DECISION OF THE MINISTER OF HOME AFFAIRS
Issuing regulations on handling complaints, reports, and receiving citizens of the Ministry of Home Affairs
Pursuant to the Law on Complaints and Reports dated December 2, 1998;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Complaints and Reports dated June 15, 2004;
Pursuant to Decree No. 53/2005/NĐ-CP dated April 19, 2005 of the Government detailing and guiding the implementation of the Law on Complaints and Reports and the Law Amending and Supplementing Certain Provisions of the Law on Complaints and Reports;
Pursuant to Decree No. 89/CP dated August 7, 1997 of the Government promulgating the Regulations on Organizing Citizen Reception;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the proposal of the Inspector General of the Ministry of Home Affairs,
DECISION:
Article 1. Issued along with this Decision are the Regulations on Handling Complaints, Reports, and Receiving Citizens of the Ministry of Home Affairs.
Article 2. This Decision takes effect fifteen days after the date of signature.
Article 3. The Head of the Ministry's Office, the Inspector General of the Ministry, and the Heads of agencies and organizations under the Ministry of Home Affairs are responsible for implementing this Decision./.

REGULATIONS ON HANDLING COMPLAINTS,
REPORTS, AND RECEIVING CITIZENS OF THE MINISTRY OF HOME AFFAIRS

PART I
GENERAL PROVISIONS
Article 1. Scope of Application
These Regulations prescribe the authorities and responsibilities of agencies and organizations under the Ministry of Home Affairs (hereinafter referred to as the Ministry) in receiving, processing, and resolving complaints, reports, requests, and letters, and citizen reception related to the functions, tasks, and powers of the Ministry.
The resolution of complaints and reports related to labor contracts at agencies and organizations under the Ministry shall be carried out in accordance with Decree No. 04/2005/NĐ-CP dated January 11, 2005 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on complaints and reports.
Article 2. Application of laws in handling complaints, reports, requests, letters, and citizen reception
The receipt, processing, and resolution of complaints, reports, requests, letters, and citizen reception by agencies and organizations under the Ministry shall be carried out in accordance with the provisions of the Law on Complaints and Reports, the Law Amending and Supplementing Certain Provisions of the Law on Complaints and Reports, and guiding documents; the Decision of the Minister stipulating the functions, tasks, powers, and organization of agencies and organizations under the Ministry, and these Regulations.
Article 3. Explanation of Terms
In these Regulations, the following terms are understood as follows:
1. "Complaint" means the act of a citizen, agency, organization, or civil servant, public official, or employee requesting the Ministry to review an administrative decision, administrative act, or disciplinary decision against a civil servant, public official, or employee when there is evidence that such decision or act is contrary to the law, infringing upon their lawful rights and interests;
2. "Report" means the act of a citizen informing the Ministry about a violation of the law by any agency, organization, or individual causing damage or threatening to cause damage to the interests of the State, the lawful rights and interests of citizens, agencies, or organizations;
3. "Request, letter" means a request or letter sent by a citizen, agency, or organization to seek clarification on benefits and policies for civil servants, public officials, or employees or to provide suggestions and recommendations on other matters within the scope of the Ministry's state management.
Article 4. Responsibilities for handling complaints, denunciations, and receiving citizens
1. Agencies, organizations, and individuals under the Ministry within their scope, functions, tasks, and authorities shall be responsible for receiving persons who come to lodge complaints, denunciations, suggestions, and reflections; promptly and properly accepting and resolving complaints and denunciations according to the law; strictly dealing with violators; applying necessary measures to prevent potential losses; ensuring that decisions on resolution are strictly enforced and bearing legal responsibility for their own decisions.
2. Individuals responsible for resolving complaints and denunciations who fail to resolve them, lack responsibility in resolving them, or intentionally resolve them contrary to the law must be dealt with strictly; if damage occurs, they must compensate according to the provisions of the law.
Article 5. Coordination in handling complaints, denunciations, and receiving citizens
Agencies, organizations, and individuals under the Ministry shall be responsible for coordinating with agencies, organizations, and individuals with authority in resolving complaints and denunciations and receiving citizens; providing relevant information and materials related to complaints and denunciations upon request of those agencies, organizations, and individuals.
