Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Veterinary Law dated April 29, 2004;

Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Veterinary Law;

Pursuant to Decree No. 119/2008/NĐ-CP dated November 28, 2008 of the Government amending and supplementing certain Articles of Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Veterinary Law;

The Ministry of Agriculture and Rural Development supplements Article 19a of Decision No. 15/2006/QĐ-BNN dated March 8, 2006 of the Minister of Agriculture and Rural Development regarding procedures and processes for animal quarantine, animal products quarantine, and veterinary hygiene inspection as follows:

Article 1. Supplementing Article 19a as follows:

"Article 19a. Importation of uncleaned terrestrial animal products for processing and manufacturing export goods.

1. Uncleaned terrestrial animal products are meat, ears, tails, legs, wings of livestock and poultry that have not been cleaned.

2. The import quarantine of uncleaned animal products for processing and manufacturing export goods shall be carried out according to the regulations on the quarantine of imported animal products (as stipulated in Section 3 of the procedures and processes for animal quarantine, animal products quarantine, and veterinary hygiene inspection of Decision No. 15/2006/QĐ-BNN dated March 8, 2006 of the Minister of Agriculture and Rural Development).

3. Uncleaned terrestrial animal products imported into Vietnam for processing and manufacturing export goods must be quarantined and issued with an export quarantine certificate by the competent veterinary authority of the exporting country containing the following information: name and address of the exporting company; name and address of the production factory of the exported product; name and address of the importing company for processed products; the product originates from animals in regions or farms without related animal diseases as defined by the World Organization for Animal Health (OIE); the product originates from animals that have been inspected before and after slaughter; the product is packaged to ensure veterinary hygiene; the purpose of use is for human consumption.

4. Processing and manufacturing of export goods can only be carried out at facilities ensuring veterinary hygiene conditions and meeting the requirements of the competent authority of the importing country.

5. After processing and manufacturing, when exporting, the quarantine of the product must be conducted according to the regulations on the quarantine of exported animal products; if the product does not meet the requirements of quarantine procedures and food safety, the animal quarantine authority will require the owner to re-export the product back to the exporting country.

Article 2. Effective Date

This Circular takes effect forty-five days from the date of issuance.

Article 3. Responsibility for Implementation

The Director of the Office of the Ministry, the Director of the Department of Animal Health, the Heads of units under the Ministry, and relevant organizations and individuals are responsible for implementing this Circular./.
