DECREE

Amending and supplementing certain articles of related decrees concerning

conditions on security and public order for certain business sectors and occupations subject to conditions; management and use of seals; management and use of fireworks; detailed regulations on certain provisions and implementation measures of the Law on Residence, the Law on Identity Cards

using fireworks; detailing certain provisions and implementing measures

Law on Residence, Law on Identity Cards

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the People's Public Security Law No. 37/2018/QH14 amended and supplemented by Laws No. 21/2023/QH15, No. 30/2023/QH15, No. 38/2024/QH15, No. 52/2024/QH15, and No. 86/2025/QH15;

At the proposal of the Minister of Public Security;

The Government promulgates Decree amending and supplementing certain articles of related decrees concerning conditions regarding security and public order for certain business sectors; management and use of seals; management and use of fireworks; detailing certain provisions and implementing measures of the Law on Residence, Law on Identity Cards.

Article 1. Amending and supplementing certain articles of Decree No. 96/2016/ND-CP stipulating conditions regarding security and public order for certain business sectors with conditions that have been amended and supplemented in 2023 (hereinafter referred to as Decree No. 96/2016/ND-CP)

1. Amending and supplementing Clause 20, Article 3 as follows:

"20. Operating beauty surgery services, including: Services using drugs, substances, equipment to intervene in the human body (surgery, procedures, interventions involving injections, infusions, injections, radiation, waves, burning or other invasive interventions) aimed at: Changing skin color, shape, increasing weight, reducing weight (fat reduction, body fat reduction); correcting defects or shaping according to desire for parts of the body (skin, nose, eyes, lips, face, chest, abdomen, buttocks, and other parts of the body); regenerating, restoring cells, organs, or functions of the human body; tattooing, piercing, embroidery activities on the skin that change the shape, identifying features of a person."

2. Amending and supplementing Clause 23, Article 3 as follows:

"23. Operating military uniforms, military supplies for armed forces, military weapons, technical equipment, special tools, and dedicated means for Military and Public Security; components, parts, accessories, special materials, and dedicated technology for manufacturing them, including:

a) Producing, purchasing, selling: Military uniforms, police uniforms; military insignia, police insignia, rank insignia, number plates of the Vietnam People's Army and the Vietnam People's Public Security Force;

b) Producing, assembling, importing, exporting, purchasing, selling, transporting, repairing:

Handguns, shoulder-fired guns, ammunition used for these types of weapons equipped for the people's armed forces and other forces as prescribed by laws on the management and use of weapons, explosives, and auxiliary tools; speed detection machines for motor vehicles on roads; breath alcohol testing devices; drug testing devices; GSM mobile phone monitoring devices and other types of mobile phone monitoring devices.

Components, parts, accessories, and dedicated technological equipment for manufacturing: Handguns, shoulder-fired guns, ammunition used for these types of weapons; speed detection machines for motor vehicles on roads; breath alcohol testing devices; drug testing devices; GSM mobile phone monitoring devices and other types of mobile phone monitoring devices."

3. Amending and supplementing Clause 8, Article 4 as follows:

"8. Valid documents include one of the following: An electronically signed electronic version for documents issued by a business entity; an electronically certified electronic version for documents issued by state agencies by authorized agencies; an electronic version extracted from the database of relevant state management agencies; a copy verified against the original; a copy issued from the original; a copy certified from the original by authorized agencies."

4. Supplementing Clause 9, 10 after Clause 8, Article 4 as follows:

“9. A foreign-invested business entity is a business entity under one of the following circumstances:

a) A business entity with foreign investment capital;

b) A business entity with one of the persons specified in Clause 5 of this Article being a foreigner;

c) A business entity providing services exclusively to foreigners.

10. A cross-provincial business entity is a business entity under one of the following circumstances:

a) Business entities operating under a parent-subsidiary structure engaging in business sectors with conditional requirements regarding security and public order within two provinces or cities or more;

b) A business entity having branches, representative offices, business locations operating within two provinces or cities and above.”

5. Amending and supplementing Point a, Clause 2, Article 7 as follows:

“a) For Vietnamese citizens:

Have been criminally indicted and the investigation, prosecution, and trial are currently being conducted by Vietnamese or foreign judicial authorities.

Having a criminal record for offenses endangering national security or other offenses due to intentional fault sentenced to over three years' imprisonment without having had the criminal record expunged; currently serving a suspended sentence; currently temporarily exempted from serving a sentence; currently serving a non-custodial correctional sentence; currently under house arrest, residence prohibition, prohibition from holding positions, or prohibition from engaging in business sectors with conditional requirements regarding security and public order as decided by the Court.

Currently subject to community education measures; having a decision on administrative handling measures pending execution; currently addicted to narcotics; currently temporarily exempted or suspended from serving a decision on compulsory educational facilities or compulsory detoxification facilities; previously subjected to administrative handling measures but not yet sufficient time has passed to be considered as not being subject to administrative handling measures;"

6. Amending and supplementing Clause 4, Article 12 as follows:

"4. Training institutions may only train security service personnel after the Department of Administrative Management of Social Order, Ministry of Public Security reviews and approves the training curriculum. After completing the training course, they must submit a request to the competent public security authority to assess the results and issue a Security Service Vocational Certificate (Model No. 04 attached as Appendix I to this Decree) to security service personnel who meet the requirements during the assessment. The Security Service Vocational Certificate is valid for five years from the date of issuance. The Ministry of Public Security shall detail regulations on training security service personnel on an information technology platform; issuing, reissuing, revoking, and invalidating the Security Service Vocational Certificate."

7. Supplementing Clause 5 after Clause 4, Article 12 as follows:

“5. Forms of training security service personnel:

a) The theoretical part is trained directly or through an information technology platform;

b) The practical part is trained directly.”

8. Amending and supplementing Clause 2, Article 19 as follows:

“2. Valid documents include one of the following types of documents:

a) Investment registration certificate; Enterprise registration certificate; Branch activity registration certificate or business location registration certificate of enterprises, branch enterprises; Cooperative registration certificate, cooperative federation registration certificate; Business household registration certificate; notification of tax identification number for business locations of business households; establishment documents or permission to operate accompanied by a notification of tax identification number for revenue-generating public institutions;

b) In cases where the documents specified in point a of this clause do not indicate the business sectors with conditional requirements, the business entity must provide additional documentation proving the business sectors with conditional requirements for which the Certificate of Compliance with Conditions Regarding Security and Public Order is requested, which have been approved by the business registration authority or the competent authority;

c) The business entity does not need to submit the documents specified in points a and b of this clause when the government agency’s database has been connected and shared on an electronic environment.”

9. Amending and supplementing Clause 3, Article 19 as follows:

"3. Valid documents and papers proving the conditions for fire safety and firefighting security for the business area and raw material storage warehouses as follows:

a) A document approving the fire safety inspection results of the competent authority for new construction projects or newly renovated projects at the time of applying for the Certificate of Compliance with Conditions Regarding Security and Public Order, as listed in Appendix III issued together with Decree No. 105/2025/ND-CP detailing certain provisions and implementing measures of the Law on Fire Prevention, Firefighting, and Rescue Operations (hereinafter referred to as Decree No. 105/2025/ND-CP);

b) Inspection records on fire safety of the competent authorities in charge of fire prevention, firefighting, and rescue operations for business entities not covered by point a of Clause 3 of this Article but listed in Appendix I issued together with Decree No. 105/2025/ND-CP;

c) Business entities not required to submit the documents specified in points a and b of Clause 3 of this Article include: Manufacturing seals; operating signaling equipment for priority vehicles; operating security services; operating betting services; operating interference and jamming devices for mobile communications; operating beauty surgery services; operating speed detection machines for motor vehicles on roads; operating breath alcohol testing devices; operating drug testing devices; operating GSM mobile phone monitoring devices and other types of mobile phone monitoring devices;

d) For business entities without storage warehouses for raw materials or products as required, they must have a warehouse rental contract ensuring fire safety and rescue conditions as stipulated in points a and b of Clause 3 of this Article.

d) For business establishments in industries and trades using industrial explosives and explosive precursors; blasting services, the documents proving the safety conditions for fire prevention, firefighting, and rescue are the documents of the storage facility for industrial explosives and explosive precursors. In cases where these establishments conduct blasting activities under a general supply contract for explosives from an industrial explosives business establishment to the blasting site and ensure that all explosives are used up on the same day without storing any explosives, they are not required to arrange a storage facility but must provide the general supply contract along with the Certificate of Eligibility for Security and Public Order issued by the industrial explosives business establishment and the Inspection Report on Fire Prevention and Firefighting for the storage facility of industrial explosives.

e) Business establishments are not required to submit documents proving the safety conditions for fire prevention, firefighting, and rescue as stipulated in points a and b of this clause when the State management agency's database has been connected and shared electronically.

10. Amend and supplement Clause 4 of Article 19 as follows:

"4. Criminal history record or Personal Declaration Form (Form No. 02b issued together with Decree No. 96/2016/NĐ-CP) of the person responsible for security and public order of the business establishment in the following cases:

a) For Vietnamese citizens residing within the country who are responsible for security and public order at the business establishment named in the Certificate of Eligibility for Security and Public Order, they must have a Criminal Record Certificate (except those currently serving in the armed forces).

b) For Vietnamese citizens residing abroad holding foreign passports and foreigners who are responsible for security and public order at the business establishment named in the Certificate of Eligibility for Security and Public Order, they must have a Personnel Declaration Form accompanied by valid documents such as Passport, Permanent Residence Card, Temporary Residence Card, or Visa still valid for residence in Vietnam.

c) Business establishments are not required to submit the Criminal Record Certificate; Passport, Permanent Residence Card, Temporary Residence Card, or Visa as specified in points a and b of this clause when the State management agency's database has been connected and shared electronically.

11. Amend and supplement Clause 4 of Article 20 as follows:

"4. For business establishments in industries and trades: Handguns, shoulder-fired weapons, ammunition used for these types of weapons equipped for the people's armed forces and other forces as prescribed by laws on the management and use of weapons, explosives, and auxiliary tools; casino operations; electronic games with rewards for foreigners; betting services, must have a permit to operate issued by the specialized State management agency."

