concerning the training program for seafarers and inland waterway vessel operators

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004 and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Vietnam Inland Waterways Administration,

The Minister of Transport hereby issues this Circular stipulating the material and technical facilities of vocational training institutions and the training programs for seafarers and inland waterway vessel operators.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the material and technical facilities of vocational training institutions (hereinafter referred to as CSDN) and the training programs for seafarers and inland waterway vessel operators.

Article 2. Applicability

1. This Circular applies to agencies, organizations, and individuals related to the training activities of seafarers and inland waterway vessel operators.

2. This Circular does not apply to agencies, organizations, and individuals related to the training activities of seafarers and inland waterway vessel operators engaged in security and defense duties.

Chapter II

REGULATIONS ON MATERIAL AND TECHNICAL FACILITIES OF VOCATIONAL TRAINING INSTITUTIONS FOR SEAFARERS AND INLAND WATERWAY VESSEL OPERATORS

General standards for classrooms

Article 3. 1. The minimum area of each classroom must be 48 square meters, with a general standard of at least 1.5 square meters per student.

2. Adequate natural lighting and artificial lighting equipment.

3. Well-ventilated space, far from noisy areas and polluted environments.

4. Equipped with sufficient technical equipment, teaching aids, and instructional materials according to the requirements of each subject.

Specific standards for specialized classrooms

Article 4. 1. Foreign language classrooms: equipped with sound systems, radios, CD players for pronunciation and listening exercises.

2. Computer classrooms: at least five operational computers installed on dedicated desks.

3. Law classrooms regarding inland waterway traffic:

a) Have raised relief maps or typical channel diagrams, models of inland waterway navigation signal systems for teaching various scenarios when controlling vessels participating in traffic;

b) Have drawings of inland waterway navigation signals, maps of river systems and inland waterway routes in Vietnam;

c) Equipment quantities and specifications as prescribed in Appendix I of this Circular.

4. Control room for inland waterway vessels:

a) Have simulation or at least a model of the control system;

b) Have instructional tools and equipment for basic operations on the control system in accordance with the minimum quantity and specifications prescribed in Appendix II of this Circular.

5. Theoretical machine-electric classrooms:

a) Have models, detailed drawings of machines, measuring instruments for machine parameters;

b) Have shipboard electrical panels, electrical measuring devices;

c) Equipment quantities and specifications as prescribed in Appendices III and IV of this Circular.

6. Basic maritime vocational classrooms: instructional and learning equipment quantities and specifications as prescribed in Appendix V of this Circular.

Standards for practical workshops

Article 5. 1. Cold workshop:

a) Area of 60 square meters or more;

b) Equipment arranged scientifically and reasonably, ensuring safety and convenience for teaching and learning, with minimum quantities and specifications as prescribed in Appendix VI of this Circular.

2. Machine-electric-mechanical workshop:

a) Area of 60 square meters or more, equipment arranged scientifically and reasonably, ensuring safety and convenience for teaching and learning;

b) Have types of ship engines corresponding to the grades being trained or supplemented;

c) Have diagrams, models of ship electrical systems and power networks, necessary electrical equipment on vessels;

d) Repairing equipment for ship engines have minimum quantities and specifications as prescribed in Appendix VII of this Circular.

Standards for practical driving and operation training areas

Article 6. 1. There must be water areas for practical driving and engine operation training for inland waterway vessels approved by the Branch of Inland Waterways Administration or

Department of Transport agreeing, with channel areas equipped with necessary signals for students' practice. 2. Fixed piers for training captains from grade two upwards or temporary piers for training grade three captains, grade four captains, and professional certificates; have boundary signals for vessels entering and leaving the pier under various scenarios, with sufficient mooring posts and anti-collision cushions for professional maneuvers.

3. Must have sufficient practice vessels according to the professional qualification certificate grades and professional certificates (hereinafter referred to as GCNKNCM, CCCM). During practice, vessels must display the "Training Vessel" sign.

4. Equipment quantities and specifications as prescribed in Appendix VIII of this Circular.

5. There must be locations for students to observe and wait for practice.

Article 7. Teaching Materials

1. There must be a training program and teaching materials issued by the competent state agency, along with a system of specialized reference materials.

