CIRCULAR

Guidelines for competition and reward activities concerning Domestic air passenger transport service on regular basic economy classcivilian self-defense volunteers

Pursuant to the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated November 16, 2013;

Based on the Militia Self-Defense Law dated November 22, 2019;

Pursuant to the Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward;

Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Political Department;

The Minister of National Defense issues this Circular guiding competition and reward activities concerning Civilian Self-Defense Volunteers.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides competition and reward activities concerning Civilian Self-Defense Volunteers, including: organization of competition movements, titles and criteria for competition titles; forms, subjects, and criteria for rewards; authority to decide on rewards; procedures, formalities, and files for rewards; competition and reward funds; prize money and preferential policies.

Article 2. Applicability

1. Individuals

a) Individuals holding command positions in Civilian Self-Defense Volunteer units, Civilian Self-Defense Volunteer soldiers;

b) Individuals not belonging to the components of Civilian Self-Defense Volunteers who have achieved results in Civilian Self-Defense Volunteer work.

2. Groups

a) Civilian Self-Defense Volunteer units from squad level and above;

b) Military Command Boards at commune level; Military Command Boards of agencies and organizations; Central Ministries' Military Command Boards;

c) Military agencies;

d) People's Committees at all levels; state agencies; political organizations; political-social organizations; political-social-professional organizations; social-professional organizations; economic organizations; international organizations in Vietnam; foreign agencies and organizations and other agencies, units, and organizations with achievements in Civilian Self-Defense Volunteer work.

Article 3. Principles for awarding competition titles and rewards

Implement the principles stipulated in Article 6 of the Law on Competition and Reward; Article 3 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing certain provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 91/2017/ND-CP) and the following specific provisions:

1. The regular awarding of competition titles and rewards for Civilian Self-Defense Volunteers is carried out by military agencies at various levels under the leadership and guidance of the Ministry of National Defense, Military Zone Commanders, Hanoi Capital Military Command; local party committees, governments, military party committees at the same level, heads of agencies and organizations; management, guidance by higher-level military agencies and coordination with competition and reward agencies at the same level.

2. At the same time, for the same achievement, if already awarded a competition title or reward in another field, then no competition title or reward will be awarded for Civilian Self-Defense Volunteer work or if already awarded a competition title or reward for Civilian Self-Defense Volunteer work, then no competition title or reward will be awarded in another field.

3. Rewards shall not be granted to collectives or individuals currently under consideration for disciplinary action or under investigation, audit, inspection when there are signs of violation or complaints and denunciations that are being verified and have not yet been concluded.

Article 4. Responsibilities for organizing competition movements and rewards

Implement the provisions stipulated in Articles 6, 7, and 8 of Decree No. 91/2017/ND-CP and the following specific provisions:

1. The Minister of National Defense directs, launches, and organizes competition movements; reviews and selects outstanding collectives and individuals to award competition titles and rewards or proposes the Prime Minister, President to award rewards for Civilian Self-Defense Volunteers nationwide.

2. Heads of military zones, military branches, Border Guard Command, Coast Guard Command, Hanoi Capital Military Command, arms, and corps direct, launch, and organize competition movements; review and select outstanding collectives and individuals to award competition titles and rewards or propose higher authorities to award competition titles and rewards for Civilian Self-Defense Volunteers within their jurisdiction.

3. Heads of central agencies and Chairmen of People's Committees at all levels launch and direct competition movements among Civilian Self-Defense Volunteers within their jurisdiction according to the Law on Competition and Reward.

4. Local military agencies direct, launch, and organize competition movements; identify and select outstanding collectives and individuals to award competition titles and rewards or propose higher authorities to award competition titles and rewards for Civilian Self-Defense Volunteers within their jurisdiction.

5. Central Ministries' Military Command Boards, Military Command Boards of agencies and organizations organize competition movements; identify and select outstanding collectives and individuals to award rewards or propose higher authorities to award rewards for self-defense forces under their authority.

6. Civilian Self-Defense Volunteer agencies at various levels, Civilian Self-Defense Volunteer assistants under County Military Command Boards, Commune Military Command Boards are responsible for coordinating with competition and reward agencies at the same level to advise on organizing the implementation of competition and reward activities concerning Civilian Self-Defense Volunteers.

