CIRCULAR
Guidelines for managing occupational diseases
Pursuant to the Law on Occupational Safety and Health No. 84/2015/QH13;
Pursuant to the Law on Medical Examination and Treatment No. 15/2023/QH15;
Pursuant to the Law on Social Insurance No. 41/2024/QH15;
Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Preventive Medicine Department;
The Minister of Health issues this Circular guiding the management of occupational diseases.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides the management of occupational diseases, including: medical examination for workers before being assigned to work, detection of occupational diseases, and statistics and reporting on occupational diseases.
Article 2. Principles for conducting pre-work medical examinations and occupational disease detection
1. Pre-work medical examinations and occupational disease detection shall be conducted at medical facilities with a scope of practice in occupational medical examination and treatment, which have been granted a license to operate in accordance with the Law on Medical Examination and Treatment No. 15/2023/QH15.
2. Mobile medical examinations for agencies, organizations, and units shall be carried out in accordance with Article 79 of Law No. 15/2023/QH15 and Articles 82 and 83 of Decree No. 96/2023/NĐ-CP dated December 30, 2023 of the Government detailing certain provisions of the Law on Medical Examination and Treatment.
Chapter II
PRE-WORK MEDICAL EXAMINATION
Article 3. Subjects of pre-work medical examination
The subjects of pre-work medical examination are workers falling under the cases stipulated in Clause 3, Article 21 of the Law on Occupational Safety and Health No. 84/2015/QH13.
Article 4. Medical records for pre-work medical examination
1. A letter of introduction from the employer according to the form prescribed in Appendix I attached hereto. In cases where a workplace has multiple individuals who need to undergo pre-work medical examination, the employer shall prepare a list and provide information about the intended occupation, job, and harmful factors at the workplace to accompany the letter of introduction.
2. A pre-work medical examination form according to the form prescribed in Appendix II attached hereto.
Article 5. Content of pre-work medical examination
1. Pre-work medical examination shall be conducted in accordance with the contents specified in the pre-work medical examination form according to the form prescribed in Appendix II attached hereto.
In cases where a worker has undergone regular medical examination, obtained a health certificate, and it remains valid within the period stipulated in Circular No. 32/2023/TT-BYT dated December 31, 2023 of the Minister of Health detailing certain provisions of the Law on Medical Examination and Treatment, specialized medical examination shall be conducted in accordance with Clause 2 of this Article.
2. Depending on the worker's job position, the medical practitioner shall prescribe specialized medical examination appropriate to the harmful factors at the job position.
3. Clinical laboratory tests (laboratory tests, imaging diagnosis, functional examinations) shall be performed when prescribed by the medical practitioner to suit the harmful factors at the job position.
Chapter III
OCCUPATIONAL DISEASE DETECTION
Article 6. Subjects of occupational disease detection
Workers engaged in workplaces exposed to factors that may cause occupational diseases, including those involved in heavy, hazardous, dangerous, or particularly heavy, hazardous, dangerous jobs, and other workers exposed to harmful factors as prescribed by laws on occupational safety and health shall be eligible for occupational disease detection.
Article 7. Time for Occupational Disease Detection Examination
1. The time for occupational disease detection examination for workers as stipulated in Article 6 of this Circular is six months after exposure to factors that may cause occupational diseases as prescribed by law.
2. In cases where there is suspicion of acute occupational disease, the time for occupational disease detection examination shall be carried out according to the proposal of the competent authority or the employer or the worker.
Article 8. Occupational Disease Detection Examination Files
1. In cases where the occupational disease detection examination is organized by the employer or at the request of the competent authority, the employer prepares the occupational disease detection examination file for the worker including:
a) Health check-up form before job assignment according to the model prescribed in Appendix II attached to this Circular;
b) Occupational disease detection health check-up book according to the model prescribed in Appendix III attached to this Circular;
c) A valid copy of the results of environmental monitoring and occupational exposure assessment (extracted from the report on the results of environmental monitoring at the workplace where the worker works) still in effect.
In cases of suspected acute occupational disease without timely determination of the level of exposure to harmful factors at the time of occurrence of the occupational disease, there must be a valid copy of the Record confirming exposure to harmful factors causing acute occupational disease according to the model prescribed in Appendix IV attached to this Circular;
d) A valid copy of discharge certificate or summary of medical record related to occupational disease (if any).
