REGARDING THE ESTABLISHMENT OF THE CIVIL ENGINEERING QUALITY CONTROL AND MANAGEMENT AGENCY 

THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;

Pursuant to Point 4, Article 2 and Article 3 of Decree No. 22/CP dated March 22, 1994 of the Government on the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;

Considering the proposal of the Director of the Personnel and Labor Department;

Article 1. Establish the Civil Engineering Quality Control and Management Agency under the Ministry of Transport based on the reorganization of the Civil Engineering Quality Control and Management Center established according to Decision No. 2973/QĐ/TCCB-LĐ dated December 29, 1992 of the Minister of Transport.

Article 2. The Civil Engineering Quality Control and Management Agency is a state management agency, accountable to the Minister of Transport for the quality management of civil engineering works nationwide, having legal personality, entitled to open accounts at the State Treasury and to use its own seal.

The Agency has its headquarters in Hanoi City.

Article 3. The Civil Engineering Quality Control and Management Agency shall perform the following tasks and powers:

1. Participate in drafting technical procedures, regulations, standards, and policies related to the quality management of civil engineering works for the Ministry to promulgate within its authority or for the Ministry to submit to the Government for promulgation.

Propose to the Ministry and competent state agencies to amend and supplement policies on the quality management of civil engineering works in accordance with the characteristics of the transport sector.

2. Participate in the Economic and Technical Appraisal Council for investment projects of civil engineering works managed by the Ministry of Transport.

Approve technical designs, budgets, construction designs, and equipment for construction of works managed by the Ministry, review technical designs of important works, works with complex technical requirements, works applying advanced technology, and works funded by foreign capital assigned by the Ministry to other Agencies to manage.

3. Serve as the permanent member of the Ministry-level Acceptance Council, examine load testing plans for works before they are put into operation and use.

For works managed by the National-level Acceptance Council, the Agency shall participate on behalf of the Ministry upon delegation by the Ministry.

4. Inspect and check the quality of civil engineering works within the scope of the Ministry's management (including works delegated by the Ministry to other Agencies to manage).

5. Organize regular or spot inspections of civil engineering works according to the Ministry’s plan.

6. Identify and participate in handling incidents arising during the construction and operation of civil engineering works; propose technical measures (maintenance, reinforcement, restoration, repair, or upgrading...) to ensure the quality of civil engineering works.

7. Temporarily halt or report to the Ministry to halt construction or operation of civil engineering works if such works do not meet quality standards and may cause accidents endangering people and social property.

8. Cooperate scientifically and technically with domestic and international organizations regarding inspection, control, and quality management of civil engineering works.

9. Organize the establishment and storage of project files and documents.

10. Manage assets and civil servants within the Agency in accordance with state regulations.

Article 4. The Civil Engineering Quality Control and Management Agency has a Central Branch located in Da Nang City and a Southern Branch located in Ho Chi Minh City.

The Branches shall perform their functions and tasks according to the delegation and decentralization of the Agency, entitled to open accounts at the State Treasury and to use their own seals.

Article 5. The Civil Engineering Quality Control and Management Agency shall be led by a Director, assisted by several Deputy Directors.

The Director and Deputy Directors shall be appointed and relieved from duty by the Minister of Transport.

The Branches shall be led by a Branch Director, assisted by several Deputy Branch Directors.

The Branch Director shall be appointed and relieved from duty by the Minister upon the recommendation of the Director.

Article 6. This Decision takes effect from the date of signing. Decisions contrary to this Decision are abolished.

Article 7. The Director of the Civil Engineering Quality Control and Management Agency, the Directors of specialized state management Agencies, the General Director of Vietnam Railway Corporation, the Heads of Personnel and Labor Affairs Department, the Heads of Departments, the Director of the Ministry's Office, and the heads of relevant agencies under the Ministry shall implement this Decision within their respective areas of responsibility.
