Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."the Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

Article 1. Position and Functions
(hereinafter referred to as Vietnamese diplomatic missions abroad) and activities of foreign diplomatic missions in Vietnam; state management of public services in areas under the jurisdiction of the Ministry of Foreign Affairs as prescribed by law.Deputy ministers of ministerial-level agencies, The Ministry of Foreign Affairs performs tasks and powers as prescribed in Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies, and the following specific tasks and powers: lSubmitting draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft resolutions, decisionsỏa and directives of the Government according to the annual legislative program of the Ministry of Foreign Affairs that has been approved and other projects and plans assigned by the Government, the Prime Minister; strategies, plans, long-term, five-year, and annual development programs, and important projects and works within the sectors and fields managed by the Ministry of Foreign Affairs. in Submitting draft decisions, directives, and other documents within the sectors and fields managed by the Ministry of Foreign Affairs or as assigned to the Prime Minister for approval.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
Issuing circulars, decisions, directives, and other documents within the scope of state management of the Ministry of Foreign Affairs; guiding, inspecting the implementation of these documents.

Directing, guiding, inspecting, and organizing the implementation of strategies, plans, national target programs, and legal normative documents within the scope of state management of the Ministry of Foreign Affairs after they have been approved; organizing information dissemination, legal education, and monitoring the enforcement of laws in areas under the jurisdiction of the Ministry of Foreign Affairs.n lRegarding state management over foreign affairs activities of ministries, sectors, relevant agencies, and localities:councillORSTaking the lead and coordinating with ministries, sectors, and relevant agencies in developing the national foreign affairs program, consolidating the foreign affairs programs of ministries and sectors; guiding the organization of implementation and requiring ministries and sectors to report periodically and urgently on the implementation of foreign affairs activities; guiding and inspecting ministries, ministerial-level agencies, and government agencies to implement uniformly policies, regulations related to state foreign affairs activities.policies Taking the lead and coordinating with relevant agencies in guiding, directing, inspecting, and urging provincial People's Committees to implement unified management of foreign affairs activities of localities.on Managing international conferences and seminars in Vietnam in accordance with the law; annually reporting to the Prime Minister on the situation of organizing international conferences and seminars in Vietnam.policies Taking the lead and coordinating with relevant ministries and sectors in protecting the sovereignty and interests of the State, the rights and legitimate interests of organizations and citizens of Vietnam abroad in accordance with Vietnamese law and international law.

a) Proposing to the Prime Minister to submit to the President for the appointment, recall of Ambassadors Extraordinary and Plenipotentiary, Permanent Representatives of Vietnam to the United Nations, World Trade Organization, and Representatives of the President at international organizations; lAppointing, recalling Permanent Representatives of Vietnam to international organizations, except as provided in Point c Clause of this Article; heads of Vietnamese consular offices abroad; deciding on the appointment and dismissal of Honorary Consuls of Vietnam abroad.
b) Regarding state protocol:

Implementing state management over diplomatic etiquette and diplomatic privileges and immunities as prescribed by law; guiding and managing the implementation of diplomatic privileges and immunities and diplomatic etiquette for foreign diplomatic missions in Vietnam and Vietnamese diplomatic missions abroad in accordance with Vietnamese law, international law, and international practice;by the Prime Minister Approving the accreditation of diplomatic representatives of countries and international organizations in Vietnam and Vietnamese diplomatic representatives abroad;
7. Preparing and serving high-level state delegations visiting countries or attending international conferences; organizing receptions for high-level delegations from countries and international organizations visiting Vietnam as prescribed by law. lRegarding economic diplomacy work:

On representing in state diplomatic activities:
9. Represent the State in diplomatic relations with countries and intergovernmental international organizations; conduct state diplomatic activities in accordance with the law;
a) Submit to the Government for approval the establishment, modification, or termination of diplomatic and consular relations with countries and intergovernmental international organizations; the establishment, temporary suspension, or termination of operations of Vietnamese representative offices abroad according to the law;
b) Propose to the Prime Minister for submission to the President to appoint, recall Special Envoys and Permanent Representatives of Vietnam to the United Nations, World Trade Organization, and Representatives of the President at international organizations;
c) Appoint, recall Permanent Representatives of Vietnam to international organizations, except in cases stipulated in Point c Clause of this Article; heads of Vietnamese consular offices abroad; decide on the appointment and dismissal of Honorary Consuls of Vietnam abroad.
d) On state protocol:
10. Implement state management over diplomatic etiquette and diplomatic privileges and immunities as prescribed by law; guide and manage the implementation of diplomatic privileges and immunities and diplomatic etiquette for foreign representative offices in Vietnam and Vietnamese representative offices abroad in accordance with Vietnamese law, international law, and international practice;

