The Prime Minister issues this Decision to regulate standards, quotas, management, and use of machinery and equipment for state agencies, organizations, and public service units.

PART I

GENERAL PROVISIONS

Article 1. Scope of application

1. State agencies, political organizations, political-social organizations funded by the state budget, public service units, project management boards, and programs using state budget funds (hereinafter referred to collectively as agencies, organizations, and units).

2. Cadres, civil servants, and employees working at agencies, organizations, and units.

3. The Ministry of National Defense and the Ministry of Public Security shall cooperate with the Ministry of Finance to issue standards, quotas, and management regulations for the use of machinery and equipment for agencies, organizations, and units under their jurisdiction; the Ministry of Finance shall cooperate with the Ministry of Foreign Affairs and relevant agencies to issue standards, quotas, and management regulations for the use of machinery and equipment for Vietnamese agencies abroad in accordance with the provisions of this Decision.

4. Political-social occupational organizations, social organizations, and social-occupational organizations may refer to the provisions of this Decision to establish standards and quotas for equipping and using office machinery and equipment for units and organizations under their jurisdiction.

Article 2. Scope of Regulation

1. Machinery and equipment of agencies, organizations, and units as stipulated in this Decision include:

a) Office machinery and equipment commonly equipped for cadres, civil servants, and employees working at agencies, organizations, and units.

b) Office machinery and equipment commonly equipped for use in offices of agencies, organizations, and units.

c) Machinery and equipment equipped for use in meeting rooms, auditoriums, permanent offices, storage rooms, and other common-use rooms of agencies, organizations, and units.

d) Special-purpose machinery and equipment equipped to serve specific activities of agencies, organizations, and units.

2. For computer network systems (servers and accompanying devices), telephone switchboards, electrical systems (central air conditioning, building-wide ventilation fans, lighting systems, and other related electrical equipment), these are not within the scope regulated by this Decision.

Article 3. Explanation of Terms

1. Commonly equipped office machinery and equipment for cadres, civil servants, and employees working at agencies, organizations, and units as stipulated in Point a, Clause 1, Article 2 of this Decision include: desk and chair sets, filing cabinets and shelves, desktop computers (including computer desks and uninterruptible power supplies), laptop computers or equivalent electronic devices, printers, fixed telephones, conference and reception furniture sets.

2. Commonly equipped office machinery and equipment for use in offices of agencies, organizations, and units as stipulated in Point b, Clause 1, Article 2 of this Decision include: conference and reception furniture sets, printers, fax machines, photocopiers, scanners, shredders, telephones, and other machinery and equipment.

3. Machinery and equipment equipped in meeting rooms, auditoriums, permanent offices, storage rooms, and other common-use rooms of agencies, organizations, and units as stipulated in Point c, Clause 1, Article 2 of this Decision include: tables and chairs, projectors, TVs, sound equipment, and other machinery and equipment.

4. Special-purpose machinery and equipment equipped for agencies, organizations, and units as stipulated in Point d, Clause 1, Article 2 of this Decision include specialized machinery and equipment with special construction according to professional requirements, directly used for specific tasks of agencies, organizations, and units, and not included in the machinery and equipment specified in Clauses 1, 2, and 3 of this Article.

5. Project Management Boards as stipulated in Clause 1, Article 1 of this Decision are project management boards using state funds (including government bonds, local government bonds, official development assistance (ODA) sources, preferential loans, and non-governmental foreign aid sources from state budget revenues).

6. Programs using state budget funds as stipulated in Clause 1, Article 1 of this Decision are national target programs approved by competent authorities.

Article 4. Principles for equipping, arranging, and using machinery and equipment

1. The State ensures the provision and funding for machinery and equipment to meet the needs and working conditions of agencies, organizations, and units according to their assigned functions and tasks; ensuring the quality of machinery and equipment to gradually modernize offices.

2. In cases where an official holds multiple positions, the standard for equipping office machinery and equipment shall be based on the highest position according to this Decision. When the predecessor retires or transfers to another job and the common office machinery and equipment provided have not yet met the replacement conditions as prescribed, the newly appointed person shall continue to use the predecessor's common office machinery and equipment without providing new ones.

3. Machinery and equipment of agencies, organizations, and units shall be equipped, arranged, and used in accordance with the standards and quotas stipulated in this Decision and regulations on managing and using state assets.