Chapter II

ORGANIZATION OF COMPETITION, AWARDS AND AWARD STANDARDS

Article 5. Forms of Mobilizing Competitions

1. Regular Competition

Shall be organized at the beginning of the year to encourage the Civil Defense Militia forces to strive to achieve their daily, weekly, monthly, quarterly, and annual work targets, tasks, and plans with excellence, individually or collectively.

2. Competitions in batches or on specific topics

Shall be organized to implement key tasks and urgent matters during specified stages and periods, aiming to mobilize the Civil Defense Militia forces to strive for the best performance in urgent tasks or difficult and complex tasks such as combat readiness, combat, support for combat, protection of national sovereignty, security, and border defense, maritime islands, airspace, national security, maintaining public order and safety, fighting crime and law violations; propaganda and mobilization of the people to build strong bases comprehensively; implementation of social policies; prevention, mitigation, and overcoming the consequences of disasters, accidents, natural calamities, epidemics, fires, explosions; search and rescue operations; forest protection, environmental protection, and other civil defense activities.

Article 6. Content of organizing the competition movement

1. Clearly define the goals, scope, and target groups of competitions, based on which specific competition criteria and contents shall be established. The determination of competition content and criteria must be consistent with the actual conditions of localities, agencies, organizations, and Civil Defense Militia units.

2. Based on the characteristics and nature of organizing and building forces, training, contests, sports meetings, and activities of the Civil Defense Militia to determine appropriate forms of competition mobilization, preventing formalism in competitions.

3. Implement measures to organize and carry out competition movements, monitor the competition process, organize pilot guidance to draw lessons and disseminate good experiences to participating competition entities.

4. Summarize and conclude the results of the competition movement; for topic-based or long-term competition movements, preliminary summaries can be conducted midway through the period to draw lessons; at the end of the competition period, conduct a comprehensive summary, evaluate results, assess, and propose commendations for outstanding individuals and collectives in the competition movement.

Article 7. Scope of Organizing Competitions

1. The scope of organizing competitions for the Civil Defense Militia is within the "Determined Victory" competition movement of the Vietnam People's Army, linked with patriotic competition movements of central ministries and sectors, localities, and nationwide.

2. Competition movements in the Civil Defense Militia are organized and launched nationwide or within each agency, organization, unit, and locality. Regular annual competition launches are carried out by local military offices at all levels, subordinate agencies and units under the Ministry of National Defense, and Military Command Boards of central ministries and sectors.

Article 8. Awards

1. For Individuals

a) Title of "National Model Soldier";

b) Title of "Army-wide Model Soldier";

c) Title of "Local Model Soldier";

d) Title of "Advanced Soldier".

2. For Collectives

a) Title of "Determined Victory Unit";

b) Title of "Advanced Unit".

Article 9. Recipients and Standards for Commendation Titles

1. Title of "National Model Soldier"

a) The title of "National Model Soldier" is awarded to individuals holding leadership positions in the Civil Defense Militia, regular Civil Defense Militia soldiers, and mobile Civil Defense Militia soldiers who have outstanding achievements, selected from those who have twice consecutively received the title of "Army-wide Model Soldier," and must have innovative ideas to enhance work efficiency or scientific research projects that have been accepted and applied in practice or demonstrated bravery and creativity in combat and support for combat, achieving significant results, recognized by the Minister of National Defense.

b) The time for considering the title of "National Model Soldier" is immediately following the second year of receiving the title of "Army-wide Model Soldier."

2. Title of "Army-wide Model Soldier"

a) The title of "Army-wide Model Soldier" is awarded to individuals holding leadership positions in the Civil Defense Militia, regular Civil Defense Militia soldiers, and mobile Civil Defense Militia soldiers who have outstanding achievements, selected from those who have three consecutive times or more received the title of "Local Model Soldier," and must have innovative ideas to enhance work efficiency or scientific research projects that have been accepted and applied, achieving significant results or demonstrated bravery and creativity in combat and support for combat, achieving results, recognized by the head of the unit directly under the Ministry of National Defense.

b) The time for considering the title of "Army-wide Model Soldier" is after the third year or more of receiving the title of "Local Model Soldier."

