Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016, issued by the Government, detailing the implementation of certain provisions of the State Budget Law;

Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 1446/QĐ-TTg dated August 30, 2021 of the Prime Minister approving the Program "Training and Retraining to Enhance Human Resource Skills to Meet the Requirements of the Fourth Industrial Revolution" (hereinafter referred to as Decision No. 1446/QĐ-TTg);

At the proposal of the Director of the Administrative and Public Finance Department:

The Minister of Finance issues this Circular regulating the content and level of expenditure for implementing certain activities of the Program "Training and Retraining to Enhance Human Resource Skills to Meet the Requirements of the Fourth Industrial Revolution".

Article 1. Scope of Regulation

1. This Circular regulates the content and level of expenditure for implementing certain activities of the Program "Training and Retraining to Enhance Human Resource Skills to Meet the Requirements of the Fourth Industrial Revolution" approved by the Prime Minister in Decision No. 1446/QĐ-TTg (hereinafter referred to as the Program). The implementation period from 2021 to 2025 is stipulated in Clause 2, Section II of Decision No. 1446/QĐ-TTg.

2. This Circular does not apply to grants and aids from the state budget that have separate financial index regulations issued by competent authorities.

In cases where the sponsor or the authorized representative of the sponsor and the Ministry of Finance have not agreed on the content and level of expenditure, the provisions of this Circular shall be applied.

Article 2. Applicability

The subjects to which this Circular applies are agencies, units, organizations, and individuals managing and using regular state budget funds to implement activities assigned under the Program.

Article 3. Sources of Funding for Implementing the Program

1. Central budget allocated in the annual regular state budget expenditure plan of the Ministry of Labor, Invalids and Social Affairs.

2. Revenue from public vocational education institutions participating in training under the Program.

3. Funds from non-public vocational education institutions and enterprises. Non-public vocational education institutions and enterprises may apply the content and level of expenditure prescribed in this Circular and ensure their own funding to implement Program activities.

4. Legal funds from various funds as provided by law.

5. Funds integrated from other programs and projects approved by competent authorities, international cooperation projects, and sources of sponsorship and support from domestic and foreign organizations and individuals.

6. Other lawful funds.

Article 4. Content and Level of Expenditure for Implementing Certain Activities of the Program

1. Survey and assess the current skills of workers at enterprises to determine training and retraining needs and appropriate training models according to sectors, industries, and occupations affected by the Fourth Industrial Revolution implemented in the Program; survey and evaluate the capacity and conditions of vocational education institutions and enterprises participating in training and retraining under the Program as prescribed by law: The content and level of expenditure shall be carried out in accordance with Circular No. 109/2016/TT-BTC dated June 30, 2016 of the Ministry of Finance on the preparation of budgets, management, use, and settlement of funds for conducting surveys and national censuses.

2. Research to apply international experience in training new professions and new vocational skills in vocational education to meet the requirements of the Fourth Industrial Revolution implemented in the Program: The content and level of expenditure shall be carried out in accordance with Joint Circular No. 55/2015/TTLT-BTC-BKHCN dated April 22, 2015 of the Ministry of Finance and the Ministry of Science and Technology guiding the establishment, allocation, and settlement of budgets for scientific and technological tasks funded by the state budget and Joint Circular No. 27/2015/TTLT-BKHCN-BTC dated December 30, 2015 of the Ministry of Science and Technology and the Ministry of Finance on the level of expenditure for scientific and technological tasks funded by the state budget.

3. Establish output standards for new training professions and revise and supplement output standards for some professions requiring new knowledge and skills:

a) College and intermediate levels: The content and level of expenditure shall be carried out in accordance with Clause 8, Article 23 of Circular No. 15/2022/TT-BTC dated March 4, 2022 of the Ministry of Finance on the management and use of public funds for implementing the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the 2021-2030 period, Phase I: from 2021 to 2025 (hereinafter referred to as Circular No. 15/2022/TT-BTC);

b) Primary level: The content and level of expenditure shall be carried out in accordance with Clause 10, Article 23 of Circular No. 15/2022/TT-BTC.

