Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 95/1998/NĐ-CP dated November 17, 1998 of the Government on the recruitment, utilization, and management of civil servants;

Pursuant to Decision No. 150/1999/QĐ-TCCP dated February 12, 1999 of the Minister - Head of the Civil Service Personnel Committee of the Government on the issuance of the Examination Regulations for Civil Servant Grade Promotion;

In accordance with the agreement of the Civil Service Personnel Committee of the Government in Circular No. 175/BTCCBCP-CCVC dated April 17, 2000 regarding the unification for the Ministry of Agriculture and Rural Development to issue the Regulations for Civil Servant Grade Promotion Examinations in the Agriculture and Rural Development sector,

Article 1. - The attached Decision promulgates "Regulations on Civil Servant Grade Promotion Examinations in the Agriculture and Rural Development Sector".

Article 2.-This decision shall take effect fifteen days from the date of signature.

Article 3.-The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for directing the implementation of this Decision.

Article 4.-The Director of the Ministry’s Office, Heads of the Civil Service Personnel Department, and Heads of related units within the Ministry are responsible for implementing this Decision.

REGULATIONS

On Civil Servant Grade Promotion Examinations in the Agriculture and Rural Development Sector
(Attached to Decision No. 58/2000/QĐ-BNN dated May 25, 2000)

PART I

GENERAL PROVISIONS

Article 1

The examination for civil servant grade promotion shall be conducted based on the following principles:

1. Grade promotion must be based on the needs and job positions.

2. Candidates for grade promotion examinations must have good moral character and possess all required certificates and diplomas for the new grade.

3. The organization of civil servant grade promotion examinations must ensure transparency, fairness, democracy, and quality.

Article 2

Candidates for grade promotion examinations under these regulations are civil servants appointed to grades within the Agriculture and Rural Development sector working at central and local agencies and organizations.

Article 3. Candidates nominated to participate in grade promotion examinations must meet the following conditions:

- Being selected by the Preliminary Selection Board according to the quota allocated by the competent authority to the agency, organization, or unit.

- Meeting the professional standards of the grade being applied for (as stipulated in Decisions No. 409, 413, 417/TCCP-VC dated May 29, 1993 of the Minister, Head of the Civil Service Personnel Committee of the Government on the issuance of professional standards for civil servant grades in the Agriculture and Rural Development, Water Resources, and Forestry sectors).

Article 4. The application dossier for candidates registering for grade promotion examinations includes:

- An application form for grade promotion examination (according to Model No. 1 in Decision No. 27/1999/QĐ-BTCCBCP dated July 26, 1999 of the Minister, Head of the Civil Service Personnel Committee of the Government).

- A performance evaluation and assessment by the direct employing and managing unit regarding the candidate's moral character, capability, work efficiency, and labor discipline awareness over a continuous three-year period up to the year of nomination.

- A scientific curriculum vitae confirmed by the employing and directly managing unit (attached model).

- Photocopies of certificates and diplomas with confirmation from the employing and managing unit.

- Two 4x6 inch photographs and two envelopes with stamps and address for contact.

The candidate's dossier shall be placed in a file folder measuring 21cm x 32cm and submitted to the Preliminary Selection Board.

Article 2. - This Decision shall take effect fifteen days from the date of signature.

Chapter II

FORM AND CONTENT OF THE EXAMINATION

Article 5. The examination for promotion to higher ranks in the agriculture and rural development sector includes:

- Written examination

- Oral examination

- Foreign language examination at level B for main ranks (one of five languages: English, French, Russian, German, Chinese).

Article 6. Content of the examination for promotion to higher ranks in the agriculture and rural development sector

A. COMMON WRITTEN EXAMINATION CONTENT FOR ALL RANKS:

- Constitution of the Socialist Republic of Vietnam, Law on the Organization of the Government.

- Party and State policies on agricultural, forestry, and water resources development.

- Civil Servant Ordinance, Anti-Corruption Ordinance, Thrift Ordinance, Organizational Democracy Regulation, and guiding documents.

- Basic knowledge of state administration.

- Organizational structure according to specialty.

- Understanding of the professional standards of the rank being applied for.

B. SPECIALIZED CONTENT OF THE EXAMINATION ACCORDING TO THE FIELD OF SPECIALIZATION:

I. CONTENT OF THE EXAMINATION FOR PROMOTION TO RANKS IN THE PLANT PROTECTION AND QUARANTINE SECTOR:

1. Examination content for promotion from Plant Quarantine Officer, Plant Protection Forecast Officer, Plant Protection Officer, Pesticide Appraisal Officer to Senior Plant Quarantine Officer, Senior Plant Protection Forecast Officer, Senior Plant Protection Officer, Senior Pesticide Appraisal Officer.

Written examination part:

- Party and State policies, industry guidelines on plant protection and quarantine work, pesticide management.