c) Direct and manage consular work of provincial and centrally-administered city foreign affairs agencies in accordance with the law;on Carry out other consular tasks as prescribed by law, assigned by the Government, and international treaties to which Vietnam is a party;
d) Regarding state management of Vietnamese citizens' emigration:
Lead and coordinate with relevant agencies to develop policies and guidelines on international migration that align with Vietnam's conditions and international practices;
e) Coordinate in managing legal migration, preventing illegal migration, and addressing related issues; Lead and coordinate with relevant agencies to guide and inspect activities related to Vietnamese citizens' emigration; Regarding Vietnamese citizens abroad: trLead and coordinate with relevant agencies and organizations to study, synthesize situations, propose, and implement policies towards Vietnamese citizens abroad;
14. Lead and coordinate with relevant agencies and organizations to guide and inspect the implementation of policies towards Vietnamese citizens abroad;
a) Organize, support, and guide Vietnamese individuals and organizations abroad in their connections with the homeland and vice versa, contributing to national development;nationalSupport and create favorable conditions for Vietnamese citizens abroad to settle their lives, integrate into the host society, maintain their cultural identity;
b) Regarding border, territory, airspace, maritime zones, islands, and continental shelf:nationalLead and coordinate with relevant ministries, sectors, and localities to conduct research, synthesis, inspection, and evaluation of border management, territorial integrity, sovereignty, sovereign rights, and jurisdiction over land, airspace, maritime zones, islands, and continental shelf; resolve disputes, defend borders, territorial integrity, sovereignty, sovereign rights, and jurisdiction over land, airspace, maritime zones, islands, and continental shelf; formulate policies, guidelines, and appropriate management measures;June 2024;Lead and coordinate with relevant ministries to advise on determining national borders, maritime zones, and continental shelf; determine the scope of sovereignty, sovereign rights, and jurisdiction over land, airspace, maritime zones, islands, and continental shelf;councillORSLead and coordinate with relevant ministries to develop plans for national border delimitation; determine the limits of exclusive economic zones and continental shelf with neighboring countries;

d) d) Submit to the Prime Minister for handling or guiding handling within authority issues arising from the activities of relevant ministries, sectors, and localities concerning sovereignty, sovereign rights, and jurisdiction over land, airspace, maritime zones, islands, and continental shelf;
15. Regarding management of Vietnamese representative offices abroad:
a) Direct and inspect the implementation of foreign policy lines and policies of the State and the performance of functions and tasks of Vietnamese representative offices abroad;
b) Take the lead and coordinate with relevant agencies and organizations in researching, compiling situations, proposing, and implementing policies towards overseas Vietnamese;
c) Take the lead and coordinate with relevant agencies and organizations in guiding and inspecting the implementation of work with overseas Vietnamese;
16. Organize, support, and guide overseas Vietnamese organizations and individuals in their connections with the domestic country and vice versa, contributing to national development;
a) Support and create favorable conditions for overseas Vietnamese to settle their lives, integrate into the social life of the host country, maintain the cultural identity of the Vietnamese nation.