4. Establish a minimum list of training equipment and economic-technical norms for new training professions; amend and supplement the minimum list of training equipment and economic-technical norms for additional training to provide new knowledge and skills for implementing training programs: The content and level of expenditure shall be carried out in accordance with Point c, Clause 2, Article 16 of Circular No. 46/2022/TT-BTC dated July 28, 2022 of the Ministry of Finance on the management, use, and settlement of public funds from the central budget for implementing the National Target Program on Sustainable Poverty Reduction for the 2021-2025 period (hereinafter referred to as Circular No. 46/2022/TT-BTC).

5. Develop training and retraining programs to meet occupational output standards; develop shared learning materials for training programs: The content and level of expenditure shall be carried out in accordance with Article 22 and Clause 7, Article 23 of Circular No. 15/2022/TT-BTC.

6. For implementing digital transformation, building electronic libraries, and online training systems at vocational education and training institutions participating in the Program: Implement in accordance with the provisions of laws on managing investment in the application of information technology using state budget funds and relevant laws; the provisions set forth in Clause 9, Article 23 of Circular No. 15/2022/TT-BTC; economic and technical norms in the field of information and communication; the provisions of laws on bidding within the approved budget estimate by the competent authority.

7. For enhancing the capacity of teaching staff, management personnel of vocational education and training institutions, and trainers in enterprises:

a) Only develop training programs to enhance the capacity of teaching staff, management personnel of vocational education and training institutions, and trainers in enterprises participating in the Program: The content and level shall be implemented in accordance with the provisions of Clause 1, Article 23 of Circular No. 15/2022/TT-BTC;

b) Expenses for organizing training and upgrading professional knowledge and necessary skills to serve training and retraining human resources to meet the requirements of the Fourth Industrial Revolution for teaching staff, management personnel of vocational education and training institutions, and trainers in enterprises participating in the Program: The content and level shall be implemented in accordance with the provisions of Clause 1, Article 4 of Circular No. 46/2022/TT-BTC.

8. Organizing training and retraining for participants in the Program in accordance with the provisions of Clause 1, Section II and Clause 5, Section III (Tasks and Solutions) of Article 1 of Decision No. 1446/QĐ-TTg and decisions of the competent authority: Implement in accordance with the provisions of Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or bidding to provide products and services using state budget funds from regular funding; the provisions of laws on vocational education, employment, and related laws.

9. Building and operating an electronic information portal to manage and connect components participating in the Program, serving the effective implementation and management of the Program: Implement in accordance with the provisions on managing investment in the application of information technology using state budget funds and relevant laws; economic and technical norms in the field of information and communication; the provisions of laws on bidding within the approved budget estimate by the competent authority.

10. Inspecting, supervising, evaluating, and summarizing the Program: The content and level shall be implemented in accordance with the provisions of Circular No. 06/2007/TT-BTC dated January 26, 2007 of the Ministry of Finance guiding the preparation of budgets, management, and use of funds to ensure the inspection of policy implementation, strategies, planning, and Circular No. 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance stipulating travel expenses and regulations on organizing meetings for state agencies and public service units.

11. In cases where the tasks specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, and 9 of Article 4 of this Circular have already been funded from the National Target Program on Socio-Economic Development of Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: 2021-2025; the National Target Program on Sustainable Poverty Reduction for the period 2021-2025; the National Target Program on New Rural Development for the period 2021-2025, and other programs, projects, and plans: Such tasks shall not be funded or settled from this Program.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Annually, along with the time for preparing the state budget revenue and expenditure plan, the Ministry of Labor, Invalids, and Social Affairs shall take the lead in compiling the content and annual regular funding needs for implementing the Program and submit it to the Ministry of Finance for consolidation and submission to the Prime Minister in accordance with Point g, Clause 1, Section IV of Decision No. 1446/QĐ-TTg.

2. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant ministries, sectors, localities, and related agencies and units to organize the implementation, inspection, evaluation, and summary of the Program (including the management and use of funds), report to the Prime Minister in accordance with Point h, Clause 1, Section IV of Decision No. 1446/QĐ-TTg, and send copies to the Ministry of Finance for supervision of the implementation of the management and use of regular funding for the Program in accordance with Point b, Clause 4, Section IV of Decision No. 1446/QĐ-TTg.

Article 6. Implementation Provisions

1. This Circular takes effect from November 10, 2022.

2. In case the legal normative documents cited in this Circular are amended, supplemented, or replaced by other legal normative documents, the provisions of the amended, supplemented, or replacing documents shall apply.

3. During the implementation process, if there are difficulties or obstacles, please reflect them to the Ministry of Finance for research and resolution./ .
