DECREE-LAW

No. 56B dated May 2, 1946

CHAIRMAN OF THE VIETNAMESE DEMOCRATIC REPUBLIC GOVERNMENT

Pursuant to the proposal of the Minister of Finance and the Minister of Justice;

After deliberation by the Council of Ministers,

ISSUES THE FOLLOWING DECREE-LAW:

Article 1: From the date when hostilities broke out in South Vietnam (September 23, 1945) until December 1, 1946, throughout the territory of Vietnam, the deadline for eliminating the registration of mortgage rights (délai de prescription des inscriptions hypothécaires) at the Notary and Land Registration Offices shall be temporarily suspended.

Article 2: A subsequent Decree-Law will determine the date and month to resume this period.

Article 3: If, during the period from September 23, 1945 to the present, there have been re-registrations (renouvellement d'inscriptions) to avoid the expiration of the statute of limitations, such registrations shall be invalid and the parties concerned must apply for new registration within the time limit prescribed by the Decree-Law mentioned in Article 2.

Taxes collected from these invalid re-registrations will be refunded to individuals.

Article 4: This Decree-Law shall take effect according to the urgent procedure stipulated in Article 14 of the Decree-Law dated October 10, 1945.

Article 5: The Minister of Finance and the Minister of Justice shall implement this Decree-Law accordingly.
