Guidelines on the management and distribution of uniforms for Legal Aid Counselors

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Pursuant to Decree No. 14/2013/NĐ-CP dated February 5, 2013 of the Government amending and supplementing certain articles of Decree No. 07/2007/NĐ-CP dated January 12, 2007 of the Government detailing and guiding the implementation of some provisions of the Legal Aid Law;
The Minister of Finance and the Minister of Justice issue this Joint Circular to guide the management and distribution of uniforms for Legal Aid Counselors as follows:
Article 1. Scope of Regulation and Applicability
Article 1. This Circular guides the management and distribution of uniforms for Legal Aid Counselors working at State Legal Aid Centers and their Branches.
Article 2. The subjects to which this Circular applies are Legal Aid Counselors and organizations related to the management, use, and distribution of uniforms for Legal Aid Counselors.

Article 3. Principles of uniform distribution and use |
Clause 1. The distribution and use of uniforms must comply with standards, purposes, correct recipients, and prescribed intervals. State Legal Aid Centers must maintain records to accurately track the distribution and use of uniforms for each Legal Aid Counselor in accordance with regulations.
Clause 2. Legal Aid Counselors are provided uniforms for use when performing legal aid activities and are responsible for maintaining and preserving them according to regulations. In cases where uniforms have been damaged or lost due to objective reasons, they will be replaced. If uniforms have been damaged or lost due to non-objective reasons, individuals must replace them themselves to meet the requirements of the Ministry of Justice's uniform standards for Legal Aid Counselors.
Clause 3. For retirement, disability leave, or transfer to other positions where the provided uniforms have not yet reached their distribution interval, there will be no recovery; if the interval has expired without being distributed, no further distribution will occur.
Clause 4. For those who are dismissed or take other types of leave, name badges and previously issued uniforms must be returned before leaving the job.
Clause 5. Based on specific conditions, after obtaining the agreement of the Director of the Department of Justice and based on prices approved by the competent authority, the Director of State Legal Aid Centers may decide to provide funds to Legal Aid Counselors to purchase uniforms according to the Ministry of Justice's regulations on standards, forms, colors, and styles.
In cases where funds are provided for Legal Aid Counselors to purchase uniforms, payment vouchers are lists of uniforms provided and unit prices of each uniform approved by the competent authority.
Article 4. Budget preparation, management, and settlement of costs for purchasing uniforms
Each year, based on the recipients of uniforms, the quantity and types of uniforms reaching their distribution intervals or needing replacement, State Legal Aid Centers prepare budgets for uniform expenses according to this Circular and incorporate them into their own budget plans to submit to the competent financial authorities for consolidation and submission to the same-level financial authorities as required.
Clause 1. Provincial Departments of Justice directly under the central government are responsible for managing and inspecting the distribution and use of uniforms for State Legal Aid Centers under their jurisdiction in accordance with current regulations.
1. The source of funds for providing uniforms shall be guaranteed by the state budget according to the current budget classification.
2. Establishing budgets:
Expenses for distributing uniforms that do not comply with this Circular, upon discovery during inspection, must be recovered and submitted to the state budget. Individuals who order incorrect expenditures will be subject to disciplinary action, administrative penalties, and reimbursement of improperly spent amounts according to regulations.
3. Managing and settling accounts for clothing expenses:
The management and settlement of accounts for clothing expenses shall be carried out in accordance with the provisions of the State Budget Law and the current guiding documents.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
Clause 2. This Circular takes effect from July 1, 2014.