12. Amend and supplement Point c, Clause 1, Point c, Clause 2, and Clause 3 of Article 23 as follows:

a) Amend and supplement Point c, Clause 1 as follows:

"c) At a business location with multiple industries and trades belonging to different business establishments under the authority of various levels of Public Security organs to issue Certificates of Eligibility for Security and Public Order, each business establishment must submit one set of application documents to the Public Security organ with the authority as stipulated in Article 24 of this Decree to obtain the Certificate of Eligibility for Security and Public Order for each business establishment;"

b) Amend and supplement Point c, Clause 2 as follows:

"c) Submit through the National Public Service Portal or the National Identity Application (VNeID) (excluding documents and papers prohibited from being uploaded via the network system as prescribed by law)."

c) Amend and supplement Clause 3 as follows:

"3. The deadline for completing the issuance of Certificates of Adequate Security Conditions from the date of receiving complete valid application documents is as follows:

a) Not exceeding four working days for cases prescribed in Articles 19, 20 and Clauses 2, 3, 4 of Article 22 of this Decree;

b) Not exceeding three working days for cases prescribed in Article 21 and Clause 1 of Article 22 of this Decree."

13. Amend and supplement Clause 4 of Article 23 as follows:

"4. In case of non-issuance of the Certificate of Eligibility for Security and Public Order, the Public Security organ must issue a written response to the business establishment within eight working hours from the time of receiving the application through the National Public Service Portal or VNeID Application, or within two working days for applications received directly or through postal service, stating the reasons."

14. Amend and supplement Article 24 as follows:

Article 24. Competence to Issue Certificates of Adequate Security and Public Order Conditions, Professional Certificates for Security Services, and Review of Training Programs for Security Service Personnel

1. The Department of Administrative Police under the Ministry of Public Security shall be responsible for:

"a) Issuing Certificates of Eligibility for Security and Public Order and managing business establishments under the authority of central agencies granting permission to establish and operate; business establishments with foreign elements; business establishments operating across provinces and cities for the following industries and trades:

Handguns, shoulder-fired weapons, ammunition used for these types of weapons; industrial explosives and explosive precursors (excluding transportation of industrial explosives and explosive precursors); blasting services; hotel accommodation services rated five stars or higher (excluding five-star tourist villas, five-star tourist apartments, five-star cruise ship accommodations); auxiliary tool services; casino operations; electronic games with rewards for foreigners;

b) Issuing Certificates of Adequate Security and Public Order Conditions and managing foreign-invested security service business establishments or those with training functions for security service personnel;

c) Taking the lead in conducting examinations and issuing Professional Security Guard Certificates for security guard personnel trained at business establishments with training functions for security guards; vocational education centers of People's Public Security colleges; training and professional development centers of units under the Ministry of Public Security with training functions for security guards;

d) Reviewing training programs for security service personnel at establishments specified in Clause 1, Article 12 of this Decree.

2. The Administrative Police Departments of provincial public security services shall be responsible for:

a) Issuing Certificates of Adequate Security and Public Order Conditions and managing business establishments (excluding those specified in point a, Clause 1 of this Article), including:

Transportation of industrial explosives; transportation of explosive precursors; stamp production; industries and trades using industrial explosives; sales of military uniforms, insignias, police insignias, emblems, rank badges, serial numbers of the People's Army and People's Police; betting services; nightclub services; cosmetic surgery services; signal equipment for priority vehicles; devices causing interference and disruption to mobile communication signals; machines and equipment (including spare parts, accessories, production equipment): vehicle speed monitoring equipment for road traffic; GSM mobile phone surveillance equipment and other mobile phone surveillance equipment; breath alcohol testing equipment; drug testing equipment; security service operations; state-run organizations with revenue from central and provincial agencies within their jurisdiction.

Industrial explosives trade; explosive precursors trade; blasting service trade; support tools trade; paintball gun trade (excluding paintball service provision).

Hotel accommodation services rated five stars or higher include: five-star hotels, five-star tourist villas, five-star tourist apartments, five-star cruise ship accommodations, and hotel accommodation services with thirty or more rented rooms.

b) Taking the lead in conducting examinations and issuing Professional Security Guard Certificates for security guard personnel trained at local Public Security training and professional development centers with training functions for security guards.

3. Police stations at commune level shall be responsible for issuing Certificates of Adequate Security and Public Order Conditions and managing business establishments (excluding those specified in Clauses 1 and 2 of this Article), including:

Providing services using paintball guns; karaoke services; massage services; pawnshop services; hotel accommodation services with twenty-nine or fewer rented rooms; printing services; fireworks; state-run organizations with revenue from conditional business operations concerning security and public order of agencies and organizations not covered by Clause 2 of this Article.

15. Amend and supplement Clause 9 of Article 25 as follows:

"9. Only employees aged eighteen or older may be employed in business establishments; they must have full civil capacity; and must not be addicted to drugs. Employees who are under investigation, prosecution, trial; temporarily exempted from serving prison sentences; conditionally released from prison; undergoing community-based correctional supervision; or serving suspended sentences shall not be employed."

16. Amend and supplement Point c of Clause 1 of Article 32 as follows:

“c) A valid health certificate issued by a medical facility meeting the standards prescribed by laws on medical examination and treatment.”

17. Amend and supplement Clause 4 of Article 38 as follows:

“4. At least six days before conducting blasting operations, the business establishment must submit a written notification to the police station at the commune where the blasting activities will take place to coordinate in ensuring security and public order.”

18. Amend and supplement Point c of Clause 3 of Article 50 as follows:

"c) Public Security organs at all levels, according to their assigned functions and tasks, when there is a need to serve political missions, strengthen security and public order, prevent crime, and combat social evils, and conduct surprise inspections, must obtain approval in writing from the head of the Provincial Public Security organ or receive a directive in writing from a superior Public Security organ."

19. Replace the phrase "commune, ward, town" with "commune, ward, special zone" in Clause 2 and 13 of Article 25, Clause 8 of Article 32, Clause 2 and 4 of Article 44..

20. Replace the phrase "vocational training centers of People's Public Security colleges" with "revenue-generating units within the People's Public Security system" in Point b of Clause 1 of Article 12.

21. Replace the phrase "valid copies" with "legitimate documents" in Clause 1 and Point a of Clause 2 of Article 20, Point b of Clause 1 of Article 21, Point b of Clause 1 of Article 22, Clause 8 of Article 32, and Clause 3 of Article 33.

22. Repeal Clause 13 of Article 3 and Model Number 02 promulgated together with Decree No. 96/2016/NĐ-CP amended and supplemented in 2023.

23. Replace Models 01, 03, and 04 promulgated together with Decree No. 96/2016/NĐ-CP amended and supplemented in 2023 with Models 01, 03, and 04 in Appendix I promulgated together with this Decree.

Article 2. Amend and supplement some articles of Decree No. 99/2016/ND-CP on management and use of seals which has been amended and supplemented in 2023 (hereinafter referred to as Decree No. 99/2016/ND-CP).

1. Amend and supplement Point a Clause 2 Article 1 as follows:

"2. This Decree does not regulate the following:

a) Management and use of seals of enterprises, cooperatives, and cooperative unions registered and operating in accordance with the Enterprise Law, Investment Law, and Cooperative Law."

2. Amend and supplement Clause 14 Article 3 as follows:

"14. The economic organizations prescribed in this Decree are enterprises established and operating under the Notary Public Law, Lawyer Law, Judicial Appraisal Law, Insurance Business Law, and Securities Law."

3. Amend and supplement some clauses of Article 7 as follows:

a) Amend and supplement Clause 3 as follows:

"3. The Government, ministries, ministerial-level agencies, and government-affiliated agencies."

b) Amend and supplement Clause 5 as follows:

"5. Supreme People's Court, Supreme People's Court Appeals Court, Provincial People's Courts, Regional People's Courts, Central Military Court, Military Region Military Courts, and equivalent courts, Regional Military Courts."

c) Amending and supplementing Clause 6 as follows:

"6. Supreme People's Procuracy, Appeals Procuracy and Trial Procuracy of the Supreme People's Procuracy, Provincial People's Procuracies, Regional People's Procuracies, Central Military Procuracies, Military Region Military Procuracies, and equivalent procuracies, Regional Military Procuracies."

d) Amend and supplement Clause 8 as follows:

"8. Civil Enforcement Agencies under the Ministry of Justice, enforcement agencies under the Ministry of National Defense, provincial civil enforcement agencies, military regional enforcement agencies and equivalent agencies."

đ) Amend and supplement Clause 10 as follows:

"10. State Committee for Vietnamese Overseas, National Border Commission, Consular Affairs Bureau, State Reception and Foreign Language Translation Bureau, Ho Chi Minh City Department of Foreign Affairs under the Ministry of Foreign Affairs."

4. Amend and supplement some clauses of Article 8 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Agencies and organizations within the organizational structure of ministries, ministerial-level agencies, government agencies, the Standing Committee of the National Assembly (excluding agencies prescribed in Article 7 of this Decree), the National Assembly Office, the State Audit Office."

b) Amend and supplement Clause 3 as follows:

"3. Agencies and organizations within the organizational structure of the Supreme People's Court, Supreme People's Court Appeals Court, Provincial People's Courts, Regional People's Courts, Central Military Court, Military Region Military Courts, and equivalent courts, Regional Military Courts."

c) Amend and supplement Clause 4 as follows:

"4. Agencies and organizations within the organizational structure of the Supreme People's Procuracy, the Public Prosecutor, and the Supreme People's Procuracy’s Criminal Appeal Inspection Office; provincial-level People's Procuracy; regional People's Procuracy; Central Military Procuracy; Military Procuracy of Military Region and equivalent units; and Regional Military Procuracy."

d) Amend and supplement Clause 6 as follows:

"6. Agencies managing criminal enforcement under the Ministry of Public Security; agencies managing criminal enforcement under the Ministry of National Defense; detention centers and temporary detention centers under the Ministry of Public Security; detention centers and temporary detention centers under the Ministry of National Defense; military region detention centers; temporary detention centers at the military region level; temporary detention centers under provincial public security organs; criminal enforcement agencies under provincial public security organs; and criminal enforcement agencies at the military region level and equivalent units."

