CIRCULAR

Detailed regulations on certain provisions of the Housing Law for the People's Public Security Force

Pursuant to the Law on People's Police dated November 20, 2018;

BASED ON THE LAW AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE POPULAR SECURITY ORGANIZATION LAW dated June 22, 2023;

Pursuant to the Housing Law dated November 27, 2023;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15 dated June 29, 2024;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Construction Management and Barracks Administration Department;

The Minister of Public Security promulgates this Circular detailing certain provisions of the Housing Law for the People's Public Security Force.

Article 1. Scope of Regulation

This Circular stipulates the model certificate proving the eligibility of individuals within the People's Public Security Force to benefit from social housing support policies and housing for military personnel; requirements for projects investing in construction of housing for military personnel under the management of the Ministry of Public Security.

Article 2. Applicability

This Circular applies to:

1. Officers and non-commissioned officers of the People's Public Security Force serving under the professional system; public security workers serving under the recruitment system.

2. Public security units and localities.

3. Agencies, organizations, and individuals related to the development and management of social housing and housing for military personnel under the management of the Ministry of Public Security.

Article 3. Model certificate proving the eligibility of individuals within the People's Public Security Force to benefit from social housing support policies and housing for military personnel

This Circular annexes the model certificate proving the eligibility of individuals within the People's Public Security Force to benefit from social housing support policies and housing for military personnel (Model NOCA).

Article 4. Requirements for projects investing in construction of housing for military personnel under the management of the Ministry of Public Security

1. Projects investing in construction of housing for military personnel under the management of the Ministry of Public Security must comply with the requirements set forth in Article 33 of the Housing Law 2023.

2. The name of projects investing in construction of housing for military personnel under the management of the Ministry of Public Security must be expressed in Vietnamese and include the phrase "People's Public Security Force."

Article 5. Responsibilities of Public Security units and localities

1. The Construction Management and Barracks Administration Department shall have the following responsibilities:

a) Supervising and inspecting the implementation of this Circular;

b) Taking the lead and coordinating with Public Security units and localities to compile housing needs of the subjects specified in Clause 1, Article 2 of this Circular according to each province and centrally-administered city; reporting to the leadership of the Ministry of Public Security to issue documents to the People's Committees of provinces and centrally-administered cities for inclusion in provincial housing development plans;

c) Taking the lead and coordinating with relevant units to advise the leadership of the Ministry of Public Security on opinions regarding projects investing in construction of housing for military personnel under the investment approval procedure as stipulated in Clause 3, Article 6 of Decree No. 100/2024/NĐ-CP dated July 26, 2024 of the Government detailing certain provisions of the Housing Law on the development and management of social housing;

d) Guiding Public Security units and localities to confirm certificates proving the eligibility of individuals within the People's Public Security Force to benefit from social housing support policies and housing for military personnel; applications for purchasing, leasing, and renting housing for military personnel; certificates proving income conditions to purchase or lease social housing;

e) Performing other tasks as prescribed.

2. The Cadre and Civil Servant Organization Department shall have the responsibility to guide Public Security units and localities to determine the income levels of individuals within the People's Public Security Force eligible to purchase or lease social housing and housing for military personnel.

3. Public Security units and localities shall have the following responsibilities:

a) Units under the Ministry of Public Security and Public Security departments of provinces and centrally-administered cities shall review housing needs of the subjects specified in Clause 1, Article 2 of this Circular within their management scope and submit them to the Construction Management and Barracks Administration Department for consolidation;

b) Heads of units under the Ministry of Public Security, Directors of Public Security departments of provinces and centrally-administered cities, Chiefs of Public Security branches of districts, counties, towns, and centrally-administered cities shall confirm certificates proving the eligibility of individuals within the People's Public Security Force to benefit from social housing support policies and housing for military personnel; applications for purchasing, leasing, and renting housing for military personnel; certificates proving income conditions to purchase or lease social housing in accordance with Point d, Clause 1 of this Article and related documents;

c) Units under the Ministry of Public Security and Public Security departments of provinces and centrally-administered cities shall consolidate registration files for purchasing, leasing, and renting housing for military personnel of the subjects specified in Clause 1, Article 2 of this Circular within their management scope and submit them to the Construction Management and Barracks Administration Department for inspection and classification.

Article 6. Effectiveness

1. This Circular takes effect from November 5, 2024.

2. During the implementation process, if the laws and regulations cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced laws and regulations.

3. During the implementation of this Circular, if there are difficulties or obstacles, Public Security units and localities, agencies, organizations, and individuals concerned shall report to the Ministry of Public Security (through the Construction Management and Barracks Administration Department) for timely guidance./.