4. Machinery and equipment shall be replaced when they exceed the usage period specified in the regulations or become damaged and cannot be used further, and shall be handled in accordance with the laws on managing and using state assets; if there is no source of machinery and equipment for reallocation, the agency, organization, or unit may purchase new ones in accordance with the standards and quotas stipulated in this Decision.

5. It is strictly prohibited to use machinery and equipment stipulated in this Decision for personal purposes; selling, exchanging, giving away, lending, pledging, mortgaging, or reallocating them to any organization or individual without permission from the competent state authority as prescribed by law.

6. The provision of office machinery and equipment for projects funded by official development assistance (ODA) or foreign aid shall be carried out in accordance with the signed agreement or project documentation approved by the competent authority. If the agreement or project documentation does not specify the quantity, price, or type of office machinery and equipment, they shall be provided based on the actual users in accordance with the standards and quotas stipulated in this Decision.

7. The procurement, leasing, and allocation of funds for the use of machinery and equipment for agencies, organizations, and units as stipulated in this Decision shall be conducted in accordance with the laws on managing and using state assets and can only be implemented after being allocated in the state budget estimate, development fund, and other legitimate sources at these agencies, organizations, and units.

Chapter II

STANDARDS AND QUOTAS FOR EQUIPPING MACHINERY AND EQUIPMENT

Article 5. Positions entitled to be equipped with common office machinery and equipment according to work requirements, without specifying specific quantities and prices

1. General Secretary of the Central Committee of the Communist Party of Vietnam.

2. President of the Socialist Republic of Vietnam.

3. Prime Minister of the Government.

4. Chairman of the National Assembly.

Article 6. Standards and quotas for equipping common office machinery and equipment at central agencies, organizations, and units

1. Common office machinery and equipment provided for cadres, civil servants, and officials at agencies, organizations, and units (per one person):

a) Members of the Politburo, Secretaries of the Central Committee of the Communist Party, Vice Presidents, Deputy Prime Ministers, Deputy Chairmen of the National Assembly, Chairpersons of the Vietnam Fatherland Front Central Committee, Chairpersons of the Central Inspection Commission, Procurators-General of the Supreme People's Procuracy, Chief Justices of the Supreme People's Court, equivalent positions, and positions with salary coefficients of 10.4 or higher:

Standards and quotas for equipping common office machinery and equipment for the position and the office of the position as stipulated in Section I Part A Appendix I attached to this Decision.

b) Heads of Central Party Departments, members of the Central Committee of the Communist Party, Chairpersons of the National Assembly Ethnic Council; members of the Standing Committee of the National Assembly, Chairpersons of National Assembly Committees; Ministers, heads of ministries-equivalent agencies, Vice Chairpersons concurrently serving as Secretaries-General of the Vietnam Fatherland Front Central Committee, Heads of central mass organizations, equivalent positions, and positions with salary coefficients ranging from 9.7 to less than 10.4:

c) Deputy Heads of Central Party Departments, Deputy Chairpersons of the National Assembly Ethnic Council, Deputy Chairpersons of National Assembly Committees, Deputy Procurators-General of the Supreme People's Procuracy, Deputy Chief Justices of the Supreme People's Court; heads of government agencies, Deputy Ministers, Deputy Heads of central mass organizations, Secretaries-General of the Central Communist Youth Union, Deputy Chairpersons of the Vietnam Fatherland Front Central Committee, General Directors, equivalent positions, and positions with position allowance coefficients of 1.25 or higher:

Standards and quotas for equipping common office machinery and equipment for the position and the office of the position as stipulated in Section III Part A Appendix I attached to this Decision.

d) Deputy General Directors, Directors, Department Heads, Deputy Directors, Deputy Department Heads of Ministries, ministries-equivalent agencies, government agencies, and other central agencies, equivalent positions, and positions with position allowance coefficients ranging from 0.7 to less than 1.25:

Standards and quotas for equipping common office machinery and equipment for the position and the office of the position as stipulated in Sections IV and V Part A Appendix I attached to this Decision.

