REGULATIONS ON THE GRADATION OF IMPLEMENTATION OF CERTAIN TASKS AND ADMINISTRATIVE PROCEDURES IN THE FIELD OF DISEASE PREVENTION WITHIN THE AUTHORITY OF THE MINISTRY OF HEALTH

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Prevention and Control of Infectious Diseases No. 03/2007/QH12;

Pursuant to the Law on Prevention and Control of Human Immunodeficiency Virus (HIV)/Acquired Immunodeficiency Syndrome (AIDS) No. 64/2006/QH11 amended and supplemented by Law No. 71/2020/QH14;

Pursuant to the Law on Environmental Protection No. 72/2020/QH14;

Pursuant to Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates amended and supplemented by Decree No. 34/2023/NĐ-CP dated July 31, 2023 of the Government;

Pursuant to Decree No. 104/2016/NĐ-CP dated July 1, 2016 of the Government on vaccination activities amended and supplemented by Decrees No. 155/2018/NĐ-CP dated November 12, 2018 and No. 13/2024/NĐ-CP dated February 5, 2024 of the Government;

Pursuant to Decree No. 89/2018/NĐ-CP dated June 25, 2018 of the Government promulgating detailed regulations implementing certain provisions of the Law on Prevention and Control of Infectious Diseases regarding border health quarantine;

Pursuant to Decree No. 141/2024/NĐ-CP dated October 28, 2024 of the Government detailing certain provisions of the Law on Prevention and Control of Human Immunodeficiency Virus (HIV)/Acquired Immunodeficiency Syndrome (AIDS);

Pursuant to Decree No. 217/2025/NĐ-CP dated August 5, 2025 of the Government on specialized inspection activities;

Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Department of Disease Prevention,

The Minister of Health issues this Circular regulating the gradation of implementation of certain tasks and administrative procedures in the field of disease prevention within the authority of the Ministry of Health.

Article 1. Scope of Regulation

This Circular regulates the gradation of implementation of certain tasks and administrative procedures in the field of disease prevention within the authority of the Ministry of Health.

Article 2. Gradation of Implementation of Certain Tasks in the Field of Disease Prevention Within the Authority of the Ministry of Health for the Department of Disease Prevention

1. To take the lead and coordinate with relevant agencies in providing accurate and scientific information about HIV/AIDS as stipulated in Clause 2, Article 12 of the Law on Prevention and Control of Human Immunodeficiency Virus (HIV)/Acquired Immunodeficiency Syndrome (AIDS) No. 64/2006/QH11 amended and supplemented by Law No. 71/2020/QH14.

2. To report on the implementation of environmental protection tasks of the Ministry of Health to the Ministry of Agriculture and Rural Development as stipulated in Point d, Clause 1, Article 118 of the Law on Environmental Protection No. 72/2020/QH14.

3. To coordinate in determining the scope of international border gates, main border gates (bilateral border gates); border crossing points, dedicated transport routes for goods and report to the Government for decision-making as stipulated in Point b, Clause 2, Article 12 of Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates amended and supplemented by Decree No. 34/2023/NĐ-CP.

4. To coordinate in drafting, reviewing, and approving tasks for planning border gates along each border line as stipulated in Point a, Clause 3, Article 18 of Decree No. 112/2014/NĐ-CP amended and supplemented by Decree No. 34/2023/NĐ-CP.

5. To participate in surveys and provide opinions on the opening, upgrading of border gates; border crossing points; border crossing points, dedicated transport routes for goods as stipulated in Article 20 of Decree No. 112/2014/NĐ-CP amended and supplemented by Decree No. 34/2023/NĐ-CP.

6. To organize and guide health quarantine agencies to perform their functions at border gates, land border crossing points according to Vietnamese laws and international treaties to which the Socialist Republic of Vietnam is a member as stipulated in Clause 1, Article 24 of Decree No. 112/2014/NĐ-CP.

7. To coordinate with the Ministry of National Defense to limit or temporarily suspend cross-border activities at border gates, land border crossing points in case of outbreaks affecting people as stipulated in Clause 2, Article 24 of Decree No. 112/2014/NĐ-CP.

8. To provide opinions on national gate projects and joint control houses as stipulated in Point b, Clause 4, Article 26 of Decree No. 112/2014/NĐ-CP.

9. To develop and implement annual plans for the use of vaccines under the Expanded Program on Immunization as stipulated in Point a, Clause 1, Article 22 of Decree No. 104/2016/NĐ-CP dated July 1, 2016 of the Government on vaccination activities amended and supplemented by Decrees No. 155/2018/NĐ-CP and No. 13/2024/NĐ-CP.

10. To direct and organize the implementation of border health quarantine according to the law nationwide; to direct and implement health declarations for people nationwide as stipulated in Points a and b, Clause 1, Article 44 of Decree No. 89/2018/NĐ-CP.

11. To receive and approve plans for demand, distribution, and regulation of antiretroviral drugs nationwide as stipulated in Point a, Clause 2, Article 51 of Decree No. 141/2024/NĐ-CP.

12. To carry out specialized inspection tasks in the field of disease prevention as stipulated in Clause 1, Article 6 of Decree No. 217/2025/NĐ-CP dated August 5, 2025 of the Government on specialized inspection activities.

13. To respond to proposals, difficulties, and obstacles of Ministries, sectors, provincial People's Committees within the scope of expertise in the field of disease prevention according to the law.

Article 3. Delegation of administrative procedures in the field of disease prevention under the Ministry of Health's jurisdiction to the Disease Control Department.

Issuance of import permits for specimen samples (procedure code 2.001229) in accordance with Article 36 of Decree No. 89/2018/ND-CP, amended and supplemented by Clause 2 of Article 15 of Decree No. 155/2018/ND-CP.

Article 4. Effective date

This Circular takes effect from February 15, 2026.

Article 5. Transitional provisions

For applications for import permits for specimen samples submitted before this Circular takes effect, the receiving agency shall continue to process them according to current regulations.

Article 6. Implementation organization

The Director of the Ministry’s Office; Heads of the Cadres and Civil Servants Department and the Legal Department; Directors of the Disease Control Department and other relevant agencies, organizations, and individuals are responsible for implementing this Circular.

During implementation, if there are difficulties or obstacles, they should be reported to the Ministry of Health (Disease Control Department) for timely guidance and resolution./.