2. In cases where the employer does not comply with the provisions of labor safety and hygiene laws and must investigate occupational diseases, the Record of occupational disease investigation shall replace the documents specified in points a, b, and c of Clause 1 of this Article.
Article 9. Procedure and Content of Occupational Disease Detection Examination
1. Procedure for Occupational Disease Detection Examination:
a) Before conducting the occupational disease detection examination, the employer or the worker must submit all required files to the healthcare facility according to the provisions of Article 8 of this Circular;
b) After receiving all files, the healthcare facility informs the employer or the worker about the time, place, and other necessary information related to the occupational disease detection examination;
c) Conduct the first occupational disease detection examination according to the provisions of Clause 2 of this Article;
d) Upon completion of the examination period, the healthcare facility completes the occupational disease detection examination book; summarizes the results of the occupational disease detection examination period according to the model prescribed in Appendix V attached to this Circular;
đ) In cases where an occupational disease diagnosis is made, the healthcare facility must issue an Occupational Disease Medical Certificate according to the model prescribed in Appendix VI attached to this Circular and prepare a report on the case of workers suffering from occupational disease according to the model prescribed in Appendix VII attached to this Circular;
e) After organizing the occupational disease detection examination, within twenty days, the healthcare facility must return the results to the employer or the worker the documents specified in points d and đ of Clause 1 of this Article.
2. Content of Occupational Disease Detection Examination:
a) Collect full personal information, current health status, personal and family medical history, and duration of exposure to harmful factors that may cause occupational diseases to record the occupational exposure history in the occupational disease detection examination book;
b) Conduct a comprehensive examination according to the guidelines for diagnosing and assessing the degree of work capacity reduction due to occupational diseases issued by the Minister of Health;
c) For female workers, they must undergo specialized obstetric and gynecological examination according to the model prescribed in Appendix VIII attached to this Circular;
d) In cases where workers have undergone regular health checks, received health certificates, and the validity period has not expired as prescribed in Circular No. 32/2023/TT-BYT, additional examinations according to the provisions of point b of this clause shall be conducted;
đ) For occupational diseases not included in the list of occupational diseases entitled to social insurance benefits, a comprehensive examination of all relevant specialties according to the instructions of the doctor conducting the occupational disease examination as prescribed by law on medical examination and treatment shall be conducted.
Chapter IV
STATISTICS AND REPORTS ON OCCUPATIONAL DISEASES
Article 10. Reporting System
Employers must report and compile statistics on occupational diseases in accordance with the contents of the annual safety and hygiene at work report as prescribed in Circular No. 07/2016/TT-BLDTBXH dated May 15, 2016, issued by the Minister of Labor, Invalids, and Social Affairs, which stipulates certain contents for the organization and implementation of safety and hygiene at work for production and business establishments.
Article 11. Occupational Disease Investigation
1. Occupational disease investigation shall be conducted in one of the following cases:
a) Many people fall ill or become sick at the same time at a workplace;
b) The results of monitoring harmful factors in the working environment (hereinafter referred to as "monitoring") exceed the permissible hygiene standards but no occupational disease cases among workers have been detected, or the workplace has not conducted monitoring, or the monitoring does not cover all harmful factors in the working environment, or the monitoring results do not exceed the permissible limits but there are workers who suspect they have occupational diseases or have not been diagnosed with occupational diseases;
c) Re-investigate occupational diseases or investigate occupational diseases upon request of the Social Insurance agency;
d) Investigate occupational diseases upon request of the employer;
đ) Investigate occupational diseases related to the individual that have not yet been resolved according to the laws on labor safety and hygiene upon request of the worker;
2. Composition of the occupational disease investigation team:
a) The composition of the provincial occupational disease investigation team is decided by the head of the provincial health administration agency, except for the case stipulated in point c of this clause, including: The leader of the provincial health administration agency serves as the team leader and representatives from the provincial civil service administration agency; the Provincial Central Committee of the Vietnam Fatherland Front; the provincial social insurance agency; doctors authorized to diagnose and treat occupational diseases under the laws on medical examination and treatment;
b) The composition of the central occupational disease investigation team is decided by the Minister of Health, except for the case stipulated in point c of this clause, including: The leader of the Department of Disease Control serves as the team leader and representatives from the Ministry of Civil Service Administration; the Central Committee of the Vietnam Fatherland Front; Vietnam Social Security; doctors authorized to diagnose and treat occupational diseases under the laws on medical examination and treatment;
c) The composition of the occupational disease investigation team is decided by the Minister of National Defense or the Minister of Public Security, including: Representatives from the health administration agencies and the social insurance agencies under the Ministry of National Defense and the Ministry of Public Security; doctors authorized to diagnose and treat occupational diseases under the laws on medical examination and treatment; other components are decided by the Minister of National Defense or the Minister of Public Security;
a) The provincial occupational disease investigation team investigates occupational diseases for the cases stipulated in Clause 1 of this Article within their jurisdiction, except for the case stipulated in point c of this clause;
b) The central occupational disease investigation team established by the Minister of Health investigates occupational diseases for cases where organizations or individuals have complaints about the results of the occupational disease investigation conducted by the provincial occupational disease investigation team, or upon request of the provincial occupational disease investigation team when the investigation exceeds its capacity;
c) The occupational disease investigation team established by the Minister of Public Security or the Minister of National Defense investigates occupational diseases for units under the jurisdiction of the Ministry of Public Security or the Ministry of National Defense.