đ) Amend and supplement Clause 9 as follows:

"9. Specialized agencies and public service organizations under people's committees at all levels."

e) Amend and supplement Clause 12 as follows:

"12. Enterprises, branches, and representative offices of enterprises established and operating under the Notary Public Law, Lawyer Law, Judicial Appraisal Law, Insurance Business Law, and Securities Law."

g) Amend and supplement Clause 13 as follows:

"13. Organizations subordinate to enterprises established and operating in accordance with the law."

h) Amend and supplement Clause 14 as follows:

"14. Provincial Election Committees, Commune-level Election Committees; Committees for electing National Assembly deputies, Committees for electing provincial-level People's Council deputies, Committees for electing commune-level People's Council deputies; Polling Stations."

5. Amend and supplement some points and clauses of Article 11 as follows:

a) Amend and supplement Point c, Clause 1 as follows:

"c) Submit through the National Public Service Portal or the National Identity Application (VNeID) (excluding documents and papers prohibited from being uploaded via the network system as prescribed by law)."

b) Amend and supplement Clause 2 as follows:

"2. The officer receiving the dossier shall be responsible for checking the information, documents, and papers contained in the dossier and shall implement the following provisions:

a) In case the agency, organization, or state position submits the dossier directly to the dossier reception section of the seal registration agency or submits it through the public postal service.

Where the file is complete, the officer receiving the file must issue a receipt for the file, clearly stating the date of receipt of the file, the date of result delivery, and directly hand it over to the person sent by the agency, organization, or state position to submit the file, or send it through the public postal service.

Where the file is incomplete, the officer receiving the file must issue a form guiding the completion of the file, clearly stating the documents and materials that the agency, organization, or state position needs to supplement, and directly hand it over to the person sent by the agency, organization, or state position to submit the file, or send it through the public postal service.

Where the file does not meet the conditions stipulated in Article 5 of this Decree, the officer receiving the file must issue a notice regarding the refusal to process the file and directly hand it over to the person sent by the agency, organization, or state position to submit the file, or send it through the public postal service.

b) In case the agency, organization, or state position submits the dossier through the National Public Service Portal or the National Digital Identity Application (VNeID),

The officer receiving the file is responsible for extracting information from the electronic identity account of the agency, organization, or database managed by the agency, organization on the National Public Service Portal, the central or provincial administrative procedure information system, or the national database, specialized databases. In cases where information cannot be extracted from the database, information system, or the National Identity Application (VNeID), the officer receiving the file shall request the agency, organization, or individual to provide documents and papers in the file according to regulations.

The officer receiving the file must notify the result of processing the file to the relevant parties via the electronic address of the agency, organization, or individual who previously submitted the file, as specified in point a, b, and c of Clause 2 of this Article.

Where the file is complete but the documents and papers in the file are not valid (electronic versions of documents issued by agencies and organizations are not digitally signed; electronic versions of documents issued by competent authorities are not electronically certified by competent authorities), the officer receiving the file shall guide the agency, organization, or individual to supplement the documents and papers according to regulations or choose to submit the file directly at the file reception department for stamp model registration or submit the file through the public postal service.

c) Amend and supplement Clause 4 as follows:

"4. Documents and papers in the file are electronic versions that have been digitally signed for documents issued by agencies and organizations; electronic versions that have been electronically certified by competent authorities for documents issued by competent authorities; electronic versions or printed versions obtained from the database of relevant state management agencies; copies verified against the original; copies issued from the original; copies certified from the original by competent authorities."

d) Supplement Clause 9 after Clause 8 of Article 11 as follows:

"9. Agencies, organizations, and state positions do not need to submit documents and papers in the file when such information is available in the database of the state management agency and the connection and sharing of this information have been completed in the electronic environment."

6. Amend and supplement Article 12 as follows:

"Article 12. Seal Registration Agency

1. The Department of Administrative Police for Social Order Management under the Ministry of Public Security is responsible for registering stamp models; issuing, replacing, and reissuing certificates of stamp model registration for agencies, organizations, and state positions, including:

a) President of the State, Chairman of the National Assembly, Prime Minister, Secretary-General of the National Assembly;

b) National Assembly, Government, National Election Council, ministries, ministerial-level agencies, central agencies, and units directly under these agencies;

c) The Supreme People's Court, the Supreme People's Court's Criminal Appeal Division, the Supreme People's Procuracy, the Public Prosecutor, and the Supreme People's Procuracy’s Criminal Appeal Inspection Office; units subordinate to these agencies;

d) Agencies within the organizational system of the Communist Party of Vietnam at the Central level, the Central Committee of the Vietnam Fatherland Front, Central political-social organizations, and units subordinate to these agencies;

đ) Military Command Board of ministries and central sectors;

e) Economic organizations established or granted registration certificates for operation or licenses for operation by competent authorities at the central level and organizations directly under them;

g) Vietnamese representative offices abroad;

h) Other organizations established or granted licenses for operation by competent authorities at the central level;

2. The Administrative Management Police Department of the Provincial Public Security Force, city shall be responsible for registering stamp samples; issuing, replacing, reissuing stamp registration certificate samples for agencies, organizations, including:

a) People's Councils at all levels, units directly under these agencies;

b) Provincial and municipal courts, district courts, provincial and municipal procuracies, district procuracies, units directly under these agencies;

c) Provincial and municipal public security forces, units directly under this agency;

d) Civil Enforcement Agencies at the provincial level, civil enforcement agencies in districts, units directly under these agencies;

đ) Military Command Boards of agencies and organizations at the grassroots level;

e) Agencies within the organizational system of the Communist Party of Vietnam, the Vietnam Fatherland Front, and political-social organizations established or granted operating licenses by local competent authorities, and units subordinate to these agencies;

g) Economic organizations established or granted registration certificates for operation or licenses for operation by competent authorities at the local level and organizations directly under them;

h) Political-social-professional organizations, social organizations, social-professional organizations, religious organizations, social funds, charitable funds, non-governmental organizations established or granted operating licenses by competent authorities, and units subordinate to these agencies;

i) Foreign organizations without diplomatic functions granted licenses for operation by competent authorities;

k) Election Committees at various levels, Election Boards for People's Council Deputies at various levels, Voting Teams;

l) Other organizations established or granted licenses for operation by competent authorities at the local level;

m) Organizations in the locality established or directly managed by competent authorities at other localities.";

7. Amend and supplement some clauses of Article 13 as follows:

a) Add Clause 1a before Clause 1 as follows:

"1a. Commonly applicable to all agencies, organizations, and state positions: The application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree)."

b) Amend and supplement Clauses 8, 9 of Article 13 as follows:

"8. For enterprises, branches, representative offices, business locations of enterprises: A license for establishment and operation or a registration certificate or an operating permit issued by the competent authority in accordance with the law."

9. Organizations directly under enterprises established and operating according to the law, the dossier includes:

a) Decision on establishment by competent authorities;

b) Operation license issued by competent authorities for organizations required to register their fields of operation according to the law.";

8. Amend and supplement Article 14 as follows:

Article 14. Dossier for registering raised stamps, reduced stamps, embossed stamps

The application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree); A document specifying the agency, organization, or state position having the function of issuing certificates and documents with photographs or sealed documents by the competent authority.

9. Amend and supplement Article 15 as follows:

"Article 15. Dossier for requesting registration of new stamp samples

1. For agencies, organizations, and state positions whose stamps are deformed, worn out, damaged, or changed in material: The application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree).

2. State agencies, organizations, and positions that have changes in organization or name change, the dossier includes:

a) Request for registration of stamp sample of state agencies, organizations, and positions (Form No. 03 attached in Appendix II issued together with this Decree);

b) Decision on changes in organization or name change of state agencies, organizations, and positions by competent authorities.

3. State agencies, organizations, and positions that have lost their stamps, the dossier includes:

a) The application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree) and confirmed by the direct supervising agency or the competent authority.

b) Registration certificate for stamp sample previously issued.";

10. Amend and supplement Article 16 as follows:

"Article 16. Dossier for requesting additional stamp registration

1. For state agencies, organizations, and positions registering additional wet stamps, the dossier includes:

a) Request for registration of stamp sample of state agencies, organizations, and positions (Form No. 03 attached in Appendix II issued together with this Decree);

b) Document permitting the use of additional wet stamps from competent authorities.

2. For agencies, organizations, and state positions registering additional embossed stamps, reduced-size stamps, or rubber stamps: The application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree).

3. For economic organizations registering additional wet stamps, embossed stamps, reduced-size stamps, or rubber stamps: The application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree)."

11. Amend and supplement Article 17 as follows:

"Article 17. Dossier for requesting replacement or reissue of stamp registration certificate

Request for registration of stamp sample of state agencies, organizations, and positions (Form No. 03 attached in Appendix II issued together with this Decree).";

12. Amend and supplement Clause 7 of Article 19 as follows:

"7. Coordinate with the Ministry of Science and Technology and the Ministry of Finance to study the application of information technology, build, upgrade, and operate the database on stamp management, allocate funds to organize implementation."

13. Amend and supplement Clause 7, 8 of Article 24 as follows:

"7. Agencies, organizations, and state positions losing their stamps or certificates of stamp model registration must report in writing to the agency that issued the certificate of stamp model registration and the police station of the locality where the loss occurred within two days from the discovery of the loss."

8. Agencies, organizations that are divided, separated, merged, consolidated, dissolved, terminated, or had their establishment and operation permits, registration certificates, or operating permits revoked, suspended, or had their stamps lost and found after being declared invalid according to points b, c, d, đ of Clause 1 of Article 18 of this Decree must return the stamps and certificates of stamp model registration to the issuing agency along with the application for stamp model registration of agencies, organizations, and state positions (Form No. 03 attached as Appendix II to this Decree).

