The Law on Forces Participating in Security and Order Protection at the Grassroots Level is enacted to build and develop these forces to ensure security and order in localities. The Law stipulates the organization, operation, rights, and obligations of these forces as well as the responsibilities of relevant agencies in managing and supporting them.

FORCES PARTICIPATING IN THE PROTECTION OF SECURITY AND ORDER AT THE LOCAL LEVEL
Pursuant to the Constitution of the Socialist Republic of Vietnam;
The National Assembly promulgates the Law on Forces Participating in the Protection of Security and Order at the Local Level.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Law stipulates the position, functions, tasks, organizational principles, activities, working relations, building of forces, conditions for operation, and the responsibilities of agencies and organizations towards forces participating in the protection of security and order at the local level.
Article 2. Interpretation of Terms
In this Law, the following terms shall be understood as follows:
1. Cơ sở vật chất (nhà cửa, cơ sở hạ tầng) bảo đảm cho việc liên doanh, liên kết refers to village, hamlet, ward, commune, township, precinct, block, neighborhood (hereinafter referred to as village), residential group, street area, community, khóm, small district (hereinafter referred to as residential group).
2. Forces participating in the protection of security and order at the local level are forces established by local authorities based on the voluntary participation of citizens to assist the Police Station of the Commune, Ward, Town (hereinafter referred to as the Police Station at the Commune Level) in helping the People's Committee at the same level in protecting security and order and building the movement of all people protecting national security.
3. Security and order protection team is the organizational form of forces participating in the protection of security and order at the local level deployed in villages and residential groups.
4. Jurisdiction refers to villages and residential groups assigned to forces participating in the protection of security and order at the local level to perform tasks as prescribed by this Law.
Article 3. Position and Functions of Forces Participating in the Protection of Security and Order at the Local Level
Forces participating in the protection of security and order at the local level are one of the mass forces, deployed in villages and residential groups, serving as the backbone supporting the Police Station at the Commune Level in helping the People's Committee at the same level in protecting security and order and building the movement of all people protecting national security.
Article 4. Organizational and Operational Principles of Forces Participating in the Protection of Security and Order at the Local Level
1. Compliance with the Constitution and laws; protection and assurance of human rights and citizens' rights; protection of state interests and legitimate rights and interests of organizations and individuals; reliance on the people and subject to the supervision of the people.
2. Subordinate to comprehensive leadership of the Party's local committee, management by the People's Committee at the commune level; guidance, assignment, and inspection by the Police Station at the Commune Level in performing tasks as prescribed by this Law.
3. Meeting the requirements of security and order protection; being appropriate to the economic and social conditions of each locality.
4. Non-discrimination regarding gender in forces participating in the protection of security and order at the local level.
Article 5. Working Relations, Coordination, and Support in the Organization, Activities, and Task Implementation of Forces Participating in the Protection of Security and Order at the Local Level
1. The working relations of forces participating in the protection of security and order at the local level are regulated as follows:
a) The People's Committee at the commune level manages the organization and activities of forces participating in the protection of security and order at the local level;
b) The Police Station at the Commune Level assists the People's Committee at the same level in directly managing the organization and activities, directing, and controlling forces participating in the protection of security and order at the local level; guiding, assigning, and inspecting the implementation of tasks by forces participating in the protection of security and order at the local level;
c) The relationship between forces participating in the protection of security and order at the local level and mass organizations and grassroots organizations at the local level is a cooperative relationship in implementing tasks related to security and order protection and building the movement of all people protecting national security.
2. Coordination and support in the implementation of tasks by forces participating in the protection of security and order at the local level are regulated as follows:
a) Cooperation with the Village Chief, Residential Group Leader, and Head of the People's Council Work Team in villages and residential groups in implementing tasks related to security and order protection and building the movement of all people protecting national security;
b) Supporting the Civil Defense Self-Defense Force and other forces at the local level in performing tasks as prescribed by law;
c) Cooperating with self-managing mass organizations and grassroots organizations, grassroots conciliators, and security forces of agencies, organizations, and enterprises located within the jurisdiction in protecting security and order and resolving cases related to security and order at the local level according to the provisions of law.