đ) Heads and Deputy Heads of Departments of Ministries, ministries-equivalent agencies, government agencies, and other central agencies, equivalent positions, and positions with position allowance coefficients ranging from 0.2 to 0.6, and other cadres, civil servants, and officials:

2. Common office machinery and equipment provided for the offices of central agencies, organizations, and units (per one office)

a) Offices of agencies, organizations, and units under Ministries, ministries-equivalent agencies, government agencies, and other central agencies:

Article 7. Standards and quotas for equipping office machinery and equipment commonly applied at agencies, organizations, and units under localities

1. For provincial level (hereinafter referred to as provincial level):

a) Office machinery and equipment commonly equipped for cadres, civil servants, and public officials at agencies, organizations, and units (per person)

- Secretary, Deputy Secretary of the Municipal Party Committee; Chairman of the People's Council, Head of the Standing Delegation of the National Assembly, Mayor of Hanoi City and Ho Chi Minh City; Secretary of the Provincial Party Committee of provinces and centrally-administered cities and equivalent positions:

Standards and quotas for equipping office machinery and equipment commonly applied for the position and office of the position as provided in Section I Part A Appendix II attached to this Decision.

- Deputy Secretary of the Provincial Party Committee; Chairman of the People's Council, Chairman of the People's Committee, Head of the Standing Delegation of the National Assembly of provinces and centrally-administered cities (excluding Hanoi City and Ho Chi Minh City) and equivalent positions;

Deputy Head of the Standing Delegation of the National Assembly, Deputy Chairman of the People's Council, Member of the Standing Committee of the Municipal Party Committee, Deputy Chairman of the People's Committee, Chairman of the Vietnam Fatherland Front of Hanoi City and Ho Chi Minh City, equivalent positions, and positions with a post allowance coefficient from 1.25 upwards:

- Deputy Head of the Standing Delegation of the National Assembly, Deputy Chairman of the People's Council, Deputy Chairman of the People's Committee, Chairman of the Vietnam Fatherland Front, Member of the Standing Committee of the Provincial Party Committee of provinces and centrally-administered cities (excluding Hanoi City and Ho Chi Minh City), equivalent positions, and positions with a post allowance coefficient from 1 to less than 1.25:

Standards and quotas for equipping office machinery and equipment commonly applied for the position and office of the position as provided in Section II Part A Appendix II attached to this Decision.

- Head of the Party Department, Chief of the Provincial Party Committee Office, Chief of the People's Council Office, Chief of the People's Committee Office, Director of Departments of provinces and centrally-administered cities, equivalent positions, and positions with a post allowance coefficient from 0.7 to less than 1:

Standards and quotas for equipping office machinery and equipment commonly applied for the position and office of the position as provided in Section IV Part A Appendix II attached to this Decision.

- Full-time member of the Party Committee of the mass organizations, full-time member of the Vietnam Fatherland Front and mass organizations, Head of the Vietnam Fatherland Front and mass organizations, Head of the Department of the Provincial Party Committee, People's Council, People's Committee, Standing Delegation of the National Assembly of the province, equivalent positions, and positions with a post allowance coefficient below 0.7; other cadres, civil servants, and public officials (per person):

Standards and quotas for equipping office machinery and equipment commonly applied as provided in Section I Part B Appendix II attached to this Decision.

b) Office machinery and equipment commonly equipped for the office of agencies, organizations, and units at the provincial level (per office):

- Office of agencies, organizations, and units at the provincial level: Standards and quotas for equipping office machinery and equipment commonly applied as provided in Section II Part B Appendix II attached to this Decision.

- Administrative Documentation Room, Office of the Provincial Party Committee, People's Committee, People's Council: Standards and quotas for equipping office machinery and equipment commonly applied as provided in Section III Part B Appendix II attached to this Decision.

- Administrative Documentation Room, Office, Comprehensive Room of agencies, organizations, and units at the provincial level: Standards and quotas for equipping office machinery and equipment commonly applied as provided in Section IV Part B Appendix II attached to this Decision.

- Citizen Reception Room, One-Stop Service Unit of agencies, organizations, and units at the provincial level: Standards and quotas for equipping office machinery and equipment commonly applied as provided in Section V Part B Appendix II attached to this Decision.

2. For district level (hereinafter referred to as district level):

a) Office machinery and equipment commonly equipped for cadres and civil servants at agencies, organizations, and units (per person):

- Secretary, Deputy Secretary of the District Party Committee; Chairman, Deputy Chairman of the District People's Council; Chairman, Deputy Chairman of the District People's Committee, equivalent positions, and positions with a post allowance coefficient from 0.6 to 0.9:

- Head of the Party Department, Deputy Head of the Party Department, Chairman, Secretary of mass organizations, Chairman of the Vietnam Fatherland Front, Deputy Secretary of mass organizations, Chief of the District Party Committee Office, People's Council Office, People's Committee Office, Head of the Department, Deputy Head of the Department of specialized agencies at the district level, equivalent positions, and positions with a post allowance coefficient below 0.6; other cadres, civil servants, and public officials:

b) Office equipment commonly provided for the office space of county-level agencies, organizations, units (for 01 office space):

- Office space of county-level agencies, organizations, units: The standards and quotas for providing common office equipment are stipulated in Section II Part B Appendix III attached to this Decision.