14. Delete the phrase "under the Central level" in Clause 2 of Article 7, point b of Clause 2 of Article 25, Article 28.

15. Repeal Clause 3 of Article 11.

16. Replace Form No. 01 issued together with Decree No. 99/2016/NĐ-CP amended and supplemented in 2023 with Form No. 01 attached in Appendix II issued together with this Decree.

17. Supplement Form No. 03 attached in Appendix II issued together with this Decree.

Article 3. Amend and supplement some articles of Decree No. 137/2020/ND-CP on the management and use of fireworks that have been amended and supplemented in 2023 (hereinafter referred to as Decree No. 137/2020/ND-CP).

1. Amend and supplement Clause 1 of Article 5 as follows:

"1. Researching, manufacturing, producing, buying, selling, exporting, importing, storing, transporting, using, or appropriating explosive fireworks; except for organizations and enterprises under the Ministry of Public Security and the Ministry of National Defense which are assigned tasks by the Minister of Public Security or the Minister of National Defense to research, produce, import, export, supply, transport, and use explosive fireworks in accordance with this Decree."

2. Amend and supplement Clause 2 of Article 7 as follows:

"2. The Commander-in-Chief of the Military Command Board at the commune level or higher or the Head of the Police Station at the commune level or higher shall approve the plan including: time, location, method, manner of destruction, members of the Council participating in destruction, preventive measures, response to incidents during the destruction process, and minimizing impact on the environment. The destruction site must be isolated, far from residential areas, public works, and minimize environmental impact."

3. Amend and supplement Point a and b of Clause 3 of Article 7 as follows:

"a) For fireworks shells made of non-water-resistant materials, the boxes and protective paper must be removed, then immersed in water until the shell and finished product separate. Collect and dry separately the paper, cardboard, and insoluble residues, then destroy them by burning or burying; for remaining chemical-contaminated water, it must be buried at locations approved by the Commander-in-Chief of the Military Command Board at the commune level or higher or the Head of the Police Station at the commune level or higher;"

"b) For fireworks shells made of water-resistant materials, the shell and pyrotechnic powder must be separated. The shell should be destroyed by burning or burying; the pyrotechnic powder must be immersed in water until it absorbs enough water to lose its explosive properties, and the insoluble residues should be dried and destroyed by burning or burying at locations approved by the Commander-in-Chief of the Military Command Board at the commune level or higher or the Head of the Police Station at the commune level or higher;"

4. Amend and supplement Point a Clause 4 Article 7 as follows:

"a) After receiving the decision to destroy from the competent authority, the Commander-in-Chief of the Military Command Board at the commune level or higher or the Head of the Police Station at the commune level or higher must establish a Destruction Council and develop a destruction plan. The Destruction Council includes: the Chairman of the Council representing the destruction agency; members representing specialized technical agencies and state management agencies responsible for environmental protection at the commune where the destruction site is located. The destruction plan must ensure absolute safety and minimize environmental impact;"

5. Amend and supplement Clause 2 Article 9 as follows:

"2. Agencies and organizations using fireworks for performances and competitions must be permitted by the Director of the Department of Culture, Sports and Tourism where the performance or competition takes place, and such activities must be carried out by organizations or enterprises under the Ministry of Public Security or the Ministry of National Defense assigned the task of producing and supplying;"

6. Amend and supplement Clause 1 Article 10 as follows:

"1. Research, production, and supply of fireworks must comply with laws on security, public order, fire prevention and fighting, and environmental protection; have internal regulations and plans for protection; ensure resources and equipment capable of preventing and responding to environmental incidents; research, production sites, and storage facilities must maintain safe distances from residential areas, public works, cultural, social, historical sites, protected areas, restricted zones; managers and direct workers involved in research and production must be trained in safety techniques, fire prevention and fighting, incident prevention and response, ensuring safety and hygiene during research and production;"

7. Amend and supplement Clause 2 Article 10 as follows:

"2. The Minister of Public Security decides on organizations and enterprises under the Ministry of Public Security that are allowed to research, produce, export, import, and supply fireworks; the Minister of National Defense decides on organizations and enterprises under the Ministry of National Defense that are allowed to research, produce, export, import, and supply fireworks. Supply to agencies and organizations permitted to use fireworks can only be carried out in cases specified in Article 11 of this Decree;"

8. Amend and supplement Clause 3 Article 10 as follows:

"3. Research and production of fireworks according to orders shall be regulated as follows:

a) Government agencies placing orders shall implement according to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of products and services using state budget funds from regular expenditure;

b) Organizations and enterprises not covered by point a of this clause shall place orders after obtaining written consent from the Chairman of the Provincial People's Committee;"

9. Amend and supplement Points a and b Clause 4 Article 10 as follows:

"a) The request document must fully record the content according to the model prescribed in Appendix VI issued together with this Decree;

b) The document prescribed in point a of this clause shall be submitted through the National Public Service Portal or the National Identity Application (VNeID) or sent via postal service to the Administrative Management Police Department under the Ministry of Public Security; if submitted directly, the request document must include the full name, personal identification number, or passport number of the person making the contact;"

10. Amend and supplement Clause 8 Article 11 as follows:

"8. Other cases shall be decided by the Chairman of the Provincial People's Committee based on the proposal of the specialized cultural agency under the Provincial People's Committee;"

11. Amend and supplement Clause 1 Article 12 as follows:

"1. Cases of organizing fireworks displays stipulated in Clauses 1, 2, 3, 4, 5, and 6 of Article 11 of this Decree shall be decided by the Chairman of the Provincial People's Committee based on the actual situation of the locality;"

12. Amend and supplement Clause 2 Article 12 as follows:

"2. Cases of organizing fireworks displays as stipulated in Clauses 7 and 8 of Article 11 of this Decree and changes in firing range and duration of fireworks displays shall be decided by the Chairman of the Provincial People's Committee based on the proposal of the specialized cultural agency under the Provincial People's Committee;"

13. Amend and supplement Clause 1 Article 13 as follows:

"1. Organizations and enterprises under the Ministry of Public Security and the Ministry of National Defense assigned tasks by the Minister of Public Security or the Minister of National Defense to conduct research, production, import, export, and supply of fireworks or enterprises under the Ministry of Public Security or the Ministry of National Defense engaged in cargo transportation and meeting conditions for transporting industrial explosives may transport fireworks and pyrotechnic powder;"

14. Amend and supplement Clause 3 Article 13 as follows:

"3. Procedures for issuing permits for transporting fireworks and pyrotechnic powder for organizations and enterprises stipulated in Clause 1 of this Article shall be implemented as follows:

a) The application dossier shall include: A request document fully recording the content according to the model prescribed in Appendix VIII issued together with this Decree. A copy of the government agency, organization, or enterprise order or export/import permit from the competent authority. In cases of transporting fireworks as stipulated in Clauses 7 and 8 of Article 11 of this Decree, the application dossier must include a copy of the decision of the Chairman of the Provincial People's Committee;

b) Organizations and enterprises under the Ministry of Public Security shall prepare the dossier prescribed in point a of this clause in one set and submit it through the National Public Service Portal or the National Identity Application (VNeID) or send it via postal service to the Administrative Management Police Department under the Ministry of Public Security; if submitting the dossier directly, the request document must include the full name, personal identification number, or passport number of the person making the contact. For organizations and enterprises under the Ministry of National Defense, they shall prepare the dossier prescribed in point a of this clause in one set and submit it to the General Staff of the Vietnam People's Army, Ministry of National Defense;

c) Within three working days from the date of receipt of the complete dossier, the Administrative Management Police Department under the Ministry of Public Security or the General Staff of the Vietnam People's Army, Ministry of National Defense shall issue a transport permit according to the model prescribed in Appendix IV issued together with this Decree; if not issuing the permit, they must reply in writing and specify the reasons;

d) The transport permit is valid for one trip only;"

15. Amend and supplement the title of Clause 1 and Point a of Clause 1 of Article 14 as follows:

"1. The research and production of fireworks and firecracker materials shall be carried out by organizations and enterprises under the Ministry of Public Security and the Ministry of National Defense and must meet the following conditions:

a) Organizations and enterprises assigned tasks for researching and producing fireworks and firecracker materials by the Minister of Public Security or the Minister of National Defense;"

16. Amend and supplement Point a of Clause 2 of Article 14 as follows:

"a) The business of fireworks shall be conducted by organizations and enterprises under the Ministry of Public Security and the Ministry of National Defense and must be granted a Certificate of Compliance with Security and Order Conditions by the competent public security agency; ensure conditions for fire prevention and fighting, incident prevention and response, and environmental protection;"

17. Amend and supplement Point a of Clause 3 of Article 14 as follows:

"a) Organizations and enterprises under the Ministry of Public Security and the Ministry of National Defense permitted to research and produce fireworks and pyrotechnic powder may export and import fireworks and pyrotechnic powder; they may only import fireworks products that cannot be produced domestically;"

18. Amend and supplement Article 15 as follows:

Article 15. Procedures for Issuing Export and Import Permits for Fireworks and Firecracker Materials

1. The application document must contain complete information according to the model prescribed in Appendix VI issued together with this Decree.

2. The document prescribed in Clause 1 of this Article shall be submitted on the National Public Service Portal or the National Identity Application (VNeID) or sent via postal service to the Department of Administrative Management under the Ministry of Public Security; in case of direct submission, the application document must include the full name, personal identification number, or passport number of the person making the contact.

3. Within three working days from the date of receiving all necessary documents, the Department of Administrative Management under the Ministry of Public Security shall issue an export and import permit according to the model specified in Appendix II attached to this Decree; if not issued, a written response with detailed reasons must be provided.