3. Title of "Local Model Soldier"

The title of "Local Model Soldier" is awarded annually to individuals holding leadership positions in the Civil Defense Militia, regular Civil Defense Militia soldiers, and mobile Civil Defense Militia soldiers who have excellently completed assigned tasks, selected from those meeting the standards for the title of "Advanced Soldier," and must have innovative ideas to enhance work efficiency or scientific research projects that have been accepted and applied at the unit level or demonstrated bravery and creativity in combat and support for combat, achieving results, recognized by the head of the unit from the Military Command Board of the district or equivalent level or higher.

4. Title of "Advanced Soldier"

The title of "Advanced Soldier" is awarded annually to individuals holding leadership positions in the Civil Defense Militia, regular Civil Defense Militia soldiers, and mobile Civil Defense Militia soldiers who meet the following standards:

a) Successfully fulfill assigned responsibilities and tasks (training, combat readiness; protecting national security, maintaining public order and safety, fighting crime and law violations; propaganda and mobilization of the people to build strong comprehensive bases; implementing social policies; preventing, mitigating, and overcoming the consequences of disasters, accidents, natural calamities, epidemics, fires, explosions; search and rescue operations; forest protection, environmental protection, and other civil defense activities);

b) Fully complete the training content and program; 100% of test or inspection items meet requirements, including at least 65% achieving good or excellent grades;

c) Successfully complete labor production, study, and work tasks.

d) Adhering well to the Party's guidelines and policies, and the State's laws; having a spirit of solidarity, mutual assistance, actively participating in competitive movements; having a healthy moral character and lifestyle.

5. The title "Victory Unit"

The title "Victory Unit" is awarded annually to the People's Militia Command at the commune level, the People's Militia Command of agencies, organizations, and permanent People's Militia units, mobile self-defense militia units that meet the following criteria:

a) Innovative, overcoming difficulties, excellently completing all competition targets and assigned tasks for the year; 100% of examination or inspection contents meet the requirements, including at least 75% achieving good or excellent results;

b) All individuals in the collective have completed their assigned tasks;

c) There is an individual who has been awarded the title "Model Worker at the Grassroots Level";

d) There is a regular, practical, and effective competitive movement;

đ) Internal unity, exemplary adherence to the Party's guidelines and policies, and the State's laws; no incidents of violations requiring handling occur; there are no individuals disciplined with warnings or higher;

6. The title "Advanced Unit"

The title "Advanced Unit" is awarded annually to the People's Militia Command at the commune level, the People's Militia Command of agencies, organizations, and permanent People's Militia units, mobile self-defense militia units that meet the following criteria:

a) Successfully completing all competition targets and assigned tasks; 100% of examination or inspection contents meet the requirements, including at least 65% achieving good or excellent results;

b) There is a regular, practical, and effective competitive movement;

c) Internal unity, exemplary adherence to the Party's guidelines and policies, and the State's laws; no incidents of violations requiring handling occur; there are no individuals disciplined with warnings or higher;

Article 10. Proportion of awarding commendation titles

1. The title "National Model Worker": No proportion specified.

2. The title "Military Model Worker": No proportion specified.

3. The title "Grassroots Model Worker": Awarded not exceeding 5% of the total number of individuals holding leadership positions in self-defense militia units, permanent People's Militia soldiers, and mobile self-defense militia units.

4. The title "Advanced Worker": Awarded not exceeding 10% of the total number of individuals holding leadership positions in self-defense militia units, permanent People's Militia soldiers, and mobile self-defense militia units.

5. The title "Victory Unit": Awarded not exceeding 5% of the total number of People's Militia Command units at the commune level, People's Militia Command of agencies, organizations, and permanent People's Militia units, mobile self-defense militia units.

6. The title "Advanced Unit": Awarded not exceeding 10% of the total number of People's Militia Command units at the commune level, People's Militia Command of agencies, organizations, and permanent People's Militia units, mobile self-defense militia units.