3. Principles of coordination, support, and responsibility in the implementation of tasks by forces participating in the protection of security and order at the local level are regulated as follows:
a) Consistent with the functions and tasks of forces participating in the protection of security and order at the local level as prescribed by law;
b) Compliance with the management of the People's Committee at the commune level and guidance, assignment, and inspection by the Police Station at the Commune Level during the process of coordination and support in task implementation;
c) Promoting the responsibility of citizens in performing tasks related to security and order protection according to the provisions of law;
d) The Police Station at the Commune Level is responsible for the implementation of tasks by forces participating in the protection of security and order at the local level according to the provisions of law.
4. For districts that do not organize communes, the People's Council, People's Committee, Vietnam Fatherland Front Committee, and District Police shall implement the tasks of the People's Council, People's Committee, Vietnam Fatherland Front Committee, and Police Station at the Commune Level as prescribed by this Law.
Article 6. Prohibited Acts
1. Using personnel to participate in security and public order protection at the grassroots level contrary to the provisions of this Law or engaging in acts that violate the law.
2. Taking advantage of or abusing duties in security and public order protection at the grassroots level to engage in acts that violate the law, harassing, infringing upon the interests of the State, rights, and legitimate interests of organizations and individuals.
3. Impersonating personnel participating in security and public order protection at the grassroots level.
4. Insulting, threatening, obstructing, opposing personnel participating in security and public order protection at the grassroots level while performing their duties.
5. Producing, buying, selling, storing, using, illegally possessing, forging, pledging uniforms, insignia, badges, signs, certificates of personnel participating in security and public order protection at the grassroots level.
Chapter II
TASKS OF PERSONNEL PARTICIPATING IN SECURITY AND PUBLIC ORDER PROTECTION AT THE GRASSROOTS LEVEL
Article 7. Supporting the Understanding of Security and Public Order Situations
1. Supporting the People's Police Station at the commune level to understand violations of laws related to security, public order, social evils, domestic violence within the jurisdiction through information from the people and mass media according to the guidance of the People's Police Station at the commune level.
2. Upon discovering or receiving information about violations of laws related to security, public order, social evils, domestic violence within the jurisdiction, immediately report to the People's Police Station at the commune level; be present at the location where the incident occurs to perform tasks according to the requirements and guidance of the People's Police Station at the commune level; promptly prevent acts that infringe upon or threaten to infringe upon the lives, health, property of individuals, and the property of agencies and organizations within the conditions and capabilities allowed and in accordance with the law.
Article 8. Supporting the Promotion of the Whole-People Movement for National Security Protection
1. Supporting the People's Police Station at the commune level to promote and disseminate policies and laws on security, public order, and build and expand advanced models in the whole-People movement for national security protection.
2. Mobilizing the people to participate in preventing, detecting, blocking, and fighting crime and violations of laws related to security, public order.
Article 9. Supporting Fire Prevention, Firefighting, Rescue, and Assistance
Personnel participating in security and public order protection at the grassroots level, according to the requirements, guidance, and assignment of the People's Police Station at the commune level, support the civilian defense force in fire prevention, firefighting, rescue, and assistance activities within the jurisdiction or other areas when mobilized.
Article 10. Supporting Administrative Management of Social Order
1. Supporting the People's Police Station at the commune level to gather information on the operations of businesses operating in industries and trades subject to conditional investment in terms of security and public order within the jurisdiction; immediately report to the directly managing People's Police Station at the commune level if directly discovering or receiving information about violations of the law.
2. Gathering demographic information and supporting the People's Police Station at the commune level in demographic checks, temporary residence, and absence registration within the jurisdiction.