4. The export and import permit has a validity period of sixty days."

19. Amend and supplement Article 16 as follows:

Article 16. Procedures for Issuing Purchase Permits for Fireworks and Transport Permits for Fireworks and Firecracker Materials for Production and Business

1. The procedure for issuing purchase permits for fireworks for business purposes is as follows:

a) The application document must contain complete content according to the model prescribed in Appendix VII issued together with this Decree;

b) The document prescribed at point a of this clause shall be submitted on the National Public Service Portal or the National Identity Application (VNeID) or sent via postal service to the agency issuing the certificate of eligibility for security and public order for organizations and businesses dealing with fireworks; in case of direct submission, the application document must include the full name, personal identification number, or passport number of the person making the contact. Within three working days from the date of receipt of the application document, the competent authority shall issue a permit according to the model specified in Appendix III attached to this Decree; if not issued, a written response with detailed reasons must be provided.

c) The purchase permit for fireworks for business purposes has a validity period of thirty days.

2. The procedure for issuing transport permits for fireworks and firecracker materials for production and business purposes is as follows:

a) The application document must contain complete content according to the model prescribed in Appendix VIII issued together with this Decree;

b) The document prescribed at point a of this clause shall be submitted on the National Public Service Portal or the National Identity Application (VNeID) or sent via postal service to the agency issuing the certificate of eligibility for security and public order for organizations and businesses; in case of direct submission, the application document must include the full name, personal identification number, or passport number of the person making the contact.

c) Within three working days from the date of receipt of the application document, the competent authority shall issue a transportation permit for fireworks and firework drugs according to the model specified in Appendix IV attached to this Decree; if not issued, a written response with detailed reasons must be provided.

d) The transport permit is valid for one trip only."

20. Amend and supplement Article 18 as follows:

"18. Training on safety techniques in the production, management, storage, and use of fireworks, explosive fireworks, and firecracker materials

1. Persons who must undergo training on safety techniques in the production, management, storage, and use of explosive fireworks and firecracker materials

a) Managers;

b) Workers directly involved in the production of explosive fireworks and firecracker materials;

c) Persons assigned to manage warehouses of explosive fireworks and firecracker materials;

d) Commanders of explosive fireworks displays;

đ) Users of explosive fireworks;

e) Guards, loaders at warehouses of explosive fireworks and firecracker materials; escorts and drivers of transportation vehicles carrying explosive fireworks and firecracker materials.

2. Persons who must undergo training on safety techniques in the production and business of fireworks

a) Managers;

b) Workers directly involved in the production of fireworks and firecracker materials;

c) Persons assigned to manage warehouses of fireworks and firecracker materials;

d) Guards, loaders at warehouses of fireworks and firecracker materials and at retail stores selling fireworks; sales staff; escorts and drivers of transportation vehicles carrying fireworks and firecracker materials.

3. Content of training

a) Legal provisions governing the production, management, storage, and use of explosive fireworks and firecracker materials, and the production and business of fireworks;

b) Safety requirements when handling fireworks, explosive fireworks, and firework drugs; management and technical measures to ensure safety in production, management, storage, and use of explosive fireworks and firework drugs, and in the production and business of fireworks; destruction of fireworks, explosive fireworks, and firework drugs; hazardous signs, symbols, and markings on packaging, containers, and transport vehicles; arrangement and storage methods for fireworks, explosive fireworks, and firework drugs; safety requirements for loading, storing, and transporting within warehouses and on transport vehicles.

c) Identification of risks, dangerous factors, and assessment of risks related to security, safety, fire prevention, explosion prevention, and natural disasters in the activities of producing, managing, storing, and using fireworks, explosive fireworks, and firework drugs.

d) Organizing emergency response drills in the production, management, storage, and use of fireworks, explosive fireworks, and firecracker materials; practicing explosive fireworks displays;

đ) Safety requirements for operating production machinery and equipment and safe work methods;

e) Requirements for storage facilities, equipment, and devices to ensure safety, fire prevention, lightning protection, and static electricity control in storage facilities;

i) Composition, properties, classification, and quality of fireworks, explosive fireworks, and firework drugs; regulations on testing, inspection, and measures to ensure quality of fireworks, explosive fireworks; requirements for packaging and labeling of fireworks, explosive fireworks, and firework drugs.

h) Procedures for exporting, importing, and inventorying fireworks, explosive fireworks, and firecracker materials;

i) Methods of firing and safety measures when firing explosive fireworks; impact of firing explosive fireworks on structures, environment, and people; determination of safe distances when firing explosive fireworks; development of firing plans for explosive fireworks.

4. Based on the objects prescribed in Clauses 1 and 2 of this Article, the agencies, organizations, and businesses authorized to conduct training as prescribed in Clause 7 of this Article shall develop appropriate training content and programs for each object.

5. Procedure and process for training

a) The application package includes: An application document fully filled out according to the model specified in Appendix IX attached to this Decree. A list of individuals participating in the training, including their full name, date of birth, position, professional qualifications, personal identification number, or passport number, and two color photographs measuring 3 cm x 4 cm taken in accordance with regulations (photographs must not exceed six months old as of the date of receipt of the application).

b) The application package prescribed at point a of this clause shall be prepared in one set. For organizations and businesses under the Ministry of Public Security, it shall be submitted on the National Public Service Portal or the National Identity Application (VNeID) or sent via postal service to the Department of Administrative Management under the Ministry of Public Security; in case of direct submission, the application document must include the full name, personal identification number, or passport number of the person making the contact. For organizations and businesses under the Ministry of Defense, the application package shall be sent to the Department of National Defense Industry under the Ministry of Defense.

c) Within three working days from the date of receipt of the application package, the competent authority shall review the application and organize the training as prescribed, or issue a written approval for the organization or business to organize the training.

6. The organization and implementation of training shall be carried out by agencies, organizations, and enterprises as follows:

a) Develop a training plan, content, and program, and issue a decision to open a training class, which must be reported to the Department of National Defense Industry under the Ministry of Defense or the Department of Administrative Management under the Ministry of Public Security.

b) Arrange training staff to ensure the standards for conducting training;

c) Within three working days from the date the Department of National Defense Industry under the Ministry of Defense or the Department of Administrative Management under the Ministry of Public Security issues a decision to open a training class for the objects prescribed at points a and d of Clause 1 and point a of Clause 2 of this Article, they have the responsibility to notify in writing the organizations and businesses requesting training. For the objects prescribed at points b, c, e, and f of Clause 1 and points b, c, and d of Clause 2 of this Article, within three working days from the end of the training, the organization or business must submit a written request to the Department of National Defense Industry under the Ministry of Defense or the Department of Administrative Management under the Ministry of Public Security for inspection, examination, and issuance of a certificate.

7. The Department of National Defense Industry under the Ministry of Defense or the Department of Administrative Management under the Ministry of Public Security shall take the lead and coordinate with relevant agencies to organize training, inspection, and issuance of certificates for technical safety training for the objects prescribed at points a and d of Clause 1 and point a of Clause 2 of this Article. Organizations and businesses permitted to research, produce, export, import, and supply fireworks, explosive fireworks, and firework drugs shall be responsible for organizing training, reporting to the Department of National Defense Industry under the Ministry of Defense or the Department of Administrative Management under the Ministry of Public Security for inspection, examination, and issuance of certificates for technical safety training for the objects prescribed at points b, c, e, and f of Clause 1 and points b, c, and d of Clause 2 of this Article.

8. The certificate of technical safety training shall be in the form prescribed in Appendix V attached to this Decree and shall be valid for four years.”

21. Add Clause 3 to Article 19 as follows:

"3. Implement statistical and reporting systems on the activities of researching, producing, trading, exporting, and importing fireworks, explosive fireworks, and firework drugs through the Database System and software connecting the Department of Administrative Management under the Ministry of Public Security with organizations and businesses permitted to research, produce, trade, export, and import fireworks, explosive fireworks, and firework drugs."

22. Add points k, l, m, n, and o to Clause 2 of Article 20 as follows:

"k) Establish a Database System and software to ensure management, statistics, and consolidation of activities related to researching, producing, trading, exporting, and importing fireworks, explosive fireworks, and firework drugs, and to receive administrative procedure documents through the National Identity Application (VNeID)."

l) Produce explosive fireworks to ensure supply to units and localities permitted to organize firework displays according to regulations;

m) Direct and guide organizations and businesses under the Ministry of Public Security that are permitted to research, produce, trade, export, import, supply, and transport explosive fireworks, firework drugs, fireworks, and firework drugs to implement management and use of fireworks in accordance with regulations.

n) Direct and guide public security units related to prepare human resources, equipment, technical means, and organize command for safe firework displays, fire prevention, and environmental protection;

o) Implement transportation of explosive fireworks, explosive firework powders, fireworks, and firework powders and organize safe firework displays in accordance with regulations.”

23. Repeal Clause 3 of Article 12.

Article 4. Amend and supplement some articles of Decree No. 154/2024/NĐ-CP detailing certain provisions and implementing measures of the Law on Residence (hereinafter referred to as Decree No. 154/2024/NĐ-CP)

1. Amend and supplement Clause 2 of Article 3 as follows:

"2. The regular parking location of a vehicle is a place where the vehicle actually parks and does not belong to a restricted area or zone prohibited by the vehicle owner who self-determines and registers with the People's Committee of the commune, ward, or special economic zone (hereinafter referred to as the People's Committee of the commune level). In cases where the vehicle owner has a lease contract for a parking lot or a written approval for parking from the management agency or organization of the parking area, registration is not required."

2. Amend and supplement point a of Clause 3 of Article 5 as follows:

"a) One of the documents or materials prescribed in Clause 2 of this Article, except in cases of registering temporary residence at a legal place of stay obtained through renting, borrowing, or staying with someone else, the document or material proving the legal place of stay is a rental agreement, loan agreement, or accommodation agreement for a legal place of stay issued by an organization, entity, or individual, and such document does not require notarization or certification."

3. Amend and supplement point e of Clause 3 of Article 6 as follows:

"e) Documents proving that the person is severely disabled, extremely disabled, unable to work, suffering from mental illness or other diseases causing loss of cognitive ability and control over behavior: A certification from a healthcare facility in the area or confirmation from the People's Committee of the commune where they reside;"

4. Amend and supplement Article 7 as follows:

“Article 7. Registration of residence for minors

1. In the case where a minor registers permanent residence or temporary residence at the place of permanent residence or temporary residence of their father, mother, or guardian, the father, mother, or guardian shall declare and confirm their opinion on the Application for Change of Residence Information.