Article 12. Duration of Occupational Disease Investigation
1. Duration of investigation: Not exceeding thirty days from the date the occupational disease investigation team becomes effective.
2. In cases where complex occupational disease investigations require an extension, the head of the occupational disease investigation team must report and request permission from the authority that established the team two working days before the end of the initial investigation period. The extended investigation period shall not exceed ten working days.
Article 13. Procedure for Investigation, Record Keeping, and Publication of Investigation Records
1. Investigation procedure and record keeping:
a) Inspect the workplace scene;
b) Collect evidence and documents related to occupational diseases (sampling harmful factors at the workplace for analysis to determine causative factors);
c) Review the labor hygiene management records, worker health status, and occupational disease records of the workplace;
d) Interview workers, employers, and other relevant parties concerning labor hygiene management, worker health status, and occupational diseases of the workplace;
e) Organize necessary examinations and tests for suspected occupational disease cases (if necessary);
f) Other contents designated by the head of the occupational disease investigation team when necessary;
g) Prepare the occupational disease investigation record according to the model prescribed in Appendix IX issued together with this Circular.
2. Publication of Investigation Records:
The occupational disease investigation team shall convene a meeting immediately upon completion of the investigation to publish the occupational disease investigation record at the investigated workplace.
Article 14. Investigation File for Occupational Diseases
1. Workplace scene record.
2. Evidence and documents related to the case.
3. Labor hygiene management records, worker health status, and occupational disease records of the workplace.
4. Direct interview record of workers, employers, and other relevant parties concerning labor hygiene management, worker health status, and occupational diseases of the workplace.
5. Examination and test results for suspected occupational disease cases (if applicable).
6. Occupational disease investigation record.
7. Other documents related to the occupational disease investigation process.
8. Retention period for the occupational disease investigation file in accordance with the provisions of the law.
Article 15. Responsibilities of the Workplace Where Occupational Diseases Occur
1. Compile and statistically analyze the workers who have been investigated for occupational diseases.
2. Fully inform workers about the situation of occupational diseases and preventive measures against occupational diseases.
3. Properly retain the occupational disease investigation file in accordance with regulations.
4. Organize a meeting to publish the occupational disease investigation record.
5. Implement corrective measures and address consequences caused by occupational diseases; organize lessons learned; implement and report on the implementation of recommendations recorded in the occupational disease investigation record; handle those responsible for causing occupational diseases within their authority.
Article 16. Operating Costs of the Occupational Disease Investigation Team
1. If the occupational disease investigation team is established by a state administrative agency, the state budget will ensure operating costs in accordance with the law.
2. If the occupational disease investigation team is established based on a request for investigation from organizations or individuals, the operating costs of the investigation team will be borne by the requesting organization or individual.
Chapter V
RESPONSIBILITIES FOR IMPLEMENTATION
Article 17. Responsibilities of Workers
1. Truthfully report information about their medical history and occupational exposure during health examinations.
2. Participate in pre-employment health examinations and periodic health examinations for occupational diseases organized by employers.