3. Promoting and mobilizing agencies, organizations, and the people within the jurisdiction to declare and hand over fireworks, weapons, explosives, and auxiliary tools as prescribed.
4. While performing the tasks specified in Clauses 1, 2, and 3 of this Article, if discovering acts violating the law, immediately report to the directly managing People's Police Station at the commune level and assist the People's Police Station at the commune level in promptly preventing such acts.
Article 11. Support for mobilizing and educating persons who have committed violations of the law and are residing at facilities
Support the People's Police of communes to mobilize and educate the following persons living within their jurisdiction to comply with the Party's guidelines and policies and the State's policies and laws:
1. Persons who have completed serving a prison sentence; persons using drugs illegally, voluntary drug rehabilitation at home or in the community; persons who have completed serving a decision to be placed in a specialized educational facility, compulsory educational facility, or compulsory drug rehabilitation facility; persons granted conditional early release from prison;
2. Persons subject to a residence restriction order; persons released on bail or personal recognizance; persons sentenced to imprisonment but without a judgment enforcement decision or with such a decision but currently on parole or temporarily suspended from serving the sentence; persons sentenced to suspended imprisonment during the probation period; persons serving a non-custodial corrective education sentence, residence prohibition, prohibition from holding certain positions, prohibition from practicing certain professions or performing certain tasks, deprivation of certain civil rights, or house arrest; persons granted conditional early release from prison during the probation period; persons who have completed their court sentences but not yet had their criminal records expunged;
3. Persons subject to community-based education measures, family-based management; persons required to serve decisions to be placed in a compulsory educational facility, compulsory drug rehabilitation facility, or specialized educational facility but currently on hold or temporarily suspended from serving the decision; persons under management while undergoing procedures for applying compulsory educational facility placement, compulsory drug rehabilitation facility placement, or specialized educational facility placement; persons involved in domestic violence incidents.
Article 12. Support for patrolling to ensure security, public order, and traffic safety; performing security and public order protection duties when mobilized
1. Support the People's Police of communes to patrol, prevent, and detect violations of laws related to security and public order within their jurisdiction.
2. Support the People's Police of communes to guide, manage traffic flow, and resolve traffic congestion when mobilized.
3. When performing the tasks specified in Clause 1 and Clause 2 of this Article and discovering incidents related to security and public order, the forces participating in security and public order protection at the grassroots level shall support or follow the guidance of the People's Police of communes, functional forces to secure the scene and protect security and public order.
4. In case of complex situations involving security and public order outside the jurisdiction, the forces participating in security and public order protection at the grassroots level may be mobilized by competent authorities to perform security and public order protection duties. The use of these forces in such mobilizations shall be carried out in accordance with relevant laws.
Chapter III
BUILDING FORCES AND ENSURING CONDITIONS FOR THE ACTIVITY OF FORCES PARTICIPATING IN SECURITY AND PUBLIC ORDER PROTECTION AT THE GRASSROOTS LEVEL
Section 1
CONSTRUCTION OF FORCES
Article 13. Standards and conditions for participation in forces participating in security and public order protection at the grassroots level
Vietnamese citizens willing to participate and meeting the following standards and conditions shall be considered and selected to join the forces participating in security and public order protection at the grassroots level:
1. At least 18 years old but not more than 70 years old; in cases over 70 years old but ensuring good health, the Chairman of the Commune People's Committee shall consider and decide based on the proposal of the People's Police of communes;
2. Having a clear record; good moral character; personally and family members complying well with the Party's guidelines and policies and the State's policies and laws; not being a person currently under criminal investigation, serving a criminal sentence at commune, ward, town level, or serving judicial measures or administrative handling measures. If they have completed serving a court sentence, they must have had their criminal record expunged; if they have completed serving an administrative handling decision, they must have exceeded the period considered as not having been subject to administrative handling measures according to the law;
3. Holding a graduation certificate or having completed a secondary school education program or higher. In border, island, mountainous, and particularly difficult socio-economic areas, or ethnic minority regions, persons who have completed a primary education program can be selected;
4. Residing permanently or temporarily for at least one year and regularly living in the place where the citizen submits an application to join the forces participating in security and public order protection at the grassroots level. In cases stipulated in Clause 3 of Article 15 of this Law, they must reside permanently or temporarily in the place where the application to join the forces participating in security and public order protection at the grassroots level is submitted;
5. Having sufficient health as certified by a medical establishment established and operating in accordance with the law.