In the case where a minor registers permanent residence or temporary residence at a place that is not the permanent residence or temporary residence of their father, mother, or guardian, the father, mother, or guardian shall declare and confirm their opinion on the Application for Change of Residence Information. If a minor is assigned to be cared for and raised by their father or mother by a court decision, then the person responsible for caring for and raising the minor shall declare and confirm their opinion on the Application for Change of Residence Information.

2. Within a maximum period of 60 days from the date of registration of birth of the minor, the father, mother, head of household, or guardian shall be responsible for completing the procedures for registering permanent residence, temporary residence, and reporting information about residence for the minor. For minors under six years old whose parents or guardians have a place of permanent residence but are not currently residing there, the minor may be registered for permanent residence at the place of permanent residence of their father, mother, or guardian.

3. In cases where neither the father nor the mother of a minor has a permanent residence or temporary residence, they shall declare information about the residence of the minor in accordance with the provisions of Article 4 of this Decree.

4. In the case of registering permanent residence or temporary residence for a minor at the place of permanent residence or temporary residence of their father, mother, or guardian as stipulated in Clause 2 of this Article, the registration authority does not need to conduct checks or verify conditions for registering permanent residence or temporary residence."

5. Amend and supplement Clause 5 of Article 8 as follows:

"5. The consent of the head of household, owner of the legal dwelling place, legal representative, heir as prescribed by law, father, mother, guardian, or member of the household shall be obtained through one of the following methods:"

a) Clearly stating the consent and signing, clearly stating their full name on the Change of Residence Information Form;

b) Confirming the consent through the National Identity Application (VNeID) or online public service; or the registration authority directly exchanges opinions and obtains consent through verification of residence;

c) Providing written consent.”

6. Amend and supplement Article 9 as follows:

Article 9. Documents and Procedures for Removing Permanent Registration

1. Within one day from the date of receiving the decision to cancel permanent residence registration from the immediate superior authority or immediately after issuing the decision to cancel permanent residence registration for a citizen, the registration authority shall remove the permanent residence registration of the citizen and update the cancellation of permanent residence registration into the Database on Residence and the National Population Registry.

2. Within one working day from the date when the National Population Registry or the registration authority receives information reflecting the situation of individuals subject to cancellation of permanent residence registration as specified in Point a and d, Clause 1, Article 24 of the Law on Residence, the registration authority shall be responsible for checking, verifying, and removing the permanent residence registration of the citizen and updating the cancellation of permanent residence registration into the Database on Residence and the National Population Registry.

3. Within seven days from the date when the household has a member subject to cancellation of permanent residence registration as specified in Points b, d, e, g, h, and i, Clause 1, Article 24 of the Law on Residence, the member subject to cancellation of permanent residence registration or the representative of the household or the legal representative shall be responsible for completing the procedures for cancellation of permanent residence registration.

a) The documents for removing permanent registration include: Application form for changing residential information and documents, evidence proving that they fall under one of the cases for removing permanent registration.

b) The person implementing the procedure shall submit 01 online application through the National Public Service Portal or the National Identity Application (VNeID) to the residence registration agency.

4. In the case where the individual proposed for cancellation of permanent residence registration does not have information in the National Population Registry or the information about them in the National Population Registry is incomplete or inaccurate, the registration authority shall be responsible for collecting and updating the information into the National Population Registry.

5. Within five working days from the date of receiving a valid application, the registration authority shall remove the permanent residence registration of the citizen and update the cancellation of permanent residence registration into the Database on Residence and the National Population Registry.

6. In the case where the individual subject to cancellation of permanent residence registration as specified in Points b, d, e, g, h, and i, Clause 1, Article 24 of the Law on Residence belongs to a household with only one member or the representative of the household or the legal representative does not complete the procedures for cancellation of permanent residence registration, the registration authority shall be responsible for checking, verifying, preparing a record regarding the citizen or the representative of the household not completing the procedures for cancellation of permanent residence registration, and removing the permanent residence registration of the citizen.

7. Organizations managing individuals studying, working, or serving in the People's Armed Forces shall issue a written request to the registration authority in the area where they are stationed to cancel the permanent residence registration of individuals under their management. The request must clearly state the surname, middle name, and given name at birth; date of birth; personal identification number of the individual subject to cancellation of permanent residence registration; and the reason for requesting cancellation of permanent residence registration.

8. After completing the cancellation of permanent residence registration, the registration authority shall notify the individual whose permanent residence registration was canceled or the representative of the household in writing or electronically or by another electronic method.

7. Amend and supplement Article 10 as follows:

"Article 10. Documents and Procedures for Removing Temporary Registration

1. Within one day from the date of receiving the decision to cancel temporary residence registration from the immediate superior authority or immediately after issuing the decision to cancel temporary residence registration for a citizen, the registration authority shall remove the temporary residence registration of the citizen and update the cancellation of temporary residence registration into the Database on Residence and the National Population Registry.

2. Within one working day from the date when the National Population Registry or the registration authority receives information as specified in Point a, d, and đ, Clause 1, Article 29 of the Law on Residence through data connection, sharing, and synchronization from national databases, specialized databases, or other databases managed by organizations or authorities, the registration authority shall be responsible for checking, verifying, and removing the temporary residence registration of the citizen and updating the cancellation of temporary residence registration into the Database on Residence and the National Population Registry.

3. Within seven days from the date when the household has a member subject to cancellation of temporary residence registration as specified in Points c, e, g, and h, Clause 1, Article 29 of the Law on Residence, the member subject to cancellation of temporary residence registration or the representative of the household or the legal representative shall be responsible for completing the procedures for cancellation of temporary residence registration.

a) The documents for removing temporary registration include: Application form for changing residential information and documents, evidence proving that they fall under one of the cases for removing temporary registration.

b) The person implementing the procedure shall submit 01 online application through the National Public Service Portal or the National Identity Application (VNeID) to the residence registration agency.

4. In the case where the individual proposed for cancellation of temporary residence registration has information in the National Population Registry but it is incomplete or inaccurate, the registration authority shall be responsible for updating and correcting the information into the National Population Registry.

5. Within three working days from the date of receiving a valid application, the registration authority must remove the temporary residence registration of the citizen and update the cancellation of temporary residence registration into the Database on Residence and the National Population Registry.

6. In the case where the individual subject to cancellation of temporary residence registration as specified in Points c, e, g, and h, Clause 1, Article 29 of the Law on Residence belongs to a household with only one member or the individual subject to cancellation of temporary residence registration or the representative of the household or the legal representative does not complete the procedures for cancellation of temporary residence registration, the registration authority shall be responsible for checking, verifying, preparing a record regarding the citizen or the representative of the household not completing the procedures for cancellation of temporary residence registration, and removing the temporary residence registration of the citizen.

7. Organizations managing individuals studying, working, or serving in the People's Armed Forces shall issue a written request to the registration authority in the area where they are stationed to cancel the temporary residence registration of individuals under their management. The request must clearly state the surname, middle name, and given name at birth; date of birth; personal identification number of the individual needing cancellation of temporary residence registration; and the reason for requesting cancellation of temporary residence registration.

8. After completing the cancellation of temporary residence registration, the registration authority shall notify the individual whose temporary residence registration was canceled or the representative of the household in writing or electronically or by another electronic method.

8. Amend and supplement point c, Clause 2 Article 13 as follows:

"c) Information about citizens that has been collected and updated into the Database on Residence must be adjusted and supplemented immediately upon any change and must be stored fully, reflecting the history of all updates, changes, and adjustments."

9. Replace the phrase "directly, online, or public postal service" with "online through the National Public Service Portal or the National Identity Application (VNeID)" in Clause 3 Article 3.

10. Amend the phrase "directly, online, or postal service" to "directly or online through the National Public Service Portal or the National Identity Application (VNeID)" in Clause 1 of Article 4, Point a of Clause 12 of Article 8.

11. Remove the phrase "under the Central Government" in point b Clause 4 Article 5, Article 16.

12. Replace Model No. 01 and Model No. 02 with Model No. 01 and Model No. 02 in Appendix IV promulgated together with this Decree.

Article 5. Amending and supplementing some articles of Decree No. 70/2024/ND-CP detailing certain provisions and measures to implement the Law on Identity Cards (hereinafter referred to as Decree No. 70/2024/ND-CP).

1. Amend Clause 1 and Clause 2 of Article 3 as follows:

“1. In addition to the information prescribed from Clause 1 to Clause 25 of Article 9 of the Law on Identity Cards, other information related to Vietnamese citizens and Vietnamese origin persons whose nationality has not been determined, as specified in the attached Appendix of this Decree, if available in the national database, specialized databases, or other databases managed and shared by agencies, organizations for the National Population Database to serve joint exploitation and utilization in state agency activities and economic-social development, digital government, digital society, and digital citizen. Shared information to the National Population Database must be verified.”

2. Entrust the Ministry of Public Security to take the lead and coordinate with ministries, ministerial-level agencies, governmental agencies, provincial People's Committees, city People's Committees, and other relevant agencies and organizations to determine and unify the information prescribed in Clause 1 of this Article to be shared, collected, updated, and stored in the National Population Database, ensuring effectiveness, cybersecurity, and data protection. Based on management requirements during each period, research and review, report to the Government for consideration and decision on amending and supplementing the information specified in the attached Appendix of this Decree.”

2. Amend and supplement Clause 2 of Article 4 as follows:

“2. The National Population Database shall be deployed to the Provincial Police Departments (hereinafter referred to collectively as Provincial Police Departments), Commune Police Stations, Ward Police Stations, Special Administrative Zones (hereinafter referred to collectively as Commune Police Stations), and other relevant agencies and organizations.”