- Administrative Records Room of county-level agencies, organizations, units: The standards and quotas for providing common office equipment are stipulated in Section III Part B Appendix III attached to this Decision.

- Citizen Reception Room, One-Stop Service Unit of county-level agencies, organizations, units: The standards and quotas for providing common office equipment are stipulated in Section IV Part B Appendix III attached to this Decision.

3. For commune, ward, town level (hereinafter referred to as commune level):

a) Office machinery and equipment commonly equipped for cadres and civil servants at agencies, organizations, and units (per person):

- Secretary, Deputy Secretary of the Commune Party Committee, Chairman, Deputy Chairman of the Commune People's Council, Commune People's Committee and equivalent positions:

The standards and quotas for providing common office equipment for these positions and their office spaces are stipulated in Part A Appendix IV attached to this Decision.

- Cadres, civil servants, public officials at the commune level:

The standards and quotas for providing common office equipment are stipulated in Section I Part B Appendix IV attached to this Decision.

b) Office equipment commonly provided for the office space of commune-level agencies, organizations, units (for 01 office space):

- Office space of commune-level agencies, organizations, units: The standards and quotas for providing common office equipment are stipulated in Section II Part B Appendix IV attached to this Decision.

- Administrative Records Room of commune-level agencies, organizations, units: The standards and quotas for providing common office equipment are stipulated in Section III Part B Appendix IV attached to this Decision.

- Citizen Reception Room, One-Stop Service Unit of commune-level agencies, organizations, units: The standards and quotas for providing common office equipment are stipulated in Section IV Part B Appendix IV attached to this Decision.

Article 8. Provision of machinery and equipment in rooms to serve the common activities of agencies, organizations, units

The Minister, Head of a ministry-equivalent agency, agency under the Government, other agencies at the central level shall decide; the Chairman of the Provincial People's Committee shall decide or decide according to the delegated authority on the quantity, type, purchase price of machinery and equipment to be provided in rooms serving the common activities of agencies, organizations, units under their management as prescribed in Point c Clause 1 Article 2 of this Decision and shall be responsible before the law for their decisions. The provision must ensure economy, efficiency, suitability with the nature of work, room area, and financial capacity of the agencies, organizations, units.

Article 9. Provision of specialized machinery and equipment

1. For specialized machinery and equipment with a purchase price of VND 500 million or more per unit of asset:

a) The Minister, Head of a ministry-equivalent agency, agency under the Government, other agencies at the central level shall issue standards and quotas for specialized machinery and equipment (type, quantity) to be provided for agencies, organizations, units under their management after obtaining written agreement from the Ministry of Finance.

b) The Chairman of the Provincial People's Committee shall issue standards and quotas for specialized machinery and equipment (type, quantity) to be provided for agencies, organizations, units under local management after obtaining written agreement from the Standing Body of the Provincial People's Council.

2. For specialized machinery and equipment with a purchase price below VND 500 million per unit of asset:

The Minister, Head of a ministry-equivalent agency, agency under the Government, other agencies at the central level, the Chairman of the Provincial People's Committee shall issue standards and quotas for specialized machinery and equipment (type, quantity) to be provided for agencies, organizations, units under their management.

3. The procurement of specialized machinery and equipment by agencies, organizations, units can only be carried out after the ministries, sectors, and localities have issued standards and quotas and are consistent with the types and quantities stipulated by the Minister, Head of a ministry-equivalent agency, agencies under the Government, other agencies at the central level or the Chairman of the Provincial People's Committee as prescribed in Clause 1, Clause 2 of this Article.

4. The Minister, Head of a ministry-equivalent agency, agency under the Government, other agencies at the central level shall decide or decide according to the delegated authority on the procurement of specialized machinery and equipment for agencies, organizations, units under central management; the Chairman of the Provincial People's Committee shall decide or decide according to the delegated authority on the procurement of specialized machinery and equipment for agencies, organizations, units under local management.

