PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
The Prime Minister issues this Decision amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.
Pursuant to Decision No. 64/2003/QĐ-TTg dated April 22, 2003 of the Government approving the "Plan for Thoroughly Addressing Severe Environmental Pollution Sources"
CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,
DECISION:
Article 1. Scope of Regulation and Applicability
1. This Decision stipulates the provision of targeted financial support from the state budget for certain severe environmental pollution sources in the public interest sector (hereinafter referred to as the facility) to implement and carry out projects for thoroughly addressing environmental pollution (hereinafter referred to as the project).
a) Pesticide storage facilities;
b) Hospitals;
c) Landfills;
d) Sites storing chemical toxins used by the United States during war;
đ) Wastewater treatment plants for urban domestic sewage.
Projects for thoroughly addressing environmental pollution of facilities as stipulated in Clause 2, Article 1 of this Decision will be considered for support when they meet all of the following conditions:
1. They have been approved by competent state agencies according to current laws and included in the annual budget plan.
2. They do not yet have funding for implementation or have been allocated but are insufficient for implementation.
3. The project must include one of the following contents: destruction and disposal of expired or banned pesticides, pesticide packaging; environmental remediation; handling of residual chemical toxins used by the United States during war; construction, renovation, and upgrading of wastewater and medical solid waste treatment systems in hospitals; control and prevention of landfill pollution, landfill waste and wastewater treatment, landfill closure, environmental restoration, landfill renovation and upgrading; urban domestic sewage treatment.
Article 3. Principles of Support
1. Full funding from the central government budget for projects managed by Ministries, ministerial-level agencies, and government-affiliated agencies.
2. Full funding from the local government budget for projects managed by provincial People's Committees and municipal People's Committees directly under the Central Government. For provinces and municipalities directly under the Central Government that still receive balanced fiscal assistance from the central government, the central government will provide targeted funding for localities equal to 50% of the total project cost for thoroughly addressing environmental pollution, with the local government responsible for providing the remaining 50%.
3. Determination of the source of funding based on the specific nature and content of each project.
Article 4. Source of capital support
1. Central and local environmental operating funds.
2. Development investment capital.
3. ODA loan capital.
4. Loans from credit organizations.
5. Aid capital.
6. Loans from the Vietnam Environment Protection Fund, Sectoral Environment Protection Funds, and Local Environment Protection Funds.
7. Capital from domestic and foreign organizations and individuals.
Article 5. Approval of Support
1. Annually, based on the provisions of this Decision, the managing agency of the facility shall develop a project to thoroughly address environmental pollution, and submit it for approval by the competent authority according to the following procedures:
a) The Chairman of the People's Committee of provinces and centrally governed cities shall approve the content of the project and decide on the specific level of support from local budget funds for projects within their management scope; send the project and the proposal for targeted financial support from the central budget to the Ministry of Natural Resources and Environment and the Ministry of Finance for consolidation;
b) Ministers, Heads of ministerial-level agencies, and Heads of government-affiliated agencies shall approve the content of the projects managed by their ministries, ministerial-level agencies, or government-affiliated agencies; send the projects and proposals for targeted financial support from the central budget to the Ministry of Natural Resources and Environment and the Ministry of Finance for consolidation;
c) The Minister of Natural Resources and Environment shall propose the specific level of financial support for projects managed by ministries, ministerial-level agencies, or government-affiliated agencies; the level of targeted financial support from the central budget for local projects managed by localities; send these proposals to the Ministry of Planning and Investment and the Ministry of Finance before July 1st each year for consolidation and submission to the Prime Minister for consideration and decision in accordance with the State Budget Law.
2. The decision approving the project content must clearly state the sources of funding, including: funding from ministries and sectors; funding from localities; funding requested from the central budget for targeted support to localities (if applicable).
1. Management mechanism:
a) Central budget support for local budgets in annual plans (recorded as a separate item);
b) Management mechanism for investment and construction of waste treatment facilities in projects implemented under the investment and construction management mechanism.
2. Implementation period: from 2008 to 2012.
Article 7. Implementation Organization
1. The Ministry of Natural Resources and Environment:
a) Take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, relevant ministries, sectors, and localities to implement the contents of this Decision;
b) Take the lead in inspecting and supervising the implementation of targeted support as stipulated in this Decision; annually compile the situation of budget allocation and the progress of implementing projects to thoroughly address environmental pollution, report to the Prime Minister any difficulties and obstacles (if any) for timely supplementation and adjustment;
c) Provide preferential interest loans and financial support from the Vietnam Environmental Protection Fund for projects that have been approved for targeted financial support to be implemented;
d) Guide the establishment and decision-making on the list of serious pollution sources requiring treatment.
2. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance to allocate capital plans from the central budget for projects to thoroughly address environmental pollution based on the proposals of the Ministry of Natural Resources and Environment.
3. The Ministry of Finance shall balance and allocate targeted financial support from the central budget for projects to thoroughly address environmental pollution based on the proposals of the Ministry of Natural Resources and Environment.
4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of People's Committees of provinces and centrally governed cities:
a) Direct facilities under their management to develop projects to thoroughly address environmental pollution, prepare project budgets, organize reviews, and approve them according to current legal regulations, and submit them to the Ministry of Natural Resources and Environment before June 15th each year for consolidation of plans;
b) Record capital in the annual budget plans of ministries, sectors, and localities for projects to thoroughly address environmental pollution supported by the state budget for targeted purposes as stipulated in this Decision;
c) Be responsible for the progress, quality, and results of implementing projects;
d) Annually report to the Ministry of Natural Resources and Environment the situation of budget allocation, the results of using targeted financial support funds, and the results of implementing projects as stipulated in this Decision, propose solutions to address any difficulties and obstacles (if any) for the Ministry of Natural Resources and Environment to consolidate and report to the Prime Minister for consideration and decision.
Article 8. Implementation clause
This Decision takes effect 15 days after its publication in the Official Gazette.
THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
