Circular No. 56/2020/TT-BTC stipulates the levels of fees and charges in the field of crop cultivation and forest tree seedlings from June 12, 2020 to the end of 2020. This document adjusts the collection levels lower than before to support businesses and citizens.

- From the date this Circular takes effect until the end of 2020, organizations and individuals maintaining the validity of Plant Variety Protection Certificates from the tenth year onwards pay maintenance fees at 70% of the levels specified in Point 3 of Section III of the Fee Table (Clause 1.2.a).

CIRCULAR
REGULATIONS ON THE LEVEL OF COLLECTION AND PAYMENT OF FEES AND CHARGES IN THE FIELD OF AGRICULTURAL CROPPING AND FOREST TREE SEEDS
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Directive No. 11/CT-TTg dated March 4, 2020 of the Prime Minister on urgent tasks and solutions to address difficulties for production and business operations, ensuring social welfare in response to the COVID-19 pandemic;
At the request of the Director of the Tax Policy Department;
The Minister of Finance issues this Circular regulating the level of collection and payment of fees and charges in the field of agricultural cropping and forest tree seeds.
Article 1. Level of Collection and Payment of Fees and Charges in the Field of Agricultural Cropping and Forest Tree Seeds
1. Organizations and individuals when requesting competent state authorities to issue certificates of protection, issue registration certificates for contracts transferring industrial property rights; submit applications for intellectual property protection; issue certificates of practice for industrial property representation, announce and register industrial property representation shall pay the following charges:
a) From the date this Circular takes effect until December 31, 2020, pay charges at 50% of the collection levels specified in Section I of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC dated November 9, 2016 of the Minister of Finance regulating the level of collection, payment, management, and use of fees and charges in the field of agricultural cropping and forest tree seeds (hereinafter referred to as Circular No. 207/2016/TT-BTC).
During the period this Circular is effective, no charges will be paid in the field of agricultural cropping and forest tree seeds according to the collection levels specified in Section I of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC.
b) From January 1, 2021 onwards, pay charges in the field of agricultural cropping and forest tree seeds according to the collection levels specified in Section I of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC.
2. Organizations and individuals when submitting applications requesting competent state authorities to protect plant varieties (maintain the validity of Plant Variety Protection Certificates) shall pay the following fees:
a) From the date this Circular takes effect until December 31, 2020
- In cases where maintaining the validity of Plant Variety Protection Certificates from the first to the ninth year, pay fees at 80% of the collection levels specified in Point 3 of Section III of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC.
- In cases where maintaining the validity of Plant Variety Protection Certificates from the tenth year to the end of the validity period of the Plant Variety Protection Certificate, pay fees at 70% of the collection levels specified in Point 3 of Section III of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC.
During the period this Circular is effective, no fees will be paid for maintaining the validity of Plant Variety Protection Certificates according to the fee levels specified in Point 3 of Section III of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC.
b) From January 1, 2021 onwards, pay fees for maintaining the validity of Plant Variety Protection Certificates according to the collection levels specified in Point 3 of Section III of the Fee and Charge Table in the field of agricultural cropping and forest tree seeds issued together with Circular No. 207/2016/TT-BTC.
Article 2. Effective Date
1. This Circular takes effect from June 12, 2020 to December 31, 2020.
2. Contents regarding the scope of regulation, applicable subjects, payers, collecting organizations, collection levels, declaration, payment of fees and charges; management and use of fees; receipts, publicizing the system of fee and charge collection and other related contents not regulated in this Circular shall be implemented according to the provisions of Circular No. 207/2016/TT-BTC.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
