ON THE FUNCTIONS AND DUTIES OF THE DELEGATE WORKING BOARD

NATIONAL ASSEMBLY STANDING COMMITTEE
SOCIALIST REPUBLIC OF VIET NAM

Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992 as amended and supplemented by Resolution number 51/2001/QH10;

Pursuant to the Law on the Organization of the National Assembly amended and supplemented by Law No. 83/2007/QH11;

Pursuant to the Regulation on the Operation of the Standing Committee of the National Assembly issued together with Resolution No. 26/NQ/2004-UBTVQH11;

Considering the Report No. 286 dated December 17, 2007 of the Head of the Delegate Working Board;

RESOLUTION:

Article 1. Position, Functions, and Duties of the Delegate Working Board

The Delegate Working Board is a specialized agency under the Standing Committee of the National Assembly; it is responsible for assisting the Standing Committee of the National Assembly in delegate work, organizational structure, and personnel within the Standing Committee's jurisdiction.

Article 2. Duties of the Delegate Working Board

1. Regarding the election of National Assembly deputies:The Delegate Working Board shall coordinate with relevant agencies and organizations to assist the Standing Committee of the National Assembly in establishing the Election Council, setting and announcing the election date, number of constituencies, constituency lists, and the number of National Assembly deputies to be elected in each constituency; coordinating with the Central Steering Committee of the Fatherland Front of Vietnam to specify the procedures for consensus-building and candidate nominations; proposing and adjusting the composition, membership, and number of National Assembly deputies to be elected from central and local agencies and organizations; allocating candidates nominated by central agencies to run in local elections; supervising and monitoring the election process; examining complaints and reports related to the election; deciding on supplementary elections.

2. Regarding National Assembly deputies and Delegation of National Assembly deputies:The Delegate Working Board shall coordinate with the National Assembly Office and relevant agencies and organizations to assist the Standing Committee of the National Assembly and the President of the National Assembly in guiding the activities of National Assembly deputies and Delegation of National Assembly deputies; maintaining contact with National Assembly deputies; specifying the organization and operation of the Delegation of National Assembly deputies' service office and allocating operational funds for the Delegation of National Assembly deputies; deciding on the transfer of deputy activities; receiving inter-session questions from National Assembly deputies and determining the time frame and format for responses; coordinating with the Session Secretariat to prepare a list of individuals responsible for answering questions at the National Assembly session; following up, summarizing, and urging the implementation of commitments made in response to questions by heads of state agencies accountable to the National Assembly; organizing exchanges of experience and training in knowledge and skills for elected representatives; coordinating with relevant agencies and organizations to assist the Standing Committee of the National Assembly in reviewing issues related to the arrest, search, prosecution, removal from office, dismissal, suspension of duties, and termination of responsibilities of National Assembly deputies; examining and handling complaints and reports related to National Assembly deputies; assisting the Standing Committee of the National Assembly in the procedures and formalities for submitting to the National Assembly for approval the resignation, removal, or cessation of duties of National Assembly deputies.

3. Regarding the remuneration and policies for National Assembly deputies and staff under the management authority of the Standing Committee of the National Assembly:The Delegate Working Board shall coordinate with the National Assembly Office and relevant agencies in preparing documents on salaries and other benefits for full-time National Assembly deputies to be issued by the Standing Committee of the National Assembly; assisting the Standing Committee of the National Assembly and the President of the National Assembly in implementing policies and benefits for National Assembly deputies and staff under the management authority of the Standing Committee of the National Assembly.

4. Regarding personnel work:The Delegate Working Board shall assist the Standing Committee of the National Assembly in serving as the lead coordinator with the Chairman of the Ethnic Council, Heads of Committees, Head of the National Assembly Office, and Heads of Boards under the Standing Committee of the National Assembly in proposing plans for human resource planning for National Assembly agencies and full-time National Assembly deputies according to the分级任务并进行翻译:

Regarding organizational structure and high-level personnel matters:The Representative Work Committee assists the Standing Committee of the National Assembly in the procedures and formalities for submitting to the National Assembly for approval the organizational structure of state agencies; the procedures and formalities for electing, approving, appointing, dismissing, and removing confidence votes for positions elected or approved by the National Assembly; receiving proposals from National Assembly members, the National Ethnic Council, and National Assembly Committees regarding confidence votes for individuals holding positions elected or approved by the National Assembly, and approving the results of the election of the Head and Deputy Head of National Assembly Delegations; assisting the Standing Committee of the National Assembly in the procedures and formalities for establishing and dissolving agencies under the authority of the Standing Committee of the National Assembly.