- Plant Protection and Quarantine Ordinance, Government Decree No. 92/CP dated November 27, 1993 guiding the implementation of the Ordinance.

- Plant Quarantine Regulations.

- Pesticide Management Regulations.

- Guiding documents and other specialized regulations.

- Legal provisions related to the professional field of countries involved in agricultural product import and export during specific periods.

Oral examination part:

- Professional issues such as technical procedures, technical norms, investigative methods... Knowledge used in professional work.

- Scientific and technical information, professional matters both domestically and internationally relevant.

- Production and economic political situation related to work in the area. - Achievements in plant quarantine and plant protection science in recent years.

- Relationships between different areas of work within the plant protection sector.

2. Examination content for promotion from Plant Quarantine Technician, Plant Protection Forecast Technician, Plant Protection Technician, Pesticide Appraisal Technician to Plant Quarantine Officer, Plant Protection Forecast Officer, Plant Protection Officer, Pesticide Appraisal Officer.

Written examination part:

- Party and State policies, industry guidelines on plant protection and quarantine work, pesticide management.

- Plant Protection and Quarantine Ordinance, Government Decree No. 92/CP dated November 27, 1993 guiding the implementation of the Ordinance.

- Plant Quarantine Regulations.

- Pesticide Management Regulations.

- Guiding documents and other specialized regulations.

Oral examination part:

- Professional issues such as technical procedures, technical norms, investigative methods... of a plant quarantine officer and equivalent positions.

3. Examination content for promotion from Staff Member to Plant Quarantine Technician, Plant Protection Forecast Technician, Plant Protection Technician, Pesticide Appraisal Technician.

II. CONTENT OF THE EXAMINATION FOR PROMOTION TO RANKS IN THE VETERINARY SECTOR:

1. Examination content for promotion from Animal Disease Diagnosis Officer, Animal Quarantine Officer, Veterinary Laboratory Officer to Senior Animal Disease Diagnosis Officer, Senior Animal Quarantine Officer, Senior Veterinary Laboratory Officer:

Written examination part:

- Party and State policies, industry guidelines on veterinary work.

- Content of the Veterinary Ordinance and Government Decree No. 93/CP guiding the implementation of the Ordinance.

- Regulations on animal disease prevention, quarantine, slaughter inspection, and veterinary hygiene inspection of animals and animal products.

- Guiding documents and other national regulations on veterinary matters.

- Veterinary Ordinance of some countries in the region related to animal and animal product import and export activities.

- Standards and technical procedures in the veterinary field.

- Professional knowledge used in work.

Part on questioning:

- New techniques, new information in the field of veterinary medicine both domestically and internationally.

- The working relationship between specialized fields within the veterinary sector.

2. Content for upgrading from animal disease diagnostic technician, plant quarantine technician, veterinary drug testing technician to animal disease diagnostician, animal quarantine officer, veterinary drug tester.

- Content of the Veterinary Ordinance and Government Decree No. 93/CP guiding the implementation of the Ordinance.

- Regulations on disease prevention and control for animals. Regulations on quarantine, slaughterhouse supervision, and veterinary hygiene inspection of animals and animal products. Other state regulations on veterinary matters.

- Ordinances on veterinary medicine of some countries in the region.

Part on questioning:

- Essential professional knowledge for the work of an animal quarantine officer and equivalent positions.

- Policies and guidelines of the industry and the State on managing the quality of plant cultivar seeds.

- Decree 07/CP dated February 7, 1996 of the Government on seed management and related implementing documents.

- Legal content on plant cultivar seeds and product quality of some countries related to seed import and export activities.

- Methods, procedures, norms, and standards for testing, inspecting, and issuing certificates of quality for plant cultivar seeds.

Oral examination part:

- Domestic economic and social conditions related to seed management work.

- Scientific and technological advancements in seed work both domestically and internationally.

- Techniques for seed field testing, laboratory testing, and issuing quality certificates for plant cultivar seeds.

2. Content for upgrading from Plant Cultivar Seed Testing Technician to Seed Tester of Plant Cultivars:

1. Content for upgrading from Embankment Control Officer to Senior Embankment Control Officer:

- State policies on embankment and flood control management.

- Content of the Embankment Law, Flood Prevention Law, and other relevant regulations concerning embankment and flood control management.

- Vietnamese standards, industry standards, procedures, and technical norms related to construction, maintenance, management, and handling incidents involving dikes, levees, and sluices.

- Dike protection techniques (handling seepage, slippage, leakage, and riverbank erosion).

- Budget preparation, monitoring systems, and organization of supervision during basic construction and dike maintenance.

Oral examination part:

- Principles of managing and using emergency flood and storm materials, including local material substitution.

- Characteristics of floods and storms in Vietnam and national and provincial measures for flood and storm prevention.