Chapter II
AUTHORITY AND RESPONSIBILITY FOR HANDLING COMPLAINTS
Section 1
Authority and responsibility for handling complaints of the Minister
Article 6. Authority of the Minister to handle complaints
1. Regarding complaints about administrative decisions and administrative acts
a. Resolving complaints about administrative decisions and administrative acts made by oneself, or by civil servants, public officials, and employees directly managed by oneself;
b. Resolving complaints that have been resolved by the Director of the National Archives and Records Administration Bureau or the Director of the National Academy of Public Administration but still have unresolved complaints;
c. Resolving complaints regarding matters within the scope of the Ministry's state management which have been initially resolved by the Chairman of the Provincial People's Committee but still have unresolved complaints;
d. Chairing, participating in resolving, or reviewing and recommending solutions for complaints related to the Ministry's state management functions according to the Prime Minister's directives;
đ. Requesting the Chairman of the Provincial People's Committee to review the final decision on complaint resolution within the Ministry's state management domain if new circumstances or signs of law violations causing damage to national interests, citizens' rights, and legitimate interests of agencies and organizations are discovered. If the request is not implemented, report to the Prime Minister for consideration and decision.
2. Regarding complaints about disciplinary decisions
a. Resolving complaints about disciplinary decisions issued by oneself;
b. Resolving complaints about disciplinary decisions that have been initially resolved by the Director of the National Archives and Records Administration Bureau or the Director of the National Academy of Public Administration but still have unresolved complaints;
c. Resolving complaints about disciplinary decisions that have been initially resolved by the Minister, Head of an equivalent ministry, Head of a government agency, or Chairman of the Provincial People's Committee but still have unresolved complaints.
Article 7. Responsibilities of the Minister in handling complaints
1. Issuing a decision to resolve complaints based on the results of meetings, dialogues, verification reports, conclusions, and recommendations for complaint resolution by the Inspector General of the Ministry or the Heads of agencies and organizations under the Ministry within the time limit stipulated in the Law on Complaints and Denunciations;
2. Seeking opinions from related ministries, sectors, and provincial people's committees where the complaint incidents occurred before signing the final decision to resolve complex cases;
3. Meeting and directly engaging in dialogue with the complainant, the person complained against, and those with rights and interests involved when resolving initial complaints; for complex cases involving multiple complainants on the same issue, engage in direct dialogue with the complainant, the person complained against, the previous complaint resolver, and those with rights and interests involved before signing the final decision to resolve the complaint;
4. Directing the National Archives and Records Administration Bureau and the National Academy of Public Administration to promptly resolve complaints within their jurisdiction. When receiving complaints within the jurisdiction of the Director of the National Archives and Records Administration Bureau or the Director of the National Academy of Public Administration beyond the prescribed time limit without resolution, require these entities to resolve the complaints and simultaneously apply measures within their authority to deal with those lacking responsibility or intentionally delaying complaint resolution;
5. Issuing a decision to temporarily suspend the execution of the complaint resolution decision of the Director of the National Archives and Records Administration Bureau or the Director of the National Academy of Public Administration when discovering violations of the law in the resolution process;
6. Issuing a decision to temporarily suspend the work of civil servants, public officials, and employees under one's management who intentionally obstruct or fail to comply with the complaint resolution decision or the requirements of the State Inspectorate;
7. Reconsidering one's final complaint resolution decision that violates the law and causes damage to national interests, citizens' rights, and legitimate interests of agencies and organizations according to the recommendation of the Chief Inspector.
Section 2
Authority and responsibility for handling complaints
of the Director of the National Archives and Records Administration Bureau,
Director of the National Academy of Public Administration
Article 8. Competence to handle complaints of the Director of the National Archives Department and the Director of the National Academy of Public Administration
1. Handle complaints against administrative decisions and administrative acts of themselves, of officials, civil servants, and employees under their direct management;
2. Handle complaints for the first time against disciplinary decisions signed and issued by themselves.
Article 9. Responsibilities in handling complaints of the Director of the National Archives Department and the Director of the National Academy of Public Administration
1. Meet and have direct dialogue with the complainant, the person complained against, and those with rights and interests related to the complaint when handling it for the first time;
2. Issue a decision to resolve the complaint in writing within the time limit prescribed by the Law on Complaints and Petitions;
3. Send the decision to resolve the complaint to the complainant, the person complained against, those with rights and interests related to the complaint, and the Inspector General of the Ministry; if necessary, publicly announce the decision to resolve the complaint;
4. Implement and organize the implementation of the decision to resolve the complaint that has legal effect within the scope of their responsibility.