Chapter III

FORMS, OBJECTS, AND STANDARDS OF REWARD

Article 11. Forms of State Awards for Self-Defense Militia

1. Forms of awards include:

a) The title "People's Armed Forces Hero";

b) "National Defense Order" First Class, Second Class, Third Class;

c) "Combat Merit Medal" First Class, Second Class, Third Class;

d) "Bravery Medal";

đ) "Prime Minister's Commendation";

2. Recipients and criteria for awards

a) The title "People's Armed Forces Hero": Implemented according to the provisions of Article 60 of the Law on Competition and Reward.

b) "National Defense Order" First Class, Second Class, Third Class: Implemented according to the provisions of Articles 45, 46, 47 of the Law on Competition and Reward and Articles 25, 26, 27 of Decree No. 91/2017/ND-CP.

c) "Combat Merit Medal" First Class, Second Class, Third Class: Implemented according to the provisions of Article 48 of the Law on Competition and Reward and Articles 28, 29, 30 of Decree No. 91/2017/ND-CP.

d) "Bravery Medal": Implemented according to the provisions of Article 50 of the Law on Competition and Reward and Article 32 of Decree No. 91/2017/ND-CP.

đ) "Prime Minister's Commendation": Implemented according to the provisions of Article 71 of the Law on Competition and Reward and Article 38 of Decree No. 91/2017/ND-CP.

Article 12. Forms of rewards for the People's Militia by the Ministry of National Defense

1. Medal "For the Cause of Mass Armed Forces".

2. Certificate of Merit.

3. Letter of Commendation.

Article 13. Medal "For the Cause of Mass Armed Forces"

1. The Medal "For the Cause of Mass Armed Forces" shall be awarded to individuals holding command positions in the People's Militia, militia soldiers who have fulfilled their duties excellently; individuals with significant contributions to the People's Militia of Vietnam, meeting one of the following criteria:

a) Individuals holding command positions in the People's Militia who have served continuously in the People's Militia force for at least 10 years; without violations of discipline from a warning level upwards;

b) For individuals not belonging to the People's Militia, they must have directly worked in People's Militia affairs for at least 15 years, recognized by competent authorities;

c) Militia soldiers who have served continuously in the People's Militia force for at least 6 years; without violations of discipline from a warning level upwards;

d) Individuals holding command positions in the People's Militia, militia soldiers who have been commended by the President of the State or the Prime Minister for outstanding achievements in military and national defense tasks;

e) Vietnamese citizens, overseas Vietnamese, foreigners who have made significant contributions to the People's Militia of Vietnam, recognized by competent authorities.

2. The Medal "For the Cause of Mass Armed Forces" shall only be awarded once to each individual.

Article 14. Certificate of Merit of the Minister of National Defense

1. "Certificate of Merit of the Minister of National Defense" shall be awarded to individuals who set a good example in implementing Party policies, state laws, military discipline, meeting one of the following criteria:

a) Individuals holding command positions in the People's Militia, militia soldiers who have excelled in their duties for two consecutive years or more, during which time they have been honored with the title "Outstanding Soldier at the Base" for two consecutive times or more;

b) Individuals holding command positions in the People's Militia, militia soldiers who have achieved outstanding and sudden accomplishments or have been evaluated during the mid-term and final reviews of mass movements and campaigns initiated by the Government or the Ministry of National Defense;

c) Individuals not belonging to the People's Militia who have achieved outstanding results in People's Militia work, recognized by competent authorities.

2. "Certificate of Merit of the Minister of National Defense" shall be awarded to groups that set a good example in implementing Party policies, state laws, military discipline, meeting one of the following criteria:

a) People's Militia groups that have excelled in their duties for two consecutive years or more, maintaining internal unity, effectively implementing democratic regulations at the grassroots level, organizing well mass movements; caring for the material and spiritual life of group members; practicing thrift; fully implementing systems, policies, and laws;

b) People's Militia groups that have achieved outstanding and sudden accomplishments or have been evaluated during the mid-term and final reviews of mass movements and campaigns initiated by the Government or the Ministry of National Defense;

c) Groups not belonging to the organization of the People's Militia who have achieved outstanding results in People's Militia work, recognized by competent authorities.

