AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE LAW ON MANAGEMENT AND USE OF WEAPONS, EXPLOSIVE MATERIALS, AND ASSISTANCE TOOLS

On the basis of the Constitution of the Socialist Republic of Vietnam;

The National Assembly enacts this Law amending and supplementing certain articles of the Law on Management and Use of Weapons, Explosive Materials, and Assistance Tools number 14/2017/QH14.

Article 1. Amendments and supplements to certain articles of the Law on Management and Use of Weapons, Explosive Materials, and Assistance Tools

1. Amending and supplementing some clauses of Article 3 as follows:

a) Amend and supplement Clause 2 as follows:

“2. Military weapons including:

a) Weapons manufactured or produced in accordance with technical standards and designs of legitimate manufacturers, equipped for the People's Armed Forces and other forces as prescribed by this Law for performing official duties, including:

Handguns: pistols, rifles, submachine guns, machine guns, anti-tank guns, grenade launchers;

Light weapons: heavy machine guns, mortars, recoilless rifles, anti-aircraft machine guns, man-portable anti-tank missiles;

Heavy weapons: fighter aircraft, armed helicopters, tanks, armored vehicles, warships, submarines, ground artillery, anti-aircraft artillery, missiles;

Bombs, mines, grenades, torpedoes, underwater mines; ammunition used for the types of weapons specified in this point;

b) Weapons manufactured or produced manually or industrially, not in accordance with technical standards and designs of legitimate manufacturers, capable of causing injury, harm to human life and health, destruction of material structures similar to those weapons specified in point a of this clause, shall not be equipped for the People's Armed Forces and other forces as prescribed in Article 18 of this Law for performing official duties.”

b) Amend and supplement Clause 6 as follows:

“6. Weapons with functions similar to hunting shotguns, crude weapons, sports weapons are weapons manufactured or produced manually or industrially, not in accordance with technical standards and designs of legitimate manufacturers, capable of causing injury, harm to human life and health, destruction of material structures similar to hunting shotguns, crude weapons, and sports weapons.”

2. Amend and supplement Clause 2 of Article 73 as follows:

“2. The Ministry of National Defense shall perform state management functions over weapons, explosive materials, explosive precursors, and assistance tools as prescribed by this Law and other relevant laws. The Minister of National Defense shall promulgate the list of military weapons as stipulated in point a of Clause 2 of Article 3 of this Law.”

Article 2. Effective Date

This Law shall take effect from January 10, 2020.

This Law was adopted by the National Assembly of the Socialist Republic of Vietnam, the 14th term, the 8th session, on November 25, 2019.