Article 14. Deployment of forces participating in security and public order protection at grassroots level
1. Forces participating in security and public order protection at grassroots level shall be organized from neighborhood watch forces, part-time village police currently in use, and neighborhood watch team leaders and deputy leaders, or selected according to the provisions of this Law.
2. Forces participating in security and public order protection at grassroots level shall be deployed into Security and Public Order Protection Teams. The area under the responsibility of a Security and Public Order Protection Team is one or several villages or residential wards within a commune administrative unit or in a district that does not organize a commune administrative unit.
3. Based on the situation, requirements for ensuring security and public order, economic and social conditions, population size, and natural area of the locality, the Provincial People's Council shall stipulate criteria for establishing Security and Public Order Protection Teams and the number of members of Security and Public Order Protection Teams within the management area.
4. The Provincial People's Committee decides the number of Security and Public Order Protection Teams to be established and the number of members of Security and Public Order Protection Teams in villages and residential wards within the scope of management down to each commune administrative unit.
5. Based on the Decision of the Provincial People's Committee stipulated in Clause 4 of this Article, the Chairman of the Commune People's Committee, upon the proposal of the Commune Police, decides to establish Security and Public Order Protection Teams and each member of Security and Public Order Protection Teams.
Article 15. Selection of Team Members of Security and Public Order Protection Teams
1. Based on the requirements for ensuring security and public order at grassroots level, the Commune Police has the responsibility to assist the same-level People's Committee in drafting plans and organizing the selection of Team Members of Security and Public Order Protection Teams to ensure standards and conditions in accordance with the provisions of Clause 4 of Article 14 of this Law.
2. The selection of Team Members of Security and Public Order Protection Teams must be transparent, democratic, and in compliance with the law.
3. Priority shall be given to selecting citizens who have served in the People's Public Security Force, the People's Army, part-time village police who have completed their term of duty, citizens familiar with customs and traditions, having credibility in the community, or those who have previously participated in forces participating in security and public order protection at grassroots level.
4. The Minister of Public Security shall stipulate the procedures and requirements for the selection of Team Members of Security and Public Order Protection Teams.
Article 16. Security and Public Order Protection Teams; Members of Security and Public Order Protection Teams
1. A Security and Public Order Protection Team consists of a Team Leader, Deputy Team Leader, and Team Members.
2. The Commune Police reports to the Chairman of the same-level People's Committee to issue decisions on establishing Security and Public Order Protection Teams, recognizing members of Security and Public Order Protection Teams, and publicly posting these decisions.
3. In villages and residential wards where neighborhood watch team leaders and deputy leaders have been appointed according to the law on fire prevention and fighting, the Commune Police bases on the capabilities and professional qualifications of the appointed individuals to propose to the Chairman of the Commune People's Committee to consider and decide to recognize them as Team Leaders and Deputy Team Leaders of Security and Public Order Protection Teams.
4. The duties of members of Security and Public Order Protection Teams are defined as follows:
a) The Team Leader of a Security and Public Order Protection Team manages and directs the activities of the Team; reports the situation and results of assigned tasks to the Commune Police and is responsible for the activities of the Team; assigns tasks to members of the Security and Public Order Protection Team;
b) The Deputy Team Leader of a Security and Public Order Protection Team performs tasks according to the assignment of the Team Leader; manages and directs the activities of the Team when there is no Team Leader, the Team Leader is absent, or the Team Leader delegates authority;
c) Team Members of a Security and Public Order Protection Team perform tasks of forces participating in security and public order protection at grassroots level according to the management and assignment of the Team Leader and Deputy Team Leader;
d) The Team Leader and Deputy Team Leader of a Security and Public Order Protection Team perform the duties of neighborhood watch team leader and deputy leader according to the law on fire prevention and fighting, rescue operations.