5. For specialized machinery and equipment that have exceeded the usage period as prescribed and cannot continue to be used or have been damaged but repair for continued use is not effective, liquidation shall be carried out. The provision of replacement specialized machinery and equipment after liquidation shall not exceed the quantity and correct type as stipulated in the standards and quotas for specialized machinery and equipment issued by the competent authority as prescribed in Clause 1, Clause 2 of this Article.

6. State Treasury shall implement control over expenditure and payment for specialized machinery and equipment with standards and quotas issued by authorized agencies.

Article 10. Competence to adjust the price level for office machinery and equipment commonly provided at agencies, organizations, and units

1. The Minister, Head of a ministry-level agency, agency under the Government, other central agencies, and the Chairman of the People's Committee of a province shall examine and decide on cases where the purchase price of commonly used office machinery and equipment of agencies, organizations, and units under their management does not exceed 10% more than the price specified in this Decision.

2. The Minister of Finance shall examine and decide on cases where the purchase price of commonly used office machinery and equipment exceeds 10% but does not exceed 20% more than the price specified in this Decision.

3. In cases where the market price of commonly used office machinery and equipment increases or decreases by more than 20% compared to the prices specified in this Decision, the Minister of Finance shall report to the Prime Minister for examination and decision to adjust accordingly.

Chapter III

MANAGEMENT AND USE OF MACHINERY AND EQUIPMENT

Article 11. Leasing machinery and equipment at agencies, organizations, and units

1. Agencies, organizations, and units shall lease machinery and equipment in the following cases:

a) There is no machinery and equipment or it is insufficient according to standards and norms, affecting the performance of assigned functions and tasks.

b) Existing machinery and equipment are damaged, unusable, or unsafe when used.

2. Authority to decide on leasing machinery and equipment:

a) The Minister, Head of a ministry-level agency, agency under the Government, and other central agencies shall decide or delegate authority to decide on leasing machinery and equipment serving the activities of agencies, organizations, and units under their management.

b) The Provincial People's Council shall delegate authority to decide on leasing office equipment serving the activities of agencies, organizations, and units within its local jurisdiction based on the proposal of the same-level People's Committee.

3. Leasing of machinery and equipment shall be carried out as follows:

a) For machinery and equipment with a need for use for less than 12 months or a maximum of three times per year, and where rental services are available on the market, leasing must be implemented; otherwise, agencies, organizations, and units shall consider and submit to the competent authority as stipulated in Clause 2 of this Article for a decision on leasing machinery and equipment that ensures leasing is more effective than purchasing.

b) The quantity and type of leased machinery and equipment must comply with the standards and norms prescribed in this Decision.

c) The rental price of machinery and equipment must be consistent with the rental price of similar machinery and equipment or those with the same technical standards and origin in the local market.

d) The selection of service providers for leasing office equipment shall be conducted in accordance with the provisions of the law on bidding.

Article 12. Allocation of budget for using commonly provided office machinery and equipment at agencies, organizations, and units

1. In cases where civil servants voluntarily register to implement the allocation of budget for using commonly provided office machinery and equipment; the amount of the allocated budget to pay civil servants shall be determined monthly and based on:

a) Standards and norms for using commonly provided office machinery and equipment as prescribed in this Decision.

b) Usage time according to asset management regulations and depreciation of fixed assets in state agencies, public institutions, and organizations using state budget funds.

2. Principles of budget allocation:

a) The allocation of budget for using commonly provided office machinery and equipment shall not affect the performance of assigned functions and tasks.

b) Ensure efficiency and cost savings over procurement.

3. The Minister, Head of a ministry-level agency, agency under the Government, and other central agencies, and the Chairman of the People's Committee of a province shall base decisions or delegate authority to decide on the allocation of budget for using commonly provided office machinery and equipment for civil servants of agencies, organizations, and units under their management on actual conditions and types of commonly provided office machinery and equipment.

Article 13. Accounting and Public Disclosure of the Procurement, Management, and Use of Machinery and Equipment

The agencies equipped with, leasing, or cost-sharing for the use of machinery and equipment pursuant to this Decision shall implement accounting and public disclosure of the procurement, management, and use of machinery and equipment of their agencies, organizations, and units in accordance with the provisions of the law on the public disclosure of state assets.

 

Chapter IV

RESPONSIBILITY FOR IMPLEMENTATION

Article 14. Responsibilities of the Ministry of Finance

1. Take the lead and coordinate with relevant Ministries, sectors, People's Committees of provinces and centrally governed cities to guide the implementation of this Decision.

