titles in the health sector, as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the standards, conditions, contents, and forms of examinations for promotion to higher ranks of occupational titles for health sector civil servants.

Article 2. This Circular applies to health sector civil servants participating in examinations for promotion to higher ranks of occupational titles in public service units.

Article 3. For civil servants currently holding occupational titles in the health sector, they may apply the provisions of this Circular to participate in examinations for promotion to higher ranks of occupational titles.

Article 2. Principles of examinations for promotion to higher ranks of occupational titles in the health sector

Clause 1. Public service units with needs and vacant positions for occupational titles for which promotions are sought shall organize such examinations.

2. The organization of examinations for promotion to higher ranks must be equal, transparent, fair, objective, and in accordance with the law.

Article 3. Standards and Conditions for Registration to Participate in Examinations for Promotion to Higher Ranks of Occupational Titles

Civil servants are eligible to register for examinations for promotion to higher ranks of occupational titles if they meet all the following standards and conditions:

Point 1. Public service units have a need.

Point 2. They hold an occupational title with the same first four digits in the occupational title code as the occupational title for which they are registering to take the promotion examination (except for promotion from the rank of medical assistant to the rank of doctor or preventive medicine doctor).

Point 3. They have the ability to perform or are currently working in a position suitable for the rank of the occupational title for which they are registering to take the promotion examination.

Point 4. They are evaluated by their employing agency, organization, or unit as having satisfactorily completed their tasks over a continuous three-year period up to the time of submitting the application, possessing good moral character; not being under disciplinary action or having been notified about potential disciplinary measures according to the law.

Point 5. They are nominated by the competent authority managing or using civil servants to participate in the examination for promotion to higher ranks of occupational titles.

Point 6. They meet the standards of the rank of the occupational title for which they are registering to take the promotion examination.

Chapter II

FORMS AND CONTENTS OF PROMOTION EXAMINATIONS TEACHER OCCUPATIONAL TITLES

Article 4. Examination for Promotion from Rank II to Higher Ranks I

Clause 1. Common knowledge subject

Point a. Examination Form: Essay.

Sub-clause b) Duration of examination: 180 minutes.

Point c. Examination Content: Assessing knowledge and understanding of the civil servant regarding the Party's viewpoints, policies, and guidelines on health care work; strategic orientation for development in the field and knowledge of specialized laws; applying this knowledge to practical situations to propose solutions to emerging issues in the field consistent with the standards of Rank I occupational titles (60% of the examination content) and understanding civil servant laws (40% of the examination content).

Clause 2. Professional subject

Point a. Examination Form: Writing and presenting, defending a project or developing a professional procedure and presenting, defending the professional procedure.

Point b. Examination Time:

Writing a project or developing a professional procedure: 8 hours (480 minutes);

Presenting and defending the project or professional procedure: 30 minutes.

Point c. Examination Content: Evaluating the level, capacity, and skills in developing projects, presenting, and defending project contents, and solving practical problems related to the standards of professional qualifications and capabilities of Rank I occupational titles.

Clause 3. Foreign language subject

Point a. Examination Form: Written test and interview.

Point b. Examination Time: Written test is 90 minutes and interview (dialogue) is 15 minutes.

Point c. Examination Content: Testing reading, comprehension, writing, listening, and speaking (dialogue) skills at Level 4 as specified in the standards of Rank I occupational titles.

4. Information technology subject:

Point a. Examination Form: Multiple choice or computer-based practical exercises.

b) Examination time: 45 minutes.

Point c. Examination Content: Assessing knowledge of the Windows operating system, use of Microsoft Office applications, and internet usage.

Article 5. Examination for promotion from Level III to Level II occupational title

Clause 1. Common knowledge subject

Point a. Examination Form: Essay.

Sub-clause b) Duration of examination: 180 minutes.

c) Content of the examination: testing knowledge and understanding of staff on strategic development orientation of the sector and specialized laws relevant to the Level II occupational title standard (accounting for 60% of the examination content) and understanding of staff laws (accounting for 40% of the examination content).