Chapter III
COMPETENCE AND RESPONSIBILITIES IN HANDLING PETITIONS
Article 10. Competence to handle petitions of the Minister
Handle petitions regarding violations of laws and regulations concerning duties and public service of heads, deputy heads of agencies and organizations under the Ministry, and other persons appointed and directly managed by them.
Article 11. Competence to handle petitions of the Director of the National Archives Department and the Director of the National Academy of Public Administration
Handle petitions regarding violations of laws by persons under their management authority. Handle petitions regarding violations of duties and public service by officials, civil servants, and employees under their management.
Article 12. Responsibilities in handling petitions
1. The Minister, the Director of the National Archives Department, and the Director of the National Academy of Public Administration are responsible for handling petitions according to the laws on complaints and petitions and this Regulation;
2. The Inspector General of the Ministry examines and concludes on the content of the petition, proposes measures to address petitions within the competence to resolve of the Minister when assigned; examines and concludes on the content of the petition resolved by the Director of the National Archives Department and the Director of the National Academy of Public Administration but found to violate the law; in case of concluding that the resolution of the petition violates the law, proposes the person who resolved it to reconsider and resolve again.
Chapter IV
3. The responsibilities of those receiving citizens shall be implemented in accordance with Article 8 of the Law on Receiving Citizens.
Article 13. Receiving Citizens of the Ministry and its Agencies and Organizations
1. The Ministry organizes the reception of citizens coming to file complaints and petitions, which are conducted at the Ministry's citizen reception venue.
2. The National Archives Department and the National Academy of Public Administration organize the reception of citizens coming to file complaints and petitions at their own citizen reception venues.
3. The Inspector General of the Ministry leads the coordination with the Director of the Ministry’s Office and the Heads of agencies and organizations under the Ministry to organize the reception of citizens by the Minister or Deputy Minister authorized, dispatching civil servants to participate in receiving citizens.
Article 14. Responsibilities of the Minister in Receiving Citizens
1. The Minister shall regularly receive citizens who file complaints, reports, suggestions, and reflections on the fifth day of the first week of each month. In cases where the Minister cannot directly receive citizens according to the schedule due to work commitments, the Minister shall delegate this responsibility to a Deputy Minister.
2. Apart from regular scheduled receptions, the Minister shall directly receive citizens when deemed necessary.
Article 15. Responsibilities of the Director of the National Archives and Records Administration Bureau and the Director of the National Academy of Public Administration in Receiving Citizens
1. The Director of the National Archives and Records Administration Bureau and the Director of the National Academy of Public Administration shall regularly receive citizens who file complaints, reports, suggestions, and reflections once a month; the schedule for receiving citizens must be publicly announced so that citizens are aware.
2. Apart from regular scheduled receptions, the Director of the National Archives and Records Administration Bureau and the Director of the National Academy of Public Administration shall directly receive citizens when deemed necessary.
Article 16. Responsibilities of the Ministry Inspectorate in Receiving Citizens
1. Drafting, submitting to the Minister for promulgation, amendment, supplementation, and organizing the implementation of internal regulations for receiving citizens of the Ministry;
2. Leading and coordinating with the Ministry Office and other organizations under the Ministry in receiving citizens at the Ministry's office on the morning of the third day and the morning of the fifth day of each week;
3. Guiding, urging, and inspecting the National Archives and Records Administration Bureau and the National Academy of Public Administration in receiving citizens;
4. Assigning civil servants to permanently receive citizens at the reception location of the Ministry. Receiving and transferring to the Ministry Office the petition letters, complaint letters, and requests submitted directly by citizens at the Ministry's reception location in accordance with Article 22 of this Regulation;
5. Notifying the Ministry Office of the list of individuals not allowed to continue filing complaints and reports at the Ministry.