5. The Minister of Public Security shall stipulate the procedures and requirements for establishing Security and Public Order Protection Teams and recognizing members of Security and Public Order Protection Teams.
Article 17. Adjustment of the number of members and security and public order protection teams, and withdrawal from participation in security and public order protection forces at the grassroots level
1. Adjustment of the number of members and security and public order protection teams in the following cases:
a) Supplementing members when the number of members of the security and public order protection team is insufficient; supplementing security and public order protection teams when the number of such teams has not been established according to the decision of the Provincial People's Committee.
b) Due to requirements for ensuring security and public order, or due to establishment, dissolution, merger, or division of villages or residential wards, it is necessary to adjust the number of members and security and public order protection teams compared to the number decided by the Provincial People's Committee.
2. The supplementation of members and security and public order protection teams as stipulated in point a, Clause 1 of this Article shall be carried out in accordance with Article 15 and Clause 2 of Article 16 of this Law. Adjustments to increase or decrease the number of members and security and public order protection teams as stipulated in point b, Clause 1 of this Article must be reported to the Provincial People's Committee for consideration and decision in accordance with Clause 4 of Article 14 of this Law.
3. Cases of withdrawal from participation in security and public order protection forces at the grassroots level include:
a) Submitting a request to withdraw from participation in security and public order protection forces at the grassroots level;
b) Failing to meet health standards as certified by medical examination and treatment facilities established and operating in accordance with the law;
c) Failing to comply with assigned tasks as dispatched or mobilized by the Police Station without justifiable reasons, failing to complete tasks, or misusing or abusing the role of protecting security and public order at the grassroots level to commit illegal acts, and being warned in writing by the Police Station two times or more but continuing to violate;
d) Committing criminal offenses with a decision to initiate criminal proceedings or measures to prevent escape as prescribed by the Criminal Procedure Code; being subject to administrative penalties.
4. The Minister of Public Security shall prescribe procedures and formalities for adjusting the number of members and security and public order protection teams, and withdrawal from participation in security and public order protection forces at the grassroots level.
Article 18. Training and Capacity Building for Forces Participating in Grassroots Security and Public Order Protection
Forces participating in grassroots security and public order protection shall be trained and capacity built in politics, law, professional skills, and participate in drills and competitions as prescribed by the Minister of Public Security.
Section 2
ENSURING CONDITIONS FOR THE OPERATION OF FORCES PARTICIPATING IN GRASSROOTS SECURITY AND PUBLIC ORDER PROTECTION
Article 19. Ensuring Operating Funds and Material Equipment for Forces Participating in Grassroots Security and Public Order Protection
1. Operating funds and material equipment for forces participating in grassroots security and public order protection shall be guaranteed by the state budget and other legitimate financial sources as prescribed by law.
2. Management and utilization of operating funds and material equipment for forces participating in grassroots security and public order protection shall be carried out in accordance with laws on the state budget, laws on management and use of state assets, and other relevant laws.
3. Annually, the Ministry of Public Security and People's Committees at all levels shall be responsible for preparing budgets, implementing, and settling accounts for the state budget guaranteeing operations and material equipment for forces participating in grassroots security and public order protection in accordance with laws on the state budget.
Article 20. Location and workplace for forces participating in security and public order protection at the grassroots level
The People's Committee of the commune arranges locations and workplaces for forces participating in security and public order protection at the grassroots level at community activity sites in villages or residential wards, or at the workplace of the commune-level police force, or other suitable locations that meet the requirements of the tasks of forces participating in security and public order protection at the grassroots level and the local capacity to ensure such arrangements.