Article 15. Commendation certificates from the heads of units under the Ministry of National Defense

1. Commendation certificates from the heads of units under the Ministry of National Defense shall be awarded to individuals or groups within the People's Militia Self-Defense Force who have achieved outstanding and sudden merits or have outstanding achievements in campaigns or movements initiated by the Government, the Ministry of National Defense, or the unit itself.

2. Commendation certificates from the heads of units under the Ministry of National Defense shall be awarded to individuals or groups not belonging to the organization or components of the People's Militia Self-Defense Force who have made outstanding contributions to the work of the People's Militia Self-Defense Force.

Article 16. Certificates of Merit from the Heads of Provincial Military Command; Heads of District Military Command

1. Certificates of Merit from the Heads of Provincial Military Command; Heads of District Military Command shall be awarded to individuals or groups within the People's Militia Self-Defense Force who have achieved sudden merits or outstanding achievements in campaigns or movements initiated by the Government, the Ministry of National Defense, or the unit itself.

2. Certificates of Merit from the Heads of Provincial Military Command; Heads of District Military Command shall be awarded to individuals or groups not belonging to the organization or components of the People's Militia Self-Defense Force who have made contributions to the work of the People's Militia Self-Defense Force.

Article 17. Forms of Reward from the Heads of Central Agencies and People's Committee Chairmen at all Levels

1. Forms of reward from the heads of central agencies and people's committee chairmen at all levels for the People's Militia Self-Defense Force include:

a) Commendation certificates.

b) Certificates of Merit.

2. Recipients and criteria for awards

a) Commendation certificates: Implemented according to the provisions of Articles 72 and 73 of the Law on Competition and Rewards; Article 39 of Decree No. 91/2017/ND-CP and specific regulations of the heads of central agencies and people's committee chairmen at all levels.

b) Certificates of Merit: Implemented according to the provisions of Articles 74, 75, and 76 of the Law on Competition and Rewards; Article 40 of Decree No. 91/2017/ND-CP and specific regulations of the heads of central agencies and people's committee chairmen at all levels.

Chapter IV

AUTHORITY TO DECIDE AWARDS AND PRESENTATIONS

Article 18. Authority to Decide on Rewards

Implemented according to the provisions of Articles 77, 78, 79, 80, and 81 of the Law on Competition and Rewards; Articles 43 and 44 of Decree No. 91/2017/ND-CP and specific regulations as follows:

1. Minister of National Defense

a) Awarding the title "Outstanding Soldier of the Entire Army", "Commendation Certificate of the Minister of National Defense";

b) Awarding the Commemorative Medal "For the Cause of Mass Armed Forces".

2. Heads of units under the Ministry of National Defense

a) Awarding the title "Victorious Unit";

b) Commendation certificates from units under the Ministry of National Defense.

3. The heads of central agencies and people's committee chairmen at all levels decide on rewards for the People's Militia Self-Defense Force under their authority with forms of reward specified in Articles 72, 73, 74, 75, 76, 79, and 80 of the Law on Competition and Rewards; Articles 39 and 40 of Decree No. 91/2017/ND-CP and specific regulations of the heads of central agencies and people's committee chairmen at all levels.

4. Heads of Provincial Military Commands

a) Awarding the title "Outstanding Soldier at the Grassroots Level", the title "Advanced Soldier", Certificates of Merit up to the level of battalion commander of the People's Militia Self-Defense Force or equivalent;

b) Awarding the title "Advanced Unit", Certificates of Merit up to the level of battalion of the People's Militia Self-Defense Force or equivalent.

5. Heads of District Military Commands

a) Awarding the title "Advanced Soldier", Certificates of Merit up to the level of company commander of the People's Militia Self-Defense Force or equivalent;

b) Awarding the title "Advanced Unit", Certificates of Merit up to the level of company of the People's Militia Self-Defense Force or equivalent.

Article 19. Bestowing, receiving commendation titles and award forms

1. When there is a commendation result, units shall announce the commendation decision and present awards to collectives and individuals within the agency, organization, or unit.

2. The organization of bestowing, receiving commendation titles or award forms shall be carried out in accordance with the provisions of Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government on organizing commemorative days; the ceremony for bestowing and receiving award forms and commendation titles; foreign diplomatic rituals and reception of foreign guests.

