Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Youth dated November 29, 2005;

Pursuant to the proposal of the Minister of Ministry Nassigned, established,

||| centralized method.Decision No. 77/2007/QĐ-BGDĐT dated December 20, 2007 issued by the Minister of Education and Training on procedures and requirements for recognition of foreign education documents awarded to Vietnamese citizens by foreign educational institutions which have been amended and supplemented by Circular No. 26/2013/TT-BGDĐT dated July 15, 2013 issued by the Minister of Education and Training. This Decision stipulates the policy for voluntary activities of youth and the responsibilities of agencies, organizations, and individuals related to the implementation of the policy for voluntary activities of youth.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decision regulates the policy for voluntary activities of youth and the responsibilities of agencies, organizations, and individuals related to the implementation of the policy for voluntary activities of youth.

Article 2. Applicability

1. Vietnamese youth residing, working, and studying within the territory of Vietnam, who have full capacity for civil conduct under the provisions of the law, may participate in voluntary activities.

2. Agencies, organizations, and individuals related to the voluntary activities of youth.

Article 3. Voluntary Activities of Youth

1. The voluntary activities of youth include the following types:

a) Voluntary activities implementing programs, projects, and plans for economic and social development and national defense approved by competent authorities for a period of twenty-four months or more;

b) Community and social voluntary activities organized by the Communist Youth Union of Ho Chi Minh or other youth organizations.

2. Voluntary activities of youth shall be carried out on a voluntary basis, with humanitarian purposes, benefiting the community and society, complying with legal regulations, and being consistent with local customs, traditions, and actual conditions where the voluntary activities take place.

Article 4. Funding for Implementing the Policy on Voluntary Activities of Youth

1. The funding for implementing the policy on voluntary activities of youth as stipulated in Point a Clause 1 Article 3 of this Decision shall be guaranteed from the state budget within programs, projects, and plans that have been approved by competent authorities.

2. The funding for implementing the policy on voluntary activities of youth as stipulated in Point b Clause 1 Article 3 of this Decision shall be covered by the agencies, organizations, and individuals organizing the voluntary activities or raised through legitimate sources of assistance and sponsorship according to the provisions of the law.

hChapter II

POLICY FOR VOLUNTARY ACTIVITIES OF YOUTH IMPLEMENTING PROGRAMS, PROJECTS, AND PLANS

Article 5. Policy for Youth During the Implementation of Programs, Projects, and Plans

1. Entitled to enter into labor contracts in accordance with the provisions of the law.

2. Entitled to participate in and enjoy social insurance, health insurance, unemployment insurance benefits as prescribed by the law.

3. Entitled to receive salary or wages, allowances, subsidies, travel expenses, and other benefits and policies as prescribed in the programs, projects, and plans that have been approved by competent authorities.

4. Provided with work equipment and personal protective equipment (if necessary) ensuring safety and suitability for the requirements of voluntary activity tasks.

5. Entitled to training and enhancement to improve knowledge and necessary skills to meet the assigned task requirements.

6. Assigned and tasked with duties commensurate with their trained expertise and the needs for arranging and utilizing youth participation in voluntary activities.

7. Entitled to participate in mass organizations' activities; considered and admitted into the Youth Union, or the Party if they meet the criteria and standards stipulated in the Charter of the Communist Youth Union of Ho Chi Minh and the Charter of the Communist Party of Vietnam.

8. Local authorities where the voluntary activities take place shall create favorable conditions for stable accommodation, living, and participation in political, cultural, and social activities at the locality where the voluntary activities take place.

9. Local party committees and authorities where the voluntary activities take place shall consider and provide sources of cadres and managers suitable for the local cadre leadership and management planning.

10. Youth participating in voluntary activities who perform courageous acts resulting in death or injury as defined by the law on preferential treatment for persons meritorious to the revolution shall be recognized as martyrs or entitled to receive benefits as war invalids according to the law on preferential treatment for persons meritorious to the revolution by the People's Committee of the commune where the voluntary activities take place upon recommendation by the competent authority.

11. In case of death during voluntary activities, the organization conducting the voluntary activities shall support funeral arrangements and transportation back to the home province or family.

Article 6. Policies for young people after completing programs, projects, and initiatives

1. They are prioritized for review to enjoy policies on resettlement in new economic zones, youth villages, and youth islands.

2. The competent authority where voluntary activities take place shall consider, plan, train, and deploy them if they complete their tasks well and wish to continue working in the locality.

3. They are supported once with half of their current monthly salary after completing assigned tasks.

4. They are given priority in admission when enrolling in college, university, and postgraduate education systems.

5. If returning to the place of origin, they are provided conditions by local party committees and authorities to stabilize their lives.

6. Young people who achieve outstanding results in voluntary activities are rewarded according to the law on commendation and rewards.