3. Fully comply with instructions and treatment recommendations given by healthcare professionals after each examination.
4. Maintain health management records in cases of termination, resignation, or retirement (occupational disease files, reports on individual workers suffering from occupational diseases, documents related to examinations and treatments at healthcare facilities) to serve as a basis for diagnosing and assessing occupational diseases if they occur after ceasing exposure to harmful factors; transfer health management records to new agencies when transferring employment.
Article 18. Responsibilities of Employers
1. Establish and manage health records and occupational disease files throughout the period of employment; return health management records and occupational disease files (if any) to workers when they transfer to other agencies or terminate, resign, or retire.
2. Coordinate with healthcare facilities to plan and organize pre-employment health examinations and periodic health examinations for occupational diseases.
3. Provide workers with all required documents as stipulated in Clause 1, Article 8 of this Circular to enable them to proactively seek diagnosis of occupational diseases.
3. Create conditions for workers to receive treatment and rehabilitation according to the law.
4. Complete records and refer workers diagnosed with occupational diseases for assessment within twenty days following treatment, rehabilitation, or detection of occupational diseases that cannot be treated.
5. Implement improvements to working conditions, prevention, and control of occupational diseases; implement labor protection regulations and material allowances for workers as prescribed by law.
6. Arrange work positions suitable to the health status of workers.
7. Provide full information and materials and cooperate with occupational disease investigation teams.
8. Report to the competent state authorities on health matters in accordance with laws on labor safety and hygiene.
Article 19. Responsibilities of Healthcare Facilities Specializing in Occupational Diseases
1. Have the responsibility to coordinate with employers upon request regarding planning and conducting pre-employment health examinations and periodic health examinations for occupational diseases as prescribed.
2. Organize consultations on occupational diseases (if necessary) in accordance with laws on medical examination and treatment; bear legal responsibility for the results of occupational disease diagnoses.
3. Participate in medical assessment boards at various levels to assess occupational diseases (upon request).
4. Develop, update, connect, and share data from the Occupational Disease Database with the National Health Database in accordance with laws concerning the contents stipulated in Clause 3, Article 21 of this Circular.
Article 20. Responsibilities of the Provincial People's Committee, Municipality under the Central Government
1. Direct agencies, units, enterprises, cooperatives to implement health check-ups before job assignment, occupational disease detection, and organize occupational disease investigations within their jurisdiction.
2. Direct regular or spot inspections of activities at medical facilities for occupational diseases.
3. Direct reporting work according to laws on labor safety and hygiene.
Article 21. Responsibilities of the Occupational Disease Prevention Bureau
1. Direct and organize the implementation of health check-ups before job assignment, occupational disease detection, statistics, and reporting of occupational diseases nationwide; supervise such health check-ups and occupational disease detection activities, and propose measures to handle violations to competent authorities as prescribed by law.
2. Develop and update databases on occupational diseases into information on medical treatment and rehabilitation functions within the national healthcare database, including the following contents:
a) Name of medical facility licensed to operate occupational health services or medical facility with expanded scope of occupational health services;
b) Name of agency, unit, enterprise having workers diagnosed with occupational diseases;
c) Name of occupational disease diagnosed;
d) Number of workers diagnosed with occupational diseases classified according to social insurance benefits.
3. Direct subordinate units under the Ministry of Health to develop training content and organize training on occupational diseases.
4. Take the lead and coordinate with relevant units to guide the implementation of this Circular.
Chapter VI
IMPLEMENTING PROVISIONS
Article 22. Effectiveness
1. This Circular takes effect from February 15, 2026.
2. Circular No. 28/2016/TT-BYT dated June 30, 2016, guiding the management of occupational diseases issued by the Minister of Health shall cease to be effective from the date this Circular takes effect.
Article 23. Cross-referencing Provisions
In case the referenced documents in this Circular are replaced or amended, they shall be applied according to the replacement or amended documents.
Article 24. Transitional Provisions
Workers diagnosed with occupational diseases who have established an occupational disease file according to Circular No. 28/2016/TT-BYT continue to use it for conducting disability assessment due to occupational diseases.
During the implementation process, if there are any difficulties, organizations, units, and individuals are requested to promptly report to the Ministry of Health (Occupational Disease Prevention Bureau) for research, consideration, and resolution.