Chapter V

PROCEDURE, DOCUMENTS FOR COMMENDATION PROPOSALS

Article 20. Commendation procedure and approval process

1. Reporting and evaluating achievements: Collectives and individuals report their achievements at the commendation evaluation conference of the agency, organization, or unit. The conference conducts evaluations and voting by secret ballot or raising hands.

2. The Competition and Reward Council, the Competition and Reward Team meet to review and vote by secret ballot or raising hands for each collective and individual.

3. Political agencies, political cadres (where there is no political agency) or agencies and cadres responsible for the Civil Defense and Self-Defense Force work report to the same-level Party Committee (Standing Committee) for review and resolution.

4. Based on the resolution of the Party Committee (Standing Committee), the head of the agency, organization, or unit, the Chairman of the People's Committees at all levels issue commendation decisions within their authority or propose commendations to higher authorities.

5. Heads of subordinate agencies and units under the Ministry of National Defense; Commanders of Military Districts of central ministries and sectors review and propose the Minister of National Defense (through the Civil Defense and Self-Defense Force Department/General Staff Department) to examine and decide on commendations or submit to the Prime Minister.

6. The Civil Defense and Self-Defense Force Department/General Staff Department receives files, reviews achievements, and reports to the Political General Department (through the Propaganda Department).

7. The Propaganda Department/Political General Department compiles, reviews, and reports to the Director of the Political General Department for review and submits to the Minister of National Defense for examination and decision on commendations or submission to the Prime Minister.

Article 21. Commendation Files

1. General Provisions on Procedures and Files

a) The level that manages the organization and individuals belonging to the Civil Defense and Self-Defense Force organizational structure and salary fund is responsible for commending or proposing commendations to higher authorities for objects within its management scope.

b) Achievement reports of collectives and individuals proposed for commendation must be consistent with the form and level of commendation. Achievement reports are implemented according to the templates (from template number 01 to number 06b) issued together with this Circular. The content of achievement reports must include sufficient grounds to compare with the standards stipulated in the Law on Competition and Rewards and the Government's Decree. When submitting to the Ministry of National Defense, they must be stamped with a cross-stamp; simultaneously send the electronic file of the file to the Civil Defense and Self-Defense Force Department/General Staff Department, except for documents containing state secrets or military secrets.

2. Common proposal files at various levels include:

a) The proposal letter of the unit (according to template number 01 issued together with this Circular);

b) List of proposed commendation titles or award forms;

c) Achievement reports of collectives and individuals proposed for commendation titles or award forms, confirmed by the recommending level (according to templates from number 03 to number 06 issued together with this Circular).

3. Proposal files for presenting "Ministry of National Defense Merit Certificate" are established in one set (original), "Prime Minister Merit Certificate" in three sets (original), Medals in four sets (original), including:

a) Documents specified in Clause 2 of this Article;

b) Minutes of meetings and results of trust votes of the Competition and Reward Council (according to template number 02 issued together with this Circular).

4. Proposal files for conferring and posthumously conferring the title "Hero of the People's Armed Forces" are established in four sets (original), including:

a) Documents specified in Clause 2 of this Article;

b) Minutes of meetings and results of secret ballots of the Competition and Reward Council (according to template number 02 attached to this Circular);

c) Other related files and documents (if any).

5. Proposal files for commendations through simplified procedures apply in cases of sudden commendations, established in two sets (original), including:

a) The proposal letter accompanied by the list of proposed commendations (according to template number 01 attached to this Circular);

b) Summary achievement reports of collectives and individuals, confirmed by the head of the recommending unit (according to templates number 06a, 06b issued together with this Circular).

6. Proposal files for presenting the Commemorative Medal "For the Cause of Mass Armed Forces" are established in one set (original), including:

a) The proposal letter of the unit (according to template number 01 issued together with this Circular);

b) List of proposed recipients of the Commemorative Medal (according to template number 07 issued together with this Circular);

c) Individual application forms, confirmed by the recommending level (according to template number 08 issued together with this Circular).

Article 22. Reporting Time for Files, Review Period, and Notification Time for Awards

1. Time for reporting commendation dossier

Agencies, organizations, and units proposing to confer commendation titles; awards based on achievements and merits (regular awards); and Commemorative Medals "For the People's Armed Cause" shall report to the Ministry of National Defense (through the Militia and Self-Defense Forces Department of the General Staff Department) before March 15 each year.

