THE MINISTER OF EDUCATION AND TRAINING

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 36/2005/ND-CP dated March 17, 2005 of the Government detailing the implementation of certain provisions of the Law on Protection, Care, and Education of Children;

Pursuant to Directive No. 23/2006/CT-TTg dated July 12, 2006 of the Government Chairman on strengthening school health work;

Considering the proposal of the Director of the Department of Student Affairs;

DECISION:

Article 1. These Regulations on health activities in early childhood education institutions are hereby issued together with this Decision.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. All previous regulations that conflict with this Decision are abolished.

Article 3. The Heads of the Office, the Directors of the Department of Student Affairs, the Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Education and Training are responsible for implementing this Decision.

REGULATIONS
ON HEALTH ACTIVITIES IN EARLY CHILDHOOD EDUCATION INSTITUTIONS

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This document stipulates health activities in early childhood education institutions including: objectives, contents of activities, and ensuring conditions.

These Regulations apply to early childhood education institutions.

Chapter II

OBJECTIVES AND CONTENTS OF HEALTH ACTIVITIES

3. To serve as a basis for evaluating and recognizing "Learning Communities" at the commune, district, and province levels.

Health activities in early childhood education institutions aim to ensure safety, disease prevention, and health care for children, helping them develop physically.

Article 4. Content of Activities

1. Management and health care for children in early childhood education institutions, specifically:

a) Managing and keeping health records or health monitoring books of children;

b) Organizing regular health check-ups and classifying children's health status at least twice a year at the beginning of each semester; Evaluating children's physical development according to current regulations;

c) Measuring height and weight, recording growth charts, monitoring physical development for children under 24 months old once a month, and for children over 24 months old once every quarter. Monitoring and coordinating with parents or guardians regarding vaccinations and preventive medications;

d) Providing first aid, emergency care, and initial health care according to current regulations of the Ministry of Health; Transferring children who have accidents or sudden illnesses to medical facilities when necessary;

đ) Educating children about personal hygiene and environmental sanitation; Participating in developing meal plans and food portions for children;

e) Regularly informing parents or guardians about children's health status;

2. Organizing annual health check-ups for management staff, teachers, and employees in early childhood education institutions.

3. Implementing school hygiene, environmental sanitation, preventing school diseases and disabilities, ensuring food safety, preventing malnutrition, preventing accidents and injuries, and other health activities in schools.

4. Promoting and training management staff, teachers, and employees on school health work. Integrating health education, school hygiene, personal hygiene, and environmental sanitation into teaching processes and organizing recreational activities for children.

5. Promoting and advising parents or guardians on health issues related to children. Rehabilitating children with disabilities through early intervention programs and individual education plans.

6. Coordinating with units, organizations, and associations within kindergartens, nursery schools, childcare centers, healthcare facilities, and local related units to implement school health activities and other health activities, creating a green, clean, and safe environment.

7. Implementing professional guidance from the local health sector.

8. Summarizing, concluding, and reporting on the results of school health work according to current regulations.

Chapter III

ENSURING CONDITIONS

Article 5. Medical staff

1. The number of medical staff at preschool education facilities shall be in accordance with the current regulations of the State.

2. Medical staff must have a professional qualification of at least a college level in medicine; They are entitled to participate in seminars, training courses, and professional development programs on health work organized by the education sector, the health sector, and local authorities.

Medical staff who concurrently perform health work at preschool education facilities must undergo professional training and capacity building on school health work.

3. Medical staff belonging to the Office's establishment according to the Kindergarten Regulation, in addition to performing their duties and responsibilities according to their positions, must also concurrently undertake other tasks as prescribed; They are entitled to salary and benefits in accordance with the current regulations of the State.

Article 6. Workroom for medical staff

1. Each kindergarten, nursery school, and childcare center shall have a workroom for medical staff (Health Room) within the administrative area, ensuring hygiene requirements, with an area of at least 12 square meters, facilitating initial first aid, emergency care, primary health care, and transportation of children suffering from accidents and sudden illnesses to healthcare facilities.² 2. Independent groups and classes shall arrange locations for providing initial first aid, emergency care, and primary health care for children.

Article 7. Equipment and Medicines

1. The Health Room shall be equipped with specialized equipment and essential medicines as prescribed by the Ministry of Health; It shall have beds for examining and keeping children requiring medical care under observation.

2. There shall be a vaccination and health check-up record board, an emergency treatment protocol for common diseases and injuries among children, and posters and materials promoting child health care and disease prevention.

3. It shall be equipped with tables, chairs, cabinets, and other general office equipment.

The funding for school health work at preschool education facilities includes sources of funding, items of expenditure, budget preparation, implementation of the budget, and final settlement in accordance with the current regulations of the State.

IMPLEMENTATION

(established by Decision No. 73/2007/QĐ-BGDĐT dated December 4, 2007 of the Minister of Education and Training on health activities in elementary schools, junior high schools, senior high schools, and comprehensive schools) 1. Responsible for directing the implementation of school health work in preschool education facilities within its jurisdiction.

2. Increase investment in human resources, funding, infrastructure, and equipment for school health work.

3. Organize inspections and audits of the implementation of this Regulation.

Article 10. Responsibilities of Departments of Education and Training

2. Directly direct, inspect, supervise, and urge educational departments within its jurisdiction to implement this Regulation.

3. Organize inspections and audits of the implementation of this Regulation for educational departments and preschool education facilities within its jurisdiction.

1. Proactively coordinate with relevant units, parents, or guardians of children to implement health activities within the scope of responsibility at early childhood education institutions.