6. Regarding the activities of People's Councils:The Representative Work Committee shall coordinate with relevant agencies and organizations to assist the Standing Committee of the National Assembly in determining and announcing the election date for representatives of People's Councils at all levels, supervising the election of representatives of People's Councils at all levels, deciding to annul the election of representatives of People's Councils in units where there are serious violations of the law, and deciding on the re-election date in such units; deciding on supplementary elections and announcing the supplementary election date for representatives of provincial-level People's Councils; overseeing and guiding the operation of People's Councils; approving the results of the election of the permanent members of provincial-level People's Councils; assisting the Standing Committee of the National Assembly in the procedures and formalities for considering and deciding to dissolve provincial-level People's Councils when they cause serious damage to the interests of the people; approving the resolution of provincial-level People's Councils regarding the dissolution of directly subordinate People's Councils; stipulating the remuneration system and living expenses for representatives of People's Councils; sending necessary documents to the permanent members of provincial-level People's Councils; maintaining contact with the permanent members of provincial-level People's Councils; organizing meetings on the activities of People's Councils.

7. Regarding supervision activities:The Representative Work Committee shall propose to the Standing Committee of the National Assembly on the supervision program of the National Assembly and the supervision program of the Standing Committee of the National Assembly; proposing the establishment of supervision delegations and working delegations of the Standing Committee of the National Assembly to localities to examine issues raised by National Assembly deputies and National Assembly Delegations.

8. Implementing other tasks assigned by the Standing Committee of the National Assembly and the Chairman of the National Assembly.

Article 3. Organization and working regime of the Representative Work Committee

1. On organizational structure.

The leadership of the Representative Work Committee consists of the Chairperson and Deputy Chairpersons appointed, relieved, or dismissed by the Standing Committee of the National Assembly.

The support staff of the Representative Work Committee includes the Department of Representative Work and the Training Center for Elected Representatives. The staffing of the support staff of the Representative Work Committee is decided by the Standing Committee of the National Assembly.

The selection of officials and civil servants, appointment, and dismissal of leaders within the support staff of the Representative Work Committee shall be decided by the Chairperson of the Representative Work Committee in coordination and agreement with the Director of the National Assembly Office; the Director of the National Assembly Office shall issue the decision. The Chairperson of the Representative Work Committee shall coordinate and agree with the Director of the National Assembly Office in managing and implementing policies and benefits for officials and civil servants within the support staff of the Representative Work Committee.

2. On working regime:

The Representative Work Committee operates under the head system. The Chairperson of the Representative Work Committee is responsible to the Standing Committee of the National Assembly and the Chairman of the National Assembly. Deputy Chairpersons assist the Chairperson in performing tasks as assigned by the Chairperson. When the Chairperson is absent, a Deputy Chairperson authorized by the Chairperson shall perform the duties and powers of the Chairperson.

Based on its functions, tasks, authorities, and organizational structure, the Representative Work Committee shall establish a Working Regulation and work procedures to ensure effective performance of assigned tasks.

Article 4.Duties and authorities of the Chairperson of the Representative Work Committee

1. Organizing and directing the activities of the Committee according to its assigned functions and tasks.

2. Being subject to the direction of the Standing Committee of the National Assembly and the Chairman of the National Assembly; maintaining contact with the permanent members of the Ethnic Minority Council, the permanent members of the National Assembly Committees, the National Assembly Office, the Committees of the Standing Committee of the National Assembly, National Assembly Delegations, and relevant agencies and organizations in the implementation of the Committee's functions and tasks.

3. Deciding on the use of the budget allocated to the Committee.

4. Performing other tasks assigned by the Standing Committee of the National Assembly and the Chairman of the National Assembly.

Article 5. Conditions to ensure the operation of the Delegation Work Board

The Delegation Work Board shall have its own seal in accordance with the State's regulations.

The operating budget of the Delegation Work Board is part of the National Assembly's operating budget. The material infrastructure and operational conditions for the Delegation Work Board shall be guaranteed by the National Assembly Office.

Article 6. Implementation Provisions

This Resolution replaces Resolution No. 368/NQ-UBTVQH11 dated March 17, 2003 of the Standing Committee of the National Assembly, Term XI, and shall take effect from the date of signature.

The Head of the Delegation Work Board, the Chairman of the National Assembly Office, and relevant agencies and organizations shall implement this Resolution in accordance with their responsibilities./.