Clause 2. Professional subject

a) Form of the examination: multiple choice or practical test decided by the Examination Board.

b) Duration of the examination: 45 minutes for multiple choice or 30 minutes for practical test.

c) Content of the examination: assessing and evaluating qualifications, capabilities, and proposing solutions to address current issues in practice in accordance with the qualification and capability standards of the Level II occupational title.

Clause 3. Foreign language subject

a) Form of the examination: written.

b) Examination time: 90 minutes.

Sub-clause c) Content of examination: Testing reading comprehension and writing skills at level 3 as prescribed by the standards of Rank II occupational titles.

4. Computer Science subject

Point a. Examination Form: Multiple choice or computer-based practical exercises.

b) Examination time: 45 minutes.

Sub-clause c) Content of examination: Testing knowledge of Windows operating system, using Microsoft Office applications, and using the Internet.

Article 6. Examination for promotion from Level IV to Level III occupational title

Clause 1. Common knowledge subject

Point a. Examination Form: Essay.

b) Duration of the examination: 150 minutes.

c) Content of the examination: testing knowledge and understanding of staff on strategic development orientation of the sector and specialized laws relevant to the Level III occupational title standard (accounting for 60% of the examination content) and understanding of staff laws (accounting for 40% of the examination content).

Clause 2. Professional subject

a) Form of the examination: multiple choice or practical test decided by the Examination Board.

b) Duration of the examination: 30 minutes for multiple choice, 15 minutes for practical test.

c) Content of the examination: assessing and evaluating qualifications, capabilities, and proposing solutions to address current issues in practice in accordance with the qualification and capability standards of the Level III occupational title.

Clause 3. Foreign language subject

a) Form of the examination: written.

b) Duration of the examination: 60 minutes.

c) Content of examination: assess skills in reading comprehension and writing at level 2 according to the standards of Level III professional title.

4. Computer Science subject

Point a. Examination Form: Multiple choice or computer-based practical exercises.

b) Duration of the examination: 30 minutes.

Sub-clause c) Content of examination: Testing knowledge of Windows operating system, using Microsoft Office applications, and using the Internet.

Article 7. Conditions for exemption from foreign language and information technology subjects in the examination for promotion of occupational titles

1. Exemption from the foreign language subject for staff meeting one of the following conditions:

a) Staff, as of December 31 of the year organizing the examination for promotion of occupational titles, are at least 55 years old for males and at least 50 years old for females;

b) Staff working in ethnic minority areas, holding a certificate of ethnic minority language training issued by a training institution within its authority (not applicable for the examination for promotion from Level II to Level I);

c) Ethnic minority staff working in ethnic minority areas (not applicable for the examination for promotion from Level II to Level I);

d) Officials holding a second bachelor's degree in a foreign language;

d) Staff holding a degree from a higher level of education than the specified occupational title standard's education level, obtained through studying abroad or in a foreign language in Vietnam.

2. Exemption from the information technology subject for civil servants who have graduated from a technical college in information technology or above.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Effective Date

1. This Circular takes effect from February 15, 2016.

2. Abolish the provisions on the content and form of the examination for promotion of medical occupational titles set out in Decision No. 07/2006/QĐ-BYT dated January 26, 2006, of the Minister of Health.

Article 9. Responsibility for implementation

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies; Chairpersons of provincial People's Committees under central government jurisdiction and Heads of health-related public service units shall base on the criteria and conditions stipulated in this Joint Circular within their assigned authority to nominate staff to participate in the examination for promotion of occupational titles and bear responsibility for the criteria and conditions of staff participating in the examination for promotion of occupational titles.

2. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies shall organize the examination for promotion of medical occupational titles strictly in accordance with the law within their assigned authority.

3. During implementation, if there are any difficulties, please report to the Ministry of Health for consolidation and coordination with the Ministry of Home Affairs to examine and resolve them./.