2. Coordinate with relevant Ministries, sectors, People's Committees of provinces and centrally governed cities to inspect and urge compliance with the regulations on the procurement, management, and use of machinery and equipment of agencies, organizations, and units as stipulated in this Decision.

3. Implement the recovery and reallocation of machinery and equipment of agencies, organizations, and units in cases of violation as prescribed in Clause 4, Article 17 of this Decision.

4. Provide detailed guidance on certain contents of this Decision.

Article 15. Responsibilities of Ministries, Bodies Equivalent to Ministries, Government Agencies, and Other Central Agencies, Provincial People's Committees

Relevant Ministries, sectors, and People's Committees of provinces and centrally governed cities have the responsibility to:

1. Inspect, supervise, and publicly disclose the implementation of the procurement, management, and use of machinery and equipment of agencies, organizations, and units under their jurisdiction as stipulated in this Decision.

2. Direct agencies, organizations, and units under their jurisdiction to review existing machinery and equipment to develop plans and budget estimates for the procurement, purchase, lease, or cost-sharing for the use of machinery and equipment based on budget capacity; ensuring the provision of machinery and equipment to agencies, organizations, and units according to the standards and norms set forth in this Decision.

3. Issue Regulations on the management and use of machinery and equipment of agencies, organizations, and units under their jurisdiction to ensure management and use in accordance with the standards and norms prescribed in this Decision and laws on the management and use of state assets. The content of the Regulations includes:

- Provisions on the quantity and types of common office machinery and equipment and the budget for purchasing for each civil servant, officer, and staff member and each office.

- Provisions on the quantity and types of machinery and equipment and the budget for purchasing for shared-use rooms of agencies, organizations, and units according to the nature of work of each room, ensuring effective and economical provision.

- Provisions on the procurement, arrangement, use, repair, maintenance, and disposal of office machinery and equipment.

- Specific provisions on determining the cost-sharing amount, accounting, and monitoring the cost-sharing for the use of common office machinery and equipment by each civil servant, officer, and staff member who has been assigned cost-sharing.

- Provisions on handling violations in the management and use of machinery and equipment.

- Other related contents.

4. Report to the Ministry of Finance on the issuance of standards and regulations on the management and use of specialized machinery and equipment as prescribed in Clause 1 and Clause 2, Article 9 of this Decision.

Article 16. Responsibilities of Agencies, Organizations, Units, and Individuals Equipped with and Using Machinery and Equipment

1. Agencies, organizations, and units have the responsibility to procure, manage, and use machinery and equipment in accordance with the objects, standards, and norms prescribed in this Decision.

2. Civil servants, officers, and staff members using machinery and equipment have the responsibility to maintain and preserve machinery and equipment, ensuring economical and efficient use.

Chapter V

HANDLING VIOLATIONS

Article 17. Handling Violations in the Procurement, Provisioning, Management, and Use of Machinery and Equipment

1. The Minister, Head of a ministry-level agency, agency under the Government, other central agencies, Chairperson of the People's Committee of provinces and centrally governed cities shall be responsible for the procurement, provisioning, management, and use of machinery and equipment of agencies, organizations, and units within their jurisdiction in accordance with the Law on State Asset Management and Use, the Law on Thrift and Anti-Waste, and relevant legal provisions.

2. The person making the decision to procure or provide machinery and equipment for agencies, organizations, and units beyond authority, not in compliance with standards and quotas stipulated herein must compensate for losses and be subject to disciplinary action according to the law depending on the severity of the violation.

3. For the management and use of machinery and equipment of agencies, organizations, and units not in compliance with regulations, the Head of the agency, organization, unit, and related individuals shall bear responsibility; depending on the nature, degree of the violation, and extent of damage, they must compensate for losses and be subject to disciplinary action and administrative penalties according to the law.

4. Machinery and equipment procured by agencies, organizations, and units not meeting standards, exceeding prescribed prices, or quotas shall be recovered and handled according to the law on state asset management and use.

Chapter VI

IMPLEMENTING PROVISIONS

Article 18. Effective Date

This Decision takes effect from January 1, 2016.

This Decision replaces Decision No. 170/2006/QĐ-TTg dated July 18, 2006, of the Prime Minister promulgating the Standards and Quotas for Equipment and Working Tools of Agencies and State Officials.

Article 19. Responsibility for Implementation

Ministers, Heads of ministry-level agencies, Heads of agencies under the Government, other central agencies, Chairpersons of the People's Committees of provinces and centrally governed cities, and Heads of related agencies are responsible for implementing this Decision./.