3. Amend and supplement Clause 6 of Article 5 as follows:

“6. The Commune Police Station where the citizen resides shall be responsible for collecting and updating information about residents within its jurisdiction into the National Population Database from the processing of registration procedures, declarations, and adjustments of residence information of citizens; residency management books; archives; from the issuance, replacement, and reissuance of identity cards; and coordinating with competent authorities to collect and update citizen information from the electronic household registration database or household registration documents and books. If the information, documents, and materials mentioned above about the citizen are incomplete or unavailable, they shall be collected and updated from the citizen through the Citizen Information Collection Form and the Request for Processing Procedures Related to Identity Cards.”

4. Amend and supplement Clause 2 and Clause 3 of Article 6 as follows:

“2. The authority managing identity cards under the Ministry of Public Security shall be responsible for coordinating with relevant agencies to check, verify, and ensure synchronization and accuracy of automatic data in the National Population Database with other databases. In case of discovering errors in the updated or adjusted information, the authority managing identity cards under the Ministry of Public Security shall coordinate with relevant agencies to adjust the information in the National Population Database and other databases.”

3. In case a citizen discovers changes or errors in the information provided by themselves for updating into the National Population Database, they may request the Commune Police Station to adjust the information in the National Population Database. The procedure and formalities for adjusting information in the National Population Database upon citizen’s request:

a) Citizens may request to adjust information in the National Population Database through the National Public Service Portal or the National Identity Application (VNeID) or directly at the nearest police agency;

"b) The application dossier includes: the Application for Processing Identity Card Procedures and evidence proving the information to be adjusted;"

c) In case the police agency receiving the application is not the Commune Police Station where the citizen resides, it must immediately transfer the application to adjust information to the Commune Police Station where the citizen is registered or temporarily residing, for resolution and notification of results to the citizen;

d) Within two working days from the date of receipt of the application to adjust information from the citizen, the Head of the Commune Police Station where the citizen resides shall be responsible for checking the legality and accuracy of the information before adjustment in the National Population Database; in case of refusal to adjust the information, a clear reason must be provided.”

5. Amend and supplement Clause 4 and Clause 5 of Article 9 as follows:

“4. The Head of the Commune Police Station has the authority to exploit information in the National Population Database to provide to state agencies, political organizations, political-social organizations at the commune level, other organizations with headquarters in the management area, and individuals residing in the management area as prescribed in Clause 3, Clause 4 of Article 8 of this Decree when there is a written request for information exploitation and provision.

5. The authorized person prescribed in Clause 1, Clause 2, Clause 4 of this Article decides to allow exploitation and provision of information in the National Population Database to organizations and individuals prescribed in Clause 8 of Article 10 of the Law on Identity Cards when the individual who is the subject of the information being exploited consents.”

6. Amend and supplement Clause 2, Clause 4, and Clause 9 of Article 11 as follows:

"a) Amend and supplement Clause 2 as follows:"

"2. Establishing personal identification numbers for citizens when registering birth, recording births registered at competent authorities abroad in the household registry

The agency managing household registration, the agency managing the Electronic Household Registration Database shall be responsible for transferring the information of persons registered for birth or recorded in the household book for births registered at the competent authority abroad to the National Population Database through connection, sharing, and synchronization of data; including the collection of the following information to establish the personal identification number:

"a) Family name, middle name, and given name;"

"b) Date of birth;"

"c) Gender;"

"d) Place of birth registration;"

"đ) Place of birth;"

"e) Place of origin;"

"g) Ethnicity;"

"h) Nationality;"

"i) Family name, middle name, and given name, nationality of father, mother, or legal representative (if any); except in cases where the father, mother, or legal representative cannot be identified."

b) Amend and supplement Clause 4 as follows:

"4. Establishing personal identification numbers for citizens who have registered birth or recorded births registered at competent authorities abroad but have not yet been assigned personal identification numbers

a) Citizens who have registered for birth or recorded in the household book for births registered at the competent authority abroad but have not been issued a personal identification number shall go to the nearest Commune Police Station to implement the collection and updating of citizen information according to Clause 6 of Article 5 of this Decree. The head of the agency managing identity cards under the Ministry of Public Security shall establish the personal identification number for citizens based on the collected and updated information in the National Population Database;

b) For citizens who have registered for birth or recorded in the household book for births registered at the competent authority abroad and are currently residing abroad without a personal identification number, the agency managing identity cards under the Ministry of Public Security shall cooperate with the Ministry of Foreign Affairs and relevant agencies to collect and update information into the National Population Database and establish the personal identification number for citizens. The collection of information of Vietnamese citizens residing abroad shall be carried out by the identity card management agency using the Citizen Information Collection Form through Vietnamese representative offices abroad; the Vietnamese representative offices abroad shall send the Citizen Information Collection Form requesting the collection and updating of information to the identity card management agency under the Ministry of Public Security to update information into the National Population Database;”

"c) Amend and supplement Clause 9 of Article 11 as follows:"

“9. The identity card management agency shall be responsible for coordinating with relevant agencies and organizations to inspect, verify, and cancel or re-establish the personal identification number for cases prescribed in Point c, Point d of Clause 7 of this Article.”

7. Amend and supplement Article 12 as follows:

Article 12. Information on the 09-digit citizen identification card number and the individual identification number that has been canceled

The information of the nine-digit ID card number and canceled personal identification number shall be encrypted and integrated into the QR code on the identity card, in the storage section of the identity card, and on the National Identity Application (VNeID). Agencies, organizations, and individuals scanning the QR code on the identity card, exploiting information in the storage section of the identity card, and exploiting information on the National Identity Application (VNeID) may use the nine-digit ID card number and canceled personal identification number retrieved through the QR code, in the storage section of the identity card, and exploiting information on the National Identity Application (VNeID) to serve administrative procedure resolution, public services, transactions, and other activities; they shall not require citizens to provide confirmation of the nine-digit ID card number and canceled personal identification number.”

8. Amend and supplement Clause 2 and Clause 3 of Article 14 as follows:

"2. The agency managing identity cards of the Ministry of Public Security shall automatically check, verify, and adjust and update citizens' information in the Identity Card Database when there are changes and synchronization from the National Population Database, other databases. In case of discovering errors in the updated or adjusted information, the identity card management agency of the Ministry of Public Security shall be responsible for coordinating with relevant agencies to adjust the information in the Identity Card Database and other databases."

"3. In case a citizen discovers that the information provided by them to update the Identity Card Database has changed or contains errors, they shall request the police station at their commune to adjust the information in the Identity Card Database. The procedure and formalities for adjusting information in the Identity Card Database upon the citizen's request:"

"a) Citizens requesting adjustments to information in the Identity Card Database within the fields of information prescribed from Clause 1 to Clause 18, Clause 24, and Clause 25 of Article 9 of the Identity Card Law shall follow the procedures and formalities stipulated in Clause 3 of Article 6 of this Decree;"

Information adjusted in the National Population Database will be updated, shared, and synchronized with the Identity Card Database;

"b) Citizens requesting adjustments to information prescribed in Clause 2 and Clause 3 of Article 15 of the Identity Card Law must go through the procedures for replacing the identity card. The procedures and formalities for replacing the identity card are stipulated in Article 21 of this Decree;"

"c) Citizens requesting adjustments to information prescribed in Clause 4 of Article 15 of the Identity Card Law during the process of replacing or reissuing the identity card. The person receiving the application will enter the citizen's reported information into the Identity Card Information Collection Form and hand it over to the citizen for verification and signature confirmation."

"Within two working days from the date of receipt of the citizen's request to adjust information, the identity card management agency receiving the request shall be responsible for adjusting the citizen's information in the Identity Card Database; if the adjustment is refused, it must be replied in writing and the reasons clearly stated."

9. Amend and supplement Clause 5 of Article 20 as follows:

"5. The procedures and formalities for integrating information into the identity card for cases where individuals under six years old apply for issuance, replacement, or reissue of the identity card, or citizens applying for reissue of the identity card due to loss, damage, or administrative boundary changes, through the National Public Service Portal, National Identification Application (VNeID) shall be carried out as follows:"

a) Citizens or the lawful representatives of persons under six years old select the information to be integrated and submit it along with the application for issuance, replacement, or reissuance of the identity card;

"b) The identity card management agency of the Ministry of Public Security shall conduct checks, comparisons, and verifications of the proposed integrated information through the Identity Card Database, National Database, specialized databases, and integrate information successfully verified;"

c) The identity card management agency under the Ministry of Public Security shall notify the result of the information integration when returning the identity card to the citizen;

"d) Citizens or legal representatives of individuals under six years old shall pay the fees for integrating, updating, and adjusting information on the identity card and service delivery fees according to the laws on fees and charges."

10. Amend and supplement Clause 2 of Article 21 as follows:

“2. Procedures and formalities for issuing, replacing, or reissuing the identity card through the National Public Service Portal or the National Identity Application (VNeID):

"a) Citizens choose the procedure and check their information extracted from the National Population Database. If the information is accurate, they register the time and the identity card management agency to proceed with the procedure; the system will confirm and automatically transfer the citizen's request to the identity card management agency for issuing, replacing, or reissuing the identity card, except for the cases specified in point b of this clause;"

Citizens shall attend the identity card management agency according to the registered time and location to carry out the issuance, replacement, or reissuance of the identity card according to the procedures and formalities prescribed in Clause 1 of this Article;

"b) In cases of lost identity cards, damaged identity cards unusable, or replacement due to administrative boundary changes, citizens choose the reissue procedure, check their information extracted from the National Population Database. If the information is accurate, they confirm the transfer of the reissue application file to the identity card management agency for consideration and issuance of the reissued identity card according to Clause 4 of Article 25 of the Identity Card Law;"

"c) In cases where legal representatives handle the issuance, replacement, or reissue of identity cards for individuals under six years old, they choose the procedure and check the information of individuals under six years old in the National Population Database. If the information is accurate, the legal representative confirms the transfer of the application file to the identity card management agency for consideration and issuance, replacement, or reissue of the identity card."

