Announcing the port water area and maritime zone within the jurisdiction of Nghe An Province

and the management area of the Nghe An Maritime Port Office

On the basis of The Maritime Code of Vietnam dated November 25, 2015;

Decree No. Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of the Maritime Code of Vietnam on maritime activity management and related amending decrees;

Decree No. 33/2025/NĐ-CP dated March 1, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Vietnam Maritime Administration and Inland Waterway Administration;

The Minister of Construction issues this Circular to announce the port water area and maritime zone within the jurisdiction of Nghe An Province and the management area of the Nghe An Maritime Port Office.

Article 1. Announcing the port water area within the jurisdiction of Nghe An Province

The port water area within the jurisdiction of Nghe An Province, measured from the highest tidal level, includes the following areas:

1. Dong Hoi Area with the scope:

a) Seaward boundary: delimited by straight lines connecting points DH1 to DH5, with the following coordinates:

DH1: 19°17’16,6”N, 105°48’10,3”E;

DH2: 19°16’31,6”N, 105°50’24,3”E;

DH3: 19°13’21,6”N, 105°53’05,3”E;

DH4: 19°12’21,6”N, 105°53’05,3”E;

DH5: 19°12’21,6”N, 105°43’59,3”E.

b) Landward boundary: from point DH1 running along the coast of Quynh Lap Commune towards the south, continuing through a straight line connecting two points HM1 with coordinates: 19°13’37,6”N, 105°45’20,3”E and HM2 with coordinates: 19°13’58,8”N, 105°45’15,4”E (Hoang Mai River mouth), running along the coast of Quynh Phuong Commune to point DH5.

2. Cu Lo - Ben Thuy Area with the scope:

a) Seaward boundary: delimited by straight lines connecting points NA1 to NA5, with the following coordinates:

NA1: 18°52’55,6”N, 105°40’24,3”E;

NA2: 18°52’55,6”N, 105°50’53,3”E;

NA3: 18°46’15,6”N, 105°50’53,3”E;

NA4: 18°46’15,6”N, 105°46’19,3”E (southern bank of Cu Hoai Channel);

T1: 18°46’02,5”N, 105°45’48,5”E (centerline of Cu Hoai - Ben Thuy Channel);

NA5: 18°45’52,6”N, 105°45’25,3”E (northern bank of Cu Hoai Channel).

b) Landward boundary in the Cam River area: from point NA1 running along the coast towards the south to the Cam River, running along the right bank of the Cam River (from the sea inward), passing through the lower reaches of the Nghi Quang Dam to the left bank of the river (from the sea inward), continuing towards the sea, passing through the Cu Lo Port, running along the coast of Cu Lo City to point NA5;

c) Landward boundary in the Lam River area: From point NA5 and point T1 with coordinates: 18°46’02,5”N, 105°45’48,5”E (centerline of Cu Hoai - Ben Thuy Channel) running along the centerline and the right bank of the Lam River (from the sea inward) towards the upper reaches to a straight line cutting across the river, 200 meters upstream from the top of the No. 06 wharf at Ben Thuy Port.

3. The boundaries of the port water area within the jurisdiction of Nghe An Province as stipulated in this Circular are determined on nautical charts issued by the Vietnam Marine Safety Assurance Corporation, including: VN30005 and VN40014 updated to the latest version in 2025. Coordinates of the points specified in this Circular are based on the VN-2000 coordinate system and are converted to the WGS-84 coordinate system as detailed in the Appendix attached to this Circular.

Article 2. The maritime zone within the jurisdiction of Nghe An Province

The port water area within the jurisdiction of Nghe An Province comprises two maritime zones:

1. Dong Hoi Maritime Zone.

2. Cu Lo - Ben Thuy Maritime Zone.

Article 3. The management area of the Quang Ngai Port Maritime Administration

The Quang Ngai Port Maritime Administration manages state affairs in the maritime sector at seaports within the territory of Nghe An Province, maritime areas specified in Article 2 of this Circular, and the Xuan Hai maritime area within the seaport waters of Ha Tinh Province as defined in Clause 2, Clause 3, Article 1 and Clause 2, Article 2 of Circular No. 54/2025/TT-BXD dated December 23, 2025 issued by the Minister of Construction to announce seaport waters and maritime areas within the territory of Ha Tinh Province and the management area of the Ha Tinh Port Maritime Administration.

Article 4. Implementation provisions

1. This Circular takes effect from February 15, 2026.

2. Repeal Circular No. 26/2016/TT-BGTVT dated October 11, 2016 issued by the Minister of Transport to announce seaport waters within the territory of Nghe An Province and the management area of the Nghe An Port Maritime Administration.

3. Repeal item number 06 in the Appendix List of maritime areas under the jurisdiction of the Port Maritime Administrations issued together with Circular No. 32/2019/TT-BGTVT dated September 4, 2019 issued by the Minister of Transport to announce the List of maritime areas under the jurisdiction of the Port Maritime Administrations.