2. There must be sufficient lesson plans and lectures for each subject that have been approved according to regulations.

3. There must be adequate record books and forms to serve teaching management, student tracking, and recording in accordance with regulations.

Article 8. Teaching Staff

1. It includes permanent teachers and invited lecturers.

2. The vocational training institution must ensure there are enough teachers to teach all subjects according to the prescribed curriculum, with schedules published for each semester (for training programs) or the entire course period (for supplementary and enhancement programs).

3. The number of invited lecturers shall not exceed fifty percent of the total number of teachers involved in each training program.

Article 9. General Standards for Teachers

1. Must meet the standard qualifications for vocational teachers as stipulated by the Vocational Training Law.

2. Must possess good moral character and ethics.

3. Must be in good health as required by the profession.

4. Must have a clear personal history.

Article 10. Specific Standards for Teachers

1. Theoretical Teachers:

a) Must hold a diploma from a vocational college or higher in the relevant field or an equivalent field assigned to teach;

b) Must have at least level A English proficiency;

c) Must have at least level A computer skills.

2. English Teachers must hold a diploma from a college of foreign languages in English or higher.

3. Practical Teachers:

a) Teachers instructing practical ship captains and chief engineers must hold a Certificate of Competency for Ship Captains and Chief Engineers at a higher rank than the rank assigned to teach;

b) Teachers instructing practical ship captains and chief engineers of the first rank must hold a Certificate of Competency for Ship Captains and Chief Engineers of the first rank and have served in the position of first rank Certificate of Competency for at least thirty-six months.

Article 11. "5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:Types of Vocational Training Institutions

Vocational training institutions for seafarers and inland waterway vessel operators are classified into four types:

1. Vocational training institutions training and supplementing ship captains and chief engineers up to the first rank;

2. Vocational training institutions training and supplementing ship captains and chief engineers up to the second rank;

3. Vocational training institutions training and supplementing ship captains and chief engineers up to the third rank;

4. Vocational training institutions training and supplementing ship captains up to the fourth rank and training and enhancing professional certificates.

Article 12. Provisions on training seafarers and inland waterway vessel operators

1. A vocational training institution meeting the requirements for physical facilities and technical training for seafarers and inland waterway vessel operators up to a certain rank may train seafarers and inland waterway vessel operators up to that rank.

2. A vocational training institution meeting the requirements for physical facilities and technical training for seafarers and inland waterway vessel operators of a higher rank may also train seafarers and inland waterway vessel operators of a lower rank.

Chapter III

ISSUING THE CERTIFICATE OF VOCATIONAL TRAINING INSTITUTION FOR SEAFARERS,

INLAND WATERWAY VESSEL DRIVER

Article 13. Certificate of vocational training institutions for seafarers and inland waterway vessel operators

1. A vocational training institution meeting the requirements for physical facilities and technical training for seafarers and inland waterway vessel operators shall be granted by the competent state agency a Certificate of Vocational Training Institution (hereinafter referred to as the Certificate).

2. Certificate vocational training institution valid for five years. The form of the Certificate is specified in Appendix XI of this Circular.

Article 14. Competence to issue Certificates, temporarily suspend or suspend vocational training activities for seafarers and vessel operators, and revoke Certificates

1. DIRECTOR OF THE VIETNAM INLAND WATERWAY ADMINISTRATION:

a) Issue Certificates to training facilities that meet the requirements for physical infrastructure and technical training for seafarers and inland waterway vessel operators at Class Three and above, professional certificates nationwide, and training facilities under the Directorate; b) Temporarily suspend vocational training activities for seafarers and vessel operators and revoke Certificates for a period of six (6) months for training facilities violating any of the seafarer and inland waterway vessel operator training programs specified in Appendices XII, XIII, XIV, XV, XVI, XVII, XVIII, XIX, XX, XXI, XXII, XXIII, XXIV, XXV, XXVI, XXVII, XXVIII, XXIX, XXX, XXXI, XXXII, XXXIII, and Appendix XXXIV of this Circular; c) Suspend vocational training activities for seafarers and vessel operators and revoke Certificates for a period of twelve (12) months for training facilities that fail to organize training for two consecutive years or violate any of the provisions specified in Appendices I, II, III, IV, V, VI, VII, and Appendix VIII of this Circular;

b) Suspend temporarily the operation of vocational training for seafarers and vessel operators and revoke the Certificate within six (6) months for training establishments violating any of the seafarer and inland waterway vessel operator training programs specified in Appendices XII, XIII, XIV, XV, XVI, XVII, XVIII, XIX, XX, XXI, XXII, XXIII, XXIV, XXV, XXVI, XXVII, XXVIII, XXIX, XXX, XXXI, XXXII, and XXXIII of this Circular;