Article 17. Responsibilities of Organizations Under the Ministry in Receiving Citizens
Organizations under the Ministry shall appoint authorized representatives to coordinate with the Ministry Inspectorate in receiving citizens regarding issues related to their functions, tasks, and authorities according to the Ministry's reception schedule. In cases where organizations under the Ministry fail to appoint representatives to coordinate in receiving citizens as requested by the Ministry Inspectorate, they shall report to the Minister for consideration and decision.
Article 18. Responsibilities of the Ministry Office in Organizing Citizen Reception
1. Leading and coordinating with the Ministry Inspectorate to organize and manage the citizen reception location of the Ministry's office; arranging the reception location at a convenient place; ensuring necessary material conditions for citizens to present complaints, reports, suggestions, and reflections related to complaints and reports;
2. Leading and coordinating with the Ministry Inspectorate to guide citizens in filing complaints and reports in accordance with the law; not allowing individuals listed in the notification of the Ministry Inspectorate to file complaints and reports at the Ministry's office;
3. Requesting the local police authority to take measures against individuals violating citizen reception regulations, causing public disorder at the reception location, slandering, and defaming the reputation and honor of state agencies and officials performing their duties.
Article 19. Responsibilities of civil servants receiving citizens
1. Request citizens who come to lodge complaints or make accusations to present identification documents, truthfully state the matter, and provide relevant materials related to the content of their complaints or accusations; in cases where multiple people come to lodge complaints or make accusations about the same content, require them to elect representatives to directly present the content of the case.
2. Guide citizens on exercising their right to lodge complaints or make accusations.
3. Receive petitions and letters for complaints or accusations, suggestions, and reflections related to complaints or accusations within the jurisdiction of the Ministry; transfer the documents of the Ministry into the registration logbook according to regulations.
4. Record and monitor the reception of citizens.
5. Maintain confidentiality regarding the name, address, and signature of the accuser when the accuser requests it.
Article 20. Handling of Complaints and Accusations Petitions at the Reception Site
1. For complaint petitions, handle them according to the laws on complaints and accusations and this Regulation; in cases where citizens directly lodge complaints and the matter falls within the jurisdiction of the Ministry, the civil servant receiving citizens guides them to write a petition or record the content of the complaint and request the citizen to sign or affix their fingerprint; if the matter does not fall within the jurisdiction of their own agency or organization, guide the citizen to the competent agency or organization.
2. For accusations, the civil servant receiving citizens must accept, classify, and handle them according to the laws on complaints and accusations and this Regulation.
Chapter V
AUTHORITY AND RESPONSIBILITY OF INDIVIDUALS, AGENCIES,
ORGANIZATIONS UNDER THE MINISTRY IN ADVISING ON RESOLVING
COMPLAINTS, ACCUSATIONS, PETITIONS, AND RECEIVING CITIZENS
Article 21. Responsibilities of the Ministry's Leadership
For direct letters sent to the Ministry's leadership containing complaints, accusations, or petitions, after reviewing, the leadership transfers them to the Ministry Inspectorate for handling and resolution according to this Regulation.
Article 22. Responsibilities of the Ministry Office
Accept, enter into the logbook, and transfer all complaint and accusation petitions and letters, and petitions received from citizens, agencies, and organizations to the Ministry Inspectorate for processing and resolution according to their authority.
Article 23. Authority and Responsibilities of the Ministry Inspectorate
1. Serve as the focal point for handling complaint and accusation petitions and letters, and petitions transferred by the Ministry's leadership and Office; classify, enter into the tracking logbook, and process as follows:
a. For complaint and accusation letters: Examine and handle according to the laws on complaints and accusations and Articles 24 and 25 of this Regulation.
b. For suggestion letters: Transfer to agencies and organizations under the Ministry those suggestion letters related to their functional areas of work for examination and resolution according to Clause 1 of Article 26 of this Regulation.
2. Guide, inspect, and urge agencies and organizations under the Ministry in implementing the laws on resolving complaints and accusations, suggestion letters, and receiving citizens.
3. Seek opinions from agencies and organizations under the Ministry on issues related to their functions to advise the Minister in resolving complex complaints and accusations.