Chapter III

POLICIES FOR VOLUNTARY ACTIVITIES OF YOUNG PEOPLE FOR THE COMMUNITY AND SOCIETY

Article 7. Policies for young people during the process of participating in voluntary activities

1. They are trained and enhanced in knowledge, skills, and techniques related to voluntary activities.

2. They receive allowances during voluntary activities, are equipped with work tools, and personal protective equipment (if necessary) ensuring safety and suitability for voluntary activity requirements.

3. They can participate in mass organizations; be considered for admission into the Youth Union and the Communist Party if they meet the criteria stipulated in the Charter of the Ho Chi Minh Communist Youth Union and the Charter of the Communist Party of Vietnam.

4. Young people who bravely act and die or are injured in one of the cases specified in the law on preferential treatment for those meritorious to the revolution shall be recognized as martyrs or granted benefits equivalent to those of war invalids according to the law on preferential treatment for those meritorious to the revolution by the People's Committee of the commune where the voluntary activity takes place upon recommendation from the organizing body.

5. Young people who have participated in social insurance and health insurance are entitled to benefits under the laws on social insurance and health insurance.

6. Young people participating in voluntary activities who are not required to join compulsory social insurance and health insurance and have not joined voluntary social insurance and health insurance and suffer accidents during voluntary activities are entitled to the following policies by the organization of voluntary activities:

a) In case of an accident leading to a reduction in labor capacity from 5% to 30%, they are supported at least half the cost of medical treatment, recovery, and rehabilitation of reduced functions.

b) In case of an accident leading to a reduction in labor capacity of 31% or more, in addition to the support provided under Point a of this Clause, they are granted a one-time allowance equal to three times the minimum wage level, and for each additional 1% reduction, they receive an additional half the minimum wage level.

c) In case of death due to a workplace accident, they are granted a one-time allowance equal to thirty-six times the minimum wage level.

7. Young people participating in voluntary activities who die are assisted by the organizing body of voluntary activities with funeral expenses and transportation back to their hometown or family.

Article 8. Policy for young people after completing voluntary activities

1. They shall enjoy support policies for vocational training and job creation in accordance with the laws on vocational education and the laws on employment.

2. They shall be considered and given priority in selection to participate in programs, projects, and plans for socio-economic development and national defense if they have engaged in voluntary activities for three months or more. In cases where multiple voluntary activities are participated in consecutively, the time spent on voluntary activities shall be accumulated.

3. Young people who are civil servants, public officials, employees working in state economic organizations, and armed forces personnel participating in voluntary activities with courageous actions to save people and property of the State and the people, and who require treatment according to the conclusion of health authorities, shall have their time off work for treatment counted towards the time they enjoy state benefits and policies as stipulated by law.

4. Young students participating in voluntary activities with courageous actions to save people and property of the State and the people, and who require treatment according to the conclusion of health authorities, causing interruption to their study process, shall be considered and provided conditions to complete their study program.

5. Young people with outstanding achievements in voluntary activities shall be rewarded in accordance with the laws on competition and rewards.

Article 9. Policy for agencies organizing voluntary activities for the community and society

1. They shall be allowed to mobilize and utilize aid and sponsorship in cash or products from legitimate sources of aid and sponsorship in accordance with the law.

2. They shall be provided favorable conditions and security assurance during the organization of voluntary activities by People's Committees at all levels.

3. Agencies organizing voluntary activities with outstanding achievements in voluntary activities shall be rewarded in accordance with the laws on competition and rewards.

hPart IV

RESPONSIBILITY FOR IMPLEMENTATION AND PROVISIONAL CLAUSES

Article 10. Responsibilities of young people participating in voluntary activities

1. Young people participating in voluntary activities as specified in Point a Clause 1 Article 3 of this Decision shall fulfill the responsibilities assigned in the programs, projects, and plans approved by competent authorities.

2. Young people participating in voluntary activities as specified in Point b Clause 1 Article 3 of this Decision shall have the following responsibilities:

a) Registering to participate in voluntary activities with the agency organizing voluntary activities;

b) Adhering to legal regulations, internal rules of the agency organizing voluntary activities, and local customs and traditions where the voluntary activities take place;

c) Fulfilling tasks assigned by the agency organizing voluntary activities; uniting and coordinating well with local young people during the voluntary activities;

d) Young people who are civil servants, public officials, or employees participating in voluntary activities must report and obtain approval from the competent authority managing and using civil servants, public officials, and employees;

đ) Young students participating in voluntary activities during their study period must report and obtain approval from the direct management agency or unit.

Article 11. Responsibilities of agencies organizing voluntary activities

1. Agencies organizing voluntary activities as specified in Point a Clause 1 Article 3 of this Decision shall be responsible for ensuring policies for young people participating in voluntary activities as stipulated in Articles 5 and 6 of this Decision, and other systems and policies within programs, projects, and plans approved by competent authorities.