2. Director of the Department of Transport: a) Issue Certificates for training facilities that meet the requirements for physical infrastructure and technical training for seafarers and inland waterway vessel operators at Class Four, basic safety training certificates, and vocational certificates within the local area; this Circular.

b) Temporarily suspend vocational training activities for seafarers and vessel operators and revoke Certificates for a period of six (6) months for training facilities violating any of the seafarer and inland waterway vessel operator training programs specified in Appendices XIV, XV, XVI, XVII, XXXI, XXXII, XXXIII, and Appendix XXXIV of this Circular, and report to the Vietnam Inland Waterways Directorate;

a) Issue Certificates to training facilities that meet the requirements for physical infrastructure and technical training for seafarers and inland waterway vessel operators at Class Three and above, professional certificates nationwide, and training facilities under the Directorate; of vocational training institutions for seafarers and inland waterway vessel operators c) Suspend vocational training activities for seafarers and vessel operators and revoke Certificates for a period of twelve (12) months for training facilities that fail to organize training for two consecutive years or violate any of the provisions specified in Appendices I, II, III, IV, V, VI, VII, and Appendix VIII of this Circular, and report to the Vietnam Inland Waterways Directorate;

b) Suspend temporarily, within the authority prescribed in point a, Clause 2, Article 5 of this Circular, the operation of vocational training for seafarers and vessel operators and revoke the Certificate within six (6) months for training establishments violating any of the seafarer and inland waterway vessel operator training programs specified in Appendices XIV, XV, XVI, XVII, XXXI, XXXII, and XXXIII of this Circular and report to the Vietnam Inland Waterways Administration;

3. Training facilities permitted to link training in accordance with the Law on Vocational Training, which have been agreed upon by the Department of Transport where the linked training takes place and the competent authority as stipulated herein. Article 15. Documents for Application to Issue Certificate 1. A request letter for issuing a Certificate from the applicant;

2. A copy of the Certificate of Registration for conducting vocational training issued by the competent authority;

3. A copy of the Safety and Fire Prevention Certificate issued by the competent authority;

4. A list of instructors directly involved in teaching in accordance with Appendix IX of this Circular, accompanied by copies of their academic degrees, certificates, and labor contracts; vocational training institution;

5. Documents regarding ownership, usage, or lease agreements for classrooms, workshops, equipment, inland waterway ports, wharfs, waters for practical training; practical training equipment must have complete registration and inspection documents and maritime equipment, life-saving, and firefighting equipment as required.

3. A copy of the Safety Fire Prevention Certificate issued by the competent authority.

4. A list of direct teaching staff members participating in teaching as stipulated in Appendix IX of this Circular, accompanied by copies of diplomas, certificates, and labor contracts of each individual.

5. Documents regarding ownership, usage, or lease agreements for classrooms, workshops, equipment, inland waterway ports, wharfs, waters for practical training; practical training equipment must have complete registration and inspection documents and maritime equipment, life-saving, and fire-fighting equipment as prescribed.

Article 16. Procedure for Issuing Certificates from Class Three Upwards of vocational training institutions for seafarers and inland waterway vessel operators from Class III upwards

1. An organization that requests issuance of a Certificate shall submit one set of application documents in accordance with Article 15 of this Circular directly or through the postal service or other appropriate means to the Vietnam Inland Waterway Administration.

2. The Vietnam Inland Waterway Administration shall receive, examine the application documents, and process them as follows:

a) In cases where the application documents are submitted directly, if the documents are complete, the Administration shall issue a receipt within three working days from the date of receiving all required documents and proceed with on-site inspection; if the documents are incomplete, they shall be returned immediately and the organization shall be guided to complete the documents.

b) In cases where the application documents are received through the postal service or other appropriate means, if the documents are incomplete, within two working days from the date of receiving the documents, the Vietnam Inland Waterway Administration must send a written request to the organization to supplement and complete the documents.