Article 21. Equipment, management, and use of support tools for forces participating in security and public order protection at the grassroots level
1. Forces participating in security and public order protection at the grassroots level shall be equipped with support tools to perform their tasks of protecting security and public order at the grassroots level.
2. The management and use of support tools by forces participating in security and public order protection at the grassroots level shall be carried out in accordance with the provisions of laws on the management and use of weapons, explosives, and support tools.
3. The Minister of Public Security shall provide detailed regulations for Clause 1 of this Article.
Article 22. Uniforms, certificates, and equipment for forces participating in security and public order protection at the grassroots level
1. Forces participating in security and public order protection at the grassroots level shall be provided with and allowed to use uniforms, badges, insignia, signs, certificates, necessary means, and equipment to perform their tasks.
2. The issuance, reissuance, replacement, recovery, management, and use of signs and certificates for forces participating in security and public order protection at the grassroots level shall be regulated by the Minister of Public Security.
3. The Government shall provide detailed regulations for Clause 1 of this Article.
Article 23. Support and allowances for individuals participating in forces participating in security and public order protection at the grassroots level
1. Individuals participating in forces participating in security and public order protection at the grassroots level shall receive regular monthly support payments, and be supported in paying voluntary social insurance premiums and health insurance premiums at levels decided by the Provincial People's Council.
2. Individuals participating in forces participating in security and public order protection at the grassroots level shall receive support and allowances when they are assigned to training, instruction, or task performance according to the division of responsibilities by competent authorities, or when they are mobilized or called upon to perform tasks. The levels of support and allowances are specified as follows:
a) When assigned to training or instruction, they shall receive allowances equivalent to the basic food allowance of conscripted soldiers of the People's Public Security Force;
b) When performing tasks from 22:00 on the previous day until 06:00 on the following morning, on rest days, holidays, or when performing arduous, hazardous, or particularly arduous, hazardous work as stipulated by labor laws, they shall receive allowances at levels decided by the Provincial People's Council;
c) When performing tasks in border areas, islands, mountainous regions, economically and socially disadvantaged areas, ethnic minority regions, or key defense communes, they shall receive additional working day allowances at levels decided by the Provincial People's Council;
d) When mobilized, called upon, or assigned to perform tasks outside their jurisdiction, they shall be supported by the mobilizing agency in transportation, meals, and accommodation during the performance of their tasks.
Article 24. Treatment and policies for individuals participating in forces protecting security and order at the grassroots level who fall ill, suffer accidents, die, or get injured while performing their duties.
Clause 1. Individuals who have participated in social insurance and health insurance and meet the conditions to enjoy insurance benefits shall be paid according to the regulations stipulated by law from the insurance fund.
Clause 2. Individuals who have not participated in health insurance but fall ill or suffer accidents and injuries shall be supported in paying medical examination and treatment costs.
Clause 3. Individuals who have not participated in social insurance but suffer accidents resulting in reduced work capacity, as concluded by the Medical Appraisal Board, shall be considered for allowances based on the degree of reduced work capacity; if they die, their dependents shall be entitled to receive pension and funeral expenses.
Clause 4. Individuals who get injured or die while performing their duties shall be considered for benefits and policies similar to those for war invalids or recognized as martyrs and entitled to other rights as prescribed by law.
Clause 5. The Government shall provide detailed regulations for Clauses 2 and 3 of this Article.
Article 25. Expenditure Tasks of the Ministry of Public Security
The expenditure tasks of the Ministry of Public Security shall be guaranteed by the central budget, including:
Point 1. Equipping means, equipment, and tools to support forces participating in protecting security and order at the grassroots level;
Point 2. Training, upgrading, drill, and competition activities organized by the Ministry of Public Security for forces participating in protecting security and order at the grassroots level;
Point 3. Summarizing, concluding, organizing competitive movements, and rewarding forces participating in protecting security and order at the grassroots level organized by the Ministry of Public Security.