2. Method of Sending Files: Through military postal service or public postal services.

3. Review of Award Files

Implement the provisions stipulated in Clause 2, Article 48 of Decree No. 91/2017/ND-CP.

4. Notification Time for Award Results

a) Within ten working days from receiving the award decision of the President, Prime Minister, or Minister of National Defense, the Propaganda Department of the Political General Department shall copy the decision and notify the award results to the agencies, organizations, and units that proposed the awards.

b) Within seven working days from receiving the award decision of the competent authority, the agency proposing the award shall notify and send the award results to the awardees.

c) For cases that do not meet the conditions, standards, and files as prescribed, within ten working days from the date of receiving complete files as prescribed, the Propaganda Department of the Political General Department shall notify in writing to the agencies, organizations, and units that proposed the awards.

Chapter VI

COMPETITION FUNDS AND AMOUNT OF AWARDS

AND BENEFITS REGIME

Article 23. Sources, Allocation of Funds; Management and Use of Competition and Award Funds

Implement the provisions stipulated in Articles 36, 37, 38, and 39 of the Militia Law; Articles 64, 65, 66, and 67 of Decree No. 91/2017/ND-CP, and specific regulations on sources of funding and the use of competition and award funds as follows:

1. For awards decided by the heads of local military agencies at all levels; the heads of agencies and organizations at the central level:

a) The award budget shall be implemented according to the provisions of the Militia Law; Articles 64, 65, 66, and 67 of Decree No. 91/2017/ND-CP; Decree No. 163/2016/ND-CP dated December 21, 2016 of the Government detailing certain provisions of the State Budget Law; Decree No. 165/2016/ND-CP dated December 24, 2016 of the Government on managing and using the state budget for certain activities in the defense and security sectors.

b) Annually, local military agencies at all levels; Military Command Boards of agencies and organizations at the central level shall prepare budget plans and report to the Chairman of the People's Committee or the head of the agency or organization at the same level for consideration and decision.

2. For awards decided by the President, Prime Minister, Minister of National Defense, or the head of a unit under the Ministry of National Defense:

a) Award funds are used from the competition and award fund of the Ministry of National Defense;

b) Annually, agencies and units shall prepare budget plans for awards and report to the Ministry of National Defense.

c) The Propaganda Department of the Political General Department shall be responsible for managing and ensuring the budget and materials for national-level and Ministry of National Defense-level awards for the Militia.

Article 24. Prize Money and Benefits

1. Calculation of Prize Money and Benefits: Implement the provisions stipulated in Article 87 of the Law on Competition and Awards; Articles 68 and 75 of Decree No. 91/2017/ND-CP.

2. Amount of Prize Money: Implement the provisions stipulated in Articles 69, 70, 71, 72, and 73 of Decree No. 91/2017/ND-CP and the guidance of the Political General Department.

Chapter VII

IMPLEMENTING PROVISIONS

Article 25. Effectiveness and Transitional Provisions

1. This Circular shall take effect from July 1, 2020, and replace Circular No. 97/2010/TT-BQP dated July 19, 2010, issued by the Ministry of National Defense on guiding the work of competition and commendation in the Self-Defense Force.

2. When the referenced documents in this Circular are amended, supplemented, or replaced by new documents, the content of the references shall also be adjusted and implemented according to the amended, supplemented, or replacing documents.

Article 26. Responsibility for Implementation

1. The Director of the Political General Department, the Chief of the General Staff, and the heads of agencies and units in the Vietnam People's Army; the Commanders of Military District Command; the Chairpersons of People's Committees at all levels and the heads of related agencies and organizations shall be responsible for implementing this Circular.

2. The Political General Department shall take the lead and coordinate with the General Staff Department and related agencies to assist the Minister of National Defense in inspecting and supervising the organization of competitions, awarding titles of honor, and commendations for the Self-Defense Force as prescribed in this Circular.

3. In the course of implementation, if there are any difficulties, central ministries, localities, agencies, and units shall report to the Ministry of National Defense (through the Political General Department) for consideration and resolution./.