- New scientific and technical information and techniques both domestically and internationally in the field of embankment and flood control management.

- Evaluation of the current status of dikes, levees, and sluices in the province.

2. Content for upgrading from Intermediate Embankment Control Officer to Embankment Control Officer:

Written examination part:

- The Embankment Law and implementing documents.

- Flood Prevention Law and other relevant regulations concerning embankment and flood control management.

- Vietnamese standards, industry standards, procedures, and technical norms related to construction, maintenance, management, and handling incidents involving dikes, levees, and sluices.

- Techniques for early detection and handling in embankment management (including violation detection and handling and dike protection).

Oral examination part:

- Features, functions, and principles of managing and using emergency flood and storm materials.

- Overview of flood and storm characteristics in Vietnam and appropriate preventive measures for the local area.

- Evaluation of the current status of dikes, levees, and sluices under the unit's jurisdiction.

3. Content for upgrading from staff to Intermediate Embankment Control Officer:

Written examination part:

- Main content of the Embankment Law.

- Flood Prevention Law and other relevant regulations concerning embankment and flood control management.

- Some standards, procedures, and technical norms related to construction, maintenance, management, and incident handling involving dikes, levees, and sluices. Part on questioning:

- Features, functions, and principles of managing and using emergency flood and storm materials.

- Common flood and storm prevention measures typically applied locally.

V. CONTENT FOR UPGRADING IN FORESTRY:

1. Content for upgrading from Forest Ranger to Senior Forest Ranger:

Written examination part:

- State policies on forest management and protection.

- Law on Protection and Development of Forests, Decree 17/HĐBT on Implementation of the Law on Protection and Development of Forests, and other implementing documents.

- Related legal documents concerning forest protection and development.

- Technical procedures, management, protection, and utilization of forests.

Oral examination part:

- Knowledge of theoretical and practical aspects of forest management and protection in Vietnam. Trends in the development of this field globally.

- General administrative and legal procedures.

- Development and implementation of projects on forest management and protection.

2. Content of the examination to promote from staff, junior forest rangers to forest ranger:

Written examination part:

- State policies on forest management and protection.

- Main contents of the Law on Protection and Development of Forests, Decree No. 17/HĐBT on implementing the Law on Protection and Development of Forests, and guiding documents.

- Some knowledge about environmental management, protection, and ecosystem, sustainable forestry. Oral examination:

- Using various types of administrative penalty records.

- Preparing initial files for cases violating the Law on Protection and Development of Forests.

- Using maps, handheld terrain maps for patrolling forests, and measuring forest area according to maps.

Chapter IV

IMPLEMENTATION

, Clause 1, Clause 2 Article 7a of this Regulation.

1. Ministries, ministerial-level agencies, and agencies under the Government (collectively referred to as "Ministries") shall organize examinations for promotion within the Agriculture and Rural Development sector for civil servants directly managed by them belonging to the ranks specified in Part B, Article 6 of this Regulation.

2. People's Committees of provinces and centrally governed cities (collectively referred to as "provinces") shall organize examinations for promotion within the Agriculture and Rural Development sector for civil servants belonging to the ranks specified in Section V and Points 2 and 3 of Sections I, II, III, and IV, Part B, Article 6 of this Regulation.

3. The organization of examinations for promotion to the principal level for provincial civil servants shall be carried out by the Ministry of Agriculture and Rural Development (except for examinations to promote from forest ranger to principal forest ranger). In cases where ministries do not have conditions to organize examinations or the number of examination quotas is small, the ministries shall submit a written request to the Ministry of Agriculture and Rural Development for it to organize joint examinations. Ministries and provinces shall implement preliminary selection in accordance with Article 10 of Decision No. 150/1999/QĐ-TCCP dated February 12, 1999, issued by the Minister, Head of the Civil Service Administration of the Government, and shall be responsible for nominating candidates to participate in the examination.

Article 8

1. Each year, ministries and provinces shall develop examination plans for promotion in accordance with Point 3, Section 5 of Circular No. 04/1999/TT-TCCP dated March 20, 1999, issued by the Civil Service Administration of the Government, and submit them to the Civil Service Administration of the Government for unified opinions and examination quotas. Based on the allocated quotas, ministries and provinces shall organize examinations for promotion in accordance with this regulation and the general rules on examinations for promotion of civil servants.

2. The Ministers and Chairmen of Provincial People's Committees shall decide to establish Examination Boards for ministries and provinces. The composition, tasks, and powers of the Examination Boards for promotion shall be implemented strictly in accordance with the Rules on Organizing Examinations for Promotion of Civil Servants promulgated together with Decision No. 150/1999/QĐ-TCCP dated February 12, 1999, issued by the Minister, Head of the Civil Service Administration of the Government.