a) Chỉ đạo, kiểm tra việc thực hiện đường lNo.i, chính sách đối ngoại của Nhà nước và việc thực hiện chức năng, nhiệm vụ của cơ quan đại diện Việt Nam in foreign nationals and members of Vietnamese representative agencies abroad in accordance with the law;
b) Implement the legal provisions regarding the organization and staffing of Vietnamese representative agencies abroad;
c) Appoint, relieve from office, dispatch, and summoni members of Vietnamese representative agencies abroad in accordance with the regulations;councillORSLead and coordinate with relevant ministries to develop plans for national border delimitation; determine the limits of exclusive economic zones and continental shelf with neighboring countries;
d) Guide, organize the management and use of assets, facilities,in material resources, technical equipment, and funds of Vietnamese representative agencies abroad in accordance with the law.
19. Regarding the management of external activities for representatives of Vietnamese agencies and organizations abroad;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP (hereinafter referred to as Vietnamese agencies and organizations abroad),i and Vietnamese delegations dispatched to work abroad:
a) Guide and inspect the implementation of state policies, tasks, and authorities of Vietnamese agencies and organizations abroad, and Vietnamese delegations dispatched to work abroad in accordance with the law;
b) Lead and coordinate with relevant ministries, sectors, and organizations to build and implement policies and programs for cultural diplomacy;nationalCooperate with relevant ministries and sectors to support and create favorable conditions for Vietnamese agencies and organizations abroad to perform their functions, tasks, and authorities in accordance with Vietnamese law, the receiving country's laws, and international law.
20. Manage the activities of diplomatic representative agencies, consular representative agencies, honorary consulates of foreign countries, and representative agencies of intergovernmental international organizations located in Vietnam in accordance with Vietnamese law and international law.
21. Manage non-governmental organizations from foreign countries in Vietnam; issue, extend, amend, supplement, revoke registration certificates of non-governmental organizations from foreign countries in Vietnam in accordance with the law.
22. Regarding international treaty work and international agreements:
a) Carry out state management over international treaty work and international agreements;
b) Inspect negotiation proposals, signing, and accession to international treaties submitted by ministries, sectors, and agencies before they are presented to the Government;
c) Take the lead and coordinate with related agencies and organizations to propose to the Government on signing, accession, and implementation of international treaties concerning peace, security, borders, territory, national sovereignty, and other areas under the Ministry of Foreign Affairs' jurisdiction;
d) Organize the compilation and publication of the Yearbook of International Treaties signed or acceded to by the Socialist Republic of Vietnam;
d) Perform other tasks related to state management of international treaties and international agreements as prescribed by the Law on Signing, Accession, and Implementation of International Treaties;policiesAccession, and Implementation of International Treaties, and the Ordinance on Signing and Implementation of International Agreements; internationally.
23. Manage organizational structure, civil servant staffing, number of personnel positions, occupational titles; implement salary systems andonother policies such as incentives, appointments, dismissals, retirements, resignations, rewards, disciplinary actions, training, and development; build a cadre and civil servant workforce at units under the Ministry of Foreign Affairs in accordance with the law.policies Conduct inspections and checks on the implementation of legal provisions within the scope of the Ministry of Foreign Affairs' state management authority; organize citizen reception, complaints, and denunciations; prevent and combat corruption, waste, and handle violations of law in these fields;

27. Organizations specified in Clauses 1 to 25 of this Article assist the Minister of Foreign Affairs in performing state management functions; organizations specified in Clauses 26 to 31 of this Article are public service units under the Ministry of Foreign Affairs.
28. Organizations specified in Clause 32 of this Article are Vietnamese representative agencies abroad established by the Government and directly managed by the Ministry of Foreign Affairs.
29. The Northeast Asia Department, Southeast Asia - South Asia - South Pacific Department, American Department, and West Asia - Africa Department shall be organized into three rooms each; the Legal and International Treaties Department shall be organized into four rooms; the European Department and Cadre and Civil Service Organization Department shall be organized into six rooms each.
30. The Minister of Foreign Affairs shall submit to the Prime Minister for approval the functions, tasks, authorities, and organizational structures of the National Committee for Overseas Vietnamese, the National Border Committee, and the Diplomatic Academy; and promulgate the list of other public service units under the Ministry of Foreign Affairs.
31. The Minister of Foreign Affairs shall prescribe the functions, tasks, authorities, and organizational structures of subordinate units of the Ministry, except for those specified in Clauses 24 to 26 of this Article.

The Minister of Foreign Affairs shall submit to the Prime Minister for promulgation regulations on the functions, tasks, powers, and organizational structure of the National Committee for Overseas Vietnamese, the National Border Commission, and the Diplomatic Academy; issue a list of other public service units under the Ministry of Foreign Affairs.
The Minister of Foreign Affairs shall define the functions, tasks, powers, and organizational structure of units directly under the Ministry, except for those units specified from Clause 24 to Clause 26 of this Article.N ||| declaration of customs import procedures.