4. Monitor, compile, and report to the Minister on the Ministry’s work in resolving complaints and accusations, suggestion letters, and receiving citizens.
Article 24. Authority of the Inspector General of the Ministry
1. Submit to the Minister for decision on inspection when signs of violation of laws on handling complaints and denunciations are discovered;
2. Decide to establish or recommend the Minister to establish inspection teams to handle complaints and denunciations;
3. Recommend the Minister to temporarily suspend the execution of decisions that are contrary to the law on handling complaints and denunciations made by agencies and organizations directly under the Ministry's management;
4. Recommend the Minister to examine responsibility and handle persons under the Minister’s management who have committed violations of laws on handling complaints and denunciations and receiving citizens;
5. Cooperate with heads of agencies and organizations within the Ministry in examining responsibility and handling persons who have committed violations under the management of those agencies and organizations;
6. Recommend the Minister to resolve issues related to the work of handling complaints and denunciations, petitions, and receiving citizens.
Article 25. Responsibilities of the Inspector General of the Ministry
1. Responsibilities in advising on the resolution of administrative decisions and actions complaints
a. Verify, conclude, and recommend the Minister to resolve complaints against administrative decisions and actions of civil servants directly managed by the Minister and assigned by the Minister;
b. Verify, conclude, and recommend the Minister to resolve complaints that the Director of the State Archives and Records Management Department and the Director of the National Academy of Public Administration have resolved but still have complaints;
c. Verify, conclude, and recommend the Minister to resolve complaints about contents within the scope of the Ministry's state management which the People's Committee Chairperson of the provincial level has initially resolved but still have complaints;
d. Take the lead and coordinate with relevant agencies and organizations within the Ministry to advise and propose to the Minister to request the People's Committee Chairperson of the provincial level to reconsider final decisions resolving complaints related to the Ministry's state management functions if new circumstances or signs of law violations causing damage to national interests, citizens' rights and legitimate interests, and organizations are found; if such a request is not implemented, conduct verification, conclusion, and advise the Minister to recommend the Prime Minister to consider and decide;
đ. Take the lead and coordinate with relevant agencies and organizations within the Ministry to advise the Minister on resolving complaints related to the Ministry's state management functions according to the Prime Minister's directives.
2. Responsibilities in advising on the resolution of disciplinary decision complaints
a. Take the lead and coordinate with the Personnel Department of the Ministry to organize verification, conclude, and recommend the Minister to resolve complaints against disciplinary decisions signed by the Minister;
b. Organize verification, conclude, and recommend the Minister to resolve complaints against disciplinary decisions that the Director of the State Archives and Records Management Department and the Director of the National Academy of Public Administration have initially resolved but still have complaints;
c. Organize verification, conclude, and recommend the Minister to resolve complaints against disciplinary decisions that the Minister, Head of a ministry-level agency, Head of an agency under the Government, and the People's Committee Chairperson of the provincial level have initially resolved but still have complaints.
3. Responsibilities in advising on the resolution of denunciation cases
a. Examine, conclude on the content of denunciations, and propose measures to handle denunciations within the Minister's authority when assigned;
b. Examine, conclude on the content of denunciations that the Director of the State Archives and Records Management Department and the Director of the National Academy of Public Administration have resolved but there are violations of the law; in case the conclusion on the resolution of denunciations involves violations of the law, recommend the person who resolved it to re-examine and resolve again.
