CIRCULAR

Amending and supplementing certain Articles of Circular No. 04/2015/TT-BCAdated January 5, 2015 of the Ministry of Public Security on sample documents related to entry, exit, residence of foreigners in Vietnam 

Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated June 16, 2014 and the Law Amending and Supplementing Certain Provisions of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated November 25, 2019;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Immigration Administration Department;

The Minister of Public Security hereby issues this Circular amending and supplementing certain Articles of Circular No. 04/2015/TT-BCA on sample documents related to entry, exit, and residence of foreigners in Vietnam.

Article 1. Amending and supplementing certain Articles of Circular No. 04/2015/TT-BCA dated January 5, 2015 of the Ministry of Public Security on sample documents related to entry, exit, and residence of foreigners in Vietnam

1. Amending and supplementing Clause 1 of Article 1 as follows:

"1. This Circular stipulates, guides the use, and manages various types of sample documents related to entry, exit, and residence of foreigners in Vietnam as prescribed in the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam and the Law Amending and Supplementing Certain Provisions of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam."

2. Supplementing some Clauses of Article 2 as follows:

a) Add Clause 1a after Clause 1 as follows:

"1a. Information for requesting an electronic visa (NA1a)."

b) Supplementing Clause 19 and 20 after Clause 18 as follows:

"19. Document requesting an electronic account (NA19).

20. Document requesting cancellation of an electronic account (NA20)."

3. Supplementing Clause 3a, 3b, and 3c after Clause 3 of Article 3 as follows:

"3a. Reply letter for requesting an electronic account (NB8).

3b. Notification letter refusing issuance of an electronic account (NB9).

3c. Notification letter for cancellation of an electronic account (NB10)."

4. Supplementing Clause 2a, 2b after Clause 2 and Clause 14, 15 after Clause 13 of Article 4 as follows:

"2a. Electronic visa (NC2a).

2b. Visa based on personnel approval list of the immigration management agency (NC2b).

14. Sample stamp for invalidation of usage value (NC17).

15. Sample stamp for expiration of usage value (NC18)."

5. Amending Point a Clause 1 of Article 5 as follows:

"a) The Immigration Management Department shall be responsible for contracting with the Institute of Science and Technology - Ministry of Public Security to research, design, and produce white print products to meet the timely requirements of competent authorities issuing visas, temporary residence cards, permanent residence cards, and visa exemption certificates."

6. Replacing the phrase "January 29, 2012" with the phrase "January 29, 2002," the phrase "Circular No. 02/2012/TT-BCA" with the phrase "Circular No. 02/2013/TT-BCA," and the phrase "Circular No. 25/2013/TT-BCA" with the phrase "Circular No. 25/2014/TT-BCA" in Clause 1 of Article 6.

Article 2. Effectiveness and responsibility for implementation

1. This Circular takes effect from July 1, 2020.

2. The Immigration Management Department shall take the lead, coordinate with public security units at all levels and other relevant units to organize the implementation and guide and inspect the implementation of this Circular. Heads of subordinate units under the Ministry, Directors of provincial-level public security departments directly under the central government shall be responsible for implementing this Circular. In case of difficulties during implementation, public security units at all levels shall report to the Ministry (through the Immigration Management Department) for prompt guidance.