Article 26. Expenditure Tasks of Localities
Point 1. The expenditure tasks of localities shall be guaranteed by the local budget, including:
a) Supporting procurement, repair of means and equipment; training, drill, and competition activities organized by localities; ensuring operational conditions for forces participating in protecting security and order at the grassroots level;
b) Equipping uniforms, badges, insignia, signs, and certificates for forces participating in protecting security and order at the grassroots level;
c) Implementing expenditures as prescribed in Articles 23 and 24 of this Law;
d) Summarizing, concluding, organizing competitive movements, and rewarding forces participating in protecting security and order at the grassroots level organized by localities;
đ) Other expenditures for forces participating in protecting security and order at the grassroots level as prescribed by law.
Point 2. Provincial People's Committees shall submit to the same-level People's Councils for decisions on the expenditure levels for forces participating in protecting security and order at the grassroots level as prescribed in Point 1 of this Article, in accordance with the economic and social conditions of the locality.
Chapter IV
RESPONSIBILITIES OF AGENCIES AND ORGANIZATIONS
Article 27. Responsibilities of the Government
Clause 1. The Government shall uniformly manage state administration over forces participating in protecting security and order at the grassroots level.
Clause 2. Contents of state administration over forces participating in protecting security and order at the grassroots level include:
a) Issuing normative legal documents on forces participating in protecting security and order at the grassroots level within its authority or submitting them to competent authorities for issuance and implementation;
b) Developing and implementing strategies, policies, programs, projects, and plans for forces participating in protecting security and order at the grassroots level;
c) Building forces, training, upgrading, drill, competition, organizing activities, and ensuring operational conditions for forces participating in protecting security and order at the grassroots level;
d) Propagating and disseminating the Party's guidelines and policies, and the State's laws on forces participating in protecting security and order at the grassroots level;
đ) Inspecting, auditing, handling violations, resolving complaints and denunciations, summarizing, concluding, promoting competitive movements, and rewarding forces participating in protecting security and order at the grassroots level.
Article 28. Responsibilities of the Ministry of Public Security
The Ministry of Public Security is the lead agency assisting the Government in uniformly managing state administration over forces participating in protecting security and order at the grassroots level and shall have the following responsibilities:
Clause 1. Submitting to the Government for issuance or issuing within its authority and organizing the implementation of normative legal documents on forces participating in protecting security and order at the grassroots level;
Clause 2. Propagating and disseminating the Party's guidelines and policies, and the State's laws on forces participating in protecting security and order at the grassroots level;
Clause 3. Guiding and inspecting the construction of forces, management, training, upgrading, drill, competition, and ensuring operational conditions for forces participating in protecting security and order at the grassroots level as prescribed;
Clause 4. Taking the lead and coordinating in inspecting, auditing, handling violations, resolving complaints and denunciations, summarizing, and concluding on forces participating in protecting security and order at the grassroots level within its authority;
Clause 5. Guiding the organization of competitive movements and rewards within forces participating in protecting security and order at the grassroots level.
Article 29. Responsibilities of Ministries, ministerial-level agencies, and government agencies
1. The Ministry of Finance shall take the lead and coordinate with the Ministry of Public Security and provincial People's Committees to balance and allocate funds for the implementation of this Law in accordance with the State Budget Law.
2. Ministries, ministerial-level agencies, and government agencies, within their respective duties and authorities, shall be responsible for organizing the enforcement of laws concerning forces participating in security and public order at the grassroots level.
Article 30. Responsibilities of local administrative authorities at all levels
1. People's Councils at all levels, within their respective duties and authorities, shall have the following responsibilities:
a) To decide on plans, projects, and proposals for building and deploying forces, ensuring conditions for operation of forces participating in security and public order at the grassroots level, in accordance with this Law and other relevant laws;
b) To decide on the budget to ensure funding for forces participating in security and public order at the grassroots level in accordance with the law.