Article 26. Responsibilities of other agencies and organizations under the Ministry
1. Receive complaints and petitions transferred by the Ministry Inspectorate for consideration and handling according to the authority prescribed in the Decision of the Minister of Home Affairs on the functions, tasks, and powers of their agency or organization;
2. Cooperate with the Ministry Inspectorate upon its request to verify, conclude, and recommend solutions to complaints and denunciations within the authority of the Minister to resolve; appoint authorized representatives to participate in inspection teams resolving complaints and denunciations chaired by the Ministry Inspectorate;
3. Cooperate with the Ministry Inspectorate to advise and propose to the Minister to request the Chairman of the People's Committee at the provincial level to reconsider the final decision on complaints related to the advisory function of their agency or organization; cooperate with the Ministry Inspectorate to advise the Minister in resolving complaints related to the State management function of the Ministry according to the Prime Minister's directives;
4. Provide written comments upon the request of the Ministry Inspectorate on issues related to the advisory function of their agency or organization so that the Ministry Inspectorate can advise the Minister in resolving complaints and denunciations related thereto. The deadline for responding is five working days from the date of receipt of the request from the Ministry Inspectorate;
5. Report periodically every quarter, six months, and annually to the Ministry Inspectorate on the results of resolving complaints, denunciations, petitions, and receiving citizens for consultation for consolidation and reporting to the Minister and the General Inspector;
Chapter VI
MANAGEMENT OF COMPLAINTS AND DENUNCIATIONS RESOLUTION
CITIZEN CONSULTATION
Article 27. Authority to manage the resolution of complaints, denunciations, and citizen consultation of the Minister
1. Issue legal documents on the resolution of complaints, denunciations, and citizen consultation of the Ministry;
2. Organize propaganda and guidance on implementing regulations on complaints, denunciations, and citizen consultation;
3. Inspect and check the implementation of regulations on complaints, denunciations, and citizen consultation;
4. Summarize the situation of complaints and denunciations and the resolution of complaints and denunciations and citizen consultation in the state administrative sector.
Article 28. Authority to manage the resolution of complaints, denunciations, and citizen consultation of the Director of the National Archives and Records Management Department
The Director of the National Archives and Records Management Department implements state management over the resolution of complaints, denunciations, and citizen consultation in the archives and records management sector in accordance with the law.
Article 29. Responsibilities of the Ministry Inspectorate
1. The Ministry Inspectorate assists the Minister in uniformly managing the resolution of complaints, denunciations, and citizen consultation of the Ministry and of agencies and organizations under the Ministry;
2. Draft and submit to the Minister for issuance, and propose amendments and supplements to regulations on the resolution of complaints, denunciations, and citizen consultation of the Ministry;
3. Recommend to the Minister measures to improve and enhance the effectiveness and quality of the work of resolving complaints, denunciations, and citizen consultation of the Ministry;
3. Assist the Minister in inspecting and checking the implementation of regulations on the resolution of complaints and denunciations by agencies, organizations, and individuals under the Minister's authority. When violations of laws on complaints, denunciations, and citizen consultation are discovered, they shall be handled according to authority or recommended to the Minister for handling;
4. Guide agencies and organizations under the Ministry in resolving or advising on the resolution of complaints and denunciations and organizing the execution of decisions on complaint resolution and decisions on denunciation handling;
5. Guide, urge, and inspect the responsibility of the National Archives and Records Management Department and the National Academy of Public Administration in resolving complaints and denunciations and citizen consultation; when necessary, propose to the Minister to convene a meeting with the Director of the National Archives and Records Management Department and the Director of the National Academy of Public Administration to propose measures to organize direction and handling of complex complaint and denunciation cases;
6. Monitor, summarize, and periodically report to the Minister on the situation of complaints and denunciations and citizen consultation of agencies and organizations under the Ministry; implement the reporting system to the General Inspector as prescribed.
Chapter VII
IMPLEMENTATION
Article 30. Awards and Handling of Violations
1. Agencies, organizations, and officials under the Ministry who have achievements in handling complaints, denunciations, and receiving citizens shall be awarded according to the provisions of the law.
2. Officials and employees of agencies and organizations under the Ministry who are responsible for handling complaints, denunciations, and receiving citizens but abuse their positions and powers for personal gain or out of personal motives thereby infringing upon or obstructing the lawful rights and interests of citizens regarding complaints and denunciations shall be subject to disciplinary action or criminal responsibility depending on the severity of the violation; if damage is caused, compensation must be provided according to the provisions of the law.
Article 31. Implementation Provisions
1. The Director of the State Archives and Records Management Agency and the Director of the National Academy of Public Administration shall implement the regulations on handling complaints, denunciations, and receiving citizens of their respective agencies and organizations based on the relevant laws on complaints, denunciations, and receiving citizens and this Regulation.
2. In the course of implementation, if there are difficulties or suggestions for amending and supplementing this Regulation, agencies and organizations under the Ministry are requested to report to the Inspectorate of the Ministry for consolidation and reporting to the Minister for consideration and decision./.