3. The Vietnam Inland Waterway Administration shall organize on-site inspections at vocational training facilities and prepare inspection reports in accordance with Appendix X of this Circular.

4. Within ten working days from the date of receiving all required documents, the Vietnam Inland Waterway Administration shall issue the Certificate to the vocational training facility in accordance with Appendix XI of this Circular. If the Certificate is not issued, a written response explaining the reasons must be provided.Within ten (10) working days from the date of receiving all required documents as prescribed, the Vietnam Inland Waterways Administration shall issue the Certificate to the training establishment as stipulated in Appendix XI of this Circular. In case the Certificate is not issued, a written response stating the reasons must be provided.

Article 17. Procedure for Issuing Certificates of Class Four, Basic Safety Training Certificates, and Professional Certificates of vocational training institutions for seafarers and inland waterway vessel operators Class IV, basic safety training certificate, service certificate

1. An organization that requests issuance of a Certificate shall submit one set of application documents in accordance with Article 15 of this Circular directly or through the postal service or other appropriate means to the Department of Transport.

2. The Department of Transport receives, reviews, and processes the documents as follows:

a) In cases where the application documents are submitted directly, if the documents are complete, the Department shall issue a receipt within three days to proceed with on-site inspection; if the documents are incomplete, they shall be returned immediately and the organization shall be guided to complete the documents.

b) In cases where the application documents are received through the postal service or other appropriate means, if the documents are incomplete, within two working days from the date of receiving the documents, the Department of Transport must send a written request to the organization to supplement and complete the documents.

3. The Department of Transport shall organize on-site inspections at vocational training facilities and prepare inspection reports in accordance with Appendix X of this Circular.

4. Within ten working days from the date of receiving all required documents, the Vietnam Inland Waterway Administration shall issue the Certificate to the vocational training facility in accordance with Appendix XI of this Circular. If the Certificate is not issued, a written response explaining the reasons must be provided.Within ten working days from the date of receiving all required documents, the Department of Transport shall issue the Certificate to the vocational training facility in accordance with Appendix XI of this Circular. If the Certificate is not issued, a written response explaining the reasons must be provided.

Article 18. Reissuing Certificates

1. Before the Certificate expires, sixty days prior, if an organization wishes to continue its training activities for seafarers and inland waterway vessel operators, it must submit an application for reissuance of the Certificate to the competent authority specified in Article 14 of this Circular to obtain a new Certificate. The procedure for reissuing the Certificate is the same as the initial issuance.

2. Certificates issued to vocational training facilities under Decision No. 18/2008/QĐ-BGTVT dated September 17, 2008, and Circular No. 13/2011/TT-BGTVT dated March 30, 2011, of the Minister of Transport will remain valid until December 31, 2015, and must be replaced with new Certificates according to the model specified in Appendix XI of this Circular. The procedure for reissuing the Certificate is the same as the initial issuance.

Chapter IV

REGULATIONS ON SEAFARER TRAINING PROGRAMS

INLAND WATERWAY VESSEL DRIVER

Article 19Seafarer training programs, inland waterway vessel operator training programs

1. The training program for Third Rank Master as stipulated in Appendix XII of this Circular Master Class III as specified in Appendix XII of this Circular.

2. The training program for Third Rank Engineer as stipulated in Appendix XI of this CircularII of this Circular.

3. The training program for First Rank Able Seaman as stipulated in Appendix X V of this CircularIV of this Circular.

4. The training program for First Rank Motorman as stipulated in Appendix XV of this Circular Chief Engineer Class I as specified in Appendix XV of this Circular.

5. The training program for First Rank Inland Waterway Vessel Operator as stipulated in Appendix XVI of this Circular. Vessel Operator Class I as specified in Appendix XVI of this Circular.

Article 20. Supplementary Program for Upgrading GCNKNCM Seafarer Certificates for Inland Waterway Vessel Operators

1. The supplementary program for issuing GCNKNCM certificates for fourth-class inland waterway vessel masters as specified in Appendix XVII of this Circular. Issue the Master Class IV Competency Certificate as specified in Appendix XVII of this Circular.

2. The supplementary program for upgrading GCNKNCM certificates for third-class inland waterway vessel masters as specified in Appendix XVIII of this Circular. Upgrade the Master Class III Competency Certificate as specified in Appendix XVIII of this Circular.