11. Amend and supplement Clause 1 of Article 22 as follows:

"1. The procedures and formalities for recalling identity cards from citizens who have been deprived of Vietnamese nationality, renounced Vietnamese nationality, had decisions on granting Vietnamese nationality revoked, or had decisions on restoring Vietnamese nationality revoked."

"a) The agency receiving and delivering results when implementing the procedures for depriving Vietnamese nationality, renouncing Vietnamese nationality, revoking decisions on granting Vietnamese nationality, or revoking decisions on restoring Vietnamese nationality shall establish a record of the recall of the identity card from the person deprived of Vietnamese nationality, renounced Vietnamese nationality, had decisions on granting Vietnamese nationality revoked, or had decisions on restoring Vietnamese nationality revoked;"

"b) Within ten days from the date of the decision to deprive Vietnamese nationality, renounce Vietnamese nationality, revoke decisions on granting Vietnamese nationality, or revoke decisions on restoring Vietnamese nationality, the Ministry of Justice shall send a notification letter along with the recalled identity card to the identity card management agency of the Ministry of Public Security;"

"In cases where the agency receiving and delivering results when implementing the procedures for depriving Vietnamese nationality, renouncing Vietnamese nationality, revoking decisions on granting Vietnamese nationality, or revoking decisions on restoring Vietnamese nationality cannot recall the identity card from the person deprived of Vietnamese nationality, renounced Vietnamese nationality, had decisions on granting Vietnamese nationality revoked, or had decisions on restoring Vietnamese nationality revoked, it shall clearly state in the notification letter sent to the identity card management agency of the Ministry of Public Security so that the identity card management agency of the Ministry of Public Security can investigate and recall the identity card according to regulations;"

"c) Within three working days from the date of receipt of the notification letter from the Ministry of Justice, the identity card management agency of the Ministry of Public Security shall be responsible for invalidating the use value of the identity card and updating the information of the person whose decision to deprive Vietnamese nationality, renounce Vietnamese nationality, revoke decisions on granting Vietnamese nationality, or revoke decisions on restoring Vietnamese nationality into the National Population Database, Identity Card Database;"

"d) In cases where the identity card management agency discovers persons required to have their identity cards recalled according to Point a of Clause 1 of Article 29 of the Identity Card Law, it must invalidate the use value of the identity card of such persons and update the information into the National Population Database, Identity Card Database; establish a record of the recall of the identity card if the person still holds the identity card and return it to the identity card management agency that established the recall record."

12. Amend and supplement Article 24 as follows:

Article 24. Procedures and formalities for collecting, updating, and adjusting information of Vietnamese-origin persons without determined nationality into the National Population Database, Identity Card Database, and issuing identity card certificates

1. Vietnamese-origin persons without determined nationality shall approach the police station of the commune within the provincial administrative unit where they reside or the identity management agency of the provincial police to request the collection and updating of their information into the National Population Database and the Identity Card Database.

2. Vietnamese-origin persons without determined nationality shall fill out the Population Information Collection Form and provide other relevant documents and materials concerning themselves and their family (if available), including:

a) Documents and materials issued by Vietnamese authorities containing information on name, date of birth;

b) Documents and materials proving blood relations with individuals who have or have had Vietnamese nationality;

In cases where the documents and materials are issued by foreign competent authorities, they must be apostilled, except in cases exempted from apostille and certified translations from foreign languages into Vietnamese.

3. The commune police station or the identity management agency of the provincial police shall receive the information declaration of Vietnamese-origin persons without determined nationality and collect biometric information such as fingerprints and iris scans (except for Vietnamese-origin persons under six years old) and facial images.

4. Within one working day from the date Vietnamese-origin persons without determined nationality complete the information declaration as stipulated in Clause 1 of this Article, the commune police station shall cooperate with related agencies, organizations, and individuals to verify and check the information declared by Vietnamese-origin persons without determined nationality. The verification period is thirty days, but may be extended up to sixty days in complex cases.

The registration authority where Vietnamese-origin persons whose nationality has not been determined reside shall be responsible for verifying whether such persons have continuously resided in the locality for at least six months.

5. The commune police station or the identity management agency of the provincial police shall transfer the information of Vietnamese-origin persons without determined nationality to the identity management agency of the Ministry of Public Security for checking and matching the information in the National Population Database and the Identity Card Database.

6. After completing the verification and matching of information of Vietnamese-origin persons without determined nationality as stipulated in Clauses 4 and 5 of this Article, the commune police station or the identity management agency of the provincial police shall collect and update the information of Vietnamese-origin persons without determined nationality into the National Population Database and the Identity Card Database for those who meet the conditions; if not collected or updated into the databases, the reasons must be clearly stated.

7. Within fifteen days from the date the commune police station or the identity management agency of the provincial police updates the information of Vietnamese-origin persons without determined nationality into the National Population Database and the Identity Card Database, the identity management agency of the Ministry of Public Security must establish a personal identification number for Vietnamese-origin persons without determined nationality and issue an identity card certificate for them.

8. The identity management agency of the Ministry of Public Security shall send the issued identity card certificate back to the commune police station or the identity management agency of the provincial police to return it to Vietnamese-origin persons without determined nationality.

9. Procedures and formalities for adjusting information in the National Population Database and the Identity Card Database upon the request of Vietnamese-origin persons whose nationality has not been determined:

a) Vietnamese-origin persons without determined nationality requesting adjustments to their information in the National Population Database and the Identity Card Database shall submit the Application for Identity Card Procedure Resolution and supporting documents (if available) to the commune police station or the identity management agency of the provincial police where they reside;

b) Within five working days from the date of receiving the application for information adjustment of Vietnamese-origin persons without determined nationality, the head of the receiving agency shall be responsible for coordinating with related agencies to verify and check the legality and accuracy of the information before making adjustments in the National Population Database and the Identity Card Database; if the information adjustment is refused, the reasons must be clearly stated.

13. Amend and supplement Clause 1 of Article 26 as follows:

"1. Vietnamese-origin persons without determined nationality shall approach the identity management agency of the provincial police or the commune police station nationwide regardless of their place of residence to request the issuance of a new or replacement identity card, providing information including surname, middle name, given name, personal identification number, and current address for the recipient to check and match the information in the National Population Database."

14. Amend and supplement Clause 2 of Article 38 as follows:

"2. Ministries, sectors, and localities shall ensure technical infrastructure conditions to connect their information systems with the National Population Database. National databases and specialized databases must complete the connection and sharing with the National Population Database no later than three months from the date of operation, exploitation, and use."

The Minister of Public Security shall provide detailed guidelines on the procedures for collecting, updating, and adjusting information in the National Population Database and the Identity Card Database; connecting, sharing, and synchronizing information between national databases and specialized databases with the National Population Database and the Identity Card Database; procedures for searching, exploiting, and using information in the National Population Database and the Identity Card Database; inspection, evaluation of cybersecurity, data protection when implementing connections, sharing, exploitation, and use of information in the National Population Database and the Identity Card Database as stipulated in Clause 2 of Article 7 and Clause 3 of Article 16 of this Decree; procedures for inspecting, re-inspecting, and supervising the collection, updating, adjustment, connection, sharing, exploitation, and use of information in the National Population Database and the Identity Card Database."

15. Replace the phrase "confirmation of the nine-digit citizen identification number, unique personal identification number" with the phrase "nine-digit citizen identification number, unique personal identification number" in Article 1.

16. Replace the phrase "the authority managing identity cards of the district-level or provincial-level police" with the phrase "the authority managing identity cards of the provincial-level police or the police station of the commune" in Clause 1, Article 18, and Clause 2, Article 34.

17. Replace the Appendix List of Information Related to Vietnamese Citizens and Vietnamese-Origin Persons Without Determined Nationality in National Databases and Specialized Databases Shared with the National Population Database issued together with Decree No. 70/2024/ND-CP with the Appendix List of Information Related to Vietnamese Citizens and Vietnamese-Origin Persons Without Determined Nationality in National Databases and Specialized Databases Shared with the National Population Database issued together with this Decree.

18. Delete the phrase "Public Service Portal of the Ministry of Public Security" in Clause 2, Article 10, and Clause 1 and Clause 3, Article 20.

19. Delete the phrase "under the Central Government" in Clause 2, Article 3, and Clause 4, Article 38.

20. Delete the phrase "Ministry of Information and Communications," in Clause 3, Article 38.

21. Repeal Clause 5, Article 5; Clause 3, Article 9; Point a, Point b, Clause 7, Clause 8, Clause 10, Article 11; Clause 3, Article 30.

Article 6. Effectiveness and Transitional Provisions

1. This Decree shall take effect from March 15, 2026, except for the provisions set forth in Clause 2 of this Article.

2. The provisions at Clause 4 of Article 4 of this Decree shall take effect from July 1, 2026.

3. Certificates of security guard vocational training obtained before the effective date of this Decree shall have a validity period of five years from the date of issuance, and must be renewed according to the provisions of this Decree upon expiration.

4. For new applications for certificates of eligibility for security and public order that have been accepted and are being processed according to Decree No. 96/2016/ND-CP; Decree No. 56/2023/ND-CP, these shall be implemented according to Decree No. 96/2016/ND-CP; Decree No. 56/2023/ND-CP.

5. For new applications for registration of new seals, additional seals, raised seals, reduced seals, wax seals, re-registration of seal models, changes, and reissuance of seal registration certificates that have been accepted and are being processed according to Decree No. 99/2016/ND-CP; Decree No. 56/2023/ND-CP, these shall be implemented according to Decree No. 99/2016/ND-CP; Decree No. 56/2023/ND-CP.

6. Ministries, ministerial-level agencies, and other related agencies shall review normative legal documents within their authority or advised by authorized authorities containing provisions related to confirming the nine-digit citizen identification number and personal identification number to amend and supplement in accordance with the provisions of this Decree.

Article 7. Responsibility for Implementation

1. The Minister of Public Security shall be responsible for guiding, inspecting, urging, and organizing the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees directly under the central government, and related organizations and individuals shall be responsible for enforcing this Decree.