2. Agencies organizing voluntary activities as specified in Point b Clause 1 Article 3 of this Decision shall have the following responsibilities:

a) Develop plans for organizing voluntary activities, clearly stating the purpose, time, location, content, program of voluntary activities, number, and composition of young people participating in voluntary activities;

b) Submit plans for organizing voluntary activities to the People's Committee of the commune where the voluntary activity takes place before organizing such activities; submit to the People's Committee of the district if the voluntary activity takes place in two communes under the jurisdiction of the district; submit to the People's Committee of the province if the voluntary activity takes place in two districts under the jurisdiction of the province. At the same time, coordinate with the Communist Youth Union at the same level to organize the implementation;

c) Organize voluntary activities, manage young people participating in voluntary activities in accordance with the plan, safely, effectively, avoiding formalism that leads to waste, and aligning with local socio-economic development tasks;

d) Establish internal regulations for voluntary activities, provide necessary knowledge and skills for young people participating in voluntary activities;

đ) Provide work equipment, personal protective gear suitable to the requirements of voluntary activities; ensure health and safety for young people participating in voluntary activities;

e) Pay allowances to young people during their participation in voluntary activities (if applicable);

g) Support or cover all expenses or provide subsidies for cases as stipulated in Clauses 6, 7, and 8 of Article 7 of this Decision;

h) Provide information when requested by local authorities and relevant agencies and organizations during the organization of voluntary activities;

i) Issue certificates of participation in voluntary activities for young people who complete voluntary tasks well, serving as grounds for preferential consideration in recruitment and employment as civil servants, public officials, employees, and workers in state agencies, public service units, and economic organizations in Vietnam;

3. The head of the agency organizing voluntary activities shall bear individual responsibility under the law for violations committed by young people participating in voluntary activities.

Article 12. Responsibilities of People's Committees at various levels where voluntary activities take place

1. People's Committees at various levels where voluntary activities take place as specified in Point a Clause 1 Article 3 of this Decision shall implement responsibilities assigned in programs, projects, and plans approved by competent authorities, and responsibilities as stipulated in Points b and d Clause 2 of this Article.

2. People's Committees at various levels where voluntary activities take place as specified in Point b Clause 1 Article 3 of this Decision shall have the following responsibilities:

a) Notify the agency organizing voluntary activities of the acceptance of voluntary activities in the locality according to their authority; if they disagree, they must specify the reasons (regarding the objectives, scope, content, number, and composition of young people participating in voluntary activities);

b) Create favorable conditions and ensure security and order so that agencies, organizations, and individuals can carry out voluntary activities according to the plan for organizing voluntary activities;

c) Temporarily suspend or terminate voluntary activities that violate the law or do not comply with the plan for organizing voluntary activities;

d) Report and propose to competent authorities timely handling and resolution of violations of the law in voluntary activities within their jurisdiction.

Article 13. Responsibilities of ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally governed cities

1. Ministry of Home Affairs

a) Take the lead and coordinate with the Ho Chi Minh Communist Youth Central Committee to implement policies regarding youth volunteer activities;

b) Guide, monitor, urge, and inspect the implementation; periodically organize mid-term reviews, final evaluations, and assessments to serve as a basis for proposing improvements to mechanisms and policies for youth volunteer activities to competent authorities.

2. Ministry of Education and Training

a) Direct and guide educational institutions to recognize the results of students' participation in volunteer activities in their assessment, classification, graduation examination according to regulations stipulated by laws on education and training;

b) Issue commendation and reward forms within their authority for young people actively participating and successfully completing volunteer tasks in educational institutions.

3. Ministries, central agencies, and People's Committees of provinces and centrally governed cities

a) Organize and manage youth volunteer activities in accordance with this Decision;

b) Create favorable conditions for youth volunteer activities within their jurisdiction; establish mechanisms to mobilize young people to participate in volunteer activities;

c) Guide, monitor, urge, and inspect the implementation; regularly report the results of youth volunteer activities to the Ministry of Home Affairs for consolidation and reporting to the Prime Minister;

d) Pay attention to, care for, and protect the legitimate rights and interests of young people; mobilize social resources to ensure youth volunteer activities;

e) Inspect, investigate, and resolve complaints and denunciations within their authority regarding policies for youth volunteer activities.

Article 14. Ho Chi Minh Communist Youth Central Committee

1. Organize propaganda and mobilization to enhance young people's awareness and promote their role in participating in volunteer activities.

2. Coordinate with ministries and central agencies to direct and provide guidance on youth volunteer activities.

3. Direct and guide provincial and centrally governed city Ho Chi Minh Communist Youth Committees and other lawful youth organizations to manage, connect, gather information, and create supportive conditions for young people to participate in volunteer activities.

4. Provide guidance to levels of the Youth League on methods to mobilize young people to participate in volunteer activities within their organizations.

5. Commend and honor organizations and individuals with outstanding achievements in volunteer activities.

Article 15. Implementation Provisions

1. This Decision takes effect from January 1, 2016.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees, and related agencies, organizations, and individuals are responsible for implementing this Decision./.