3. The supplementary program for upgrading GCNKNCM certificates for second-class inland waterway vessel masters as specified in Appendix XIX of this Circular. Upgrade the Master Class II Competency Certificate as specified in Appendix XIX of this Circular.

4. The supplementary program for upgrading GCNKNCM certificates for first-class inland waterway vessel masters as specified in Appendix XX of this Circular. Upgrade the Master Class I Competency Certificate as specified in Appendix XX of this Circular.

5. The supplementary program for issuing GCNKNCM certificates for third-class engine room officers as specified in Appendix XXI of this Circular. Issue the Chief Engineer Class III Competency Certificate as specified in Appendix XXI of this Circular.

6. The supplementary program for upgrading GCNKNCM certificates for second-class engine room officers as specified in Appendix XXII of this Circular. Upgrade the Chief Engineer Class II Competency Certificate as specified in Appendix XXII of this Circular.

7. The supplementary program for upgrading GCNKNCM certificates for first-class engine room officers as specified in Appendix XXIII of this Circular. Upgrade the Chief Engineer Class I Competency Certificate as specified in Appendix XXIII of this Circular.

Article 21. Training Program for Issuing Specialized Certificates for Inland Waterway Vessel Operators

1. The training program for issuing certificates to operate high-speed vessels of type I as specified in Appendix XXIV of this Circular.

2. The refresher course program for issuing the Certificate of Competency for operating Type II high-speed vessels as specified in Appendix XXV of this Circular.

2. The training program for issuing certificates to operate high-speed vessels of type II as specified in Appendix XXV of this Circular.

4. The refresher course program for issuing the Certificate of Safety Working on Inland Waterway Vessels Operating Along the Coast as specified in Appendix XXVII of this Circular.

3. The training program for issuing certificates to operate inland waterway vessels along coastal areas as specified in Appendix XXVI of this Circular.

6. The refresher course program for issuing the Certificate of Safety Working on Chemical Carrying Vessels as specified in Appendix XXIX of this Circular.

4. The training program for issuing safety work certificates on inland waterway vessels operating along coastal areas as specified in Appendix XXVII of this Circular.

8. The refresher course program for issuing the Able Seaman Class II Certificate as specified in Appendix XXXI of this Circular.

5. The training program for issuing safety work certificates on inland waterway vessels carrying petroleum products as specified in Appendix XXVIII of this Circular.

10. The refresher course program for issuing the Vessel Operator Class II Certificate as specified in Appendix XXXIII of this Circular.

6. The training program for issuing safety work certificates on inland waterway vessels carrying chemicals as specified in Appendix XXIX of this Circular.

Article 22. Compilation and use of textbooks, question banks, and answer keys.

7. The training program for issuing safety work certificates on inland waterway vessels carrying liquefied gases as specified in Appendix XXX of this Circular.

2. Based on the training programs prescribed in this Circular and the teaching materials already issued by the Vietnam Inland Waterways Administration, the head of the training establishment may organize the compilation and approval of textbooks as formal teaching and learning materials for their own establishment or directly use the teaching materials issued by the Vietnam Inland Waterways Administration.

8. The training program for issuing certificates for second-class seamen as specified in Appendix XXXI of this Circular.

Chapter V

IMPLEMENTING PROVISIONS

Article 23. Reporting System

Annually on December 20, the Department of Transport of the provinces and centrally administered cities shall report to the Vietnam Inland Waterways Administration on the results of issuing Certificates within their respective jurisdictions.

Article 24. Implementation Organization

9. The training program for issuing certificates for second-class engineers as specified in Appendix XXXII of this Circular.

a) Organize the implementation of this Circular;

b) Organize inspections and audits of seafarer and inland waterway vessel operator training activities and the implementation of this Circular throughout the country.

10. The training program for issuing certificates for second-class vessel operators as specified in Appendix XXXIII of this Circular.

3. The head of the training establishment is responsible for implementing this Circular; implement reporting procedures and 11. Article 25. Effective Date

1. Based on the training programs stipulated in this Circular, the Vietnam Inland Waterways Administration shall take the lead and coordinate with vocational training institutions to compile, review, and approve textbooks, question banks, and answer keys as standardized teaching materials nationwide.