2. People's Committees at all levels, within their respective duties and authorities, shall implement state management over forces participating in security and public order at the grassroots level and shall have the following responsibilities:
a) To submit to the same-level People's Council for approval and decision on plans, projects, and proposals for building and deploying forces, ensuring conditions for operation of forces participating in security and public order at the grassroots level, and the budget estimate for revenue and expenditure of the budget to ensure the operation of forces participating in security and public order at the grassroots level;
b) To issue normative legal documents, directives, and guidance and organize the implementation of regulations concerning forces participating in security and public order at the grassroots level in accordance with this Law and other relevant laws;
c) To organize propaganda and dissemination of the Party's policies and the State's laws regarding forces participating in security and public order at the grassroots level within their jurisdiction;
d) To manage the organization and activities of forces participating in security and public order at the grassroots level within their authority; to arrange locations, workplaces, funds, and other operational conditions for forces participating in security and public order at the grassroots level in accordance with the provisions;
đ) To organize competitive movements among forces participating in security and public order at the grassroots level, linking them with competitive movements in the locality;
3. The People's Council of a district where a commune-level People's Council is not organized, or the People's Council of a province where a commune-level People's Council is not organized and the People's Council of a district shall perform the tasks of the commune-level People's Council. The commune-level People's Committee shall report to the district-level People's Committee on the organization and activities of forces participating in security and public order at the grassroots level in its area.
Article 31. Responsibilities of the Vietnam Fatherland Front and its member organizations
The Vietnam Fatherland Front and its member organizations, within their respective duties and authorities, shall have the responsibility to propagate and mobilize all strata of the people to comply with laws concerning forces participating in security and public order at the grassroots level; to mobilize, supervise, and provide social feedback on the implementation of laws concerning forces participating in security and public order at the grassroots level.
Chapter V
IMPLEMENTING PROVISIONS
Article 32. Amending, supplementing, and abolishing certain articles and clauses of related laws
1. Amend and supplement Clause 1 of Article 44 of the Fire Prevention and Combating Law No. 27/2001/QH10, which has been amended and supplemented by Law No. 40/2013/QH13, as follows:
"1. Civil defense teams shall be established at village and residential ward levels. Individuals recognized as heads or deputies of security and public order protection teams according to the law on forces participating in security and public order protection at the grassroots level shall be appointed as team leaders or deputy team leaders of civil defense teams. The establishment and management of civil defense teams shall be decided by the Chairman of the People's Committee at the commune level."
"c) Persons participating in forces participating in security and public order protection at the grassroots level."
3. Amend and supplement Point n of Clause 1 of Article 55 of the Law on Management and Use of Weapons, Explosives, and Supporting Tools No. 14/2017/QH14, which has been amended and supplemented by Laws No. 50/2019/QH14 and No. 59/2020/QH14, as follows:
"n) Forces participating in security and public order protection at the grassroots level;"
4. Amend and supplement Clause 2 of Article 6 of the National Security Law No. 32/2004/QH11 as follows:
"2. Agencies and organizations, within their scope of duties and authority, shall have the responsibility to build civilian self-defense forces, protect agencies and enterprises, forces participating in security and public order protection at the grassroots level, and civil defense teams participating in national security activities in accordance with the law."
5. Amend, supplement, and abolish certain clauses and articles of the People's Public Security Law No. 37/2018/QH14, which has been amended and supplemented by Law No. 21/2023/QH15, as follows:
a) Amend and supplement Clause 13 of Article 16 as follows:
"13. Guide and train professional skills, and provide legal knowledge training for mass organizations participating in security and public order protection at the grassroots level, forces participating in security and public order protection at the grassroots level, civil defense teams, and agency and enterprise security personnel in accordance with the law."
b) Abolish Clause 2 of Article 46.
Article 33. Effective Date
1. This Law shall take effect from July 1, 2024.
2. The Village Police Regulation No. 06/2008/PL-UBTVQH12 shall cease to be effective from the date this Law takes effect.
